AN ORDINANCE TO AUTHORIZE THE COMMISSIONER TO GRANT A FRANCHISE TO THE YUKON" ELECTRIC­AL COMPANY LIMITED FOR THE DISTRIBUTION OF ELECTRICAL POWER IN THE AREA OF CARMACKS

IN THE YUKON TERRITORY

(Assented to April 12th, 1961)

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:

1. The Commissioner is hereby authorized to grant a franchise to the Yukon Electrical Company Limited for the distribution of electrical power in the area of Carmacks, in the Yukon Territory, upon such terms and conditions as are approved by the Commissioner-in-Council.

The Commissioner of the Yukon Territory, by and with R.O.Y.T. 1958. c. 12;

the advice and consent of the Council of the said Territory, 1960 (1st Session).

enacts as fol1ows: c.7.

l. The Business Licence Ordina11ce is amended by adding thereto, immediately after section 14 thereof. the fol1owing section:

"IS. Every person to whom a licence has been issued under this Ordinance shal1

(a) display and keep displayed in some conspicuous public position in the place of business, if any, where he carries on the business, calling, trade or occupation in respect of which he is licenced, his licence for the cur· rent year; and

(b) produce his licence when required to do so by the Commissioner or by a person authorized by the Corn· missioner to require production of the licence."

2. The Schedule of the said Ordinance is repealed and the fol1owing substituted therefor:

CHAPTER 4

ORDINANCES OF THE YUKON TERRITORY 1961 (First Session)

AN ORDINANCE TO AMEND THE TAXATION ORDINANCE

(Assented to April 12th, 1961) The Commissioner of the Yukon Territory, by and with

the advice and consent of the Council of the said Territory, enacts as follows:

1. Paragraph (g) of section 2 of the Taxation Ordinance is repealed and the following substituted therefor:

"(g) "real property" means land and all buildings, fixtures and things erected upon or under or affixed thereto;"

2. (l) Paragraph (f) of section 3 of the said Ordinances is repealed and the following substituted therefor: .

"(f) churches, including residences and b4ildings in con­nection therewith, and the lands used in conncetion with such churches to the extent of not more than two acres in respect of each church;"

(2) Section 3 of the said Ordinance is further amended by deleting the word "and" at the end of paragraph (h) thereof, by adding the word "and" at the end of paragraph (i) thereof and by adding thereto the following paragraph:

"(j) all buildings, fixtures, machinery and things erected upon or under land or that are otherwise affixed there­to and used solely for the purpose of obtaining min­erals from the ground or for the concentrating or otherwise processing of minerals."

3. Section 22 of the said Ordinance is repealed and the following substituted therefor:

"22, (1) The Assessor shall, at least thirty days before the date fixed for the sitting of the Court of Revision for the revision of the assessment roll in any year,

(a) send by mail to every person listed in the assessment roll whose real property or interest therein is assessed

at an increased value or newly assessed or to the agent of that person a notice to that effect and shall keep a proper record of same, including a notation of the date of mailing;

and give public notice

that the assessment roll to be revised has been de­posited in the office of the Assessor and will remain open for the inspection of any person for a period of fifteen days from the date of the notice;

that any person desiring ~o.complain against the assess­ment must lodge his complaint in the office of the Assessor at least ten days before the date fixed for the sitting of the Court of Revision; and

(d) that the Court of Revision will sit for the revision of the assessment roll and to hear <;omplaints on the date fixed in the notice, and that notice shall fix the place, date and hour of the sittings:

. (2) ·The notice shall be given by posting it in the·Assessor's office and by publi,cation. in at least two issues of.a newspaper published or circulated in the Territory and shall be in such form as is prescribed by the Commissioner,"

CHAPTER 5

AN ORDINANCE TO AMEND THE MOTOR VEHICLES ORDINANCE

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:

1. Section 2 of the MOlor Vehicles Ordinance is repealed and the following substituted therefor:

2. In this Ordinance,

(a) "chauffeur" means a person who, for gain or reward, drives or operates a motor vehicle on a highway;

(b) "dealer" means any person who carries on the busi­of buying, selling or exchanging motor vehicles or trailers either as principal or agent;

(c) "driver" means a person who drives or is in actual physical control of a vehicle;

(d) "gain or reward" means any payment, consideration, compensation or gratuity, directly or indirectly charged, demanded, received or collected for the use of a vehicle by a person who, as owner, lessee, hirer, chauffeur, operator or otherwise, has possession of or control over the vehicle or has directed the move­ment of the vehicle;

