What is provisional application?

When an agreement covers more than just exclusive EU competencies

Can apply parts of the agreement before Member States have ratified, but:

• Only parts of the agreement that are EU competence or shared competence

• Only after EU ratification (Council and European Parliament)

• 27 of 28 National

Parliaments need to vote

• 38 chambers

• Belgian sub-federal approval

• Perhaps a referendum

• Member States that have ratified:

– Latvia, Malta, Denmark and Croatia
