Notice is hereby given that a Regular Meeting of the Board of Trustees of the Pearland Independent School District will be held on September 8, 2020, beginning at 5:00 PM at 1928 North Main, Pearland, Texas. All people who attend the Board meeting in person including trustees, administration, and visitors - are required to wear facial coverings and will practice social distancing via seating arrangements and other precautions in place. While the Board will not prohibit visitors from attending the meeting in person, visitors are strongly urged to observe the meeting via the livestream link rather than attend in person. However, those wishing to make Public Comment are asked to attend so that their comments can be transmitted via Livestreaming. Livestream Notice: Due to the public health threat of COVID-19 and pursuant to the Governor Abbott’s Temporary Suspension of Open Meetings Laws issued on March 16, 2020, this meeting will be livestreamed on the district YouTube channel.

August 11, 2020

The Board of Trustees of the Pearland Independent School District met in regular session on Tuesday, August 11, 2020 at 5:00 p.m. at 1928 North Main Street, Pearland, Texas in accordance with Chapter 551 of the Government Code. Due to the public health threat of COVID-19 and pursuant to the Governor Abbott’s Temporary Suspension of Open Meetings Laws issued on March 16, 2020, the meeting was also livestreamed on the district YouTube channel and accessed by Zoom for those making Public Comment.

Opening 1.0 After noting that a quorum was present, President Gooden Jr. opened the meeting at 5:01 p.m.

A motion was made by Secretary Decker and seconded by Vice President Botkin that the board accepts and approves the superintendent’s recommendation for Employment of Personnel as presented.

Public Comment

5.0 – A link to a public comment form was made available prior to the board meeting at: https://www.pearlandisd.org/publiccomment. The deadline to submit the completed form was prior to 5:00 p.m. on Monday, August 10, 2020 for anyone who wished to address the Board of Trustees on an agenda or non-agenda item. Dr. Dona Kim Murphey, parent, expressed her concerns with the district’s plan to re-open school and with the proposed contract with the Shiloh Treatment Center and facility. Yoonhee Park, parent, spoke regarding the remote learning requirements and expectations of students and concerns with the contract being proposed with the Shiloh Treatment Center. Sarah Castillo, parent, addressed the proposed increase in funding for disability services and the proposed contract with the Shiloh Treatment Center. Vidya Muthupillai, DHS student, referenced student sentiments and concerns regarding the reopening of schools during the COVID-19 pandemic, Shiloh Treatment Center and making a visible page or slide on the Pearland ISD home page regarding voting accessibility/information for voting in the November General Election. Joseph Say, citizen, addressed COVID rate in Brazoria County, asked administration to push back the start of school and disapprove the Shiloh Treatment Center contract.

A motion was made by Secretary Decker and seconded by Trustee Barry that items 8.A.1, 8.A.2, 8.A.3, 8.A.4, 8.A.6, 8.A.7, 8.A.9 and 8.A.10 of the consent agenda be approved as presented.

8.A.5 -- Trustee Floyd asked to pull this item to talk about his concerns with the Shiloh Treatment Center. A discussion followed with Executive Director of Special Programs Dr. Lisa Nixon responding to these concerns. General Counsel Tanya Dawson also participated in the discussion.

A motion was made by Trustee Carbone and seconded by Secretary Decker that the board approves the agreements between PISD and Shiloh Treatment Center, Inc. (utilizing Pearland ISD Contract# 19-0411-03) to provide adaptive behavior and life skills services to students with disabilities in the amount of $305,541 (Fund 224) contingent based upon having an over site person/paraprofessional on campus every day.

Trustee Carbone restated the motion with a revised oversight provision to direct administration to have more frequent visits from Pearland ISD staff to the facility. Secretary Decker agreed with the change in motion.

Motion carried 5-2 FOR: Trustees Carbone, Decker, Botkin, Barry and Gooden Jr. AGAINST: Trustees Floyd and Murphy

Student Code of Conduct

8.A.8 -. President Gooden Jr. pulled this item to ask if the clause regarding harassment was in the prior versions of the student code of conduct? Dr. Kelly responded: the code of conduct wording addressing harassment is additional language from a recent Supreme Court ruling expanding the requirements for school districts to investigate such issues. That same Supreme Court ruling is also reflected in TASB Update 115 on the Consent Agenda. Ms. Serrano also stated that an emphasis in this area is something that principals and others with whom she consulted thought would be helpful.

