OVERVIEW

WIPO – Centralized Access to Search and Examination (WIPO-CASE) provides a platform to share information regarding search and examination reports among participating national IP offices.

This system was initially developed by the International Bureau in response to a request from the Vancouver Group offices (the patent offices of Australia, Canada and the UK). Based on their requirements, an initial system was deployed in 2011. The system was further enhanced during 2012 to offer direct data exchange through web services.

The objective of this application is to improve the efficiency and quality of the Search and Examination process at national patent offices. Time taken for search and examination work can be reduced by referring to information on search results and examiner’s opinions from other offices. The patent office can carry out further search and/or examination work after analyzing existing information of any equivalent filing at another participating office.

As of December, 2015, nineteen participating offices and International Bureau (IB) are involved in information sharing using the WIPO CASE System. Of those, five are active providing offices:

Furthermore, the WIPO CASE is connected to One Portal Dossier operated by IP5 offices, and can search and obtain examination documents of JP, KR and US.

The list of participating Offices will be updated and published on the WIPO CASE web site at the URL http://www.wipo.int/case/en/.

This document describes the latest functionality of WIPO CASE portal for helping users to get to know how to retrieve and obtain search and examination information.

ACCESSING THE PORTAL

Access to WIPO-CASE requires a WIPO online account which is provided via a generic WIPO account management system (see https://pct.wipo.int/wipoaccounts/usercenter/public/register.jsf). There are two types of WIPO accounts: standard user accounts for general public which are required for accessing some of the new WIPO online services such as ePCT and office user accounts which are created for users of national IP Offices to use office related online services such as RO/ISA features in ePCT and WIPO-CASE.

Creation of User Accounts

Creation of office user accounts is a three stage process and it requires two step approval actions:

- Creation of new office user account is initiated by the first office admin user using the WIPO online portal http://pct.wipo.int/wipoaccounts/office (e.g. WIPO colleagues who are responsible for operating the requested service or contact points of national Offices who are nominated as ‘office admin’. Access to office admin services requires a stronger authentication method using RSA tokens (WIPO will send nominative RSA tokens to the office contact points upon requests).

- An automatic e-mail will immediately be sent from no.reply@wipo.int to the office account holder giving a link to a page allowing him/her to set the password (please make sure that your office’s email system does not consider this incoming email as spam). The following is an example of the email content:

- Finally the second office admin user (similar profile as in stage one) would confirm the account creation and grant access to WIPO-CASE.

Based on special arrangement with individual IP Office, WIPO may take the two step actions as office admin.

Roles and Access Rights

Office user login is based on username and password authentication. Some restricted functionality requires a strong authentication method by digital certificate as office administrator user.

FUNCTIONS OF WIPO CASE 3.0

To sign in to the portal1. Open a Web browser and enter the URL https://www3.wipo.int/caseportal. The Home page is

displayed and requests the credentials.2. Enter your Username and Password in the respective fields, and you can log on the new WIPO-

CASE portal.

3. Click Sign in. The Search page is displayed.

4. Click the Sign out displayed at the upper-right of the page to log out of the portal. The Login page is displayed when you log out.

Note: If the username and password are wrong, the Invalid login message is displayed

If username and password exist in the database, but the country is not the participant country of CASE, then Access Denied message is displayed.

If username and password are correct and the country is the participating office for CASE, only then the Successful login message is displayed.

Patent Family SearchYou can search the patent family for the patents and can view the bibliographic data along with documents like specifications, Examination reports, and so on.

There are two types of patent family search:

Extended Search - A user can view all sets of patent applications inter-related by either priority claims or PCT national phase entries, normally containing the same subject matter. Patent Family is formed based on relation with Priority Claims.

Simple Search : A user can find related priority applications by "one level backward and then one level forward" in the patent family tree (see annex).

Note:

It is possible to search in WIPO CASE by publication number.

The application number for Australia is AU followed by 10 digits. AU publication number and application number have the same serial number for patent application (e.g. AU2011202229).

The application number for Canada is CA which is the two digit country code, followed by 7 digits. CA publication number and application number have the same serial number for patent application (e.g. CA2645707).

The application number for China is CN followed by 4 digit year and 9 numeric digits (e.g. CN2011800236860, CN2010101340801). CN publication number has a 9 digit format (e.g. CN102970894)

The application number for United Kingdom is GB, which is the two digit country code, followed by 7 digits, followed by a dot and 1 digit (e.g. GB0804201.2). Publication numbers for GB application are in the format of GB2nnnnnn (e.g. GB2443592)

The application number for Israel is IL followed by 6 digits. IL publication number and application number have the same serial number for patent application (e.g. IL202200)

The application and publication number for Japan is JP followed by formats as indicated below:

The application and publication number for Republic of Korea is KR followed by 2 digit code, 4 digit year and 7 numeric digits (e.g. KR1020130074261).

The application number for United States of America is US followed by 2 digits as series code and 6 digits as serial number (e.g. US12/604213). You can use “/” to divide series code and serial number.

