A. Pursuant t o Cl~apter 13, Section 5 of Public Law 1-8, the Division of Ayriculture, Deparisnwt of Natural Resources (DNR) Rules and Reyulaticns adopted May 15, 1979, are hereby amended'as follms:
Sectim K. COMP~SAllION FOR SERVICES RENDERED
(1.) A l l a i r and sea carrier and other persons whose operation riquire the service of Ouar-antin.e officers of the Government of the Northern Marianas after establ.ished working hours shall be charged with the !
overtime pay of the Quaran tine officers (s) rendering the service. Service of less than two ( 2 ) hours for each arrival shall be charged with the minimum of two ( 2 ) - hours overtime. Any fracture of an hour i n excess of the two (2 ) hours minimum is charged per actual time for services rendered. On lec la1 holidays, the charge shall be the holiday pay of the Quarantine officers rendered the service during the f i r s t eight (8) hours of work perfonncd. Any time i n excess of eight (8 ) hours shall be charged as overth~c pay. Tkch leyal holiday shall tx rnl 24-hour d3y, 0001 hours to 2400 hour. Said overtime charyes and holiday charges shall be waived when services a m rendered to a carrier operating under emergency condi- t i m s or for emergency pwposes.

(a) For services rendered for cargo inspection, the charges are based on the actual time incurred for inspectian for each carrier.
I For scrvices rendered for passenger inspection, the charges are based on the passenger count of each carrier.
(6) Interest of eight percent (8%) per &-mum shall be imposed on a l l unpaid charges inposed by th is Part.

Pursuant t o t h e r egu la to ry a u t h o r i t y o f Pub l i c Law 1-8, Chapter 13 , s e c t i o n 3 ( i ) and s e c t i o n 5 , the Division of Animal Health and Animal Indus t ry , Department of Natural Resources hereby g ives n o t i c e t o t h e p.ublic of t h e fol lowing change i n r egu la t ions :
Whereas, t h e Division has determined t h a t t h e p r o h i b i t i o n on importing c e r t a i n b i r d s i n t o t h e Commonwealth i s no longer necessary and t h e no t h r e a t t o pou l t ry o r o the r animals e x i s t s , importat ion of P s i t t a c i n e Birds and mynahs s h a l l be allowed under t h e following condi t ions :

C o r n e r s , marking: Every c o r n e r o f a Land Survey must b e . marked by a permanent monument o r marker b e a r i n g t h e r e g i s t r a - t i o n number o f t h e s u r v e y o r o r a n i d e n t i f y i n g mark approved by t h e Commonwealth Surveyor . Reference monuments may be set where it is p h y s i c a l l y i m p o s s i b l e t o se t t h e t r u e c o r n e r o r i n c a s e s where t h e d e s t r u c t i o n o f a c o r n e r i s imminent due t o c o n s t r u c t i o n . 8. Measurement: T h e minimum a c c u r a c y o f measurements s h a l l be I p a r t i n 10 ,000 on a l l p r o p e r t y l i n e s o f boundary o r i n t e r i o r su rvey . A c i r c u i t o f l e v e l s between p r e c i s e bench marks on a c i r c u i t c l o s e d upon t h e i n i t i a l bench mark s h a l l n o t d i f f e r more t h a n 0.02 f o o t m u l t i p l i e d by t h e s q u a r e r o o t o f t h e number o f miles i n t h e c i r c u i t , and i n no c a s e t o exceed 0.05 f o o t , e x c e p t i n l e v e l s f o r p r e l i m i n a r y o r rough s t a d i a c o n t r o l , i n which c a s e t h e a l l o w a b l e e r r o r o f c l o s u r e may b e 0.10 f o o t . Accuracy o f measurement i n t r i a n g u l a t i o n d imensions s h a l l conform w i t h t h e s t a n d a r d s set b y - t h e Uni ted S t a t e s C o a s t and Geode t i c Survey.
I n t h e c a s e o f any su rvey r e q u i r e d f o r purpose o f r e g i s t r a - t i o n , t h e s u r v e y o r must comply w i t h any a d d i t i o n a 1 , r e q u i r e - rnents imposed by t h e c o u r t . 5. Use of Abbreviatims and Symbols : Abhrcviaticns ;md symbols must be clearly defined in the legend of the maps. The Divisim of Lands and Surveys i n the Department of Natural Resources maintains copies of standard surveying abbreviations and symbols that should be used:'

