    Dear Council Member and County Executive Leggett,

    Selling the old Peary High School property to the MJBHA would not be a wise financial decision, since your missionis tokeep the long term interest of the tax payers and county residents as your highest priority.

    We must not be short sighted when we view the long term, known and unknown, potential use of this propertyto thetaxpaying residents that presently own it.

    We must resist serving our own special interests and must continue to serve the long and short term financial andeducational best interests of the residents.

    The Academy has been a terrific tenant, no doubt, and has beautified and made good use of the property, but the landalone is worth much more than $1.9M now, and in the future.

    I pray that the MC Council will do the right thing to benefit all 1,000,000 of us county residents, now and in the future,andnot serve the special interests of the few.

    SUBJECT: Action - Resolution to approve the sale of Peary High School

    Education and Management and Fiscal Policy Committees' joint recommendation: On November29, 2010 the joint Committee (4-1; Councilmember Andrews opposed) recommended approval of thesale of the former Peary High School site to the Berman Hebrew Academy. The joint Committee (3-1;

    Councilmember Andrews apposed) further recommended approval of all of the terms and conditionsproposed by the Executive.

    The Joint Committee believes that all of the terms of the 1996 lease with the Academy should be givenfull force and effect including the Academy' s right to purchase the property. In the opinion of the jointCommittee, the Board of Education did not give sufficient reasons to deny the proposed sale.

    I had felt early on I should stay out of this matter, as it seemed the recently proposed agreementmade the sale a much fairer deal for the county. However, as I read through the lease and learnedmore about the new agreement, I developed misgivings about whether the sale would be fair to thecounty, the school system, and ultimately the most important stakeholders, the county's taxpayers.Additionally, as I listened to those who testified at the public hearing, my concerns deepened.

    Many of the individuals testifying were putting quite a spin on what they were saying as facts, when inreality, they were presenting much erroneous material and numerous exaggerations. I am personallyfamiliar with many of the conditions described, and the statements made, as well as the parties givingthe views.

    In the interest of brevity I'll give some observations and suggestions which I hope will be informativeand helpful in reaching a decision good for all.

    As we look back at the beginning of the lease and consider that the building needed a great deal ofrenovation, the agreement would not have been for a $2 million valuation, but closer to a $10million value, factoring in what Berman expended, if the Academy had received a pristine property.

    Also, through the next 12 years of usage post 1998, the Berman Academy would have needed toexpend some funds for upkeep, maintenance, repairs, etc. The averaged appraisal, circaapproximately 1996, of roughly $2 million does not currently reflect inflation or much less what thecounty would have to pay for a 20 acre parcel on which they could properly build a school.

    Those in favor of selling the property now put on a mighty full-court press to bring their message tothe council in the form of testimony, emails, letters, and a large crowd spilling out of the hearingroom. One must ask why. The answer might be that there is a feeling the county will be mostamenable to a deal that brings them $2 million in tight financial times. Beware of a small short-termgain that results in a great deal of long-term pain. With a near-term shortfall of $200 million, $2million does not go very far, so don't give away any farms.

    In regard to some provisions in the lease and the new agreement, a reasonable observer wouldquestion why the county should give the Academy 5 more years of occupancy after a condemnationis final in addition to relocation expenses. Perhaps some of the problems we are facing currently infinding this a fair deal for the county and the taxpayers, have their roots in the original leaseagreement and with those responsible for its terms. However, the county does not have to go alongwith an unwise transaction. We have legislative erasers and improved legal agreements based oncurrent knowledge and conditions for correcting erroneous or unfair actions or agreements of thepast. Following a final condemnation decree, occupancy of two years by the lessee is time enough.

    Another consideration is that if the lessee continues to lease, the cost is $5000. per month plusinflation. If the lease endures until it ends, Berman will not have spent $2 million. The lease does notconstitute a hardship for the Academy, so there is no need to hastily enter an unwise agreement.

    Additionally, this item must be agreed to by the Montgomery County Council, the County Executive,and the State of Maryland Board of Public Works. Hopefully, the collective wisdom resident amongthe 13 individuals involved will render a decision fair to all. Before a decision is made to sell on thebasis of what is now in the lease and in the new agreement, changes must be made that willmake the sale fair not only to The Berman Hebrew Academy, but to Montgomery County, MCPS, andabove all, the county's taxpayers, as well.

    Plus, to reiterate, given the mandated separation of religion and state, this is not a religious issue, itsa business transaction and should be handled as such with wisdom, foresight, and a business-likeapproach.

    One of these Leases is not like the other

    In a previous post we provided readers with links to Montgomc1:yCountyJcase.sfor ClosedSchool sites.

    One thing becomes immediately clear when reviewing those leases: one ofthose leases is very different from the rest.

    Take a few minutes and clickdown the list of leases.

    One of those leases was not written using the standard Montgomery County lease form. Who wrote that lease?

    One of those leases was signed by the County Executive whilethe rest were signed bythe ChiefAdministrative

    Officer. Why?

    One ofthose leases givesthe lessee the option to buy the property. Why don't all ofthe lessees ofClosedSchool siteshave the option to buy the property they are using? Allofthe lessees took over a closed school site and made the propertyuseful when not needed as a school. Many of those lessees have improved the properties. Shouldn't they all have theoption to buy? Is there any other lease on the list like the one for the Peary High School site? Please post ifyou can finda similar lease for another site.

    Why does one Closed School site lease appear to be different from all the rest?

    the Montgomery County Council will vote to sell a 19.5 acre former public school site to aprivate entity for $1.9 million. That much is known for sure. Council members have stated their intentions and majority

    rules.

    The deal has been called a win-win-win. But there's an oops that hasn't been discussed.

    What part of the proceeds of this sale will go to Montgomery County and what part will go to the State of Maryland?

    Public school land comes to each county through the State of Maryland and when the land is sold or leased the State can

    get their cut.

    Remember last year's Mmyland Rcp01ter storv on the Audit of the Board of Public Works Interagency Committee

    on School Construction that showed that Montgomery County OWED the State of Maryland $3.2 million in

    proceeds from school land transactions? Has that debt been settled yet? Will the State of Maryland be passing on any cut

    of the Peary High School transaction?

    And, why didn't the County Executive or County Council discuss the share owed to the State in any of their

    discussions of this win-win-win?

    Hmm. OKay, thank you. Anybody else up on the issues? If the state tells me that they're not interested in ashare of the proceeds, then the whole story is a nonstarter, but they told me (again, with their mistakenunderstanding that the building was going to be demolished), that if the building isn't being demolished they'dwant a cut.

    I'll resolve with them, but it'll be a story for tomorrow's paper if indeed they hold to that interest in somefinancial redress.
