Pursuant to Los Angeles Municipal Code Section·12.24-W, 1, I hereby APPROVE:

a conditional use permit to allow the sale and dispensing for consideration of a fullline of alcoholic beverages for on-site consumption in conjunction with an existingbar/lounge which currently is authorized to sell beer and wine for on-siteconsumption,

upon the following additional terms and conditions:

1. All other use, height and area regulations of the Municipa' Code and all otherapplicable government/regulatory agencies shall be strictly complied with in thedevelopment and use of the property, except as such regulations are hereinspecifically varied or required.

2. The use and development of the property shall be in substantial conformance withthe plot plan submitted with the application and marked Exhibit "A", except as maybe revised as a result of this action.

3. The authorized use shall be conducted at all times with due regard for the characterof the surrounding district, and the right is reserved to the Zoning Administrator toimpose additional corrective Conditions, if, in the Administrator's opinion, suchConditions are proven necessary for the protection of persons in the neighborhoodor occupants of adjacent property.

4. AI! graffiti on the site shall be removed or painted over to match the color of thesurface to which it is applied within 24 hours of its occurrence.

5. A copy of the first page of this grant and all Conditions and/or any subsequentappeal of this grant and its resultant Conditions and/or letters of clarification shall beprinted on the building plans submitted to the Zoning Administrator and theDepartment of Building and Safety for purposes of having a building permit issued,

. 6. The applicant shall defend, indemnify and hold harmless the City, its agents,officers, or employees from any claim, action, or proceeding against the City or itsagents, officers, or employees to attack, set aside, void or annul this approval whichaction is brought within the applicable limitation period. The City shall promptlynotify the applicant of any claim, action, or proceeding and the City shall cooperatefully in the defense. If the City fails to promptly notify the applicant of any claimaction or proceeding, or if the City fails to cooperate fully in the defense, theapplicant shall not thereafter be responsible to defend, indemnify, or hold harmlessthe City.

7. Maximum seating shall not exceed 50 indoor seats. No outdoor seating has beenrequested or approved herein. Maximum square footage shall not exceed 1,100square feet.

8. Hours of operation shall not exceed 10 a.m. to 2 a.m. daily.

g. No pool tables or coin operated electronic, video,or mechanical amusement devicesshall be maintained on the premises. An existing juke box is permitted.

10. The applicant for shall maintain a copy of these conditions on the premises andavailable upon request by any enforcement agency. All employees shall be made.famil iar with all conditions. AI! applicable licenses, including a license issued by theDepartment of Alcoholic Beverage Control (ABC), shall be posted in a visiblelocation on the premises

11. The applicant shall be responsible for maintaining the area adjacent to the premisesover its control free of litter.

12. Any exterior lighting shall be installed such that the light is directed onto the subjectsite. Lighting shall be adequate to identify anyone in the front or rear of the buildingat njght.

13. The applicant owner and on-site manager(s) shall comply with all applicable lawsand conditions and shall properly manage the facility to discourage illegal andcriminal activity on the subject premises and any accessory parking areas overwhich they exercise control, including insuring that no activities associated withnarcotics sales, use or possession, gambling or prostitution occur.

14. Within six months of the effective date of this action, all employees involvedwith the sale of alcoholic beverages who have not had training within the past 12months shall enroll in the Los Angeles Police Department "Standardized Training forAlcohol Retailers (8T AR)". Upon completion of such training, the applicant shallrequest the Police Department to issue a letter identifying which employeescompleted the training. The applicant shall transmit a copy of the letter from the

Police Department to the Zoning Administrator as evidence of compliance. In theevent there is a change in the licensee, this training program shall be required for allstaff.

15, No cover or admission charge to gain entry into the premises shall be permitted.

16. No after-hours use of the premises is permitted.

17. No loitering shall be allowed to occur within the area of the control of the applicant

18. An electronic age verification device which can be used to determine the age of anyindividual attempting to purchase alcoholic beverages shall be installed on thepremises at each point-of-sale location. This device shall be maintained inoperational condition and all employees shall be instructed in its use priorto the saleof any alcoholic beverage.

19. No pay phone shall be maintained on the exterior of the premises.

20. No conditional use for dancing has been requested nor approved herein.

21. A camera surveillance system shall be installed which will cover all common areasas well as high-risk areas and entrances and exits of the premises. Video tapesshall be maintained for 30 days and shall be made available to the PoliceDepartment or other enforcement agency upon request

22. The applicant shall secure a City permit decal denoting approval of alcoholicbeverage sales from a Planning Department public counter and mount it on eitherthe inside of the window of the subject site facing the street or on the outside of thebuilding (if inside mounting is not possible). The decal shall be visible at all timesand mounted before the privileges granted herein are utilized.