7. Informatim to be sham: In general every line, point, object and structure actually surveyed must be clearly sham and accurately located on the map. Specifically included are:
(a) The basic l o t i n which the surveyor is Wcel l ing , suldiving, con- solidating and etc.
(b) An arrm indicating north and the bearing systm used noted.
(c) 'fie courses and distances of a l l lines and incases of curved l ines a l l data necessary t o identify, locate, o r retrace each line.
(dl When record bearings or angles or distances di f fer fran measured bearings or angles o r distances, both the record and measured bearings, arlyles and distances shall be clearly indicated i n a manner t o permit the ready distinction between record and measured data. The source of the record data must be indicated on the plan.
(c) Measured and record distances ( i f h a m ) f r m corners of the premises being surveyed t o the nearest right-of-way lines of dedicated public streets or roads, together with evidence of found l o t comers, shall be noted an the map. Where conditions warrant, the distances t o the nearest ddicated s t reet or road right-of-way l ine i n both directions fran the surveyed premises and the bearing and name of such s t reet or road shall be noted. The Board of Directors of the Economic Development Loan Fund and the Governor pursuant to"Section XXIV of t,he Adopted Rules arid l<equLations, Policy and Procedure Manual of the Economic ~ ) c . v o . l . o p ~ u c ~ ~ ~ t l,oc?11 Fund daLc?d August 15, 1979, wishes to advise the public of the adoption of amendments to Section V(A) as set forth bs.low.
Section V, Management Part A, is amended to provide for increasing the Board of ~irectors from 10 to 11 members and to i~rclude the Director of Finance as ex-officio, non-voting member of the Board of ~irectors.
As amended Section V in its entirety reads as follows:
The affairs of the Fund shall be managed by a Board of Directors, eleven (11) in number of which, four shall be ex-officio without voting power representing the Department of Commerce and Labor, Department of Natural Resources, the Department of Finance and the Attorney General. Ample representation shall be from the business community and at least two of which shall be representing the commercial banking community (from a bank or savings and loan authorized to do business in the Northern Mariana Islands and which its deposits are Federally insured) and one each representing the business community, the public sector and the adminis- tration, one representing the island of Rota and one representing the island of Tinian. All Directors shall be appointed by the Governor of the Northern Mariana Islands. The representation of the commercial bankinq community on the Board shall be on a rotation basis among all the commercial banks or savings and loans duly licensed to do business in the Northern Mariana Islands. During the first year of operation of the Fund, the members of the Board shall serve staggered terms: One member shall serve for one (1) year, another for two ( 2 ) years, and the balance of the membership shall be for three (3) years. Each member replacing a Board member after his original terms, shall serve a period of three (3) years. The Governor shall determine the initial terms of the members of the Board and insure that the appointment comply with Public Law 1-8, Title l(A), Chapter 1,

The Board of Directors of the Economic Development Loan Fund and the Governor pursuant to Section XXIV of the Adopted Rules and ~egulations, Policy and Procedure Manual of the Economic Development Loan Fund dated August 15, 1979, wishes to advise the public of the adoption of amendments to Section XXI, Subsection A of the Rules and Regulations.
As amended Section XXI, Subsection A reads as follows:
The lsxccutive Director or his representative shall closely monitor the payment of all loans by the borrower. The monthly installment,of interest or principal and interest may be payable on any fixed day of the month as provided in the Loan Agreement. If any payment is not received within thirty (30) days from such fixed date, the Executive Director or his representative shall contact the borrower immediately concerning payment. Authority
In accordance with Public Law 1-8, Chapter 12, Section 3, the Department of Public Health and Environmental Services has the responsibility of administering all government-owned health care facilities and of adopting relevant regulations as deemed necessary. The Director of Public Health and Environmental Services has the responsibility of carrying out the duties of the Department. In accordance with those duties, the Director of Public Health and Environmental Services promulgated a schedule of fees for the provision of health services. The fee schedule.was adopted after the expiration of a period of time designated for public comment.

The adopted regulations included the following subjects:
1. Fees for medical services 2. Fees for emergency medical transportation 3. Fees for purchase and rental of medical and surgical
supplies 4. Fees for purchase of prescription drugs and medication
Public Comment - During the period of time designated for public comment on the proposed regulations of the Department of Public Health and Environmental Services, the Senate of the Commonwealth of the Northern Plarianas received complaints about the amount of the increase in the fees for medical services and about the proposed two-tiered fee schedule for Micronesians and non-Micronesians. In addition, a lawsuit was filed challenging the constitutionality of a two-tiered fee schedule.
In response to these comments, the proposed regulations were changed to their present form. Despite'adverse public comment, it was necessary to increase the fees previously charged for medical services. Because of the continuous increase in costs in health delivery systems including the purchase of medicine, equipment and medical supplies in the national and international market, the cost of providing

health services has increased substantially since health care fees were originalby established in 1963. Even with the increase in fees, recipients of medical care and related services pay only a small percentage of the actual cost of p r o v i d i n g such care . The proposed fee schedule was changed to provide for uniform application to all recipients regard- less of race or national origin.

The Department of Public Health and Environmental Services is soliciting views, opinions, facts and data for and against the adopted regulations from the general public.
Anyone interested in commenting on the adopted regulations may do so by submitting comments in writing to the Depart- ment of Public Health and Environmental Services, As Terlaj e, Commonwealth of the Northern Mariana Islands, Saipan, Mariana Islands 96950, within 30 days from the date this notice is published in the Commonwealth Register.