(e) "gross weight" means the maximum weight of the motor vehicle when loaded to maximum capacity;

(f) "highway" includes any thoroughfare, street, road, trail, avenue, parkway, driveway, viaduct, lane, alley, square, bridge, causeway, trestleway or other place, whether publicly or privately owned, any part of which the public is ordinarily entitled or permitted to use for the passage of vehicles;

(g) "intersections" means the area at the intersection of two or more highways that is or would be enclosed by cross lines connection the' middle points of the curb corners of adjoining highways or, where there are no curbs, connecting the points of intersection of the lateral boundary lines of adjoining highways;

(h) "licence" means a valid and subsisting licence issued under this Ordinance;

(i) "livery" or "taxicab" means a motor vehicle that is used by its owner, chauffeur or driver for the busi­ness of transporting passengers at their request toa stated destination but that is not operated at reg­ular intervals or in accordance with a set time schedule;

(j) "motor vehicle" means a vehicle not run upon rails, that is designed to be self-propelled, but does not include a traction engine and a vehicle used exclusive­ly for mining, forestry, construction, road mainten­ance or farming operations and that is not primarily designed to carry a load;

(k) "municipality" means a municipal corporation;

by a municipality nor a motor vehicle or trailer used by its owner for the· distribution or transportation of goods manufactured or sold by him or a single vehicle used by the owner to distribute commodities on his own behalf;

(r) "recovery vehicle" meaJ.ls a vehicle that is constructed for or primarily used for the retrieval of other vehicles which are temporarily or permanently Im­mobilized on or adjacent toa highway;

(s) "Registrar" means the Commissioner or any person authorized by the Commissioner to act as Registrar for the. purposes of this Ordinance;

. (t) "settlement" means any area or place outside the limits of a municipality in respect of which, pursuant to section 151, signs have been erected or notices posted up respecting the rate of speed of vehicles within the limits ·of that area or place for the safety of the inhabitants thereof;

(u) "traction engine" means a self-propelled vehicle de­signed primarily for traction purposes and not con­structed itself to carry a load, but does not include a truck tractor;

(v) "trailer" means a vehicle that is drawn on a highway by a motor vehicle, whether or not part of its weight or load rests upon or is carried by that motor vehicle, but does not include an implement of husbandry temporarily drawn, propelled or moved on a highway or a sidecar attached to a motorcycle;

(w) "truck" means a motor vehicle that is constructed for or primarily used for the transportation of goods and chattels;

(x) "truck tractor" means a motor vehicle that is used solely for the purpose of supplying power for the propulsion or drawing of a trailer or other vehicle: and

(y) "vehicle" means a device m, upon or by which a person or thing is or may be transported or drawn

upon a highway, ~ except a device designed to be moved by human power or used exclusively upon stationary rails or tracks."

2. Section 49B of the said Ordinance is repealed and the following substituted therefor:

"49B. (1) Except as authorized by this Ordinance and the Regulations, no person shall operate on a highway a vehicle that is equipped with any lamp that lights intermit­tently or in flashes.

(2) An ambulance, police vehicle or fire-fighting vehicle may, when operated on a highway by an authorized person, be equipped with and use one or more lamps that cast a red light and that lights intermittently or in flashes.

(3) A vehicle designed for use asa recovery vehicle· or designed for use in highway construction or highway main­tenance may be equipped with one or more lamps that cast an amber light and that light intermittently or· in flashes.

(4) No person shall operate on a highway a vehicle re­ferred to in subsection (3) that is actually engaged in the work of recovery, highway construction or highway main­tenance unless that vehicle is showing a flashing amber light that is clearly visible in both directions on the high­way.

(5) A vehicle designed for use as a snow plow may be be equipped with one or more lamps that cast a blue light and that light intermittently or in flashes.

(6) No person shall operate on a highway a vehicle re­ferred to in subsection (5) that is actually engaged in the work of snow plowing unless that vehicle is showing a flashing blue light that is clearly visible in both directions on the highway."

ORDINANCES OF THE YUKON TERRITORY 1961 (First Session)

AN ORDINANCE TO AMEND THE MUNICIPAL ORDINANCE

(Assented to April 12th, 1961)

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:

1. Section 109 of the Municipal Ordinance is repealed.

2. Subsection (3) of section 124 of the said Ordinance 1S

repealed and the following substituted therefor:

"(3) The real property referred to in paragraphs (b) to (h) inclusive of subsection (1) and occupiers liable to taxa­tion under subsection (2) are liable to taxation for local improvements."