A motion was made by President Gooden Jr. and seconded by Trustee Decker that the board approve the 2020-2021 Student Code of Conduct as presented.

Motion carried 7-0.

Remaining 8.A.5 items for Approval

A motion was made by Trustee Carbone and seconded by Trustee Floyd that the board of trustees approves and ratifies the recommended single, budgeted purchases listed below exceeding $75,000 as listed in the attached CH Local report.

Approval of purchase utilizing BuyBoard Contract #587-19 for Uniforms and Accessories with Fred J. Miller, Inc. for band uniforms to be used at Dawson High School in the amount of $177,960 (Fund 199).

Approval of agreement between PISD and Riverkids Pediatric Home Health (utilizing Pearland ISD Contract# 19-0411-03) to provide speech therapy services to students within PISD’s speech programs, evaluations, and/or ARD meetings in an amount of $91,800 (Fund 224).

Ratification of purchase utilizing Omnia Partners Contract #R150702 for Educational Software, Media, and Peripherals with Instructure, Inc. for the annual renewal of Canvas Cloud subscription in the amount of $83,314.08. Canvas is a Learning Management System that provides course content, an assignment tool, a discussion board, collaborative integrations through Microsoft 365 and quizzes in an online environment (Fund 199).

Ratification of purchase utilizing Region 5 Contract #20200307 for Security Systems, Fire Alarms, Extinguishers and Services with Nazca Tech and Consulting LLC for equipment purchase and installation of Aruba switches on PISD campuses in the amount of $177,090.58 (Fund 199).

Ratification of purchase utilizing Pearland ISD Contract RFCSP #08-0228-13 for Institutional Software with Skyward System for annual license renewal fees in the amount of $222,325 (Fund 199).

Motion carried 7-0.

Regular Agenda Additional Personnel

8.B.1 –. Dr. Sundie Dahlkamp stated based on the current need to address employee COVID issues and prepare for the recent approval of one-to-one devices, administration is proposing one COVID Nurse for employee assistance and two additional technicians to assist with deployment of and

service to the additional student devices. A discussion followed. CTO Bartay contributed to the discussion.

A motion was made by Trustee Floyd and seconded by Trustee Murphy that the board of trustees approve the recommendation of additional positions for the 2020-2021 school year and subsequent years.

The motion carried 7-0.

Public Hearing District Tax Rate

8.B.2 – President Gooden Jr. opened the Public Meeting at 7:52 pm. CFO Carter stated administration recommends a tax rate of $1.3585 per $100 valuation for 2020, which is $0.0371 below the 2019 tax rate. The change in the tax rate is as follows:

No change is being proposed to the I&S tax rate for fiscal year 2020-21. When the 2016 Bond Election was called, it was anticipated that it would cost taxpayers a total of 7 cents; however, the I&S tax rate of $0.4256 represents a maximum tax impact of 5 cents. Administration is working on defeasing debt as well as taking advantage of a bond refunding opportunity during this fiscal year, which will enable us to decrease the I&S tax rate next fiscal year. A discussion followed with CFO Carter answering questions presented.

A motion was made by Trustee Decker and seconded by Trustee Barry that the board of trustees adopt a resolution adding $0.05/$100 value to the Tax Year 2020 Maintenance and Operations Maximum Compressed Tax Rate. In using the appropriate language as prescribed by the Property Tax Code that the board also approves the resolution levying an annual ad valorem tax, that the property tax rate be increased by the adoption of a tax rate of 1.3585, which is effectively a 1.96 percent increase in the tax rate.

NOTE: The Tax Rate actually decreases but statutory language requires this wording.

The motion carried 6-1 FOR: Trustees Carbone, Murphy, Decker, Botkin, Barry and Gooden, Jr. AGAINST: Trustee Floyd A brief discussion followed. President Gooden Jr. closed the Public Hearing at 8:14 pm.

Order Calling November 3, 2020 Election

8.B.3 – Dr. Kelly stated since the May, 2020 election was postponed the revised order calling School Board of Trustee Election, Order for Voter Adopted Tax Rate Election (VATRE) and Canvassing Results of the Election is needed to comply with state law. Position One [1] and Position Two [2] will be on the ballot for the November 3, 2020 election.

