Main sponsor, ABay StationersCEO Sean Barnard, expressed his excitementregarding the alliance between ABay Station-ers, formerly Algoa Bay Stationers, and the As-sociation for Persons with Physical Disabili-ties Nelson Mandela Bay (APD NMB).

The launch of the ABay Wheelchair Wednes-day initiative, which is steered by the Associa-tion for Persons with Physical Disabilities Nel-son Mandela Bay (APD NMB), will take placefromtheAPDNMBOfficesat 55PatersonRoad,North End at 10am today.

“The reason for the unprecedented buy-infrom business to participate in ABay Wheel-chairWednesdaymustbeattributed to the rele-vance and simplicity of the initiative,” saidAPD Executive Director Brian Bezuidenhout.

How does it work?• Each of the 5 Wednesdays in May will see

a set of 10 different local leaders pay to spend4 hours in a wheelchair. Typical participants

would be business, sports and community per-sonalities.

. Participants will spend an initial periodassessing the wheelchair friendliness of theirown business environment, whereafter theywill be assigned simple, fun tasks at other pub-lic places like shopping centres where they willreport back regarding accessibility issues.APD NMB will use the feedback to negotiatemeaningful change where necessary.

. The R5 000 entry fee for each participantwill also go toward the purchase of a wheel-chair for a needy child. The wheelchairs willbe handed to the relevant children by the par-ticipants at the Handover Function on June 6.

. All profits generated by the campaign willhelp to continue the services provided at theAPD Day Care Centre in Motherwell whereAPDstaff care for 29ChildrenwithDisabilities.

APDFundraisingManager,WillieBosch, ex-pressed his gratitude to the other sponsors whohave each in their own way contributed to thesuccess of the project.

AN alley in a residential areawhich serves as a thoroughfarefor pedestrians is posing a safetyrisk to them and the residentsalike.

Ward 31 DA Councillor PennyNaidoo wants to warn residents andthose who pass through the area ofthe danger that lurks in the alley inSilver Oaks Street, Algoa Park. Thealley leads to an open space betweenAlgoa Park and Windvogel.

“The residents are complainingthat they are being robbed and as-saulted by criminals who hide be-hind the wall of the alley. This prob-lem has been here for years and theattacks take place even in broad day-light,” Naidoo said.

She added that the alley is not onlyposing a safety risk, but is also ahealth threat since it is also used forillegal dumping. When the Port Eliz-abeth Express visited the scene,many flies could be seen in andaround the alley.

“The residents would like to havea meeting with the sector police andthe CPF to address these issues, be-

cause there is zero police visibility inthis area and they expect the policeto patrol this vulnerable area,”Naidoo said.

A resident who lives close to the al-ley said that there are regular break-ins at his house.

“The thugs who sit behind thatwall also break into the nearbyhomes. I caught some of them red-handed in my garage, trying to stealfrom me. Something needs to be doneimmediately, because it cannot go onlike this. The people who use this al-ley see it as a shortcut, but I say it’snothing but a shortcut to hell,” theirate resident said.

Another resident said the robber-ies and assaults take place any timeof the night or day.

“From my house I can hear thewomen screaming when their bagsare grabbed on their way to work.

Even the school children are robbedof their cellphones and money. Noone is safe when passing throughthere, and I wouldn’t even advise myworst enemy to walk through there.

“The only solution to this problemwould be either a satellite police sta-tion or, the alley must be closed com-pletely,” he said.

Colonel Conrad Botha, stationcommander of the Algoa Park policestation, said that the alley in SilverOaks forms part of their normal areaof policing, and that he would meetwith the councillor to discuss the res-idents’ grievances.

Botha also added that they wouldsharpen policing in that specific ar-ea.

Wayile slapped on wrist over bucket toilets

THICK layers of dust and sand intheir homes and in their swim-ming pools have the residents ofBelinda Road in Charlo extremelyagitated.

They allege that heaps of soil fromthe Clover Rose nursery on the cor-ner of Circular Drive are beingblownoverCarringtonRoadand intotheir homes. Carrington Road is theonly separation between the busi-ness and the residential properties.

After a battle of 18 months to getthe Nelson Mandela Bay Municipali-ty to take action about the situation,the residents have now threatened totake legal action gainst the munici-pality.

Owner of Clover Rose nursery,Clive Long, said that he had donewhat he could to to resolve the situa-tion.

“As far as I’m concerned I did eve-

rything in my power to better the sit-uation for everyone. This is zoned ag-ricultural land and I am allowed tohave my business here.”

Resident Bennie Lourens says theonly solution would be if the nurserywent back to selling only plants, andnot soil.

