I, the undersigned, being duly sworn, state that all facts contained in this Complaint and Affidavit, known by me or told to me by other reliable persons form the basis for mybelief that the defendant committed this crime

 AFFIDAVIT

State all facts and persons relied upon supporting elements of alleged crime

On March 8, 2015 at approximately 0300hrs I was requested to check on a vehicle parked in the cemetery South of Odebolt. I observed a red Jeepparked and running. When I pulled into the cemetery the vehicle started pulling away. I put my spot light on the vehicle it stopped and then proceed totake off again. I actvaited my emergency lights. I made contact with the driver, when doing so i observed a 24 pack of Bush light in the back seat and aopen container. The driver was identified as Royce Rosemeyer. Royce admitted to drinking and consented to FST. Royce also consented to a PBTwhich was over the legal limit of .08. Royce was arrested and Transported to the Sac County Jail. When at the Jail Royce consented to a Datamasterwhich was .131.