23. The applicant shall maintain on the premises and present upon request to anyenforcement agency, a copy of the Business Permit, Insurance Information and avalid emergency contact phone number for any security company that may beemployed.

24. The mitigation measures identified in environmental document ENV-2010-0229-MND are incorporated as conditions of this grant as summarized below:

a. Aesthetics (Vandalism)

1) Every building, structure, or portion thereof, shall be maintained in asafe and sanitary condition and good repair, and free from graffiti,debris, rubbish, garbage, trash, overgrown vegetation or other similarmaterial, pursuant to Municipal Code Section 91.8104.

2) The exterior of all buildings and fences shall be free from graffiti whensuch graffiti is visible from a public street or alley, pursuant toMunicipal Code Section 91.8104.15.

1) On-site signs are limited to the maximum allowable under the code.

2) Multiple temporary signs in the store windows and along the buildingwalls are not permitted.

c. Aesthetics (Light)

Outdoor lighting shall be destqned and installed with shielding, so that thelight source cannot be seen from adjacent residential properties,

d. Air Pollution (Stationary)

An air filtration system shall be installed and maintained with filters meetingor exceeding the ASHRAE Standard 52.2 Minimum Efficiency ReportingValue (IVlERV)of 13, to the satisfaction of the Department of Building andSafety.

e. Objectionable Odors

1) Open trash receptacles shall be located a minimum of 50 feet from theproperty line of any residential zone or use,

2) Trash receptacles located within an enclosed building or structureshall not be required to observe this minimum buffer.

f. Standard Urban Stormwater Mitigation Plan (Parking Lots with 25+ Spaces orGreater than 5,000 s.f.; Food Service Industry)

Food Service Industry: Restaurants, Bakeries, Food Processors):

1) Cleaning of oily vents and equipment to be performed withindesignated covered area, sloped for wash water collection, and with apretreatment facility for wash water before discharging to properlyconnected sanitary sewer with a CPI type oil/water separator. Theseparator unit must be: designed to handle the quantity of flows;removed for cleaning on a regular basis to remove any solids; and theoil absorbent pads must be replaced regularly according tomanufacturer's specifications.

2) Store trash dumpsters both under cover and with drains routed to thesanitary sewer or use non-leaking and water tight dumpsters with lids.Wash containers in an area with properly connected sanitary sewer.

3) Reduce and recycle wastes, including oil and grease.

4) Store liquid storage tanks (drums and dumpsters) in designated pavedareas with impervious surfaces in order to contain leaks and spills.Install a secondary containment system such as berms, curbs, Ofdikes. Use drip pans or absorbent materials whenever greasecontainers are emptied.

5) Prescriptive methods detailing BMPs specific to this project categoryarea available. Applicants are encouraged to incorporate theprescriptive methods into the design plans. These PrescriptiveMethods can be obtained at the Public Counter or downloaded fromthe City's website at:www.lastormwater.org. (See Exhibit A).

g. Increased Noise Levels (Retail Markets, Bars, Entertainment etc...)

1) No window openings shall be permitted along the residential sides ofthe building.

2) A 6-foot-high solid decorative masonry wall adjacent to the residentialproperties shall be constructed, if no such wall currently exists.

h. -Public Services (Police)

The plans shall incorporate the design guidelines relative to security, semi-public and private spaces, which may include but not be limited to accesscontrol to building, secured parking facilities, walls/fences with key systems,well-illuminated public and semi-public space designed with a minimum ofdead space to eliminate areas of concealment, location of toilet facilities orbuilding entrances in high-foot traffic areas, and provision of security guardpatrol throughout the project site if needed. Please refer to "Design outCrime Guidelines: Crime Prevention Through Environmental Design"published by the Los Angeles Police Department. Contact the CommunityRelations Division, located at 100 W. 1st Street, #250, Los Angeles, CA90012; (213) 486-6000. These measures shall be approved by the PoliceDepartment prior to the issuance of building permits,

I. Utilities (local Water Supplies - Restaurant, Bar, or Nightclub)

1) Install/retrofit high-efficiency toilets (maximum 1.28 gpf), includingdual-flush water closets and high-efficiency urinals (maximum 0.5gpf), including no -flush or waterless urinals, in all restrooms asappropriate.

