    In this issue we present two topics that are of utmost importance with regards to the prices and

    availability of medicines - Compulsory licensing and National Pharmaceutical Pricing Policy. There

    is a landmark judgement regarding the former and deliberations are on within the government and

    with stakeholders regarding the latter.

    INDIA'S FIRST COMPULSORY LICENCE

    Hyderabad based drug maker NATCO has been granted India's first compulsory licence. NATCO

    can make and sell a similar version of BAYER's advanced kidney cancer drug Nexavar in India. The

    landmark judgment was pronounced by the Indian Patent Office under the amended IndianPatent's Act (2005)

    The judgement reasoned that Bayer had not met the reasonable requirement of the public. It had

    not "worked the patent" or manufactured it to a reasonable extent in India. Besides the drug was not

    available at an affordable price.

    A compulsory licence is granted by a country on health grounds, where patients are unable to

    access a life saving medicine. NATCO is to sell the drug at Rs. 8880/- for a month's supply of 120

    tablets as against Bayer's Rs. 2.8 Lacs for a month's supply. NATCO will have to pay BAYER a

    royalty of 6% of the net sales.

    NATIONAL PHARMACEUTICAL PRICING POLICY

    The Prime Minister's Office (PMO) is examing the impact of the proposed drug pricing policy (NPPP- 2011) on consumers and the pharmaceutical industry ahead of a crucial inter ministerial meeting

    to sort out the issue. (Please see our J an-Mar 2012 issue for details regarding the draft policy)

    Several stake holders, including the health ministry, the World Health Organization, health groups

    and experts, have said that the proposals would raise the cost of medicines and healthcare.

    However, the industry associations have in principle agreed with the DOP's draft proposal, although

    with minor changes.

    The Department of Pharmaceuticals (DOP) and the health ministry are against the

    recommendation to introduce market based pricing (MBP). MBP involves the pricing of drugs on the

    basis of the top three brands in each segament.

    The DOP and the ministry are in favour of cost plus pricing for molecules in markets where oligopoly

    prevails and the weighted average price of the bottom three brands in competitive markets. Mean

    while, the health ministry has suggested that the pricing should be based either on the

    government's bulk procurement price or the average price of three cheapest brands to uphold the

    principle of affordability.

    Another recommendation in the draft policy that has been opposed is the free pricing of all drugs as

    long as they remain within the cap of Rs. 3 per unit. This some believe would provide leeway for

    increase in prices of many essential medicines, including painkillers, anti-inflammatory drugs which

    are currently available at prices far below Rs. 3 per unit.

    MEDICINES AND THE BUDGET

    In the latest budget the excise duty on the bulk drugs has been increased from 10% to 12% while the

    excise duty on formulations had increased from the present 5% to 6%. There is an increase in the

    excise duty of the packing material also. This will lead to an increase in the prices of formulations.
