June 30, 2019 Introduction The Office of Real Estate and Land Management (REALM) was created by the 131st General Assembly’s Senate Bill 293 in 2016, amending Ohio Revised Code Chapter 1504. REALM’s duties include coordinating and conducting real estate functions for the Ohio Department of Natural Resources (ODNR), including land and easement acquisitions, sales, exchanges, donations, leases, licenses, Articles of Dedication, and transfers to other governmental agencies. The REALM staff works closely with the Divisions of Parks & Watercraft, Wildlife, Forestry, Natural Areas & Preserves, and other divisions and offices to provide services and solutions to real estate projects REALM also administers the real estate services associated with Ohio’s historic canals that are part of ODNR’s ownership, including the Miami & Erie Canal in western Ohio and the Ohio & Erie Canal in eastern Ohio. As part of its real estate function, REALM maintains and updates the inventory of state-owned lands, including parks, wildlife areas, nature preserves, forests and other lands administered by ODNR. The Inventory is managed through a comprehensive database that includes the record of property transactions since ODNR was created by the Ohio Legislature in 1949 in addition to available historical transactions prior to 1949. The Land Inventory Summary report provides detailed information on Fiscal Year (FY) 2019 transactions and summary tables of land holdings by division and facility as of June 30, 2019. The ODNR’s land acres of 546,270 acres were acquired at a cost of over $263 million at the time of acquisition. A conservative estimate of the current value of ODNR’s real property holdings would be in excess of $2 billion. In FY 2019, there were a number of land acquisition highlights, including the acquisition of an additional 118 acres to the Lakeside Daisy Nature Preserve on the Marblehead Peninsula in Ottawa County that will help protect the endangered Lakeside Daisy as well as provide valuable habitat for migratory birds, including the federally endangered Kirtland’s warbler and bald eagle. The Division of Forestry had a couple of notable acquisitions, including the creation of a new state forest area with a donation of 350 acres near Saint Clairsville in Belmont County and an additional 123 acres added to Pike Forest. The Division of Parks & Watercraft continued to focus acquisitions on properties needed for the dam improvements at Buckeye Lake and Portage Lakes State Parks. The Division of Wildlife established two new wildlife areas in FY 2019. The Eagle Creek Wildlife Area in southwest Brown County was created with the acquisition of 1,825 acres at a cost of over $4.9 million that was funded by the Land and Water Conservation Fund, the Ohio Department of Transportation and Wildlife funding programs. Ducks Unlimited provided funding assistance for

the Division to acquire 719 acres in Hardin County at a cost of $1.2 million. This new wildlife area provides excellent birding opportunities with its habitat of grasses, wetlands and small woodlots. The Land Inventory Summary illustrates ODNR’s diversity of land holdings to fulfill its mission “To ensure a balance between wise use and protection of our natural resources for the benefit of all.” Types of Real Estate Transactions REALM provides a depth of real estate assistance for the Department, providing real estate services for not only acquisitions, donations, transfers, easements and sales, but also for a variety of transactions not reported as part of the land inventory. The table below illustrates the diversity of transactions that REALM processed during FY 2019.

Canal Program

Ohio’s Miami & Erie and Ohio & Erie canals were once active transportation corridors to transport goods to market. Today, sections of the canals are still active transportation corridors as state highways and recreational trail corridors, such as the Towpath Trail in Cuyahoga Valley National Park. Other sections of the canal have been incorporated into ODNR land-holdings, such as Blackhand Gorge Nature Preserve in Licking County and Monroe Basin Wildlife Area in Coshocton County.

In addition to the 309-mile long Ohio & Erie Canal and the 249-mile long Miami & Erie Canal and their associated reservoirs (Buckeye Lake, Grand Lake St. Mary’s, Indian Lake, Lake Loramie, and Portage Lakes), the canals have several feeders and connecting canals that about double the mileage of canals in the state and connect cities and counties not on the main canal, such as the Columbus feeder and the Hocking canal.

Until 1989, the canal program was managed by the Department of Public Works and then the Department of Administrative Services. In 1989, when ODNR became the lead agency for the canals, the administration and real estate services of the program have evolved as the canal system provides complex real estate issues yet also provides outdoor recreational opportunities for the public. The Division of Parks & Watercraft manages the canal reservoirs, such as Buckeye Lake and St. Mary’s Lake, and the watered sections of the canal corridors, such as the canal south of Akron. REALM administers the remainder of the canal program and provides the real estate services for various uses of the canal.

Currently there are approximately 200 active leases that are administered by REALM that are invoiced annually providing about $300,000 in revenue to ODNR. The leases are typically for 15 years, though there are several renewable 99-year leases that were negotiated in the 1930’s-1950’s for railway and utility purposes. The lease agreements provide for revaluation of value at various intervals from 3 to 15 years. Typically, about 20-25% of the canal leases need revalued or a renewal lease prepared each year.

