COMMENTS ON THE NOTICE OF PREPARATION FOR THE CRYSTAL GEYSER BOTTLING PLANT PROJECT DRAFT ENVIRONMETNAL IMPACT REPORT, SCH#2016062056, MT. SHASTA, SISKIYOU COUNTY

The Central Valley Regional Water Quality Control Board (Central Valley Water Board) is a responsible agency for this project, as defined by the California Environmental Quality Act (CEQA). On 28 June 2016, we received your request for comments on the Notice of Preparation (NOP) for the Crystal Geyser Bottling Plant Project Draft Environmental Impact Report (EIR).

The Crystal Geyser Water Company (Discharger) is proposing the operation of Crystal Geyser Bottling Plant (Facility) as a bottling facility with the addition of several proposed components and utility/infrastructure options. The proposed addition of an onsite permanent caretaker/security residence requires a conditional use permit from Siskiyou County, which triggers the need for compliance with CEQA. The proposed EIR will analyze all plant modifications undertaken and proposed by the Discharger to resume operation of the Facility.

Based on our review of the information submitted for the proposed project, we have the following comments:

Wastewater Treatment and Disposal The proposed operation of the Facility discusses several options for wastewater treatment and disposal that will be considered in the EIR. Currently the Facility is allowed to discharge wastewater consisting of filter backwash and ozonated rinse water to an onsite leach field under Waste Discharge Requirements (WDR) Order 5-01-233 adopted by the Central Valley Water Board on 7 September 2001 .

An evaluation of proposed wastewater treatment and disposal options in the EIR should include assessments of potential water quality impacts underlying or in the vicinity of the Facility. In accordance with the State Water Resources Control Board Resolution 68-16 (the Antidegradation Policy) a detailed evaluation of the preferred/selected wastewater treatment and disposal method should be provided in the EIR. This antidegradation analysis should demonstrate that the proposed discharges from the Facility would not degrade underlying water quality or that any change in water quality will be consistent with maximum benefit to the people of the state, will not unreasonably affect beneficial uses, and will not result in water quality less than as described in applicable water quality control plans and policies

(i.e., cause or contribute to groundwater containing waste constituents in concentrations exceeding applicable water quality objectives).

Depending on the preferred wastewater treatment and disposal method identified in the EIR the current WDRs may need to be amended or revised. A complete application for WDRs (referred to as a Report of Waste Discharge, or ROWD) must be submitted at least 140 days prior to discharging waste. Waste Discharge to City Utilities The proposed project is considering several options for discharging wastewater from the Facility, all of which include utilizing the City of Mt. Shasta's (City) municipal sewer collection system and treatment facilities for a~l. or a portion of, the Facility's waste.

Collection System The Mt. Shasta Sanitary Sewer Collection System is owned and operated by the City and is regulated under WDRs for Sanitary Sewer Systems (Water Quality Order No. 2006-0003-DWQ). The Sanitary Sewer Systems WDR requires public agencies that own and operate sanitary sewer systems to develop and implement sewer system management plans and report all sanitary sewer overflows (SSOs) to the State Water Board's online SSO database. The sewer system management plans include provisions to provide proper and efficient management, operation, and maintenance of sanitary sewer systems while taking into consideration risk management and cost benefit analysis. The scope of the EIR should address the potential impacts of the proposed project's wastewater alternatives on the City's sanitary sewer system and the City's ability to maintain compliance with the requirements of the Sanitary Sewer System WDR. Specifically, the proposed project will require the City to update their sanitary sewer system evaluation and capacity assurance plan and demonstrate to the Central Valley Water Board that the City sewer collection system can accommodate full production flows.

Wastewater Treatment Plant The Mt. Shasta Wastewater Treatment Plant 0/VWTP) effluent discharge to the Sacramento River and to a leach field on land owned by the US Forest Service is regulated pursuant to WDR Order R5-2012-0086 (NPDES No. CA0078051) (NPDES Permit). The 'NW.TP average dry weather design flow is 800,000 gallons per day (gpd) and the leachfield design flow is limited to 700,000 gpd. The WWTP is prohibited from discharging to the Sacramento River in the summer (15 June through 14 September) and therefore relies on their ability to produce recycled water for reuse at the Mt. Shasta Resort Golf Course and their leach field to dispose of WWTP effluent during the summer period. Currently the NPDES permit contains a compliance schedule for the City to comply with final effluent limitations for 5-day biological oxygen demand, total suspended solids, pH, and disinfection requirements. The deadline for compliance with these parameters is 23 November 2020. In addition, Time Schedule Order RS-2012-0087 established a compliance schedule for the City's WWTP to come into compliance with final effluent 'limitations for ammonia, copper, and zinc. The deadline for compliance with these parameters is 1 June 2017. The EIR should address whether the alternatives provided wilt have any impact on the City's ability to maintain compliance with these compliance schedules and the requirements of the NPDES permit.

The proposed waste disposal alternatives to the collection system include industrial waste flows greater than 25,000 gpd and waste flows that make up 5% or more of the average dry weather hydraulic capacity of the VWITP. For this reason, the Facility would be considered a Significant Industrial User (SIU), as defined in 40 CFR Part 403.3(t), and be the City's first SIU for the WWTP. The City currently does not administer a Pretreatment Program to manage industrial waste discharges to its collection system and therefore the EIR should assess the need for a program and/or control mechanisms to ensure that the City's regulatory obligations associated with their collection system and treatment facilities are met. Specifically, the EIR should assess the proposed industrial discharge to the collection system to determine if the nature and volume of the discharge may cause inhibition or pass-through of pollutants, sludge contamination, or upsets atthe WWTP.

Thank you for your June 10, 20161etter to ChiefSisk notifying the Winnemem Wintu Tribe (WWT) of the opportunity to comment on the Crystal Geyser Bottling Plant Project EIR (Proposed Project). Please note that The Native American Heritage Commission (NAHC) has added the WWT to their list of tribes having aboriginal territory and many cultural/historical sites in Siskiyou County. NAHC has assured the Tribe that they will be sending their corrected list to the County of Siskiyou.

The Tribe officially requests that the County of Siskiyou notify WWT of any project that occurs within the County.

WWT believes that the Proposed Project will have significant adverse effects on Tribal Cultural Resources and requests an AB52 consultation with the County.
