They are listed by PAC and number (the number is annotated on each mailer):: PAC South Sound Future Enterprise Washington #1 (Minor Issue) PAC Disclosure is not 10-Pt (I had numbered the flyers before I realized this was the only issue). #3 & #5: Incorrect statements: - Higher property taxes: See the Puyallup 2020 Budget Appendix E. - Higher Sales Tax: They are referring to SB 1406, which allows cities to receive a sales tax credit for affordable housing. - Cemetery "Death Tax" Fee increase resolution. See the Minutes of March 12, 2019, Puyallup City Council Meeting, Julie Door was excused from that meeting and did not vote on this resolution. People For Jobs Enterprise Washington Mailer #2, 4, 6 Complaints the same as #3 and 5. These two PACs are operated by the same officers and board members who are in the building industry and top donors are from the realtors, building industry, and petroleum industry. Due to the makeup of the organization and top donors, I can only assume these are not simple errors, rather they are intentionally false as I can't imagine professionals in these industries would not understand the SB 1406. Since they had the wherewithal to comb through six years of council minutes to find these items, I am also doubting a simple error in their research. 2. RCW 42.17A.110 - I received the first erroneous mailer on July 15, 2020, and immediately (blasted) wrote a response to the errors on Facebook. In this post, I tagged Chris Gildon's name to ensure he saw my post. I did not receive any rebuttal to my comments. Last week, right after the Primary election, the Tacoma News Tribune wrote an article about the errors. Mr. Gildon made a weak rebuttal that he has no control over independent expenditures. True that, however, it was not prompt and would not have been public if they hadn't run the story. 3. (Unknown statute) Potential conflict of interest. Tom Perry owns a small business, Campaign Compliance Solutions. I am inquiring whether his appointment/employment as the Treasurer for Candidate Gildon and Deputy Treasurer for the two PACs in question is a conflict of interest. Even though he is the Deputy Treasurer for the two PACs, Mr. Perry's name is on most if not all the submitted forms for both PACs. 4. South Sound Future Enterprise Washington has not reported any expenditures. I've read the instructions several times and I can't figure out when the report is due. So this may not even be

an issue. I really appreciate the staff and PDC's attention to this matter. It takes a lot for me to report someone to the PDC, but this is just wrong. Sincerely, Robin Farris What impact does the alleged violation(s) have on the public? The 6 mailers and media buys depict false and misleading statements that (then) Councilmember Julie Door supported significant tax increases in the City of Puyallup. These false statements create a great deal of anxiety during a time of economic uncertainty, loss (hopefully a gap) of unemployment insurance supplement, and the eviction moratorium. Currently, the poverty rate in Puyallup is nearly 11% and seniors (65 and older) make up 20% of the adult population. As a result, up to 30% of the population has some level of economic insecurity during normal conditions. Unfortunately, we are not in normal conditions and the economic insecurity is exacerbated by the inability of Congress to agree on the HEROS Act. Secondly, the sheer volume of mailers and media buys creates a very large net to amplify this erroneous information. One mailer can be ignored, but I received six (6) mailers, a website using the candidate's name (juliedoor.com), and media ads. I haven't seen the cable ads as I don't have cable service; however, it is reported to have the same information in the ads that are listed on the mailers. Additionally, the donors and PAC administrators are not political neophytes. I imagine they are rolling the dice and are willing to pay the fine if they get caught. The seeds of doubt they sow and impact on citizens don't seem to be a consideration, which if true, is extremely disappointing. Thirdly, WAC 390-32-010 Fair Campaign Practices Code for candidates and political committees (4) states, "I shall not use or authorize, and I shall condemn material relating to my ca.mpaign which falsifies, misrepresents, or distorts the facts, including but not limited to malicious or unfounded accusations creating or exploiting doubts as to the morality, patriotism or motivations of any party or candidate." and (7) further commits the candidate to do the following, "I shall promptly and publicly repudiate the support of any individual or group which resorts, on behalf of my candidacy or in opposition to that of my opponent(s) to methods in violation of the letter or spirit of this code." I received the first flyer on July 15, 2020, and immediately posted a rebuttal on Facebook and tagged candidate Chris Gildon. To the best of my knowledge, Mr. Gildon did not take any action to repudiate the false statements until the Tacoma News Tribune wrote an article about the false statements. Finally, I have not discovered any guidance on this next issue, but it seems like a conflict of interest to have the same treasurer for candidate Gildon and for the two PACs opposing Julie Door. It seems that there is a conflict of interest as there is a greater likelihood of disclosure of the independent expenditures. RESOLUTION NO. 2366

A RESOLUTION of the City Council of the City of Puyallup, Washington, adopting the Americans with Disabilities Act (ADA) Transition Plan

