1/ "Minster" or "Ministry" means the Minister orMinistry of Infrastructure, respectively;

2/ "Association" means an association established bypersons and enterprises engaged in publiccommercial road transportation and registered inaccordance with this Proclamation;

3/ "Commercial Road Transport" means thecarrying by a natural or juridical person, orpassengers or goods for hire, remuneration orprofit, classified as either private or public asfollows:

a) "Private Commercial Road Transport"means if the vehicle used for carryingpassengers or goods is owned by theenterprise, and

(i) in the case of goods being transported, thegoods are owned by the enterprise or havebeen entrusted to it for the purpose ofrepairs or transportation by it and thetransportation of said goods is necessaryand complementary to the principalcommercial activity carried out by theenterprise; or

(ii) in the case of passengers being transported,the passengers are employees of theenterprise and are being transported to orfrom their place of work or are engaged inthe business of the enterprise;

b) "Public Commercial Road Transport" meansall commercial road transport not classifiedas private;

4/ "Disciplinary Directives" means directives issuedby the Minister in accordance with whichdisciplinary measures to be taken, decided andenforced;

5/ "Highway" means a road administered and designatedas such by the Ethiopian Roads Authority;

6/ "Trip Schedule" means yearly, monthly, weeklyor daily program fixed for the movement ofpublic commercial road transport vehicles;

7/ "Route of Operation" means a place of departureand destination to be determined by theAuthority where public commercial roadtransport vehicles are assigned to operate.

8/ "Driving License" . means a permit to drive amotor vehicle issued in accordance withregulations and directives issued under thisProclamation;

9/ "Federal Driving License" means a permit todrive a motor vehicle issued to foreigners basedon the principle of reciprocity or to Ethiopiansgoing abroad for tour, business or officialduties in accordance with regulations anddirectives issued under this Proclamation;

10/ "Passenger" means any person riding in avehicle, other than the driver, cashier or any

other person assigned to work on a vehicle;

11/ "Follow-up" means the ascertainment of theproper implementation of road transport laws,regulations, directives, standards and decisions;

12/ "Road" means any road, street, highway or anyother travel route, customarily used by vehiclesother than private roads not open to all traffic;

13/ "Vehicle" means any type of wheeled vehicle,other than special military vehicles, for use onroads classified as carriage, bicycle, motorvehicle, semi-trailer and trailer;

14/ "Carriage" means any vehicle other than abicycle, a motor vehicle, a semi-trailer and atrailer;

15/ "Bicycle'" means a vehicle moving by themotivepower of the person operatingthe same;

16/ "Motor Vehicle" means a vehicle moving bymechanical or electrical power, classified astruck, motorcycle, private motor car, publicservice vehicle, truck tractor and specialmobile equipment;

17/ "Truck" means a motor vehicle constructedoradapted for use and used primarily for theconveyance of goods of any description andincludes a truck tractor;

18/ "Motorcycle" means a 'motor vehicle with lessthan four (4) wheel&,' the weight of which,exclusive of any side-car attached thereto, doesnot, when, unl~d~n exceed four , h~dredkilogram~; 0'

21/ "Commercial Motor Car" means a publicservice vehicle having accommodation for notmore than twelve passengers;

22/ "Motor Omnibus" means a public servicevehicle having accoIIUIlodation for more thantwelve passengers;

231 '~TruckTractor" means a motor vehicleconstructed or adapted for use and usedprimarily for drawing other vehicles, and soconstructed as to carry no load other than a partof the weight of the vehicle and load beingdrawn;

241 "Special Mobile Equipment" means any vehicledesigned, adapted or used for agricultural,horticultural, livestock raising, roadconstruction, building, digging or any othersimilar operation; this term does not includevehicles designed or used for the transportationof persons or goods;

251 "Semi-tra,iler" means a vehicle constructed oradapted for use ~d used for use and used forcarrying persons or goods and being drawn by amotor vehicle, and so constructed,. that somepart of its weight and that of its load rests uponor is carried by another vehicle;