2) Install/retrofit restroom faucets with a maximum flow rate of 1.5gallons per minute.

3) Install/retrofit and utilize only restroom faucets of a self-closingdesign.

4) Install and utilize only high-efficiency Energy Star-rated dishwashersin the project, if proposed to be provided. If such appliance is to he

furnished by a tenant, this requirement shall be incorporated into thelease agreement, and the applicant shall be responsible for ensuringcompliance.

Single-pass cooling equipment shall be strictly prohibited from use.Prohibition of such equipment shall be indicated on the building plans andincorporated into tenant lease agreements. (Single-pass cooling refers to theuse of potable water to extract heat from process equipment, e.q., vacuumpump, ice machines, bypassing the waterthrough equipment and dischargingthe heated water to the sanitary wastewater system.

j. Utilities (Solid Waste Recycling)

(Operational) Recycling bins shall be provided at appropriate locations topromote recycling of paper, metal, glass, and other recyclable material.These bins shall be emptied and recycled accordingly as a part of theproject's regular solid waste disposal program.

Condition Nos. 25 through 29 are alcohol-specific conditions which have beenvolunteered by the applicant.

25. No off-site sales of alcohol as a secondary use to the on-site sales is permitted.

26. No alcohol shall be allowed to be consumed on any adjacent property under thecontrol of the applicant.

27. No "Happy Hour" or reduced price drinks shall be offered.

28. No artificially fortified wine (greater than 16% alcohol content) shall be sold.

29. There shall be no exterior advertising of any kind or type, including advertisingdirectly to the exterior from within, promoting or indicating the availability of alcoholicbeverage.

30. A Plan approval shall be required if there is any change in the ownership and/oroperator for these premises, so as to evaluate the applicability of existing conditionsand any review of potential changes in the "mode and character" of the newoperation. Prior to any review, the local Neighborhood Council shall be notified andprovided an opportunity for review and recommendation

31. The authorization granted herein for the sale of a full line of alcohol is for a period ofeight (8) years from the effective date of this grant Thereafter, the applicant willneed to seek authorization to continue the sales of a full line of alcohol on-site. .

32. Within 30 day,s of the effective date of this action, a covenant acknowledgingand agreeing to comply with all the terms and conditions established herein shall berecorded in the County Recorder's Office. The agreement (standard mastercovenant and agreement form CP-6770) shall run with the land and shall be bindingon any subsequent owners, heirs or assigns. The agreement with the conditions

OBSERVANCE OF CONDITIONS D TIME liMIT ~ LAPSE OF PRIVILEGES - TIMEEXTENSION

All terms and Conditions of the approval shall be fulfilled before the use may beestablished, The instant authorization is further conditional upon the privileges beingutilized within two years after the effective date of approval and, if such privileges are notutilized or substantial physical construction work is not begun within said time and carriedon diligently to completion, the authorization shall terminate and become void. A ZoningAdministrator may extend the termination date for one additional period not to exceed oneyear, if a written request on appropriate forms, accompanied by the applicable fee is filedtherefore with a public Office of the Department of City Planning setting forth the reasonsfor said request and a Zoning Administrator determines that good and reasonable causeexists therefore.

TRANSFERABILITY

This authorization runs with the land, In the event the property is to be sold, leased, rentedor occupied by any person or corporation other than yourself, it is incumbent upon you toadvise them regarding the conditions of this grant

VIOLATIONS OF THESE CONDITIONS, A MISDEMEANOR

Section 12.29 ofthe Los Angeles Municipal Code provides:

"A variance, conditional use, adjustment, public benefit or other quasi-judicialapproval, or any conditional approval granted by the Director, pursuant to theauthority of this chapter shall become effective upon utilization of any portion of theprivilege, and the owner and applicant shall immediately comply with its Conditions.The violation of any valid Condition imposed by the Director, Zoning Administrator,Area Planning Commission, City Planning Commission or City Council in connectionwith the granting of any action taken pursuant to the authority of this chapter, shallconstitute a violation of this chapter and shall be subject to the same penalties asany other violation of this Code,"

Every violation of this determination is punishable as a misdemeanor and shall bepunishable by a fine of not more than $1,000 or by imprisonment in the county jall for aperiod of not more than six months, or by both such fine and imprisonment

