Petition

To obtain TAA reemployment services and benefits a group

of workers must first file a petition with the U.S Department

of Labor's Trade Adjustment Assistance Program (TAA)

requesting certification as workers adversely affected by

foreign trade. Once a complete petition is filed, the Office of

Trade Adjustment Assistance (OTAA) initiates an

investigation to determine whether a group of workers

meets the group eligibility requirements. If the worker

group meets the group eligibility criteria, a group eligibility

certification will be issued. This certifies that the workers of

the group are eligible to apply for Trade Adjustment

Assistance benefits.

Approved Training

Contract

An approved contract is a defined written plan for training a

Trade Impacted Worker and is signed by the Impacted

Worker, Training Provider/Third Party Vendor, and ODJFS

Trade Staff. There are 6 criteria that must be met for an

approved Training Contract:

1. There is no suitable employment for the worker.

2. The worker would benefit from training.

3. There is a reasonable expectation of employment

following training.

4. Training must be reasonably available to the worker.

5. The worker is qualified to obtain and complete the

training and has adequate financial resources to complete

the training, which may extend after income support is

exhausted.

6. The training is suitable and available at a reasonable cost.

Waiver In order to qualify for Trade Readjustment Allowance (TRA)

benefits, customers must either be enrolled in training OR

receive a waiver that postpones the training requirement.

When waivers are applicable, their purpose is to assess,

verify eligibility and preserve TRA benefits for customers

who meet eligibility guidelines.

Training Benchmark The TAARA establishes new training benchmark

requirements for workers participating in training plans with

durations of 26 weeks or greater. Training benchmarks must

be established at the start of the training plan to monitor

the worker’s progress towards completion within the

maximum duration of weeks in training. Two specified

standards that must be met in order to receive Trade

Adjustment Assistance: (1) the customer must be in good

academic standing and (2) must be on pace to complete the

training on time.

To receive income support in the form of Trade

Readjustment Allowances (TRA), a worker must either be

enrolled in training or receive a waiver of the training

requirement within:

• 26 weeks after certification: or

• 26 weeks after the most recent qualifying separation; or

• The enrollment deadline may be extended 45 days for

extenuating circumstances.

(Note: OWCMS needs to create Contract or Waiver by the

Deadline)
