Operational Certificate of Occupancy Information Packet
No building or structure shall be used or occupied, and no change in the exiting occupancy classification of a
building or structure or portion thereof shall be made until the building official has issued a certificate of occupancy.
Application:
Complete as much information as possible, including: property address information, contact or applicant information, property owner information, fire prevention information, zoning information, etc.
Supporting Documents:
Site plan Floor plan Letter of Intent Sales tax ID (If Applicable) List of Suite numbers, Square Feet and
Business Names (If multi-tenant).

CO Application Process:
Once you have submitted your application, your permit will be entered into our system and your address will be verified by our Permit Technicians.
Your application is then reviewed by the Planner of the Day or POD. This Planner will verify zoning and permitted uses for the structure. This can take up to 3 business
days. The Planner will then forward the “Approved”
application back to the Permit Technician. If the application is not approved, the Planner will notify the applicant to see if compliance issues can be resolved. If the compliance issues cannot be resolved, the Certificate of Occupancy process will end here.
A permit Technician will contact you to take payment and schedule your inspections. Inspections will include: FIRE, BUILDING and COMMUNITY IMPROVEMENT and if necessary CONSUMER HEALTH.
After all inspections divisions have verified compliance with city codes, a Certificate of Occupancy will be issued.
If inspections have not passed, the Inspectors will issue a list of conditions that do not meet code compliance for the applicant to address before a Certificate of Occupancy can be issued.
The Certificate of Occupancy shall be posted at the business.
Additional Permits May Be Required: Place of Assembly Permit (Fire Prevention) –
for assembly areas such as restaurants, bars, churches, etc.
Health Permit (Consumer Health) – for establishments that prepare and serve food to the public
Pool Permit (Building Inspections) – for buildings such as apartments or hotels with swimming pools

$95 inspection fee. Visa, MasterCard, Discover, Check or Money Order made payable to the “City of Denton”.
An additional $35 fee is added if the utilities are not currently connected.

Industrial Storm Water Survey
All commercial businesses must complete the survey located at:

Solid Waste
All commercial businesses must have solid waste services. The Solid Waste department is located at; 601 E Hickory, Suite F, Denton, TX 76201. You may call them at (940) 349-8787.
Utilities will not be released until a Solid Waste account is set up.
Sales Tax Permit
If applicable, a copy of your Sales Tax Permit must be provided to the City of Denton Building Inspection Department. You can get your sales tax permit at the Comptroller’s Office located at; 2108 E Randoll Mill Rd Suite 100, Arlington TX 7611. They can be reached at 940-459-1155.

Hotel Occupancy Taxes
The City receives 7% of the 13% occupancy tax collected by hotels, motels, and B&B’s. Please contact the Finance Department for proper reporting and payment at 940-349-8206.

This permit becomes null and void unless a City inspection is performed within six months from the date of issuance. The granting of a permit does not presume to give authority to
violate or cancel the provisions of any law or ordinances regulating construction. No inspection will be performed unless this permit is displayed on the jobsite and the City approved