3. Section 133 of the said Ordinance is repealed and the following substituted therefor:

"133. Every person who

(a) obstructs or hinders, or

(b) makes a false or misleading statement to an assessor engaged in carrying out his duties or functions under this Ordinance

is guilty of an offence and liable on summary conviction to a fine not exceeding one hundred dollars or to imprison­ment for a period not exceeding sixty days or to both the fine and imprisonment."

4. Section 144 of the said Ordinance IS repealed and the following substituted therefor:

(a) send by mail to every person listed in the assess­ment roll whose real property or interest therein is assessed at an increased value or newly assessed or to the agent of that person a notice to ·that effect and shall keep a proper record of same, including a notation of the date of mailing;

and give public notice

(b) that the assessment roll to be revised has been de­posited in the office of the clerk and will remain open for the inspection of any person for a period of fifteen days from the date of the notice;

(c) that any person desiring to complain against the assessment must lodge his complaint in the office of the clerk at least ten days before the date fixed for the sitting of the Court of Revision; and

(d) that the Court of Revision will sit for the revision of the assessment roll and to hear complaints on the date fixed in the notice and the notice shall fix the place, date and hour of the sittings.

(2) The notice shall be given by posting it in the muni­cipal office and by publication in at least two issues of a newspaper published or circulated in the municipality and shall be in such form as is prescribed by the council."

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:

1. Subsection (1) of section SI of the /IIJicaJu,.e O,.dinance is repealed and the following substituted therefor:

"51. (1) Every person appointed as a Small Debt Official has jurisdiction in the Territory to try and adjudi­cate upon any claim for a debt, whether payable in money or otherwise, where the amount or balance claimed does not exceed two hundred dollars, but such jurisdiction does not·extend to any case in which the title to land is involved."

The Commissioner of the Yukon Territory, by and with ~~;~1. the advice and consent of the Council of the said Territory, enacts as follows:

1., (1) Section 2 of· the Engineering Profeuion Ordinance is amended' by adding thereto, immediately after paragraph (b) thereof, the following paragraph:

," (bb) "licensee" means the holder of a temporary .. Licensee ....

(2) Section 2 of the said Ordinance is further amended by deleting the word "and" at the end of paragraph (g) thereof, by adding ~he word "and" 'to the end of paragraph (h) there­of and by adding thereto the following paragraph:

"(i) "temporary licence'" means a licence issued pur­suant to subsection (2) of section 12."

2. Section 8 of the said' Ordinance is repealed and the following ~ubstituted therefor:

"S. (1) The Councii shall appoint from the membership of the Association a Registrar and a Secretary-Treasure'r who shall hold office during the pleasure of the <;:quncil.

(2) The office of Regis~rar and of Secreta'ry-Tre'asurer 'may, where the Council so directs, be held by one person.

3. (1) Paragraphs (d), (e) and (f) of subsection (1) of section 12 of the said Ordinance are repealed and the following substituted therefor:

"(d) establishes to the satisfaction of the Council

(i) that he is a duly registered member in good standing of an associatIOn or corporation of professional engineers of any province of Canada,

(ii) that he is a duly registered member in good standing of the Engineering Institute of Canada and has a certificate therein of the grade of "member", or

(iii) that he is fully qualified

(A) for admission to membership in one of the associations or corporations referred to in subparagraph (i), or

(B) for admission to membership at the grade of "member" in the Institute referred to in subparagraph (ii)

in accordance with the relevant laws govern­ing admission to such membership;

(e) has had at least two years actual experience in en­gineering work of a nature satisfactory to the Council; and

(f) pays all fees prescribed by the Council."

(2) Subsections (2), (3), (4) and (5) of section 12 of the said Ordinance are repealed and the following substituted therefor:

"(2) The Council may, subject to such terms and con­ditions as it may impose, issue a temporary licence to en­gage in the practice of professional engineering in the Territory to any person who

(a) is qualified for membership in the Asociation pur­suant to subsection (1),

(b) applies for a temporary licence in the form pre­scribed by the Council, and

(c) pays all fees prescribed by the Council.

(3) A temporary licence shall specify

(a) the purposes for which it is issued, and

(b) the period during which it shall remain JO force.

(4) No corporation or partnership shall

(a) be admitted as a member in the Association, or

(b) be issued a temporary licence."

4. Section 13 of the said Ordinance IS repealed and the following substituted therefor:

"13. The Council shall examine all degrees, diplomas, certificates and other credentials presented or given in evidence for the purpose of obtaining membership in the Association or of obtaining a temporary licence, and may require the holder of such credentials to attest by oath or by statutory declaration any matter involved in his appli­cation."