Additional Consulting Services – Public Safety Building (PSB) Councilmember Jacobsen referred to the high price quoted for the public safety building and asked for more information on the request for additional consulting services. City Manager Kevin Yamamoto explained that the request is for future scoping and needs assessment services. Additional services are necessary to address council’s cost concerns and to retain architectural services as the project progresses. Each councilmember voiced his/her opinion regarding the extension of architectural services. All agreed upon the need for a new police department, acknowledged the short time frame and were agreeable to moving forward with the project. Mr. Yamamoto responded to several concerns voiced by councilmembers regarding the extension of the consultant contract, council’s desire to stay abreast of project costs and the ability to halt the project should council deem it necessary. Council Action: A motion was made by Councilmember Jacobsen and seconded by Deputy Mayor Swanson to approve the contract for additional consulting services related to the Public Safety Building with proper fiscal management. The motion passed 6-0. ORDINANCES Ordinance updating the Puyallup Municipal Code related to small cell wireless facilities Community Development Director Tom Utterback pointed out that the two ordinances, small cell wireless (20.59) and telecommunication service providers (11.32), interrelate and would be

addressed as one item. He outlined the format of the presentation, provided a brief history of past and current actions and identified the difference between the two codes, and described staff’s actions in meeting the additional rules adopted by the FCC. Assistant Planner Rachael Brown reviewed the key policy issues addressed during the 2018 code amendment cycle and identified the mandated policy changes per the new FCC rules. Additionally, she outlined administrative code changes made to meet the new FCC guidelines along with other changes intended to modernize the current language. Ms. Brown and outside legal counsel Elana Zana (Ogden Murphy and Wallace) responded to several questions, comments and concerns voiced by councilmembers relating to the City of Seattle’s appeal of the FCC regulations; antenna aesthetics; the siting of antennas on ornamental and traffic signal poles; the number of wireless facilities allowed on a pole; and the city’s ability to change the code should the lawsuit prevail. Council Action: A motion was made by Councilmember Johnson and seconded by Deputy Mayor Swanson to approve first reading of the ordinance. The motion passed 6-0. Ordinance updating the Puyallup Municipal Code relating to Telecommunication Service Providers Council Action: A motion was made by Councilmember Johnson and seconded by Deputy Mayor Swanson to approve first reading of the ordinance. The motion passed 6-0. Ordinance relating to Lewd Conduct Deputy City Attorney Shawn Arthur explained that that the city follows the state’s indecent exposure code. The amendment will close a loophole and allow the police department to enforce the law against certain acts. Council Action: A motion was made by Councilmember Johnson and seconded by Councilmember Jacobsen to approve first reading of the ordinance. The motion passed 6-0. RESOLUTIONS Resolution updating the Woodbine Cemetery Fee Schedule Mr. Yamamoto explained that the resolution will adjust fees and incorporates the niche wall; it meets the business plan and is straight forward. There was discussion regarding the possibility of incorporating commemorative items and if the Cemetery Fee Schedule is where this activity would be added. Deputy Mayor Swanson further spoke of a program by the City of Sumner where they plant young trees at their cemetery, allow them to grow, and transplant them as the need arises.

RESOLUTION NO. 2367

A RESOLUTION of the City Council, of the City of Puyallup, Washington revising fees charged at Woodbine Cemetery

CITY MANAGER’S REPORT Mr. Yamamoto advised of an executive session to discuss real estate and collective bargaining. COUNCIL REPORTS Councilmember Jacobsen reported on her attendance at the 2019 Puyallup Police Awards Ceremony. She voiced her support of the police department, acknowledged conditions at the current facility and the need for a new facility, but struggled with the high cost quoted by the consultant. She outlined the financial impacts to the average homeowner and opined that the property tax increase may cause the ballot measure to fail. She voiced a need to lower the cost and expressed disappointment that the issue was not revisited at this meeting. Councilmember Farris recognized the new At Home store and the reopening of the Meridian Café. She advised of her attendance at the Ice Cream with the Mayor event, where she spoke with citizens about Shaw Road and the need for air conditioning at the senior center. She reported on Pierce Transit’s (PT) new LYFT program, phone App, and Bus Rapid Transit (BRT) service on Pacific Avenue in Tacoma. She pointed out that PT is considering Meridian as a potential BRT route. Councilmember Kastama thanked Mr. Swanson for his comments about WSU and Mr. Churchman for his dialogue about conflicts of interest. He explained the rationale behind the insurance company’s settlement of a lawsuit against the city for the clearing of encampments and infringement of civic rights. Deputy Mayor Swanson advised of his attendance at the Step by Step Banquet. He reported that the group has met their fundraising goal, their finances have been secured, and he anticipated a grand opening celebration later this year. MAYORS REPORT Mayor Palmer applauded council’s efforts at the retreat regarding the public safety building, Washington State University, and downtown development. He accepted the high quote as the beginning from which council will focus their energies over the next few months, with the goal to present a viable public safety building to the community.

EXECUTIVE SESSION At 8:33 p.m., Mayor Palmer announced an executive session of approximately twenty-five minutes, to discuss labor negotiations and real estate matters. City Manager Kevin Yamamoto, Assistant City Manager Steve Kirkelie, City Attorney Joe Beck, Deputy City Attorney Shawn Arthur, Police Chief Scott Engle, Human Resources Director Katie Ortega, Community Development Director Tom Utterback, City Engineer Hans Hunger, Administrative Clerk Cindy Huff, Executive Assistant Jessica Johnson, Mayor Palmer, and the councilmembers moved into executive session. At 9:00 p.m., Mayor Palmer extended the executive session for an additional thirty minutes. The executive session ended at 9:10 p.m., with no action taken. ADJOURNMENT – 9:11 p.m.
