Qualified Person’s Statements and CertificationsAs the qualified person, I certify that:

A phase one environmental site assessment of the RSC property, which includes the evaluation of the information gathered from a records review, site reconnaissance, interviews, a report and any updates required, has been conducted in accordance with the regulation by or under the supervision of a qualified person as required by the regulation.

As of 2014/04/01, no phase two environmental site assessment is required by the regulation for the RSC property and based on the phase one environmental site assessment for the RSC property, in my opinion, it is not necessary for any other reason to conduct a phase two environmental site assessment for the RSC property.

As of 2014/04/01, in my opinion, based on the phase one environmental site assessment, there is no evidence of any contaminants in the soil, ground water or sediment on, in or under the RSC property that, if the RSC property were put to any of the types of property uses listed in subsection 1 (2) of the regulation, are likely to interfere with any of those types of property uses.

I am a qualified person and have the qualifications required by section 5 of the regulation.

I have in place an insurance policy that satisfies the requirements of section 7 of the regulation.

I acknowledge that the RSC will be submitted for filing in the Environmental Site Registry, that records of site condition that are filed in the Registry are available for examination by the public and that the Registry contains a notice advising users of the Registry who have dealings with any property to consider conducting their own due diligence with respect to the environmental condition of the property, in addition to reviewing information in the Registry.

The opinions expressed in this RSC are engineering or scientific opinions made in accordance with generally accepted principles and practices as recognized by members of the environmental engineering or science profession or discipline practising at the same time and in the same or similar location.

PHASE ONE CONCEPTUAL SITE MODEL 

Phase One CSM Information Pertaining to Property Figures of the Phase One Study Area are provided that:

i. Show any existing buildings and structures,

There are no buildings or structures on the Property.

ii. Identify and locate water bodies located in whole or in part on the Phase One Study Area

A review of topographic mapping indicates that there is one water body located within the Phase One Study Area. Mimico Creek is located about 40 m south of the Phase One Property, and drains from the northwest to the southeast. The creek is visible on the attached Figure 2.

iii. Identify and locate any Area of Natural Significance located in whole or in part on the Phase One Study Area

Terraprobe reviewed the Ontario Ministry of Natural Resources NHIC database for natural area listings. No Areas of Natural Significance are located in the Phase One Study Area.

iv. Locate any drinking water wells at the Phase One Property

No drinking water wells were identified on the Property during the site inspection. No records of wells on the Property were found in the MOE Water Well Information System (WWIS).

v. Show roads, including names, within the Phase One Study Area

The major roads located within the Study Area are Torbram Road and Clark Boulevard. Other roads located in the Study Area are Eastborne Drive, Ellis Drive, Enmount Drive, and Ellerslie Road, as shown on the attached Figures 1 and 2.

vi. Show use of properties adjacent to the Phase One Property

The neighbouring properties are residential in use to the north, parkland and residential to the west, commercial (retail plazas) to the south, and commercial/industrial to the east, as shown on Figure 2.

vii. Identify and locate area where any potentially contaminating activity has occurred, and show tanks in such areas

No Potentially Contaminating Activities were identified. The Phase One Property has never been developed, and was Parkland in use since the 1970s. Prior to the 1970s the Property was rural farmland. Surrounding properties that are upgradient from (i.e. located northwest of) the Phase One Property are residential in use and did not contain any PCAs. Five properties within the Study Area were identified as registered waste generators in the Ecolog ERIS report, but these properties were all located downgradient, crossgradient, and/or at such a distance (i.e. 200m or more) from the Property that they are unlikely to have caused impact to the Phase One Property, especially since the soil in the area is clayey silt glacial till. One gasoline station was identified within the Phase One Study Area, at 26 Eastborne Drive. This property was located 250m southwest (i.e. downgradient) of the Phase One Property. Due to the distance between them, and the glacial soils present, the gasoline station is not likely to have impacted the Phase One Property.

viii. Identify and locate any areas of potential environmental concern

No Areas of Potential Environmental Concern are present.

The following is a description and assessment of:

i. Any areas where potentially contaminating activity on or potentially affecting the Phase One Property has occurred,

No Potentially Contaminating Activities on or potentially affecting the Phase One Property have been identified.

ii. Any contaminants of potential concern,

Since no Potentially Contaminating Activity was identified, there are no contaminants of potential concern associated with the Phase One Property.

iii. The potential for underground utilities, if any present, to affect contaminant distribution and transport,

This item is not applicable since there is no contaminant of potential concern.

iv. Available regional or site specific geological and hydrogeological information,

Based on published geological information, the near surface overburden soil at and in the vicinity of the Phase One Property consists of Halton Till deposits of silty clay. A geotechnical investigation conducted by Terraprobe in 2013 confirms the soil conditions. The ground water flow direction is towards the south.

v. How any uncertainty or absence of information obtained in each of the components of the Phase One ESA could affect the validity of the model.

No uncertainty was encountered while conducting the Phase One ESA that could affect the validity of the model.