S. Subsection (1) of section 14 of the said Ordinance IS

repealed and the' following substituted therefor:

"14. (1) Every person who has become a member of the Associa'tion is entitled to be entered in the register upon payment to the Registrar of such fee as is prescribed by the by-laws of the CounciL"

at his last recorded address demanding payment, the Registrar, on direction of the Council, shall remove his name from the register without further notification, 'where­upon he shall cease to be registered and, he shall not be registered again except at the discretion of Council and upon payment of such arrears of fees 'as the Council directs."

7. (1) Subsection (1) ,of section 17 of the said Ordinance IS repealed and the following substituted therefor:

"17. (1) E~cept as otherwise provided in this Ordinance, no person shall engage in the practice of p'rofessional en­

Any person who advertises or uses in any manner in connection with 'a person who is not a member of the Association or who is not a licensee the title of professional. engineer or any 'word, name, title or designation mentioned in the definition of professional engineering, or any com­bination or abbreviation thereof or any other word, name, title, designation, descriptive term or statement implying or calculated to lead any other person to believe that such person is a professional engineer or is ready or entitled to engage in or is engaged in the practice of professional engineering is guilty of an offence and liable on summary conviction to a penalty not exceeding one hundred dollars for the first offence, and a penalty not exceeding five hundred dollars for every subsequent offence."

9. Section 20 of the said Ordinance is repealed and the following substituted therefor:

"20. (1) No person. shail be entitled to recover any fee or remuneration in any court of law in the Territory for 'any work or service comprised in the practice of profes­sional engineering unless at the time such work or service was performed, -

(a) he was a member of the Association and held a -certificate of· registration issued pursuant to· this Ordinance, or

(b) . he was a licensee.

(2) No plans or specifications for any works or buildings or for any alteration thereto involving the safety of the 'public or costing over the sum of twenty thousand dollars shall be passed, approved or accepted by any municipality formed under the provisions of the M1IniC'ipal Ordinance or hy any official or employee thereof, 'unless the said plans or specifications have been duly signed and sealed by a pro­fessional engineer or a person registered as an architect under any Act of the provi~ce~ relating to the practice of a.rchi tecture."

10. Section 22 of the said Ordinance IS repealed and the following substituted therefor:

"22. Where a person wilfully procures or attempts to procure himself to be registered or licensed under this Ordinance by· making or producing, or causing to be .made or produced, any false or fradulent representation or declar­ation, either verbally or in writing, he, and every person knowingly aiding and assisting him therein, is guilty of an offence and liable on summary conviction to a penalty not exceeding five hundred dollars."

11. Section 25 of the said Ordinances is amended by adding thereto the following subsection:

"(2) The Council may cancel the temporary licence of any person who has been convicted in Canada of an in­dictable offence."

"26. (1) The Council, after giving written notice to any person affected, may, and upon application of any three members of the Association shall, cause inquiry to be made into matters respecting any fraudulent or incorrect entry in the register, unprofessional conduct, negligence or mis­conduct of or relating to any member or a person licensed under this Ordinance, or any violation of the Ordinance or the by-laws by any such member or such licensee."

(2) Subsection (3) of section 26 of the said Ordinance IS

repealed and the following substituted therefor:

"(3) After the inquiry the Council may in its discretion order the removal or correction of any entry in the register or roll or the cancellation of any licence, and may repri­mand, censure, suspend or expel from the Association any person found guilty."

13. Sections 31 and 32 of the said Ordinance are repealed and the following substituted therefor:

"31. In any proceedings or prosecution under this Ordi­nance in which proof is required that any person is or is not a member of the Association or a licensee, a certificate purporting to be signed by the Registrar and under the seal of the Association that such person is or is not a mem­ber of the Association or a licensee, as the case may be, shall be prima facie evidence of the fact so certified, with­out any proof of the signature or of the seal or of the person signing being in fact the Registrar.

32. No action shall lie against the Council, any member of the Association or a licensee for any proceedings bona fide taken or enforced or attempted under a by-law of the Association or' for anything done bona fide and pursuant to this Ordinance."