APPEAL PERIOD - EFFECTIV~DATE

The applicant's attention is called to the fact that this grant is not a permit or license andthat any permits and licenses required by law must be obtained from the proper publicagency. Furthermore, if any Condition of this grant is violated or if the same be notcomplied with, then the applicant or his successor in interest may be prosecuted for

violating these Conditions the same as for any violation of the requirements contained inthe Municipal Code. The Zoning Administrator's determination in this matter will becomeeffective after JANUARY 3, 2011, unless an appeal therefrom is filed with the City PlanningDepartment. It is strongly advised that appeals be filed early during the appeal period andin person so that imperfections/incompleteness may be corrected before the appeal periodexpires. Any appeal must be filed on the prescribed forms, accompanied by the requiredfee, a copy of the Zoning Administrator's action, and received and receipted at a publicoffice of the Department of City Planning on or before the above date or the appeal will notbe accepted. FINDINGS OF FACT

After thorough consideration of the statements contained in the application, the planssubmitted therewith, the report of the Zoning Analyst thereon, the statements made at thepublic hearing on December 9, 2010, all of which are by reference made a part hereof, aswell as knowledge of the property and surrounding district, I find that the requirements forauthorizing a conditional use permit under the provisions of Section 12.24~W have beenestablished by the following facts:

BACKGROUND

The property IS a relatively level, rectangular-shaped, corner lot consisting of 6,111.6square-feet, having a frontage of 51.15 feet on the west side of La Brea Avenue and124.56 feet on the north side of 8th Avenue, Legal addresses for the property range from757 to 759 South La Brea Avenue and from 5301 to 5307 8th Street. There is a two-story,10, 812 square-foot commercial building on the premises. The building was originallyconstructed in 1925.

Adjoining properties to the north are zoned C2-1 and are developed with an auto repairfacility and several neighborhood-serving commercial establishments.

Adjoining properties to the south are zoned C2-1 and are developed with a restaurant,parking lot and thrift store. There is a coffee shop located directly south of the baroccupying the same building.

Adjoining properties to the east across La Brea Avenue are zoned C2-1-0 and developedwith one-story commercial buildings that are occupied by an automotive repair facility, andprinting, mattress and gift stores. The area directly across the street is vacant andpresently under construction.

Adjoining properties to the west are in the R2-1~OZone and are developed with one- andtwo-story duplexes and single-family dwellings.

La Brea Avenue, adjoining the property to the east, is a Major Highway with a width of100 feet and improved with curb, gutter and sidewalk on both sides.

West 8th Street, adjoining the property to the south, is a Local Street with a width of 60 feetand improved with curb, gutter and sidewalk.

Case No, ZA 95-0736(CUB)(CUX)(SP) - On February 12, 1996, the ZoningAdministrator approved a conditional use and shared parking to allow the sale anddispensing of alcoholic beverages for on-site consumption, and an approximate 14-by 15-footdance floor, in conjunction with the proposed expansion of an existingrestaurant to accommodate approximately 130 persons; and to allow the restaurantand other commercial establishments within the subject property to share their off-street parking spaces at 726 South La Brea Avenue.

Case Nos. BZA 4673 and ZA 92-0539(CUB) - On October 27, 1992, the Board ofZoning Appeals approved a conditional use permit to allow live entertainment anddancing and the sale and dispensing of alcoholic beverages for on-site consumptionin conjunction with a proposed restaurant, accommodating approximately94 persons, and having hours of operation from 11 a.rn. to 1 a.rn., Monday throughSaturday, and 11 a.m, to 12 midnight on Sundays, and a variance to allow 35 of the42 required parking spaces to be provided through a lease agreement on a differentlot, instead of the recorded agreement required on a site in the C2-1 Zone describedas Lots 101,103,105,107,109,111,113 and 115, Tract No. 4642, located at 720South La Brea Avenue, Wilshire Planning Area.

Case No. ZA 92-0836{RLA)(PAD) - On September 3, 1992, the ZoningAdministrator approved a Zoning Administrator's determination of the deemed-to-be-approved conditional use status and approval of plans for the rebuilding of anapproximately 4,972 square-foot portion of a mini-shopping center with 20 parkingspaces, located at 720 South La Brea Avenue.

Case No. ZA 86-0725(CUB) - On October 10, 1986, the Zoning Administratorapproved the sale and dispensing of alcoholic beverages for consumption on thepremises in conjunction with a proposed restaurant facility accommodatingapproximately 130 patrons, located at 720 South La Brea Avenue.