“We never had any problems withthe business, and we understand thateveryone is just trying to make a liv-ing, but the dust and red sand blow-ing into our homes is making ourlives hell. It’s been going on for twoyears now.”

According to Lourens he had to re-place his swimming pool’s KreepyKrauly pump many times becausethey can’t keep up with all the sandin the pool and breaks. He furtherclaims that there is also a stenchcoming from the nursery’s direction,due to compost being made. “Onwindy days we cannot dare to go out-side because the dust affects mywife’s contact lenses. On such dayswe also have to keep our windows

and doors closed at all times.”Ward 6 DA Councillor, Retief

Odendaal, said he had brought the is-sue under the attention of the NelsonMandela Bay Municipality on vari-ous occasions. “This situationproves that a business situated in aresidential area just doesn’t work.

“This saga has dragged on for thebetter part of two years already. Dur-ing this time affected residents suf-fered as a result of the continued dustpollution emanating from the close-by nursery,” said Odendaal

“It is truly unfortunate that it hastaken the metro such a long time be-fore they finally decided to inter-vene. I sincerely believe that thismatter could have been addressedmonths ago and find it totally unac-ceptable that these residents had tofirst threaten the NMBM with legalaction before the municipality final-ly decided to take the necessary ac-tion. I trust that this matter will beaddressed speedily and that we shallfind an amicable, workable solution

worker was so old that he felldown dead when he picked up abucket. We are busy recruiting150 new workers.

“ Another reason is that theworkersdonotwant toworkover-time since they fear that they willnot be paid for it,” said Shaidi.

Baloyi said in reaction to thisexplanation, “People do not growold overnight. Do not wait untilsomeone falls down before you ap-point some-one else.”

Why parking bays for disabled?WHY the constant outcry about Accessible Park-ing Bays?

“The bays are 3,5 metres wide, a metre widerthannormal bays,whichallows individuals easyaccess in and out of their vehicle.

Accessible parking bays are usually locatedclose to the main entrances of buildings and aredemarcated with yellow road markings and blueand white signage with the wheelchair and re-served symbols clearly displayed. It is importantto note that the bays were designed with wheel-chair users and severely mobility-impaired indi-viduals in mind. The assessment criterion usedwhenscreeningapplicantsiswhethertheindivid-ual is “severely mobility impaired”.

Applicantswithheartconditions,emphysema,etc.,will notusually qualify for adiscunless theymake use of assistive devices (e.g. crutches orwheelchairs) and have great difficulty transfer-ring in and out of their vehicle and or have limit-ed mobility.”

Conditions relating to the issuing of a parkingdisc:

• When parking in an accessible parking bay,the registered disc holder MUST exit the vehicle.It is not acceptable for the disc holder to remainin the vehicle while an able-bodied partner exitsthe vehicle on his/her behalf.

• Discs issued to organisations or shuttle serv-ices are only valid when transporting personswith disabilities who are “severely mobility im-paired”. Once passengers have been offloaded,the vehicle must exit the accessible parking baytomaketheparkingspaceavailable forotherdischolders.

If one or more of the acceptable usage termsareviolated, theLocalTrafficAuthority reservesthe right to revoke the issued parking disc. Weurge the public not to abuse accessible parkingbays as doing so denies persons with disabilitiestheir equal rights to all buildings, facilities andservices. If you see someone abusing these bays,please confront the individual and inform themwhy their actions are unacceptable.

Crazy Diamond is a multi-di-mensional show and will take theaudience on a scintillating two-hour journey that follows the his-tory of Pink Floyd, seen through

the eyes of Keith Barrett, one ofthe group’s founding members.

MOTHERS of all ages are in for atreat with a special event that al-so serves to raise funds for acrèche in need.

Fresh Look, a new events compa-ny, is presenting a Mothers’ PamperDay which is a fundraiser for theThree Bears Educare Centre in Ex-tension 31.

The Three Bears Educare Centrehas been in existence for sevenyears, and owner Brenda Matyosays they cater mostly for childrenfrom low-income families.

“The centre provides quality edu-cationandcare for 60 children, rang-ing from1to6years.Weprovidepor-ridge and a meal and look after themfrom7amuntil 5pm.Weask themin-imum schoolfees as many of the par-ents cannot afford daycare,” Matyosaid.

Their most pressing needs are

building material to finish the roofof their Grade R section, and someoutdoor play equipment.

Fresh Look Events, managed byMichelle Valentyn and Dunane Wil-liams, decided to step in help with afundraiser. “We believe through in-vestinginourcommunity’schildrenwe will be able to empower them todeal with their current socio-eco-nomic situation and equip themwith the tools to rise above their cir-cumstances,” Valentyn said.