261 "Trailer" means a vehicle which has noindependent, motive power and which iscapable of being attached to and drawn by amotor vehicle, and so constructed that nopart of its weight rests upon the motorvehicle by which it is drawn, but shall notinclude a side car attached to a motorcycle;

27/ "State" means a state specified in Article 47 ofthe Constitution and includes the Addis Ababaand Diredawa City Administrations;

28/ "Cross-country Road Transport Service" meansanycQmmercial road transport serviceconducted on roads linking two or more thantwo States;

29/ "International Road Transport Service" meansany road transport service or movementconducted on the roads across the boundaries ofEthiopia;

30/ "Transport" means any transport serviceundertaken on road, railway and water bymotor power carriers;

31/ "Ship" means a seaplane carrier moving byengine power;

32/ "Bureau" means a State executive organ incharge of enforcing transport laws;

33/ "Train" means any vehicle moving on the railsof a railway lines;

34/ "Rail" means any travel route used by train;

35/ "Seafarer" means any person including master,pilot and apprentice employed or assigned onboard on Ethiopian ship or any cross countrywater transport vessel.

Scope of Application

Without prejudice to the powers and duties givenby law to State Bureaux, this, Proclamation shallapply:

1/ to the use of any road within Ethiopia, vehicleusing the roads and their drivers;

2/ to the.use of any railways within Ethiopia,trains using the railwaysand their operators;

3/ to Ethiopian ships and seafarers;

PART TWOTRANSPORT AUTHORITY'

Establishment

11 The Transport Authority (hereinafter the"Authority") is hereby established as anautonomous public authority having separate.juridical personality.

Ministry. .

Head Office

The Authority shall have its head office in AddisAbaba and may establish branch offices at anyother place, as may be necessary.

6. Objectives of the Authority

The Authority shall have the following objectives:

11 to promote an ,efficient, adequate, economicaland equitable transport system;

21 to ensure iliat public transport services aresafe and comfortable;

31 to develop domestic andintemational transportnetwork; and

41 to promote the development of all aspects oftransport.

7. Powers and Duties of the Authority

The Authority shall have the powers and duties to:

a) prepare and submit policy proposalsto the Ministry relating to transportand implement same upon approval;

b) follow up the proxision of safe, efficient,adequate and equitable transportservices to the public;

c) implement and enforce governmentpolicies and laws relating to transport aswell as treaties to which Ethiopia is aparty;

d) cause the development of domestic andinternational transport service network;

e) develop an integrated system oftransport for passengersand goods;

f) issue and follow up the implementation ofdirectives relating to conditions under whichpassengers, goods and mail may betransported by commercial transport;

g) collect and compile, on regular basis,any information and statistical datarelating to transport;

h) render, as may be appropriate, training andconsultancy s~rvices relating to transportservice; establish and operate traininginstitutions as may be necessary;

i) undertake studies and prepare plans andprograms to promote the development ofall aspects of transport,encouragestudies to be conducted and implementsame upon approval;

j) in cooperation with the concerned organprepare and submit and, upon approval,implement standards relating to the smoke,gas, .

vapour and the like emitted from theexhaust pipes of vehicles and trains with aview to preventing pollution taking intoaccount international criteria and thecapacity of the country;

f) .manufacture plates to be affixed onthosevehicles to be registered by the Authorityor State Bureaux;

g) approve tariff proposed by persons,organizations or associations engaged incross-country and internationalpassenger transport, taking into accounttheir benefit they should get ITom theservice provided and the capacity of theusers topay;

h) issue a transit permit to vehicles andtheir drivers engaged in internationalcommercial road transport or otherrelated.servicesand followup same;

i) issue directives for registration andinspection of vehicles and follow upsame;

j) issue and follow up the implementationof directives relating to the licensing ofdriving schools and instructors;

k) issue and supervise the. implementationof directives. relating to.'the certificationof' the .technical competence, licensingand grading of garages engaged in therepair and maintenance ofvehicIe;

v) Encourage the expansion of intermediatetransport machinery in compliance withlandscape of the country.