DEFRAY THE EXPENSES OF THE PUBLIC SERVICE OF THE TERRITORY

. WHEREAS it appears by message from Frederick Howard Collins, Commissioner of the Yukon Territory, and in the estimates accompanying the same, that the sums hereinafter mentioned in Schedule HA" of this Ordinance are required to defray certain expenses of the Public Service of the Yukon Territory and for the purposes relating thereto, for the twelve months ending March 31st, 1962;

Therefore the Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:

1. This Ordinance may be cited as the Appropriation Ordi­nan.e 1961-62.

2. From and out of the Yukon Consolidated Revenue Fund there may be paid and applied a sum not exceeding in the whole six million nine hundred thousand eight hundred and sixty-three dollars and fifty-one cents for defraying the several charges and expenses of the Public Service of the Yukon Territory for the twelve months ending March 31st, 1962, as set forth in Schedule HA" of this Ordinance.

3. The due application of all monies:-

AN ORDINANCE FOR GRANTING TO THE COMMISSIONER CERTAIN ADDITIONAL SUMS OF

MONEY TO DEFRAY THE EXPENSES OF THE· PUBLIC SERVICE OF THE TERRITORY

(Assented to April 12th, 1961)

WHEREAS it appears by message from Frederick Howard Collins, Commissioner of the Yukon Territory, and in the estimates accompanying the same, that the sums hereinafter mentioned in Schedule "A" of this Ordinance are required to defray certain expenses of the Public Service of the Yukon Territory and for the purposes relating thereto, for the twelve months ending March 31, 1961,

AND WHEREAS it appears that certain of the said sums are recoverable as set forth in Schedule "B",

THEREFORE the Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:

1. This Ordinance may be cited as the Second SuppLementary Ap pro priaJion Ordinance 1960·61.

2. From and out of the Yukon Consolidated Revenue Fund the~e may be paid and applied a sum not exceeding in the whole One hundred and forty-eight thousand, nine hundred and ten dollars and seventy-one cents for defraying the several charges and expenses of ·the Public Service of the Yukon Territory for the twelve months ending March 31, 1961, as set forth in Schedule "A" of this Ordinance.

3. The due application of all monies

(a) expended pursuant to Section 2, and

(b) recoverable as set forth in Schedule "n",

shall be duly accounted for.

CHAPTER 1

ORDINANCES OF THE YUKON TERIUTORY 1961 ( Second Session)

AN ORUlNANCE TO AUTHOruZE THE CO\1\lISSIONEll TO PURCHASE CERTAIN LANDS FRO\1 THE BRITISH YUKON RAILWAY CO\1PANY, TO SELL THE\1 TO THE CORPORATION OF THE CITY OF WHITEHORSE

AND TO LOAN MONEY TO THAT CORPORATION

(Assented to July 6, 1961)

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:

1. This Ordinance may be cited as the Whitehorse Land Sale and Loan Ordinance (1961).

2. (1) The Commission er is authori zed to en ter in to and ex­ecute on behalf of the Yukon Territory an Agreement with the Bri­tish Yukon Railway Company for the purchase from the Company of the lands described in the Schedule hereto for seventeen thousand. eight hundred dollars.

(2) From and out of the Yukon Consolidated ilevenue Fund there may be paid a sum not exceeding seventeen thousand. eight hundred dollars for the purpose of carrying out the Agreement

described in subsection 0).

3. 0) The Commissioner is authorized to enter into and ex­ecute on behalf of the Yukon Territory an approved Agreement with the Corporation of the City of Whitehorse providing for the sale to the Corporation. notwithstanding the Yukon Lands Ordinance, t;>fthe lands described in the Schedule hereto for seventeen thousand, eigh t hundred dollars.

(2) The Agreement described in subsection (1) shall·pro-vide

(a) for payment in full to the Commissioner. of the purchase price of the said land in thirty equal consecuti ve annual paymen ts of principal and interest, th e first of sllch paymen ts to be made on a date not later than one year from the date of the tran­sfer of the said land to the Corporation of the City of Whitehorse;

(b) for the payment of interest at the rate of five and one quarter percent per annum on the amount from time to time outstanding on the purchase price of the said land; and

(cl for such other terms and conditions as may be ag­reed upon by the Commissioner.

REPEAL.

4. 0) The Commissioner may enter into and execute on behalf of the Yukon Territory an Agreement with the Corporation of the City of Whitehorse providing for the making of a loan to that Corporation of a sum not exceeding one hundred and fifty-seven two hundred dollars for the purpose of constructing roads and sew­ers for, and supplying water to, the lands described in the Schedule

(2) The Agreement described in subsection (1) shall provide that the loan

(a) shall bear interest at the rate of five and one­quarter per cen t per ann um;

(b) be for a term not exceeding thirty years;

(cl be secured by debentures issued by the Corp-oration; and

(d) be repayable In full under the conditions of the Agreemen t.