“Three Bears also hopes to raisefunds to be able to offer two mealsper day, bearing in mind that forsomeof thesekids, itwill be theiron-ly meals for the day. Proceeds fromthis event will be used to purchasemuch-needed learning materials,which will improve the quality oflearning at the centre.”

The Mothers’ Pamper Day entailstransporting 120 mothers from the

community intheNorthernsuburbsto hotels in Summerstrand by luxu-ry bus, where they will enjoy abreakfast. Thereafter they will betaken toaspa inNewtonParkwherethey will be pampered with head,neck and shoulder massages, ex-press manicures and gift bags, aswell as a cheese and wine treat andmore entertainment.

Williams said that they are tryingto give the community a lift withtheir hard work and passion. “Somany people out there have a nega-tive outlookabout theNorthern sub-urbs and we are trying to changethat. Itwillnothappenovernightbutif everybody in our community cando a little towards change we canand will succeed. We have taken astand to help where we can and togive new and upcoming artists aplatform to show what they can do,”she said.

ALGOA FM and Discovery recentlyhanded over R80 000 to charity.

The money was raised through theannual Discovery Algoa FM BigWalk, which took place in October2011. The Igazi Foundation and CAN-SA each received R40 000.

CANSA is known for its endeav-ours of fighting cancer through con-tinued research, education and sup-port in this field, whilst the IgaziFoundation raises awareness re-garding the prevalence of haemato-logical malignancies and other blooddiseases in the Eastern Cape.

“We are extremely grateful to ourloyal listeners, and the generousPortElizabeth public who helped to makethis all happen. This donation isR20 000 more than we raised in 2010,”

said Algoa FM managing director,Dave Tiltmann.

This is the message Theodor Her-zl High School pupils received at aspecial Holocaust Remembranceceremony, marked in April annual-ly by Israel and other Jewish com-munities.

Pupils lit six large and many tea-light candles in tribute to the sixmillion men, women and childrenwho died in Nazi concentrationcamps during World War II.

In Israel, the sound of a sirenstops traffic and pedestrians for twominutes of silent devotion on ‘YomHashoah Ve-Hagevurah’ (translat-ed from the Hebrew as Holocaustand Heroism Remembrance Day).

The day was set on the Hebrewcalendar in 1951, as it marks the an-niversary of the Warsaw ghetto up-rising. In 2005 the United Nationsdesignated 27 January, the anniver-sary of the liberation of Auschwitz-Birkenau camp, as InternationalHolocaust Remembrance Day.

This week the Property Poserpanel addresses a problem from areader who is renting a cottage onanother person’s property.

She explains that she pays herrental in advance and her utilitiesin arrears and settles them jointlyaround the 27th, even though herlease stipulates that they are onlydue at the end of the month.

Recently, her landlady obtainedan up-to-date municipal accountand insisted that the amount waspayable by the 7th even though, inthe normal course of events, thereader would have paid it at month-end.

The landlady even went as far asdisconnecting the electricity as a re-sult of non-payment. The readerwould therefore like to know whather rights are.

In the absence of further informa-tion, one must assume that the rent-al agreement stipulates that the util-ities are payable with the rental on

or before the end of the month, saysCharlotte Vermaak from ChasEveritt in Port Elizabeth.

“The landlady is therefore actingin breach of the agreement betweenthe parties.”

Furthermore, says Vermaak, theprovisions of the Rental HousingAct state that it is an unfair practicefor a landlord to unlawfully shut offthe utilities to a rented property.

“The regulations provide that atenant may lodge an urgent com-plaint with the Rental Housing Tri-bunal for spoliation or an interdict.”

Vermaak says the landlord maynot interrupt the supply of servicesto the tenant’s dwelling without acourt order and a landlord who failsto comply may be liable for the pay-ment of a fine or even imprison-ment.

The courts do not want people totake the law into their own hands,says Rian du Toit from DTS Attor-neys in PE.

“When a person owns or is using

something like municipal servicesthat is then taken away from them,he or she can apply for a spoliationorder for its restoration.”

Du Toit says the investigationdoes not take into account whetherthe previous user or owner had law-ful rights to the item or services,simply whether the current user(tenant) was in peaceful possessionthereof and that it was taken away.

“The merits of the matter will beinvestigated at a later stage shouldthe parties take it further.”

The appropriate remedy for thereader is therefore to approach thetribunal for urgent relief, says DuToit.

“If our reader requires quicker as-sistance, she might seek the assist-ance of an attorney who could warnthe landlady of the consequences ofher actions should she continue totake the law into her own hands.”