Another type of lease agreement utilized in the canal program is a Lease Management Agreement, or LMA. For example, the City of Akron and the City of Barberton have LMAs for providing stewardship and management of the historic canal towpath that is used for recreational trail use and links to the Towpath Trail in the Cuyahoga Valley National Park, providing a long-distance trail for walking, hiking, bicycling, fishing, and jogging. In addition to leases, REALM staff handles licenses, easements, right-of-entries, transfers, and sales. The process for a transfer or sale of canal land can be lengthy as it provides opportunity for comment from the public and local governmental agencies, and the proposed canal land requested is evaluated for recreational, ecological, and cultural values.

In FY 2019, there were four transfers to local park districts, townships and cities for recreational and community use such as Paulding County Parks Board requested to acquire the remaining canal corridor in the county for development of trails and outdoor recreational opportunities and to interpret the history of the canal system. REALM staff also assists land-holding divisions in real estate transactions that include the historic canal such as the transfer of easements along the Ohio & Erie Canal in Summit County for the Division of Wildlife’s development of protective structures to prevent aquatic nuisance species movement between watersheds.

Managed and Dedicated Lands

In addition to land holdings by ownership or easement, ODNR manages or oversees thousands of acres throughout the state via leases, land management agreements, memorandums and Articles of Dedication. The properties are managed, but not owned, by ODNR to advance conservation and recreation initiatives. For example, the Division of Parks & Watercraft and the Division of Wildlife hold lease agreements with the U.S. Army Corps of Engineers (USACE) for several reservoirs and surrounding lands that are incorporated into state park and wildlife areas for management and public enjoyment, such as Dillion State Park in east central Ohio. USACE retains flood control management and the state provides public recreation opportunities such as boating, swimming, fishing, and camping.

The Division of Natural Areas & Preserves utilizes Articles of Dedication to protect natural resources, including natural habitats, rare plants, and unique land features. Articles of Dedication are special agreements described under Ohio Revised Code 1517.05. Dedicated lands have restrictive deed language to protect the property from modification and encroachment and to preserve the property’s unique characteristics.

Federal Interest

Over the years, ODNR has acquired and improved lands utilizing various federal grant funding programs. The terms and conditions that apply to lands with federal interest are dependent upon the statutes and regulations that authorized the funds but are often long-term or perpetual. For example, the federal Land and Water Conservation Fund (LWCF) restricts lands acquired, improved, developed and/or rehabilitated with LWCF program funds and may also restrict surrounding park land. The summary tables on the following pages note state-owned lands that utilized LWCF funding. In 2018, REALM updated Ohio’s Statewide Comprehensive Outdoor Recreation Plan (SCORP) that is required by the National Park Service for the state to receive LWCF funds. The SCORP is available on ODNR’s website.

Other federal interests, such as the U.S. Fish & Wildlife Service’s Fish Restoration Program and Wildlife Restoration Program are tracked by the land holding divisions.

GIS Maps

The GIS maps provided are developed by ODNR’s Office of Information Technology (OIT) and may also be viewed on ODNR’s website. OIT works with REALM and the land-holding divisions to update the GIS with real estate transactions.

Forestry The Division of Forestry manages state forest areas that range from 320 acres to over 64,000 acres. Shawnee State Forest, the largest state forest, has nearly 8,000 acres designed as wilderness and is often referred to as “the Little Smokies of Ohio.” The Division manages for multiple uses including sustainable timber production, wildlife habitat, soil and water protection, and outdoor recreation. The acquisition of state forest lands officially began in 1916 and the majority of state forest land was purchased prior to 1950. However, acquisitions continue and in 2019, a new forest area, Cravat Forest, was created in Belmont County.

Natural Areas & Preserves

The Division of Natural Areas & Preserves is responsible for managing lands in Ohio that represent examples of the state’s natural landscapes, natural vegetation, and geological history. In FY 2019, the Scenic Rivers program was transferred to the Division of Natural Areas & Preserves from the Division of Parks & Watercraft.

Parks & Watercraft Originally created in 1949 as the Division of Parks, the state’s park system continues to grow with new parks and improvements to serve visitors. The Division also manages water supply lakes, a legacy of the canal era and now familiar to many as popular boating and recreation lakes, including Buckeye Lake, Grand Lake St. Mary’s, Indian Lake, Lake Loramie, and the Portage Lakes.

Canals Ohio’s Miami & Erie and Ohio & Erie Canals were built between 1825 and 1845 as a result of the Ohio Canal Act of 1825 that provided a Canal Commission to build two canal systems in the state. The Act gave authority to the State to take land necessary to build the canals. The Miami & Erie Canal connects Toledo and Cincinnati and the Ohio & Erie Canal connects Cleveland to Portsmouth.