(3) From and out of the Yukon Consolidated Revenue Fund there may be paid a sum not exceeding one hundred and fifty· seven thousand two hundred dollars for the purpose of carrying out the Agreement desl:ribed in this section.

5. The Commissioner is empowered to do every act and exercise every power for the purpose of iinplementing every oblig­ation assumed by the Territory under this Ordinance.

6. The Yukon Housing Loan Ordinance , chapter 2 of the Ordinances of the Yukon Territory, 1960, Third Session is repeal­ed.

SCHEDULE "All that portion of Lot 19, in Group' 804 (5) in the Townsite of Whitthorse in the Yukon Territory, as said Lot is shown on a plan of survey in the Canada Lands Surveys Records under number 8406, described as follows:

First. The whole of Blocks ,lettered G, H, ], K, L, M, N, 0 and P, as said Blocks are shown ona plan of survey in the Canada Lands Surveys Records under number 50096;

Secondly. The whole of Lots 1 to 6 inclusive, In Block 41, as shown on said plan 50096;

Thirdly. The whole of Lots 1 to 6 inclusive, In Block 31, as shown on said plan 50096; and

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, en­enacts as follows:

1. This Ordinance may be cited as the Loan Agreemen.t

2. The Commissioner may, on behalf of the Yukon Territory, borrow from the Government of Canada a sum not ex­ceeding one hundred and seventy-five thousand dollars.

3. The Commissioner is authorized to enter into and execute on behalf of the Government of the Yukon Territory an Agreement with the Government of Canada providing for

(a) the repayment to the Government of Canada of the amount borrowed pursuant to section 2;

(b) the payment to the Government of Canada of interest at such rate as may be agreed upon by the Co­mmissioner on the principal from time to time outstanding on the amount borrowed pursuant to section 2; and

(c) such other terms and conditions as may be agreed upon by the Commissioner.

4. The Commissioner is empowered to do every act and exercise every power for the purpose of implementing every obligation assumed by the Government of the Yukon Territory under this Agreement.

CHAPTER 3

ORDlN ANCES OF THE YUKON TERRITORY

AN ORDINANCE TO PROMOTE THE CONSTRUCTION OF NEW HOUSES AND TO IMPROVE HOUSING AND LIVING CONDITIONS IN THE YUKON TERRITORY

(Assented to luly 6, 1961)

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the BIlid Territory, en­acts as follows:

1. This Ordinance may be cited as the Yukon Housing Ordinance.

2. In this Ordinance,

(a) "approved lender" means a lender approved by the Governor in Coun cil for the purpose of making loans under the National Housing Act, 1954; and

(b) "Corporation" means the Central Mortgage and Housing Corporation.

3. (1) Subject to this Ordinance, the Commissioner may make a loan to any person described in subsection (2) to assist that per son in the construction of a house.

(2)'The Commissioner may make a loan to any person who

(a) is the holder in fee simple of the land on which the house is to be constructed;

(b) is not a mortgager to the Commissioner; and

(c) satisfied the Commissioner that the Corporation has agreed to make a loan to him, or has undertaken to insure a loan made to him by an approved lender, to assist in the construction of th e house.

(3) A loan made under the authority of this section shall

COMMISSIONER MAY EXECUTE AGREEMENT.

TERMS OF AGREEMENT.

~a) not exceed two thousand dollars in respect of anyone house;

(b) bear interest at the rate of seven and three-quarters per cen t per annum;

(c) be for a tenn not exceeding thirty -five years;

(d) be secured by a mortgage in favour of the Commission­er upon the land on which the house is to be constructed;

(e) be repayable in full during th e tenn thereof by equal payments of principal and interest; and

(f) be sllbject to such other tenns and conditions as the Commissioner may deem desirable.

4. (l) The Commissioner is authorized to enter into and ex­ecute on behalf of the Yukon Territory an Agreement with the Corp­oration respecting the administration of loans made by the Commis­sioner pursuan t to this Ordinan ce.

(2) The Agreement described in subsection (l) shall pro-

vide that

(a) the Corporation will attend to the preparation, exec­ution and registration of all documents necessary to complete ap­plications for loans made under this Urdinance and for the secur­ing of such loans, and will advise the Commissioner respecting the advancement of moneys' under such loans;

(b) the Corporation will collect all moneys due to the Commissioner under mortgages given to secure loans made under this Ordinance and pay such moneys to the Yukon Consolidated Revenue Fund;

(c) the Corporation will take all action necessary to en­force payment of mortgages given to the Commissioner to secure loans under this Ordinance including the foreclosure thereof;

(d) the Territory will, semi-annually and not in advance pay to the Corporation an amount equal to one half of one per cent per annum of the aggregate of all principal moneys then outstand­on all loans made under this Ordinance; and

(e) such other terms and conditions as may be agreed upon by the Commissioner.