Case l\lo. ZA 85~1211 (E) - On January 26, 1986, the Zoning Administrator approvedan exception for the sale of alcoholic beverages in a restaurant with an occupancyload of 40 patrons, located at 803 South La Brea Avenue.

Case No. ZA 85-1211(E)(PA1} ~ On November 30,2000, the Zoning Administratorapproved a Plan Approval to continue the sale of alcoholic beverages in a 40-seatrestaurant, located at 803 South La Brea Avenue.

BASIS FOR CONDITIONAL USE PERMITS

A particular type of development is subject to the conditional use process because it hasbeen determined that such use of property .should not be permitted by right in a particularzone. All uses requiring a conditional use permit from the Zoning Administrator are locatedwithin Section 12.24-W of the Los Angeles Municipal Code. In order for the sale of a fullline of alcoholic beverages for on-site consumption to be authorized, certain designatedfindings have to be made. In these cases, there are additional findings in lieu of the fourstandard findings for most other conditional use categories.

FINDINGS

Following (highlighted) is a delineation of the findings and the application of the relevantfacts to same:

1. The proposed location will be desirable to the public convenience or welfareand the location is proper in relation to adjacent uses or the development ofthe community.

The subject project entails a request to sell a full line of alcoholic beverages in anexisting bar which currently has a license to sell beer and wine. The facility hasbeen a bar dating back to 1950, according to the applicant. At the public hearing,the applicant noted that for some time the bar had a poor image and had been alocation where B-girls were employed. The former bar was authorized to sell a fullline of alcohol but at some point in 1980, the alcohol license was downgraded tobeer and wine only. In 2004, the prior bar tenant lost the lease. The currentapplicant took over in 2005. The request to upgrade to a full line triggers therequirement for a conditional use permit.

As noted, the applicant acquired the business in 2005 and has made renovations tothe premises. In 2008, the applicant also took over an adjacent retail space andconverted it into a coffee shop that caters to the neighborhood. The applicant notesthat the bar is also neiqhborhood-orlented and that most clients walk to the location.The applicant's goal is for the bar to be regarded as a neighborhood-congregatingestablishment Patrons of the establishment have menus made available whichoffer various food options from local restaurants which allow bar patrons to orderand have the food delivered to the bar. The request does not involve an expansionof the premises nor any entertainment or live music. Seating is limited to 50 seats.

Correspondence from the Mid City West Community Council was received notingsupport for the request. The letter notes that the location is across from a recently

approved large mixed-use project at Wilshire Boulevard and La Brea Avenue,adding that a " ... small neighborhood bar at this location is not inappropriate". Theletter notes that the Council believes in supporting existing businesses whoseviability will be improved from said request. At the hearing, two neighbors alsotestified in support of the request and emphasized the value in being able to walk tothis location. Correspondence was also received from the Los Angeles PoliceDepartment recommending conditions if the request was approved but not taking aposition on the request. No other communication regarding the request wasreceived,

As proposed, the request does not represent the introduction of a new use. The barwill continue to serve a public convenience and welfare and as sited, the locationremains compatible with the character of the surrounding uses. The property,according to testimony, has been the site of a bar for approximately 60 years, Theproposed use, in conjunction with the imposition of a number of conditionsaddressing operational and alcohol-related issues will safeguard public welfare andenhance public convenience.

2. The use will not be materially detrimental to the character of the developmentin the immediate neighborhood.

The grant authorized herein incorporates a number of conditions which have beenimposed upon the use, some of which are based on conditions which have beenvolunteered by the applicant and others suggested by tile Police Department. Theapplicant indicated that he is proposing installing a camera surveillance system,which has been conditioned also in this grant Alcohol-sales training for staff by thePolice Department is also required. These and other conditions will continue tomake the use more compatible with other uses in the surrounding community.