A motion was made by Trustee Carbone and seconded by President Gooden Jr. that the board of trustees approve and adopt the Order calling the November 3, 2020 School Board Trustee Election and Voter-Approval Tax-Rate Election. Further, that the date to canvass these elections shall be set for November 17, 2020.

The motion carried 7-0.

Joint Election Contract for November 3, 2020 Election

8.B.4 - House Bill 1 of the 79th Legislature, 3rd Called Session, 2006, require school board elections to be held jointly with either an election for city officials or a general election for state and county officers using the same polling places as those other elections. Pearland ISD has the opportunity to participate in the countywide joint election to be held on November 3, 2020. Pearland ISD may participate in this election conducted and supervised by officials of Brazoria County and Harris County in accordance with Section 31.092(a) of the Texas Election Code.

A motion was made by Secretary Decker and seconded by Trustee Barry that the board of trustees approve the Joint Contract for Election Services between Pearland ISD and the County Clerk of Brazoria County which allows the officials of Brazoria County to conduct and supervise the November 3, 2020 Trustee and VATRE Election. (Contracting with Harris County will also take place but is not yet finalized.)

The motion carried 7-0.

Quarterly Investment Report

9.B In order to comply with Chapter 2256 of the Texas Government Code which is commonly referred to as the Public Funds Investment Act a copy of the Report of Investments was included in the agenda.

Administration is pleased to report that all investments were in compliance with the district’s investment policy and pledged securities were sufficient to protect the district’s funds at all times during the quarter ended June 30, 2020.

Bond Financial Update

9.C – An updated copy of the 2016 Bond Budget and Projections and Technology Bond Projects were included in the agenda.

August 25, 2020

The Board of Trustees of the Pearland Independent School District met in special session/workshop on Tuesday, August 25, 2020 at 11:00 a.m. via videoconference in accordance with Chapter 551 of the Government Code. Due to the possibility of impact from Hurricane Laura this meeting was conducted via video and

audio conference. The Board President, presiding officer or trustees were not physically present

at one location but a quorum participated in the meeting which was available by audio and video

to the public.

Opening 1.0 After noting that a quorum was present, President Gooden Jr. opened the special meeting/workshop at 11:02 a.m.

Superintendent Dr. John Kelly participated in closed session with the board regarding all items. Assistant Superintendent for HRS David Moody also participated in closed session with the board regarding all items.

Open Session 5.0 The board reconvened in open session at 11:55 a.m. No action was taken in closed session.

6.0 – Personnel:

A motion was made by Secretary Decker and seconded by Trustee Carbone that the board accepts and approves the Superintendent’s recommendation to name Rebecca “Rusty” Mathis as principal of Cockrell Elementary School.

Motion carried 5-0. Trustee Barry was present but was having technology problems and could not respond. Trustee Barry rejoined the meeting at 11:58 a.m. and voted “Aye.” President Gooden Jr. noted the motion carried 6-0. Congratulations were offered to Ms. Mathis.

Workshop Update on COVID-19 7.A - - Dr. Kelly updated the board on related matters/developments

that are occurring daily regarding the COVID9 pandemic. Dr. Kelly’s update included

Technology updates – Dr. Kelly stated no refundable fee will be charged to students instead a cost for damages to devices will be provided/charged.

Executive Summary: House Bill 1 of the 79th Legislature, 3rd Called Session, 2006, require school board elections to be held jointly with either an election for city officials or a general election for state and county officers using the same polling places as those other elections. Pearland ISD has the opportunity to participate in the joint election to be held on November 3, 2020. Pearland ISD may participate in this election conducted and supervised by officials of Harris County in accordance with Section 31.092(a) of the Texas Election Code and/or Chapter 271 of the Election Code. AMENDMENT #1 TO PEARLAND INDEPENDENT SCHOOL DISTRICT

RESOLUTION SETTING THE TAX RATE FOR THE YEAR 2020

This Amendment #1 to the Pearland Independent School District Resolution Setting the

Tax Rate for the Year 2020 is effective as of the ____ day of September, 2020.