5. From and out of the Yukon Consolidated Revenue Fund there may be paid an amount not exceeding one hundred thou­sand dollars for the purpose of making loans under this Ordin-

ance.

6. No loan shall be made by the Commissioner pursuant to this Ordinance after the 31st day 01 March, 1962.

7. The Commissioner is empowered 'to do every act and exer­ci se every power for the purpose of impl emen till g every obligat­ion assumed by, and enforcing every right accruing to, th e Yukon Territory under this Ordinance.

8. The Commissioner may by regulation make provisions for any matters concerning which he deems regulations are necess­ary or desirable to carry out the purposes or provisions of this Ordinance. .

ORDINANCES OF THE YUKON TERRITORY

AN ORDINANCE TO AMEND THE WORKMEN'S COMPENSATION ORDINANCE

(Assented to July 6, 1961)

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, en­acts as follows:

1. (1) Paragraph (a) of subsection 0) of section 25 of the

Workmen's Compensation Orclinan ce is repeal ed an d the followin g substituted there for:

.. (a) the necessary expenses of th e burial of the workman , not exeeding two hundred and fifty dollars."

(2) Paragraph (cl) of subsection (l) of section 25 of the said Ordinanc e is repealed and the following substituted therefor:

"(cl) to a dependent widow or a dependent invalid widower,

(j) where the accident occured on or before the 31st day of December, 1955, a mon thly paymen t of fifty dollars,

(H) where the accident occured on or after the 1st day of January, 1956, and on or before the 8th day of July, 1961, a mon­thly payment of seventy-five dollars, or

(iii) where the accident occured on or after the 9th day of July, 1961, a monthly payment of one hundred dollars."

(3) Paragraph (e) of subsection (1) of section 25 of the said Or-dinance is repealed and the following substituted th erefor:

"(e) to a dependent child under the age of sixteen years, other th­an a dependent invalid child, where the accident occured on or be(ore the 8th day of July, 1961, a monthly payment of twenty­five dollars, to continne until the child attains the age of sixteen years or dies before attaining that age."

(4) Subsection (1) of section 25 of the said ordinance is further amended by adding thereto, immediately after paragraph (e) thereof, the following paragraph:

"(e) to a dependent chi Id under the age of eighteen years, oth­er than a dependent invalid child, where the accident occured 0 n or after the 9th day of July, 1961, a monthly payment to contin u e until the child attains the age of eighteen years, or dies before att­aining that age, as follows:

(i) for the first child, thirty-five dollars,

(ii) for the second child, thirty-five dollars, and

(iii) for each additional child. twen ty dollars. "

(5) Paragraph (0 of subsection (1) of section 25 of the said Or­dinance is repealed and the following is substituted therefor :

"(f) to a dependent invalid child, irrespective of the age of the child,

(i) where the accident occured on or beft)fe the 8th. day of July, 1961, a monthly payment of twenty-five dollars, or

(ii) where the accident occur~d on or after the 9th. day of July, 1961, a monthly payment of thirty-five dollars,

to con tinue as long as, in the opinion of the referee, it mi gh t rea­sonably been expected, had the workman lived, he would have continued to contribute to the support of the child."

AN ORDINANCE TO AMEND THE MUNICIPAL ORDINANCE

(Assented to July 7,1961)

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts a5 follows:

O.Y.T. 1959 (2NO) C.I 1. Section 122 of the Municipal Ordinance is repealed and the following substituted therefor :

LEVYING OF TAXES "122. Taxes shall be levied by by-laws of the municipal i ty each year in accordance with this Ordinance at such uniform rate per dollar on ,the assessed value of all land in the municipality liable to taxation and upon such percentage, not less than fifty

'percent, of the assessed value of improvements as Council deems necessary in order to provide for the raising of revenue of the municipality sufficient to meet the estimated expenditures of the municipality for that year."

LEVY OF SCHOOL

TAX.

2. Section 194 of the said Ordinance is repealed and the folio win g substitute d therefor :

"194. The Council of each municipality shall in each year, levy a school rate not exceeding ten mills on the assessed value of all land liable to taxation in the municipality and upon such percent­age of the assessed ·value of improvements as is set out in a b y­law passed by the Council pursuant to section 122."