THOUSANDS of runners have already signedup for the Eastern Cape’s biggest road racethis Saturday (May 5) – and it is not too lateto enter.

Although pre-entries for this year’s SPARWomen’sChallengeclosedonSaturday(April 28),thosestillwantingtobepartof thesportingactioncan register on Thursday and Friday (May 3 to 4)from 9am to 7pm at the race tent at King’s Beach,or from 6am on Saturday (May 5).

Last year’s event saw over 11 000 runners tak-ing to the streets of Port Elizabeth and organisersare anticipating a similar turn-out this year.

“We usually take between 2 000 and 3 000 en-tries on the last two registration days and at least1 000 entries from 6am on the day of the race it-self,” said Colleen Muller, spokesperson for raceorganisers Walmer Athletics Club.

It isanenormous last-minute tally, consideringthat the 5km fun run kicks off at 7.15am and the10km race at 8am. “A lot of people only decide onthemorningoftheracethattheyaregoingtorun.”

Muller said schools and companies accountedfor most of the entries received to date. The highschoolwiththemostpre-entrieswill receivea lap-top from Core Technologies, while the primaryschoolandcompanywithtopraceattendancewilleachreceiveR2500.Totalprizemoney for topcon-tenders in the popular road run, now in its 19thyear, exceeds R25 000.

All finishers will receive medals, and t-shirtswill go to the first 11 000 entrants. Only womenwill be eligible for the big lucky draw prize of ayear’sworthofSPARgroceries, valuedatR15000.

Women aged 15 and older can enter the 10kmrace, while anyone older than nine can sign upfor the fun run. Male participants must don dragand run near the back.

The entry fee for the 5km run is R30, while li-censed athletes can enter the 10km race for R35and unlicensed athletes for R60, the latter includ-ingacompulsorytemporarylicencefee.Entrancefor the 10km run is free to licensed athletes aged60 or older.

The main beneficiary is the Yokhuselo Havenfor victims of domestic violence.

The event forms part of a five-race nationalGrand Prix series, which provides elite athleteswith a chance to accumulate points towards theoverall prize of a Nissan Micra.

The SPAR Women’s Challenge series is alsoSouth Africa’s third largest athletics brand afterthe Comrades and Two Oceans marathons.

Saturday’s run departs from the King’s Beachcar park. Both the 10km and 5km routes start onBeach Road and head towards Summerstrand,passing theOceanariumbefore turningright intoSecond Avenue. THE three-week gap between races isone dreaded by race fans the world over.Nevertheless, it does afford an opportu-nity to have a look at what’s made theheadlines, so far, in 2012.

It started in spectacular fashion downunder with a superb win by Jenson Buttonas McLaren set themselves as the earlypace-setters of 2012. One the most notablechanges from the previous season was RedBull Racing’s lack of domination either inqualifying or in the race. Even so, Sebas-tian Vettel and Mark Webber found them-selves in solid point scoring positions inall of the first few races.

What is important to note after the startof the season is that the RB8 is still a funda-mentally quick car. It hasn’t become aslouch overnight; rather the ever-deter-mined McLaren team have finally hit thesweet spot in terms of design and hit theground running from the get-go. The Wok-ing-based team had started previous cam-paigns a tad behind the eight-ball. In 2012the designers of the MP4-27 raised eye-brows by choosing to steer clear of the pre-ferred step-nose design and proved impres-sively quick on the track. It led to a consist-ent rather than spectacular start to theseason for the British duo and is definitelyin the reckoning for the driver’s title.

LET’S not muck about. A newspaper re-port last week alluded to the possibility ofCheetah’s hooker and captain, AdriaanStrauss, being in pole position to lead theSpringboks in the three-test rugby seriesagainst England in June.

Bok coach Heyneke Meyer had some nicethings to say about Strauss after the trainingcamp in Pretoria involving the Cheetahs andLions. Though the report said Strauss had“emerged the frontrunner” to lead the Boksagainst England, Meyer in fact did NOT saythis.

What he DID say was he was “impressedwith Strauss’s leadership qualities” and thathe had “plans to select five rising stars” forthe Springbok squad to oppose the tourists.

Last weekend’s Super Rugby clashes cer-tainly left the best for last. (Well, last but one,with the Waratahs-Crusaders match in Syd-ney played on Sunday.)

But sadly – because the Cheetahs had playedso well in the first half, leading 23-9 at thebreak, only to lose – the one quality missingfrom their performance in this pulsating clashwas coolness of head. Not to place too heavyan emphasis on it – leadership. The Highland-ers, on the other hand, showed how to handlea situation even when the cause looks to be to-tally lost.