The zoning permit will travel in concert with the Certificate of Occupancy (CO). The purpose of the zoning permit is to ensure compliance with the Denton Development Code (DDC) as it relates to zoning requirements. The Zoning Permit is designed to allow the applicant to provide basic project details which can be verified for compliance with the DDC. The following items or information must be submitted along with this checklist:
A Zoning Compliance Review
A Transmittal Letter indicating the purpose of the submittal
(2) copies of Site plans and (1) copy of floor plan of the structure Note: APPLICATION MUST BE ACCOMPANIED BY A PLAN (a scaled drawing of the property) showing the following: 1) property boundaries with dimensions, 2) existing structure/improvements with identification of any to be removed, 3) proposed structures/improvements with dimensions, 4) existing landscaping.
In addition to the general information that must be shown on the sketch plan, detailed information, as it pertains to the request may be required. Staff will discuss any additional information deemed appropriate and necessary to process the application with the application based on the specifics of the application submitted. The following uses are identified in Subchapter 5 of the the Denton Development Code (DDC). Please check the use that applies to your development. The uses are categorized as residential, commercial, industrial or institutional land uses. Most uses are defined in Subchapter 23 of the DDC. *NOTICE TO CREDIT ACCESS BUSINESSES:
The City of Denton has recently adopted an ordinance regulating Credit Access Businesses (Ord. No. 2013-073). This ordinance requires Credit Access Businesses to register with the City of Denton’s Building Inspections Division. Credit Access Businesses include but are not limited to businesses offering Check Cashing, Payday Loans, Motor Vehicle Title Loans, Extension of Consumer Credit and/or High-Interest Installment Loans. The Certificate of Registration requires the applicant to provide a copy of the current, valid state license held by the Credit Access Business. The Certificate of Registration is separate and apart from a required Certificate of Occupancy (CO) to lawfully inhabit a structure for business purposes. Additionally, the Certificate of Registration must be conspicuously displayed to the public in the Credit Access Business and must be presented upon request to the Director of Planning and Development or any peace officer for examination.

Current and accurate site plans are required for all Certificate of Occupancy (CO) applications in order to
determine if the site is in compliance with the zoning and site design requirements. Below is a list of the
minimum requirements of a site plan for a CO, accompanied by sample site plans on the next page.
Information about building and lot sizes can be obtained online from the Central Appraisal District
(www.dentoncad.com), by using the “Property Search” function. The dimensions of the site may need to be
obtained by taking measurements on the site if a survey or other site plan is not available.
Project Boundary
Clearly illustrate the boundaries of the site.
Provide the size of the property in acres or square feet (this is the entire boundaries of the site legally held by the property owner).
Building Information
Provide the dimensions and area (square footage) of all buildings on the property (see example)
Driveways
Identify all driveway access points, to and from, the site. Specify if driveways are one-way only.
Setbacks
Label the distance (in feet and inches) between the building(s) and property lines (e.g. front, side, and rear yard setbacks).
Lot Coverage
Identify all areas of the property that are used for parking, vehicular and pedestrian circulation, outside loading areas, outside storage, etc. or that have buildings on them. Provide the combined area (square feet or acres) of all of these areas. This information is used to determine the lot coverage ratio; if lot coverage is already provided on a site plan, you do not need to provide additional calculations.
Parking
Show the parking area and number of spaces (grass, dirt, and gravel are NOT allowed as surfaces for required parking). Note that parking spaces must be striped, and each space is to be 9’ x 18’.
Landscaping
Illustrate all landscape areas, and identify if planted areas containing trees, shrubs, or groundcover. Include all landscaped areas on the site. This information is used to determine the proportion of the site that is landscaped.
Dumpsters
Show the location and approximate sizes of dumpsters and dumpster enclosures, if any exist
Signs
Show locations of all signs on the property
Outside Storage
Show the locations of all storage areas, including height of fences or screening walls, if any exist.
NOTE: Approvals are granted based on the information submitted by the applicant, and failure to provide an
accurate site plan may result in delays and/or non-issuance of an approval.

Interior: Electrical, Plumbing and Mechanical Systems
Verify interior electrical panel location, panel is properly
labeled for identification, panel cover is secured in place,
all breakers are installed in correct locations and
permanently labeled. Install blank covers in open breaker
panel slots that are not in use.
Verify electrical panel locations are not blocked or covered
and have a minimum of 3 foot clearance on all sides
Verify all electrical outlets, switches, fixtures and etc. are
installed correctly with no exposed or hazardous wiring.
Check for unsafe or exposed NM Cable (Romex), wiring or
extension cords
Verify Restroom locations for code compliance
Verify all lavatory and sink fixtures installed inside the
building have working/running tempered water to the
faucets
Verify all plumbing fixtures are installed correctly and are
