CAPITAL IMPROVEMENTS AND STREET MAINTENANCE COMMITTEE ___________________________________________________________________________________________ Date of Meeting: March 14, 2019, at 5:30 p.m. in the Council Chambers of City Hall. Members Present: Gisselman, McElhaney, Rasmussen, Thao, Kellbach Also Present: Mayor Mielke, Lindman, Buckner, Wesolowski, Niksich In compliance with Chapter 19, Wisconsin Statutes, notice of this meeting was posted and received by the Wausau Daily Herald in the proper manner. Noting the presence of a quorum, at approximately 5:30 p.m. Chairman Gisselman called the meeting to order. Public Comment for matters not appearing on the agenda No one came forward to offer public comments. Approval of minutes of the February 14, 2019 meeting Rasmussen moved to approve the minutes of the February 14, 2019 meeting. McElhaney seconded and the motion carried unanimously 5-0. Discussion and possible action on a preliminary resolution to pave the alley bounded by Fleming Street, Weston Avenue, Emerson Street and Fairmount Street Wesolowski explained this alley was a part of the asphalt overlay project last year. The bid came in too high so the project was not completed. If approved, another public hearing will be held. Resident are assessed the cost of the asphalt. Rasmussen moved to approve a preliminary resolution to pave the alley bounded by Fleming Street, Weston Avenue, Emerson Street and Fairmount Street. Kellbach seconded and the motion passed unanimously 5-0. Discussion and possible action on renewing permit to operate 90,000 lb. vehicles on city streets (3M) Wesolowski stated this permit allows 3M to operate 90,000 lb. vehicles. The 5 year permit is up for renewal. There have been preliminary discussions with 3M and they have requested a 10 year permit. Todd Bollert, site manager for 3M at 144 Rosecrans Street, indicated there is a resolution for a 5 year renewal period on their weight limits for their trucks. In 2012 the state removed the sunset clause and no longer requires permitting through the state. The original request was to remove that clause with the City as well, or extend from a 5 year to a 10 year permit. Rasmussen said part of the reason the City was content with the length of the permit was to keep an eye on the impact of the increased weight on our infrastructure on both 1st Avenue and 3rd Avenue. This year we will be rebuilding 1st Avenue and the trucks will not be traveling as close to the edge as they are today. She asked if any adverse impacts have been noticed on 3rd Avenue, Business 51 as it goes to Merrill Avenue, or 1st Avenue. Wesolowski noted the truck route map and stated Campus Drive is concrete and Business 51 is an asphalt overlay. The area seeing distress is the asphalt pavement from Crescent Drive to Union Avenue, which was constructed about 15 years ago. South of Union Avenue the roadway is concrete, which tends to hold up better. The returning trucks are empty or at least lighter. Bollert stated many of the northbound trucks may carry fines but are lighter. Wesolowski indicated the most distressed section northbound is 1st Avenue from Sherman Street to Stewart Avenue, which will be reconstructed this year. 1st Avenue north of Stewart is concrete and turns to asphalt from Union Avenue to the north. The asphalt section from Union Avenue to Fernwood is seeing distress. He does not know if the distress can be 100% attributed to the truck traffic. There is obvious rutting on the outside lane for southbound traffic. The return route is not seeing as much distress. The entire section does need

CISM Committee March 14, 2019 – Page 2 to be overlaid as the asphalt is about 15 years old and cracking. Staff would like to have the two southbound lanes, from Fernwood to Union, milled and overlaid this year if the budget allows. Rasmussen asked if staff is supportive of extending the permit assuming overlay can be accomplished and new life is given to the road. Wesolowski would be alright with extending as the existing roadway is about 15 years old. Lindman has had a conversation with 3M on areas of rutting and they are willing to contribute to some of the overlay costs. Bollert said there is no question that the amount of traffic with the weights would have some impact. They are willing to share in that but at this point he cannot speak to what that would be. Lindman also would be supportive of a 10-year permit as the existing asphalt has been in place for 15 years. Rasmussen moved to renew the permit to operate 90,000 lb. vehicles on city streets with a 10-year window. Seconded by McElhaney. Thao asked what the new route will be for 3M during the reconstruction of 1st Avenue. Wesolowski said 3M’s route to the plant will remain the same and they will continue down 3rd Avenue. During construction, 3M will have to use Sherman Street for the return route, which is when the trucks are lighter. Rasmussen asked if 3rd Avenue will be used for the detour. Wesolowski replied 3rd Avenue will not be used for the detour as it is a one-way street. Thao asked if there will be a future discussion at CISM on the detour route and questioned if Sherman would be the best route. Wesolowski stated Thomas Street will also be under construction. Rasmussen noted that Sherman Street was hammered with traffic during the last Thomas Street project. If Sherman is used for the detour of 1st Avenue, there is a need for major speed control. Thao agrees with Rasmussen and asked that this be a future agenda item. Thao asked why there is a request to increase the permit from 5 years to 10. Bollert indicated 10 years would be easier for both parties if there are no concerns from the City. He has been in this position for a year and this caught him by surprise. Thao is interested in learning what the contribution to overlay costs would look like. Bollert stated this relationship is positive and they intend to do whatever they can to supplement and keep the relationship positive. There being a motion and a second, motion to renew the permit to operate 90,000 lb. vehicles on city streets with a 10-year window passed 4-1, with Kellbach the descending vote. Discussion and possible action on State/Municipal Agreement for Project ID 6999-18-07/77, North 6th Street from Horseshoe Spring Road to Evergreen Road Wesolowski explained that a State/Municipal Agreement is standard for any state project. Urban funding will be used for this project with a 50/50 cost share. This project would be a mill and overlay project. It was felt using funding for an overlay project would help make the money go further instead of using it for a complete reconstruction project. There is no real estate involved and a major environmental document is not needed with a mill and overlay project. McElhaney moved to approve the State/Municipal Agreement for Project ID 6999-18-07/77, North 6th Street from Horseshoe Spring Road to Evergreen Road. Seconded by Kellbach and the motion passed unanimously 5-0. Update on the pedestrian crossing at North 6th Street and Jackson Street Niksich stated at the last meeting the committee recommended staff meet with County staff to discuss this pedestrian crossing. Staff reached out to Brad Karger and discussed meeting. A Master Plan for this area is in the draft stages. Karger thought it would be best to meet with County staff once the Master Plan is adopted. A date has not been set at this point. The Master Plan will come to CISM eventually. When networking with County employees, Rasmussen would like the County employees encouraged to park in the Sears ramp as that crossing is safer. She understands that they want something better at 6th and Jackson but parking in that adjacent neighborhood is furthering an unsafe situation. She hopes that the work force is

