W hen Vani Henderson and her husband Irv moved into their home on Wal-

ter Hays Drive in 2009, they were four days away from giving birth to their second child. One of the things that attracted them to the neighborhood was a child-friendly atmosphere that would suit their growing family.

“We wanted a good school and somewhere we could see kids around and playing outside,” Hen-

derson said.Three years later, Henderson

noted that her family’s experience in the Duveneck neighborhood is exactly what she was hoping for. “This is a really nice community. On weekends we have kids running in and out of the house,” she said.

Henderson and her family take advantage of many of the facilities

that are close by. She said that she, her husband and their two young children often visit Eleanor Pardee Park, the Palo Alto Junior Museum & Zoo and the Palo Alto Children’s Library.

move. I love these kids,” she said.In 2009, Nemet and her neighbor, Jen-

nifer Antonow, founded Camp Iris Way, a yearly, week-long summer camp filled with activities for children from Iris Way and the adjoining Primrose Way.

Nemet, who said she knows all of her neighbors, appreciates the relationships she has built over the years. However, there is one thing she would change about her neighborhood if she could.

“I wish we weren’t in the flood zone,” she said.

Nemet and her family were not around for the 1998 San Francisquito

Creek flood, but resident Kurt Taylor was there.

Taylor moved to De Soto Drive in 1991 and said that even though the flood took everybody by surprise, he and his neighbors were quick to act.

“The neighborhood really pulled to-gether almost instantly to try to help the people whose houses were hit the worst,” he said.

Some neighbors had to make major repairs to their homes after the flood, but other than that, the neighborhood has nearly stayed the same.

“There’s not been any dramatic phys-ical changes primarily because most people who buy these houses buy them because they like them. They like the

mid-century look,” he said.On Walter Hays Drive, many people

renovate their homes to some extent. Henderson and her husband are no ex-ception.

“Often the homes are older and could benefit from some sprucing up,” Hen-derson said. However, Henderson said she believes that her community and the nearby facilities make the expenses associated with moving into an older home on a nice street negligible.

Now that the Hendersons have fin-ished renovating their home and are settled in, Henderson said that the fam-ily is there to stay for the long-term.

“I couldn’t imagine living in a better place.”

Q I am a first-time landlord who just bought a small six-unit apartment building as a

personal investment. My Christian faith is extremely important to me and it affects every aspect of my life. I would prefer to rent out the apartments in my building to other Christians, not because I am preju-diced against non-Christians, but because I like the idea of creating a community of believers living together in fellowship.

I have been told that the fair-housing laws do not allow me to specify in my advertising that I will only accept Christian tenants. Even if that is the rule, in my own selec-tion process can I ask about an ap-plicant’s religious beliefs and give a preference to an applicant who is a true Christian applicant, if all other qualifications are even? By making a selection on this basis, I think I would just be exercising my own religious freedom guaranteed by our laws. I also want to know

if it would violate the fa i r-hous-ing laws if I only adver-tise rentals in Christian n e w s p a -pers or on Ch r i s t i a n

websites?

A Both federal and state fair-housing laws prohibit refus-ing to rent to a prospective

tenant because of his or her reli-gion, and you would be doing just that by choosing one applicant over another based on the fact that one of the applicants is a Christian, when all other qualifications are even. Even though you may not feel like you have discriminatory motives when you prefer Christian tenants as a way of practicing your religion, operating rental property is a business, subject to all of the state and federal laws that govern

such a business, including fair-housing laws.

It is true that a recognized reli-gious organization is allowed to prefer tenants of that organization’s religion in some circumstances, but an individual with strong religious beliefs such as yourself is not in-cluded in that exception to the gen-eral fair-housing rules.

As for your second question, federal and state fair-housing laws do not prescribe where or how you must find your tenants. As long as your rental advertisements do not contain language that indicates a preference for Christian tenants, or discourages in any way non-Chris-tian tenants from applying, and as long as you do not prefer Christian tenants over non-Christian tenants in the selection process, simply lim-iting your rental advertisements to particular venues would probably not, in and of itself, violate the fair-housing laws.

Q We recently moved out of a house that we were renting. Our lease stated that the ten-

ant was required to have the home and carpets professionally cleaned upon vacancy. We offered the land-lady $350 from our deposit to hire a company to clean the house to her liking. When we received our refund, we saw that she deducted

this amount from our security de-posit.

However, by then I had driven back to our rental to pick up my re-maining boxes. When I was there, I saw that our landlady had painters repainting the entire house. I de-cided to drive by the house again, a few days later. When I did, I saw a flooring and carpet company rip-ping out and replacing all of the flooring.

Was the landlady entitled to de-duct this $350 for cleaning when she was intending to repaint and re-carpet the entire house anyway?

A California Civil Code Sec-tion 1950.5 regulates the dis-position of security deposits

in California. An important part of the procedure established by that statute is the requirement that the landlord provide an accounting of the security deposit to the former tenant within 21 days after the ten-ant has vacated. If more than $125 was deducted for cleaning or re-pairs, that accounting should have included receipts and invoices for any repair and cleaning work that was being charged against your deposit.

Since the amount of $350 was de-ducted from your security deposit, you should have received an invoice from a carpet-cleaning company or other similar service provider re-

flecting that the cleaning work was actually performed. If the work wasn’t performed, there shouldn’t be any supporting invoice.

Civil Code Section 1950.5 was amended several years ago to re-quire that the security-deposit de-position include actual receipts to expressly end the prior practice of some landlords who charged for work that was never performed. If you wish to pursue this issue, you can write a letter to your for-mer landlady pointing out that the invoice for cleaning was not in-cluded. You could request that she refund the $350 deduction to you, or that you two reach a compromise on the deduction, particularly if she can produce the required documen-tation.

If she refuses, you can contact your local mediation agency or pursue a small claims court action against her.