WHEREAS, the Pearland Independent School District (“the District”) Board of Trustees

approved and adopted a Resolution setting the tax rate for the year 2020 at a duly called and posted

meeting held on August 11, 2020 (“Resolution”);

WHEREAS, on August 24, 2020, the Brazoria County Tax Assessor Collector corrected

its miscalculation concerning the amount by which taxes will be raised for maintenance and

operations on a $100,000 home, necessitating a correction to the Resolution;

WHEREAS, it has come to the Board’s attention that Article 2 of the Resolution, which

attempts to set forth a contingent tax rate in the event the voters do not approve the tax rate set by

the District for tax year 2020, is without legal authority, as the Texas Tax Code does not authorize

the District to adopt such a contingent tax rate;

WHEREAS, the Texas Tax Code proscribes that in the event the voters do not approve the

tax rate set by the District for tax year 2020, the Board of Trustees shall then approve a tax rate;

WHEREAS, because two Board of Trustee positions (Position 1 and Position 2) are on the

November 3, 2020 ballot for election, the makeup of the Board of Trustees could change;

WHEREAS, the current Board of Trustees hesitates to curtail the discretion of a future

Board of Trustees in setting the District’s tax rate in the event the voters do not approve the tax

rate set by the District for tax year 2020;

WHEREAS, the Board of Trustees desires to amend the Resolution to correct the amount

by which taxes will be raised for maintenance and operations on a $100,000 home detailed in the

Resolution’s Article 1 and to remove Article 2 of the Resolution for the foregoing reasons;

NOW, THEREFORE, the Board of Trustees of Pearland Independent School District

hereby amends the Resolution as follows:

1. The last paragraph of Article 1 is amended as follows:

The reference to “-$37.00” included in the last sentence of the last paragraph of Article

1 is deleted and is replaced with “-$28.00” The last paragraph of Article 1 now reads:

“THIS TAX RATE WILL RAISE MORE TAXES FOR MAINTENANCE AND

OPERATIONS THAN LAST YEAR’S TAX RATE. THE TAX RATE WILL

EFFECTIVELY BE RAISED BY 1.96 PERCENT AND WILL RAISE TAXES FOR

MAINTENANCE AND OPERATIONS ON A $100,000 HOME BY

APPROXIMATELY -$28.00.”

The remaining portion of Article 1 is unchanged and remains in full force and effect.

REVISED ORDER OF TRUSTEE ELECTION AND

ORDER FOR VOTER-APPROVAL TAX RATE ELECTION

This Amendment #1 to the Pearland Independent School District Revised Order of Trustee

Election and Order for Voter-Approval Tax Rate Election is effective as of the 8th day of

September, 2020.

WHEREAS, the Pearland Independent School District (“the District”) Board of Trustees

approved and adopted a Revised Order of Trustee Election and Order for Voter-Approval Tax Rate

Election at a duly called and posted meeting held on August 11, 2020 (“Order”);

WHEREAS, the ballot language for the voter-approval tax rate election included in the

Order needs to be corrected to conform to the Board of Trustees’ Resolution setting the tax rate

for the year 2020, approved and adopted at a duly called and posted meeting held on August 11,

2020 (“Resolution”) and amended by the Board at a duly called and posted meeting on September

8, 2020;

WHEREAS, on August 25, 2020 the Brazoria County Election Director and on and

September 2, 2020, Harris County Director of Election Projects respectively notified the District

an amendment to the polling places listed in the Order;

WHEREAS, the Board of Trustees desires to amend the Order to correct the ballot

language for the voter-approval tax rate election and to revise the polling placed listed in the Order;

NOW, THEREFORE, the Board of Trustees of Pearland Independent School District

hereby amends the Order as follows:

1. The ballot language for the voter-approval tax rate election listed in the Order at

the bottom of page 1 of the Order is amended as follows:

The following language is deleted from the Order: “Ratifying the ad valorem tax rate

of 1.3585 in the Pearland Independent School District for the current year, a rate that

will result in an increase of 1.96 percent in maintenance and operations tax revenue for

the district for the current year as compared to the preceding year, which is an additional

-$37.00”

The following correct ballot language for the voter-approval tax rate election is added

to the Order: “Ratifying the ad valorem tax rate of $1.358500/$100 in Pearland

Independent School District for the current year, a rate that will result in an increase of

2.33 percent in maintenance and operations tax revenue for the district for the current

year as compared to the preceding year, which is an additional $1,662,856.00.

