Guidelines in the Review and Compliance Procedure in the Filingand Submission of Sworn Statement of Assets, Liabilities

and Net worth (SALN)

1.0 Objective

To establish guidelines in the filing, review and submission of the Sworn Statement of Assets,Liabilities and Net Worth (SALN) of Philippine Council for Health Research and Development(PCHRD) officials and employees pursuant to existing laws and pertinent CSC issuances.

2.0 Legal Basis

2.1 Code of Conduct and Ethical Standards for Public Officials and Employees (RA 6713)and its Implementing Rules

2.2 CSC MC No. 10 s. 2006 dated April 17, 2006 on the "Review and ComplianceProcedure in the Filing and Submission of the Statement of Assets, Liabilities and NetWorth and Disclosure of Business Interest"

2.3 CSC MC No. 2 s. 2013 dated January 24, 2013 entitled Revised SALN Form (withguidelines)

2.4 CSC MC No. 03 s. 2013 dated January 24,2013 on the "Amendment to the Reviewand Compliance Procedure in the Filing and Submission of the Statement of Assets,Liabilities and Net worth and Disclosure of Business Interest and FinancialConnections"

2.5 CSC Resolution No. 1300455 dated March 4, 2013 entitled Review and ComplianceCommittee for the SALN"

2.6 CSC Resolution No. 1500088 dated January 23, 2015 entitled "Amendment to CSCResolution No. 1300173 dated January 24, 2013 on the "Revised SALN Form"

2.7 MC No. 03 s. 2015 dated February 17, 2015 entitled "Amendment to CSC MC NO.2.S. 2013 on the "Revised Statement of Assets and Liabilities and Net worth (SALN)Form"

3.0 Coverage

This covers all permanent employees of the Philippine Council for Health Research andDevelopment

4.0 Form

The PCHRD permanent employees shall use the Civil Service Commission (CSC) prescribedSALN form and the Guidelines in the Filling-out of the SALN Form.

5.0 Filling and Submission of SALN

All PCHRD Officials and employees shall file under oath their three (3) copies of SALNs, alloriginally signed by declarant to the Chief Administrative Officer of the Finance andAdministrative Division (FAD), to wit:

5.1 Within thirty (30) days after assumption of Office, statements of which must bereckoned as of the employee's first day of service;

5.2 On or before January 31 of every year thereafter, statements of which must bereckoned as of the end of the preceding year, and

5.3 Within thirty (30) days after separation from the service, statements of which must bereckoned as of the employee's last day of office.

All PCHRD officials and employees are strictly required to fill-in all applicable informationand/or make a true and detailed statement in their SALNs. Items not applicable should bemarked N/A (not applicable).

6.0 Issuance of Advisories

An advisory shall be issued not later than 3rd week of December every year to set thedeadline/s for the annual submission of SALN of all PCHRD officials and employees as ofDecember 31 of the previous year. The advisory shall remind and update all PCHRD officialsand employees of the general guidelines and any pertinent changes in CSC rules andregulations in the preparation and submission of SALN.

7.0 Review Committee

The PCHRD Executive Director shall designate and authorized the PCHRD Review andCompliance Committee (PSRCC) to receive the SALN and to evaluate if the same has beensubmitted on time, complete and in proper form.

The Committee shall have one Chairperson and two members. The Head of Finance andAdministrative Division is the designated Chairperson.

8.0 Review Process

8.1 Upon receipt of the accomplished SALN forms, the PSRCC shall evaluate the same todetermine compliance with the following:

8.1.1 The declarant is strictly required to fill in all applicable information in the SALNform. Otherwise, such items should be marked with "N/A" or "not applicable."

8.1.2 A declarant who has no business interests and/or relatives in the governmentshould tick off the box indicating such information and not write "N/A" in theavailable blanks.

8.1.3 In case the signature of the spouse cannot be secured, an explanation for thepurpose should be attached to the SALN.

8.1.4 Additional sheets may be used as necessary provided that each page shall containthe printed name and signature of the declarant, with the proper pagination, i.e.,page 1 of x number of pages.

8.1.5 Any or all changes or revisions in the accomplished and submitted SALN formsshall only be made by the respective declarants and shall bear the declarant'sinitials.

8.2 The HRMS, shall submit to the PSRCC on or before February 20 of every year areport containing the list of employees, in alphabetical order, who: (a) filed their SALNswith complete data; (b) filed their SALNs but with incomplete data and (c) did not file theirSALNs. The report shall likewise indicate any findings as a result of the evaluationconducted by HRMS.

