Patent Portfolio of Major Indian IT Companies- A Measure of Innovation

Executive SummaryThe purpose of the study was to analyze the importance given by selected major Indian IT

firms to innovation based on their Patent portfolio as a measure. Analysis of the Patenting

activity provides an insight into current trends in intellectual property generation apart

from providing an account of innovation and technological development taking place in the

Information Technology sector. The study summarizes results of the research that was

conducted on HCL Technologies Limited, Infosys Technologies Limited, Mahindra Satyam ,

Tata Consultancy Services Limited and Wipro Limited.

This report covers filing trends of the above mentioned companies along with status of

Patents, International Patent Classification and Priority Date. The study also provides the

filing trends and status with the field of engineering to which they belong, along with details

of all Patents filed by these companies since their inception.

Our research suggests that after a moderate retrenchment in the years 2008-2009, the IT

industry in India is recommitted to pursue innovation. The fact that the said companies

consider innovation to be one of their key assets and are committed to boost their spending

on Research & Development and innovation is evident from the increase in number of Patents

that have been filed by these companies in US Patent Office, European Patent Office and

Intellectual Property Office India. The study details the challenges associated with software

Patenting in India and postulates that despite the restrictions of obtaining a software Patent

per se in India, the IT industry is taking a prominent stand on generating and protecting

Intellectual Property in India and abroad.

Since the year 2000, awareness about Innovation and Intellectual Property Management

has been on the rise in the IT industry. It is evident from the Patent filing statistics of the

Intellectual Property Office India that the number of Patent filings in the field of computer

science has been on the rise since 2004. Across the world, a large number of organizations

are considering innovation as top priority, and consequently raising the investment on

innovation. In this study, the trends indicate that innovation has been geared towards minor

improvements to existing products and services as against innovation targeting newer

products. However, the companies are broadening types of innovation functions they are

targeting. The emphasis on product development and idea generation is increasing.

IntroductionThe Information Technology sector in India experienced an exceptional growth as a result

of increased globalization and has emerged as a key sector of the economy in terms of its

contribution to export earnings, investments, employment opportunities and overall socio-

economic development. Notwithstanding competitive pressures from around the world,

India continues to be an attractive source for IT sourcing due to low cost of operations, high

quality of products and services and availability of highly skilled manpower.1

Vertical Market for Indian IT SectorBanking, Financial Services & Insurance (BFSI) and Hi-Tech/Telecom are two key verticals

served by the IT industry in India. These two account for more than 60 percent of the IT

space in India. Other key verticals include Manufacturing, Retail, HealthCare, Airlines &

Transportation, Construction and Utilities in the decreasing order of percentage of the total

IT Market.

BFSI – Banking, Financial, Services and Insurance;

In 2008-2009, the global recession emerged as a key concern to the sector since the industry

has a significant dependence on external demand. It forced clients to cut their IT budgets,

delay payments and vouch for severe price cuts & waivers. This necessitated a transformation

for the IT industry and it began to re-engineer the challenges posed by the macro-economic

environment. The change in the demand outlook prompted the industry to adopt greater

robustness and flexibility in its business models which would benefit the industry in the

long run. The changed environment encouraged companies to, concentrate more on the

domestic market and to diversify beyond their core offerings and markets in order to have

a larger market penetration and operational flexibility. These measures adopted by the

industry have widened its leadership position in the ever-growing global sourcing market.2

Another approach for Indian IT companies to maintain their global competitive advantage

has been to move up the value chain. In order to achieve this, they have started focusing on

innovation and intellectual property generation through their domain knowledge and

transforming themselves into Innovation centers. Several multinational companies are

already generating significant Intellectual Property (IP) through their Research &

Development centers established in India. 3

As a measure of innovation, Indian publication activity in the field of Information and

Communication Technology (ICT) grew slowly during years 1990 to 2001, gradually picked

up thereafter during 2002-2006 and showed a significant rise during 2007. Fields such as

communication systems, cyber security systems, network management and digital

computing devices witnessed a rise in the number of Indian publications related to them.

To supplement the increase in publications, Indian patenting activity has also grown slowly

since year 1990, but a sudden spurt in growth was witnessed during the years 2002-2007.

Publications by IT Companies accounted for 10% of overall publications relating to ICT sector.

However, IT Companies accounted for 40% of the patents files in India. This clearly indicates

an increased interest in research & development and innovation among IT companies in

India.3 As Indian IT companies strive to move up the value-chain, they seem to have realized

the importance of Innovation and Intellectual Property as an important aspect of their

credentials.

Although software per se cannot be patented in India, companies have sought patents for

their software in other parts of the world. These companies also continue to seek non-

software patents in India. Several patents related to IT processes have been filed. This

indicates a level of maturity for the Indian IT industry to remain a preferred IT source.

As Indian IT companies restructure their operations, they are focused on innovation and

intellectual property generation. They are seeking protection for their intellectual property

through patents filed in different parts of the world. As such, their Patent Portfolio provides

a measure of Innovation.