Subject: Consider Submission of School Year Transition (Phase-in Period) Waiver Beyond Initial Four (4) Weeks of School Year

Executive Summary: In accordance with TEA directives, those districts considering a longer phase-in period for students whereby only a portion of on-campus students attend on a daily basis – requires a board approved waiver request to TEA. Such waivers can extend the phase-in period for up to an additional 4 weeks beyond the initial 4 weeks already scheduled and initiated by Pearland ISD. It is uncertain at present whether this extension will be needed. However, the waiver application must be submitted prior to the initiation of an additional phase-in beyond the first 4 weeks of the school year. The initial 4 weeks of the school year end on September 25, 2020. At present, the phase-in consists of limiting daily attendance to approximately 1/4th to ½ of the student body of those electing on-campus instruction. Such students attend one to two days per week – and this ratio would be extended should this extension be necessary. The school district will continue to use metrics developed by local medical professionals to guide decisions as to whether a continued phase-in of 1 to 4 weeks is necessary. Those metrics include the total number of new cases over a rolling 14 day period, the positivity percentage rate for a rolling 14 day period and favorable/unfavorable trend in such metrics over time. Should such an extension be required, the district will continue to provide daily remote learning to ALL students and will ensure all students have access to technology and the Internet. During this phase-in period, the district will also provide daily on-campus learning to a limited portion of the student body. As has already occurred, the district will continue to communicate to families and staff the plans and priorities for this extended period of time, should this continued phase-in be required. See the TEA stipulated waiver application attached.

Subject: Consider to Approve Asynchronous Remote Learning Plan for Submission to TEA

Executive Summary: As part of the requirements for implementing remote learning, TEA requires that districts provide various information and assurances to TEA with regard to remote learning for students during the 20/21 school year. TEA requires that this plan must be submitted to them by October 1, 2020. Pearland ISD’s plan (for which a link is provided below) provides remote learning through a combination of “Asynchronous” and “Synchronous” instruction. The Pearland ISD plan incorporates the template and suggestions provided by TEA. The following attestations accompany the plan:

All students able to receive instruction via asynchronous/synchronous methods and able to provide accommodations or resources to support when necessary.

Student IEPs will be followed regardless of learning environment such that students with disabilities receive a free appropriate public education.

Families and students will be provided with clear communications about expectations and support for accessing and participating in asynchronous/synchronous instruction.

Families will be made aware of options for transferring between instructional settings and the design of the asynchronous/synchronous remote options allows for transitions to occur with minimal disruption to continuity of instruction.

Educators will be trained and supported to provide asynchronous and synchronous instruction on the LEA chosen platform, including practice with the platform prior to delivery with students.

Educators will receive ongoing, job-embedded support to continuously improve their practice in the asynchronous and synchronous remote setting.

District IT staff will be trained on the platform and can troubleshoot access issues for parents and students when issues arise. A helpdesk or other support line is accessible for parents and students for this purpose.

A consistent, daily platform is identified by the district for delivery of instruction to students.

Educators have technology equipment that allows them to deliver asynchronous and synchronous remote instruction including proper internet bandwidth and devices with enabled cameras and microphones.

Curriculum is fully aligned to the TEKS and designed to ensure all TEKS are covered by the end of the year.

Instructional schedule will follow the campus bell schedule with a blend of asynchronous and synchronous instruction . Note: All grade attendance is recorded through the asynchronous procedure – even if synchronous instruction occurs for such students.

Subject: Interim Financial Statement Report as of July 31, 2020

Executive Summary: The attached Financial Statement Report is presented to provide a Fiscal Year 2020-2021 update as of the first-month period ending July 31, 2020.

This report includes an Interim Statement of Revenues and Expenditures for all appropriated funds (e.g. General Fund, Food Service Fund, and Debt Service Fund) as well as an Analysis of Tax Revenue and Collections.

General Fund – Revenues realized during the first month of operations total 0.5% of the budget while actual expenditures total 7.1%.

Food Service Fund – Local and federal revenues are minimal for the month of July, as well as expenditures.

Debt Service Fund – Debt service payments occur twice during the year – an interest payment in August and an interest and principal payment in February; prior year tax collections are as expected for the month of July.

Analysis of Tax Revenue and Collections – During the month of July, only prior year taxes are collected; current year tax collections begin in late October after the Board adopts a tax rate and the county mails out the tax statements.

No action is required on behalf of the school board.