The application number for PCT is “PCT/” followed by the country code (two digits) of the country where the application was filed, and 10 digits divided by “/”. (e.g. PCT/US2013/071150)

The publication number is WO followed by 10 digits divided by “/”. (e.g.WO2014/081006)

As of December 2015, the patent family service covers application and priority numbers of AU, CA, CN, GB, ID, IL, JP, KR, WO, MY, PH, SG, US and VN.

To perform a search1. Log on to the web portal with appropriate credentials.

2. Select Application Number or Publication Number from Search Type drop-down list.

3. If you select Application Number, enter the two letter country code and the filing number without space characters in the adjacent text box. If you select Publication Number, then enter the two letter country code and the publication number in the text box.

4. When you enter the two letter country, some examples of patent application or publication number will be shown next to the “Simple” button.

5. Click “Extended” or “Simple”, and then “Time Line” tab is displayed. Just pressing enter without clicking any buttons will be processed as “Extended” search.

Extended Family (Timelines View)When selecting “Extended” search”, you can view all sets of patent applications inter-related by either priority claims or PCT national phase entries.

1. Fill out an application number, and click “Extended” or just enter.

2. “Time Line” shows as a result of extended family search in order of time.

When applications have the same application date or priority date, such application numbers are aligned on the same vertical line.

Quick info popup

1. Put a mouse pointer onto application numbers, and Quick info popup is displayed.

2. Quick info popup shows the filing date, priorities, PCT information and the availability of search/Examination results.

Search report indicator

1. The indicator means that the application has the search and/or examination report.

Application data non availability indicator

The indicator means that the application is not available.

Extended Family (Tabular View)Click “Tabular View” tab next to “Time Line”, and then the list of applications will be shown for helping you understand the relevance to each priority application.

Simple Family (Timelines and Tabular View)When selecting “Simple” search, you can view related priority applications by "one level backward and then one level forward" in the patent family tree.

1. Fill out an application number, and click “Simple”.

2. “Time Line” shows the result of simple family search in order of time.

3. Click “Tabular View” tab, and then you can also view the list of applications generated by simple family search in a tabular manner.

To view the patent detailsWhen you double-click the application number on the timeline or click the acive application number on the tabular view, three window of “Document List”, “Bibliographic Data” and “Citation Data” will be displayed.

“Document List” is selected by default.

Doclist Section

This section shows the list of document title for the selected application.

Press the button when you want to view a document. The PDF document is displayed on the right side of screen.

Regarding the function of download, there are two types of formats: Original and PDF

Click the button , and you can download a document in original format such as TIFF or Word.

Select the check box when you want the multiple download.

Click the button , and you can download a document in PDF.

Bibliographic Data Section

This section shows bibliographic information for a selected application.

Click the tab “Bibliographic Data”.

Note: The Bibliographic data page displays the publication number, application number, publication

date, applicants, title, priority details, and so on.

When Priority Details have an active linkage, you can click it to view the Bibliographic data of the priority application.

When an application is originated in a PCT application, you will see the relevant PCT information at PCT App No, and so on. You can click the application number to open the new tab showing Document List or else.

In addition, when you click the button , you can also view the PCT application on PATENTSCOPE.

Citation section

This section shows the list of document cited by offices for the selected application. As of December, 2015, the citation data is available for AU, CN, GB, JP, KR and US applications

Click the tab “Citation Data”.

A list of patent literature or non-patent literature cited by office examiners is shown. You can also refer to additional information for some office (currently only AU), i.e. Category, Claim-Ref and Status.

Click the button , when you want to see the citation history.

Each citation may be raised and revised by examiners and changes are made available through a kind of change log. At the moment, this information is provided by AU.

Tick the box and click the “Copy”. The window of citation information is displayed and you can easily copy them.

Click the button next to cited document.

And then the new window of PATENTSCOPE is generated to show the detailed information like bibliographic data and Claims.

Even though non-English documents are cited, several translation utilities on PATENTSCOPE help you understand their contents.

In addition, you can click linked numbers of cited document, and then the new tab shows a result of patent family search.

To view patent documentsYou can see the more effectively utilize the viewing area of the application.

1. Navigate to “Document List” page.

2. Click the button shown next to the selected Document Name.

3. The document is displayed on the right side of the screen in PDF.

To download multiple documents:1. Select the check boxes for documents that you want to download.

2. Click or on the upper bar, and you can download multiple files.

3. You can also select all the files by selecting the check box as indicated below.

To compare documentsYou can compare documents side by side at the “Compare View” window.

1. Click the button in the document list, and confirm the button changed to .

2. Press the button “Compare”, and call up the “Compare View” window.

3. Choose documents you want to compare from “Document” drop-down list, where the titles of documents you clicked are sited.

4. You can change configuration to compare up to four documents together on a screen. For more information, take a look at “User Preference”.

5. Click “Manage List”, and you can remove selected document lists partially or fully.

6. When you want to leave the comparison view, click the button “Close” or “Clear and Close”.

TranslationNon-English documents can be machine-translated by using google online service.

1. Press the button , when you want to see the machine translated document.

2. Select the language at google translate bar, and then the document will be translated.

In addition, some offices (e.g. CN, JP or KR) provide both original and translated documents in English.