The subject g rant for the sale of a full line of alcoholic beverages is authorized for aterm of eight years after which time the applicant will have to seek authorization tocontinue such sales on the premises, This allows the City an opportunity to reviewthe operation of the facility anew. if the operation has been conducted appropriatelyand without creating problems, then a subsequent decision on the continuation ofsuch sales may take that into favorable consideration. A record of poor complianceand/or nuisance complaints would allow the City the discretion to not permit thecontinuation of the sales of a full line of alcohol and thus avoid the need to proceedwith prolonged nuisance abatement proceedings. Additionally, as the term grant isfor a longer period than usually is granted, a condition has been included whichrequires a review if the business is taken over by a new owner or operator to insurethat the mode and character of the operation remains compatible and consistentwith this grant. Thus, as conditioned, the use is not anticipated to be materiallydetrimental to the development of the immediate neighborhood,

3. The proposed location will be in harmony with the various elements andobjectives of the General Plan.

The Wilshire Community Plan Map designates the property for C2 "GeneralCommercial" land uses with a corresponding zone of C2 and HeigHt District No.1.

The Wilshire Community Plan Map designates the property for C2 "GeneralCommercial" land uses with a corresponding zone of C2 and Height District No. 'It

The subject property is planned and zoned for commercial uses. The conditionalauthorization for the sale of alcoholic beverages on-site, is allowed through theapproval of the Zoning Administrator subject to certain findings. The requiredfindings in support have been made herein.

4. The proposed use will not adversely affect the economic welfare of thecommunity or result in an undue concentration of premises for the sale ofalcoholic beverages after given consideration to the State laws and to theCalifornia Department of Alcoholic Beverage Control's guidelines for undueconcentration and giving consideration to crime rates in the area.

According to the California State Department of Alcoholic Beverage Controllicensing criteria, five on-site and four off-site licenses are allocated to Census TractNo. 2151.00, which has a population of 5,630. There are currently 12 on-site andfour off-Site licenses in this census tract. Located within 600 feet of the subjectproperty, there are seven on-site and zero off-site licenses existing. These figuressuggest that there is an undue concentration of on-site alcohol sales establishmentsin the area. It should be noted that according to ABC records, there have been nodisciplinary actions regarding this particular establishment.

The subject location is within an area of concentrated commercial development.However, the request will not result in the addition of a new license but rather theconversion of an existing license to another type of license.

Statistics from the Los Angeles Police Department's Wilshire Division Vice Unitreveal that in Crime Reporting District No. 735, which has jurisdiction over thesubject property, a total of 193 crimes were reported in 2008, compared to thecitywide average of 235 crimes and the high crime reporting district average of 282crimes for the same period. The above figures indicate that the project proposal isnot located within a high crime reporting district. Of these crimes, there were a totalof 3 arrests for "Public Drunkenness" and 8 arrests for "Driving While Intoxicated"most recently in 2008. These numbers do not reflect the total number of arrests inthe subject reporting district of the accountable year. Arrests for each calendar yearmay reflect crimes reported in previous years.

The crime rate numbers are lower than those rates identified for the City.Nonetheless, a number of conditions, including a camera surveillance system, havebeen imposed which seek to mitigate any adverse impacts on the area, which whencoupled with a limited term grant will insure that any potential impacts are mitigated.

5. The use will not detrimentally affect the nearby resldentlally zonedcommunities in the area after giving consideration to the distance of theproposed use from residential uses, churches, schools, hospitats, publicplaygrounds and other similar uses and other establishments dispensing, forsale or other consideration, alcoholic beverages, including beer and wine,

There are residential uses in the vicinity of the site as well as other establishmentswhich sell alcohol. Since the site is located in a prime cornrnerclal area, the diversityand proximity amongst the uses is not uncommon. This grant has placed numerousconditions on the proposed project and not authorized uses of the property whichmight create potentia! nuisances for the surrounding area. Such imposition ofconditions, including an eiqht-year term grant on the approval regarding the sale ofalcohol, will make the use a more compatible and accountable neighbor to thesurrounding uses than would otherwise be the case.

ADDITIONAL MANDATORY FINDINGS

6. The National Flood Insurance Program rate maps, which are a part of the FloodHazard Management Specific Plan adopted by the City Council by Ordinance No.172,081, have been reviewed and it has been determined that this project is locatedin Zone C, areas of minimal flooding.

7. On October 13, 2009, a Mitigated Negative Declaration (ENV 2009-2229- MND)wasprepared for the proposed project. On the basis of the whole of the record beforethe lead agency including any comments received, the lead agency finds that withimposition of the mitigation measures described in the MND (and identified in thisdetermination), there is no substantial evidence that the proposed project will have asignificant effect on the environment. I hereby adopt that action. This MitigatedNegative Declaration reflects the lead agency's independent judgment and analysis.The records upon which this decision is based are with the Environmental ReviewSection of the Planning Department in Room 750, 200 North Spring Street.