AN ORDINANCE TO AMEND THE GAME ORDINANCE

(Assented to July 6, 1961)

The Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:

1. Section 78 of the Game Ordinance is amended by adding thereto the following subsections:

"(3) The Director may issue a licence to a person who is the holder of a licence in the Territory to do business as a retail merchant or lodge keeper, to buy, sell or traffic in the skins, pelts or parts thereof of, such fur-bearing animals endorsed on the by the Director and are endorsed on the licence.

(4) A licence issued pursuant to subsection (3) authorizes the licensee, his employee or agent to buy, sell or traffic in the skins, pelts or parts thereof of the fur-bearing anim'als endorsed on th e licence only at the place 0'£ business described therein." .

2. Schedule A of the said Ordinance is amended by adding thereto immediately after item 9 thereof, the following item :

THE COMMISSIONER of the Yukon Territory, by Th-8·Y.T· 62 and with the advice and consent of the Council of the . c. .

said Territory, enacts as follows:

~. The Labour Provisions Ordinance is amended by adding thereto, immediately after section 3 thereof, the following section:

"3A. (1') Subject to subsection (3), no employer shall Holidays

require an employee to work on any of following days: (a) New Year's Day, "( b) Good Friday, ( c) Domi nion Day; (d) August 17, known as Discovery Day; (e) Labour Day; or (f) Christmas Day.

(2) Where any of the days mentioned in subsection (1) Where falls on a Sunday, no employer shall require an employee :~"g~~da~l:IB to work on the Monday immediately following. .

(3) An employer may request or permit an employee to Remuner­work on any of the days mentioned in subsection (1) if he ;:~~~ !~r pays that employee remuneration at a rate of not less than holidays

AN ORDINANCE TO AUTHORIZE THE COMMISSIONER TO BORROW A SUM NOT EXCEEDING FIVE HUNDRED THOUSAND DOLLARS FROM THE GOVERNMENT OF CANADA AND TO AUTHORIZE THE COMMISSIONER TO EXECUTE AN AGREEMENT RELATING THERETO {1961}

THE COMMISSIONER of the Yukon Territory. by and with the advice and consent of the Council of the

said Territory. enacts as follows:

1. This Ordinance may be cited as the Loan Agreement Ordinance (1961).

2. The Commissioner may on behalf of the Territory borrow from the Government of Canada a sum not exceeding five hundred thousand dollars.

3. The Commissioner is authorized to enter into and execute on behalf of the Government of the Yukon Terri­tory an agreement with the Government of Canada pro­viding for

(a) the repayment to the Government of Canada of the amount borrowed pursuant to section 2 and

(b) the payment to the Government of Canada of in­terest at such rate as may be agreed upon by the Commissioner on the principal from time to time outstanding of the amount borrowed pursuant to section 2

in twenty equal annual instalments including principal and interest.

4. The Commissioner is empowered to do every act and exercise every power for the purpose of implementing every obligation assumed by the Government of the Yukon Terri­tory under the agreement.

AN ORDINANCE FOR GRANTING TO THE COMMIS· SIONER CERTAIN ADDITIONAL SUMS OF MONEY TO DEFRAY THE EXPENSES OF THE PUBLIC SERVICE OF THE TERRITORY

(Assented to November 29, 1961)

WHEREAS it appears by message from Frederick How-ard CoIlins, Esq., Commissioner of the Yukon Terri­

tory, and in the estimates accompanying the same, that the sums hereinafter mentioned in Schedule "A" of this Or­dinance are required to defray certain expenses of the Public Service of the Yukon Territory and for the purposes relating thereto, for the twelve months ending March 31, 1962.

AND WHEREAS it appears that certain of the said sums are recoverable as set forth in Schedule "B",

THEREFORE the Commissioner of the Yukon Territory, by and with the advice and consent of the Council of the said Territory, enacts as follows:

1. This Ordinance may be cited as the First Supplemen- Short Title ta,ry Appropricttion Ordinance 1961-62.

2. From and out of the Yukon Consolidated Revenue Amount Fund there may be paid and applied a sum not exceeding granted in the whole one hundred and seventy-eight thousand, five hundred and twenty-six dollars and seventy-four cents for defraying the several charges and expenses of the Public Service of the Yukon Territory for the twelve months end-ing March 31, 1962, as set forth in Schedule "A" of this Ordinance.

3. The due application of all monies (a,) expended pursuant to Section 2, and (b) recoverable as set forth in Schedule "B",

shall be duly accounted for.