Such an order may for cause shown be made on ex parte application. When a motion is supported by affidavit, the affidavit shall be served with the motion; and, except as otherwise provided in Rule 59(c), opposing affidavits may be served not later than 1 day before the hearing, unless the court permits them to be served at some other time.

Rule 5
Appearance ,
(a) Generally. The filing of any pleading or other
paper shall constitute an appearance by the attorney who signs
it in the case in which the paper is filed, unless the Opaper
states otherwise.
( b ) Notice of Appearance. An appearance in a case may
be made by filing a notice of appearance,-containing the name,
;~.ddress, and telephone number of the person entering an
appearance.
(c) Appearance pro se. A party who appears pro se
shall so state in the initial pleading or other paper filed
by him or in his notice of appearance. he words "pro sen'
, shall follow his signature on all papers subsequently filed
by him in the same case.
(d) Withdrawal of appearance. An attorney may withdraw
from a case by serving notice of his withdrawal on his client
and all other parties and filing the notice, provided that
(1) such notice is accompanied by notice of the appearance of
other c o u l x ~ l , (2) there are no motions pending before the
court, and (3) no trial date has been set. Unless these
conditions are met, an attorney may withdraw from a case only
by leave of court.

Rule 6
Service and Filing of pleadings
and Other Papers
(a) Manner of serviGe. Service of all pleadings *
subsequent to the original complaint and of all other papers
required to be served shall be made in the manner specified
by Rule 5, Commonwealth Rules of.Civi1 Procedure; provided
further, in serving counsel with orders, judgments, notices
or any other document by the Court or clerk, and if a box is
maintained in the Clerk's office for the attorney, service is
considered complete upon depositing the document in the
respective attorney's box.
(b) Proof of service.
(1) Except as otherwise provided by the Commonwealtl~
Rules of Civil Procedure, proof of service of all pleadings
and other papers required to be served shall be filed in the
office of the clerk promptly after service has been made. The
proof shall show the date and manner of service and may be made
by written acknowledgment of service, a certificate of a member
of the bar of this court, or an affidavit of the person who
served the paper.
( 2 ) Failure to make proof of service does not
affect the validity of the service.
(c) Service on party acting pro se. On application of a
party, the court may order any party who i-s appearing without
an attorney and who does not maintain an office or residence
within the Northern Mariana Islands where service can be made

. on him by delivery in the manner provided by Rule 5(b),

the clerk is so designated, he shall forthwith on receipt of
papers served on him as the representative of the party mail
the papers to the party at the latter's address.
(d) Application for default. When amember of the bar
of this court applies to the clerk for the entry of a default
or of a default judgment or for the certification of the
record on appeal, or applies to the court for an order or
judgment, such application is a representation that due
service has been made of all pleadings or papers required by
the Commonwealth Rules of Civil Procedure to be made as a I
condition to the relief sought.
( e ) Relief from default. A party who has been prejudiced
by failure to receive due notice may apply to the court for
appropriate relief.
(f) ~ i m e and place of filing. The original of all papezs
required to be served shall, unless otherwise submitted to
the court, be filed in the office of the clerk within three
( 3 ) days after service has been completed.
( g ) Additional copies. Wnenever because of the nature of
a proceeding additional copies of a paper required to be filed
are necessary, either for the use of the court or to enable the

Witnesses
(a) Unavailable witnesses. When a party learns or has
reason to believe in advance of the date set for trial that
a person whom he intends to call or has called as a witness
will not appear, with or without cause, the party shall,
unless he prefers to proceed to trial without the witness,
move in writing for a continuance as far in advance of the
trial date as practicable.
(b) Bench warrants for witnesses. When a person who
has been summoned to appear as a witness does not appear as
directed, the party on whose behalf the subpoena was issued

Proposed Rules and Regulations Governing the Administration of the Northern Mariana Islands Village
Homesteading Program (Public L ~ W 1-42)
The Marianas Public Land Corporation (MPLC) hereby gives
public notice that it has developed and established propssed rules
and regulations that will govern the administration and implementa-
tion of the Village Homesteading Act of 1979, Commonwealth Public
Law 1-42. The rules and regulations to be promulgated are authorized
pursuant to Section 7 of P. L. 1-42.
MPLC hereby advises the general public that the proposed
village homestead rules and regulations are available at the MPLC
office, at the Nauru Building, 6th Floor, Saipan, Mariana Islands.
Interested persons may obtain copies of the proposed rules and
regulations for review and comment in writing, addressed to the
Executive Director, MPLC, P. 0. Box 380, Nauru Building, Saipan,
CM, 96950. The offices of the Corporation open Monday through
Friday, 7:30 a.m.-ll:30 a.m, and 12:30 p.m.-4:30 p.m.
All comments shall be in writing and submitted within thirty
( . l o ) days of the date of this notice for aonsideration and review.
The proposed rules and regulations shall become effective ten (10)
days after adoption and final publication.