They are indexed by “ORIGINAL” and “TRANSLATED”. The translation is implemented by their own MT engines.

Family CitationsCitations related to whole applications grouped in the same patent family are shown in a summarized manner.

1. Click the tab “Family Citations”, and then all citations listed in the same patent family are displayed.

2. The numerical indicator like means the number of citations in the patent family.

Users PreferencePreference function allows you to change a configuration for more convenience.

1. Click “Preferences” on the first page of portal.

2. A window of “User Preferences” is popped up, offering two types of preferences:

- Default Search Type; and

- Compare Documents Panels.

3. By ticking any items and clicking “save”, the configuration is reflected by default.

Maximize & RestoreYou can effectively utilize the viewing area of the application.

2. The WIPO Banner is disappeared, and the viewing area broadens.

You can also click the icon to change a size of windows.

3. Click “Restore”, and then area becomes a normal size.

To view the tree structure1. Perform an extended search. The patent family is displayed.

Click “View Tree”, and the patent tree is displayed.

This page displays all the links.

Notification ListThe office administrator users and the office users can set notifications, that is, the users receive an e-mail notification for the added applications. The office users can add multiple applications to their notification list for future reference, and can remove applications from the notifications list.

When a document is added to an application or deleted from an application, all the users who have added the application to their notification list receive an e-mail.

Currently, this function is only used for applications of AU, CA, GB and IL.

1. Click “Subscribe” or “Family Subscribe.”

2. Select “Yes”, when the confirmation dialogue pops up. The color of the button changes when the process is successful.

3. When you want to remove the notification, click “Subscribe” or “Family Subscribe”. The confirmation of unsubscribing pops up as well, and just click “Yes.”

4. Click “Notification” on the top of the screen, when you need to manage the notification list.

In this list, you can edit the record to extend notification to the family or delete it.

5. Click “Users Notifications” on the top of the screen, when you need to see previous notifications from WIPO.

Family Search in WIPO CASE

An application may claim priority to one or many earlier application and may be claimed as a priority application by other later applications. Simple search in WIPO-CASE finds all related priority applications by "one level backward and then one level forward" in the patent family tree. This is related differently from the possible definitions provided by the EPO (see http://www.epo.org/searching/essentials/patent-families/definitions.html).

Let's consider the following applications and related priority applications. In this example, P1, P2 and P3 do not have prioirities:

How to use WIPO CASE for your examinationAs patent system and procedure vary amongst patent offices, you can choose any methodologies of using the WIPO CASE suitable for your examination.

Here is one generalized example for reference.

1. You enter your own application number, which you are examining, and click “Extended” or “Simple”.

Then, a patent family search returns “Time Line” of other offices’ applications.

You can briefly see the icon to check whether patent families have search/examination reports.

[How to find relevant applications for your examination]

If your application is at the stage of a national phase entry, PCT application is so relevant to your application that an ISR or IPRP would be quite useful. In addition, other applications at the stage of its national phase entry would also be relevant to your application.

In the case of Paris Convention route, you see the information of priorities of your examining application and check other applications which have the same ones. They are usually relevant to your application, but you may compare a similarity of claims. Search/examination reports for applications with the closest claims will be more useful.

You can briefly understand necessary information like priorities or PCT application, by looking at “Quick info popup” below:

[How to do when a search result isn’t returned]

You directly enter other office’s application numbers to which your application claims the priority, or enter PCT application number related to yours.

2. Select one of applications you are interested in, and then you see “Document List”.

“Document List” helps you understand the prosecution history about the application.

3. Click each document to view its contents, and obtain detailed information for your examination.

As offices use their own document types, refer to ANNEXE 2 to know main documents of each office.

[Which documents should been seen]

All documents are valuable, and especially, outgoing documents, which are drafted by examiners, are more important. It is because they show relevant prior arts and explain why applications should be patented or refused.

Through the process of understanding examiners’ thoughts and decisions, you can effectively utilize the search/examination reports.

4. Once you understand search/examination reports of one office, you can also explore the search for other offices’ reports and collect additional input to your examination.

After collecting relevant reports, you will compare and analyze to see which information should be referred. For the comparison, you select documents at “Document List” to forward to “Document Comparison View”. On the view mode, you can choose document titles you want to compare and show it side by side.

[Why cited documents sometimes differ among examiners]

Basically examiners have established their own examination method based on their experiences or infrastructure or else. All factors which surround examiners will cause the differences of search results and citations.

On the other hand, there could be some reasons resulting in these situations.

PCT provides the search report along with the examiner’s comment in the document such as “International Preliminary Report on Patentability Chapter I.”

One reason is the difference of claims among applications. Applicants sometimes add some technical features to original claims during period of priority. You can investigate a difference through the process of comparison with claims of each office.

Another reason is a difference of patent family. Examiners usually tend to cite documents written in their mother tongues, which mean that there could be no substantive differences among citations. The WIPO CASE offers the useful utility by which users can search for patent family of citations.

Or, you sometimes have some other applications, which you want to keep tracking their results.