8.3 The PSRCC shall review the submitted report and issue SALN Compliance Request(SCR) indicating all of its findings and the corresponding actions available to the non-compliant declarants within the five (5) days from the receipt of report.

8.4 Only those who have satisfactorily responded with the SCR within the prescribed periodshall be included in the list of those who have complied with the filing of SALN to besubmitted to the PCHRD Executive Director on or before March 15 of every year. SaidReport shall contain a list of PCHRD officials and employees in alphabetical order, who:(a) filed their SALNs with complete data; b) filed their SALNs but with incomplete dataand (c) did not file their SALNs. The Report may be revised to reflect adjustments, if any.The Final Report as submitted to the PCHRD Executive Director shall be submitted tothe CSC on or before April 30 of every year.

8.5 Based on the recommendation of the PSRCC, the PCHRD Executive Director, within five(5) days from the receipt of the Final Report, shall issue Compliance Order/s requiringthose who have not complied with the SCR or not have satisfactorily responded theretoto correct/supply the desired information in and/or submit their SALNs within a non-extendible period of thirty (30) days from receipt of the said Order.

8.6 The PSRCC shall review the response/justification of the non-compliant declarants andmake the proper recommendation to the Executive Director. The PSRCC shall thensubmit a Final Report reflecting any revision/adjustment of the Report initially submittedto the Executive Director copy furnished the CSC.

8.7 Finally, the PSRCC shall recommend to the Executive Director the issuance of the Show-Cause Order to the PCHRD employees who have not complied with the Order ofsatisfactorily responded thereto.

The PSRCC shall likewise evaluate the response/justification to the Show-Cause Orderand recommend to the PCHRD Executive Director the filing of appropriate administrativecharges when evidence so warrants. Upon approval of said recommendation, theExecutive Director shall direct the matter to the Disciplinary Action Committee (DAC) forappropriate action.

9.0 Transmittal and Distribution

The FAD Human Resource Management Section shall:

1. Consolidate the SALN submitted to them;2. Prepare the Certification of Compliance and Summary List of Filers (e-file and hard

copy);3. Transmit all original copies of the SALNs (pt copy) of PCHRD employees

to the CSC on or before 30 June of every year;4. Transmit the Lists of Those Who Filed their SALNs with Complete Data, Those Who

Filed their SALN with Incomplete Data, and Those Who Did Not File Their SALNs tothe Civil Service Commission; and

5. Ensure that the declarant properly acknowledge receipt of his/her personal copy (2nd

copy) of SALN. The HRMS shall maintain the 3rd copy of the SALN for the 201 files ofthe employee.

10.0 Sanction for Failure to Comply

Failure to comply to correct or submit the SALN in accordance with the procedure andwithin the given period ( 30 days from receipt of order) pursuant to the directive in Section3 of MC NO.3 s. 2013 shall be a ground for disciplinary action. The Executive Directorshall issue a show -cause order directing the official or employee concerned to submittheir comment or counter-affidavit; and if so the evidence warrants, proceed with theconduct of the administrative proceedings pursuant to the 2017 Rules on AdministrativeCases in the Civil Service (2017 RACeS), esc Resolution No. 1701077 dated July 3,2017. The offense of failure to file SALN is punishable under Section 50 (D) (8) of Rule Xthereof, with the following penalties:

1st Offense - Suspension for one (1) month and one (1) day to six (6) months2nd Offence - Dismissal from the Service

Public officials and employees who fail to comply within the thirty (30) day period requiredunder Section 3 of MC NO.3 s. 2013 or who submit their SALNs beyond the said periodshall be considered as not having filed their SALNs and shall be made liable for theoffense of Failure to File SALN with the following penalties:

1st Offense - Suspension for one (1) month and one (1) day to six (6) months2nd Offence - Dismissal from the Service

Heads of agencies/offices who fail to comply with the provisions of CSC Resolution 06-231 dated February 1, 2006, as amended, shall be liable for Simple Neglect of Duty, whichshall be punishable with following penalties;

1st Offense - Suspension for one (1) month and one (1) day to six (6) months2nd Offence - Dismissal from the Service

11.0 Resolution of IssuesTo ensure standard and consistent interpretation of the SALN rules, the PSRCC shallresolve all issues pertaining to compliance with the submission and filing of SALNs by allPCHRD officials and employees.