3/ notwithstanding the provisions of Article 3 ofthis Proclamation, with respect to roadtransport in cities accountable to the FederalGovernment:

a) promote the expansion of the transportservice; cause the construction andadminister bus and. taxi stops andterm~nals;

b) register vehicles, undertake annualtechnical inspection and follow up;

c) organize individuals and enterprisesengaged in transport services; design andimplement mechanisms. on theeffectiveness of traffic management;provide capacity building support;

d) issue certificate of competence toindividualS and enterprises engaged intransport and garage services;

e) issue license to driving lesson institutionsand trainers; issue driving license;

t) follow up arid suspend the operation ofvehicles that could affect the safety ofthepublic;

g) carry out other activities related to thecities' transport services;

8. Management of the Authority

The Authority shall have:

11 a General Manager to be appointed by theGovernment upon the recommendation ofthe Minister; and

2/ the necessary staff.

Powers and Duties of the General Manager

11 The General Manager shall, subject to thegeneral directives of the Ministry, directand administer the activities of theAuthority.

2/ Without limiting the gener~lity of theprovisions of Sub-Article (1) of thisArticle, the General Manager shall:

a) exercise the powers and duties vested inthe Authority under this Proclamation;

b)"

employ and administer the employees ofthe Authority in accordance with thefederal civil servants laws;

c) prepare and submit to the Ministry thework program and budget of theAfuthority; and implement same uponapproval;

d) effect payments in accordance with theapproved budget and work program of theAuthority;

e) represent the Authority in all itsdealings with third parties;

f) prepare and submit to the Ministry annuloperational and financial reports of theAuthority.

3/ The General Manager may delegate part of hispowers and duties to the officials and otheremployees of the Authority to the extentnecessary for the efficient management of theactivities of the Authrotiy; provided, however,that the prior consent of the Minister isrequired where such official is to act on behalfof the General Manager for more than 30days.

10. Budget

The budget of the Authority shall be drawnfrom the following sources:

11 license fees and service charges collectedby the Authority;

21 governmental subsidies; and

3/ any other source. ,

11. Books of Accounts

II The Authority shall keep complete andaccourate books of accounts.

2/ The books of accounts and other financialdocuments of the Authority shall beaudited annually by the Auditor Generalor by an auditor designated by him.

PART THREE

PUBLIC COMMERCIAL ROAD TRANSPORTACTIVITIES AND PUBLIC COMMERCIAL

ROAD TRANSPORT ASSOCIATIONS

12. Undertaking Public CommercialRoad Transport Activities

11 Any individual or an enterprise establishedin accordance with the law may engage inpublic commercial road transport.

21 Persons and enterprises, licensed to engagein public commercial road transport, maycarry out their activities either bybecoming members of associations to beestablished in accordance with Article 13of this Proclamation or on their ownwithout becoming members of anyassociation.

13. Establishment of Associations

1/ Persons and enterprises engaged in publiccommercial road transport may establishand join public commercial road transportassociations.

21 The Authority shall, in order to ensure theprovision of competitive road' transportservices, determine the number ofmembers that may join an association.

3/ Subject to the provisions of Sub-Article (2) ofthis Article, any association shall be obliged toaccept the membership of any person orenterprise engaged in public commercial roadtransport provided. that such person orenterprise satisfies the requirements ofmembership as provided for in the statutes ofthe association.

4/ No person or enterprise engaged in publiccoIrimercial road transport. shall belong,within the same route of operation, tomore than one associationat a time.

5/ The Authority shall issue model statutes ofassociations.

