Statutory Changes Pursuant to the definition for “used tire” in 27A O.S. § 2-11-401.1: waste tire” is referred to as “used tire.” “Tire dealer” means any person engaged in the business of selling new and used tires to final consumers, not for resale. Effective July 1, 2019, “automobile” means every motor vehicle constructed and used for the transportation of ten persons or less, including the driver, or used for the transportation of property. However, the automobile’s gross vehicle weight rating may not exceed sixteen thousand (16,000) pounds (example: car, SUV, pickup truck and other such passenger vehicles). Tire manufacturers, retailers, wholesalers and retreaders can store up to 2,500 tires if they are in compliance with applicable Oklahoma Tax Commission requirements pursuant to 27A O.S. § 2-11-401.7. Pursuant to 27A O.S. § 2-11-401.7, it is unlawful to remove more than ten used tires or reusable tires from the possession of the dealer unless the dealer provides a manifest form, approved by the Department of Environmental Quality (DEQ). A manifest form documents the removal and approved disposition or sale of the tires and accompanies the tires in transport. It is unlawful to transport used or reusable tires in violation of rules enforced by the DEQ. A tire recycling fee is collected on any tire sold in Oklahoma that meet the requirements in 27A O.S. § 2-11-401.2 All fee changes effective July 1, 2019 (see reverse).