Scope of the study & Research MethodologyThis study provides an insight into the Patent Portfolio of key Information Technology (IT)

companies in India, namely HCL Technologies (‘HCL’), Infosys Technologies (‘Infosys’),

Mahindra Satyam (formerly Satyam Computer Services Limited), Tata Consultancy Services

(‘TCS’) and Wipro Limited (‘Wipro’).

The analysis looks at all the Patents applied by the above mentioned companies in USA,

European Union, India and Canada. This includes Patents at all stages – application,

publication and granted - of their lifecycle. For each company, the following data is presented

in addition to the complete list of patents filed:

Apart from a comparative look at these five IT companies and an insight into the areas of

possible patent generation, this report also highlights certain key aspects of Patenting for IT

companies in India.

Patent databases such as Thomson Reuter’s Delphion and several other Patent information

sites mentioned below were searched for Patents filed by companies indicated. As on 15th

August 2010, records of all the Patent documents filed by above mentioned companies

were extracted and analyzed. The results of the search have been tabulated in Exhibits. The

entire process was verified using multiple Patent databases to ensure accuracy of the results.

The Patent Databases of United States Patent and Trademarks Office (USPTO), European

Patent Office (EPO), Canada intellectual Property Office (CIPO) and Indian Patent Office

(IPO) were searched for ‘Live Patents’, and these results were also recorded in the report.

It is important to note that Patent applications filed during the last 18 months are not

reflected in the report since Patent databases only include patents in the publication phase.

In most cases, patent applications get published 18 months after the date of filing as per

the Patent filing norms except in the case of early publications, where they may appear in

the patent databases a little sooner. For this reason, all graphs indicate data until and including

the year 2008 only, to ensure uniform comparison across companies.

Infosys Technologies LimitedExhibit 6 depicts that Infosys has made patent filings in India and USA. It has filed 133 Patent

applications in India and 111 applications in USA. In our research, we did not find any

instances where Infosys has sought patent protection in any other parts of the world. A few

interesting observations regarding Infosys are that 22% of the 111 filings in USA have first

been made in India and then followed with overseas filing and that 3 of its 244 total patent

filings have been through the Patent Cooperation Treaty (PCT) route.

Timeline Depicting Patent Applications

Exhibit 26 displays the comparison of yearly filing trend in USA for HCL, Infosys, Mahindra

Satyam, TCS and Wipro. The graph for Infosys indicates that it has significantly high number

of Patent filings in USA compared to its peer companies. On the contrary, HCL Technologies

has not filed for any patents in USA. Others - Mahindra Satyam, TCS and Wipro - have had a

very limited number of patents filed in USA.

General Comments� The above trends spell out that Infosys is active in its Intellectual Property creation and

protection in India and USA. This is the indicator that it is promoting in-house research

activity.

� In the past couple of years, Infosys has clearly been focusing on innovation and on creating

IP wealth with a remarkable increase in the number Patent filings.

� Infosys is seeking protection using various patent filing options including PCT route.

� Among the companies in this report, the other four companies - TCS, HCL, Mahindra

Satyam and Wipro – are falling behind Infosys quite rapidly and need to urgently appreciate

an emphasis on Innovation and IP development.

� None of the companies considered had ‘Triadic patents’. The ‘Triadic patents’ are a series

of corresponding patents filed at the European Patent Office (EPO), the United States

Patent and Trademark Office (USPTO) and the Japan Patent Office (JPO), for the same

invention, by the same applicant or inventor. Triadic patents form a special type of patent

family.

� While the above companies do serve their clients in Mechanical Engineering services or

ConclusionThe study concludes that major Indian IT companies have started focusing on Innovation

and Intellectual Property creation. However the number of patents filed is rather limited

and needs to accelerate.

This study has brought out the insights of Patent portfolio of top five Indian IT companies

which would pave the way for understanding their respective technological advancements

and their Intellectual Property enforcement capabilities related to Patents.

Infosys is accelerating its IP creation activities significantly faster compared to its peer

companies and investing on patent filing specifically in India and USA. Apart from . TCS has

invested in seeking patent protection in many other countries apart from India and USA.

The other three companies - HCL, Mahindra Satyam and Wipro possess a lean Patent

Portfolio.

One of the reasons for limited filings in India could be that software per se Patents are not

permissible in India. But as global IT space gets more competitive, the emphasis needs to

be on creation and protection of Intellectual property and such an emphasis on Intellectual

Property calls for harmonization of Indian IP system with that of developed countries such

as USA, Great Britain and also for accommodating improved protection for software

integrated inventions in India.

For Indian IT companies to have a sustained growth in terms of intellectual wealth creation

and patent portfolio, they need focused in-house IP development and commercialization of

these innovations. This needs to be supported by an increased thrust on Patents for these

companies to stay ahead in the technology licensing market.

This study has highlighted that the major Indian IT companies are gradually upgrading itself

from ‘coding factory’ to ‘idea factory’.