14. Applicable Laws

The provisions of Article 404-482 of the Civil Codeshall, in so far as they are not inconsistent with theprovisions of this Proclamation, apply to publiccommercial roa<i.transport associations; provided,however, that.. all responsibiliti~s IiSsigned to theMinistry of Justice and the Office of Associationsby said provisions are, with respect to suchassociations, hereby transferred to the Authority.

15. Registration of Associations

1/ Every association shall, promptly upon itsestablishment, submit to the Authority anapplication of registration together with itsstatutes.

2/ When an application of registration issubmitted to it, the Authority shall, uponascertaining that:

a) the statutes are consistent with thelaw and model statutes issued by it;and

b) other requirements of any applicablelaw are fulfilled;

and upon the payment of the prescribedfee, register the association.

3/ If the Authority refuses... to register theassociation, it shall,.within 7 days so notify theassociation giving reasons therefore. If theAuthority fails to take any action with respectto the application for registrations within thespecified time, said association shall bedeemed registered. .

16. Renewal of Registration

Associations shall have the following purposesand duties:

1/ to prepare trip schedules for public servicevehicles of their members; and enforce sameupon appro"al by the Authority, as the casemay be;

2/ to establish and operate common facilitiessuch as public service vehicles' termina!s,road stations, freight distripution offices,repair centers, fuel depots, spare parts shopsand the like;

3/ to properly keep necessary information anddocuments in accordance with directives tobe issued by the Authority; and submit sameto the Authority when requested;

4/ to promote, among their members, theawareness and observance of laws,regulations and directives relating to roadtransport;

5/ to promote awareness and facilitate trainingsystem. with a view to minimizing' traffcaccidents caused by vehicles of theirmembers; and

6/ to perform other lawful activities relating totheir duties.

18. Establishment of Data Center

20. Exclusive Rights and Contracts

11The Authority may, where it finds it necessary, issuedirectives that enable the granting of exclusive orrestricted franchises to persons, associations ororganizations enga.ged in cr9ss-country andinternational commercial road transport within aview to encouraging investors to engage in theprovision of public commercial road transport tolocalities where there is no such ~rviCeor where it isinadequate.

2/ Nothing herein contained shall, be deemed toprohibit or restrict the right of any shipper to,conclude exclusive contracts of carriage withany person or enterprise engaged in publiccommercial road ~ansport.

21. Duty to have Vehicles Registered

11 No vehicle, except special mobile equipment with amaximum speed of less than 20k.m per hour,shall be driven or operated on any road unless saidvehicle: '

a) has been registered in accordance withregulations and directives issuedhereunder; and

b) bears the appropriate plates or otheridentification marks.

2/ The absence of the appropriate registrationplates or other identification marks shallconstitute prima facie evidence that thevehicle has not been registered and the policemay detain said vehicle pending the makingof appropriate inquiries.

2/ The organs referred to in Sub-ArtiCle (1) ofthis Article, shall in exercising the powersand duties delegated' to them, follow andobserve proclamations, regulations, directivesand standards relating to transport set by theAuthority.

25. Repeal and Savings

1/ The Road Transport Regulation Proclamation,No. 14/1992 is hreby repealed.

26. Transfer of Rights and 'Obligations .

2/ The rights and obligations of the Addis AbabaCity Transport Authority and the Dire DawaTransport Agency are hereby transferred tothe Autho~ty, and they shall be organized asbranch offices of the Authrotiy.

27. Transitory Provisions

11 Associations established pursuant to. Proclamation

No. 14/1992 shall be considered as beingestablished by this Proclamation and shallcontinue their activities.

2/ Until the States issue their own law theprivisions of this Proclamation shall apply tothe States in the affairs related to transport,

28. Power to Issue Regulations

The Council of Ministers may issue Regulationsfor the proper implementation of thisProclamation.

29. Penality

Any person who violates the provisions of thisProclamation and Regulations issued hereundershall be punishable in accordance with the PenalCode.

30. Effective Date

This Proclamation shall enter into force on the6thday of August, 2005.