CISM Committee March 14, 2019 – Page 3 encouraged to park in the ramp first and the lot across 6th Street as a last resort. Niksich will include this in their future discussion. Niksich has reached out to the DOT regarding pedestrian crossing signal options. Per the DOT, the RFB would cost approximately $10,000. Staff had estimated this at $7,000 because City staff was anticipated to install the units. Costs for the devices listed in the staff report would be about 25% lower if City staff installs. Gisselman added that stripping of the intersection and signage will occur this spring. Wesolowski clarified that signage has already been installed and the crosswalk painting will be freshened up this spring. Discussion and possible action on amending the parking ordinance related to city wide parking Lindman indicated after recent snow emergencies, it was asked to have a discussion on whether there should be restricted parking city wide. Rasmussen said garbage and plow trucks cannot get through neighborhoods that have narrow streets when cars are parked on both sides. Then people call and complain that their street wasn’t plowed. During a snow emergency, fines can be issued which are $100 each. One would think a $100 fine would get someone’s attention. In most cases in her district, there are driveways people can use but they just do not want to play musical cars so the car they want to leave with in the morning is left on the road. In winter one cannot navigate that way. There are some cars where there are a couple $100 tickets sticking under the wiper and the owner is not around. She would like a better way to manage this, which may mean going to year round odd/even enforcement. As of last week it was thought that Lindman or the Police Chief had the authority to issue a temporary parking restriction for overnight parking. However, according to the City Attorney, unless the entire City is posted they cannot make that declaration. When there are streets that are one car length wide and there is four feet of snow on the boulevard, it is not reasonable to post signage. She wonders how Mosinee could accomplish a goal like this in one day with a phone call to the media. She is looking to network between CISM, DPW and parking enforcement to find a better way to manage this. In a normal snow year, it is rough at this time of year. This year it is really bad. In the core of the City there are some streets that are narrow to begin with. She is looking for a proactive solution and loves the $100 fine, but she does not know that is entirely effective. In Minneapolis when it snows if you do not have your car off the street, they have to go to the impound and pay to get their vehicle back. We do not have the infrastructure or logistics to do that. She is looking for input on how we can do this better because the garbage company, bus drivers, plow drivers and residents complain. Rasmussen said one suggestion would be to enforce odd/even parking year round and from November to April parking on the street would not be allowed between the hours of 2:00 am and 6:00 am. When the plows are out overnight trying to get snow off the road, we should not have to declare a snow emergency every time it snows. It gets to a point where people are desensitized to a snow emergency if too many are issued. Thao is glad this was brought up as this has been a rough winter and snow is not going away. She also wants to think about those that do not own homes. A lot of people do not have garages or driveways. She challenged City staff to help develop some opportunities for the committee to review how we combat snow removal when vehicles are on the street. She appreciates the conversation regarding odd/even parking for narrow streets but there is still a concern for those that do not have a driveway. She would love to hear potential opportunities before next season. Buckner stated from a law enforcement aspect, they rely on the ordinance and/or state statute. State statutes allow the local authority to adopt parking enforcement and do additional things beyond state statue as long as they do not override issues. They rely on the City Attorney’s office to create the ordinances that allow them to enforce. Part of the current ordinance makes a distinction between declaring and posting. Staff could draft something to meet the need we are trying to address. The existing ordinance seems to prevent the quick response. Going forward there are options they can discuss and brainstorm to come up with solutions. When dealing with parking disputes, one of the most common issues is alleys are plowed in and residents cannot park there. There are limited solutions. He believes there is an accommodation somewhere in between. Alternate-side parking year round does pose problems with posting and navigating individual parking concerns. There are things to consider if drafting an overall ordinance for odd/even parking. Staff can research how other cities handle this. One idea

CISM Committee March 14, 2019 – Page 4 would be to have alternate side parking during a snow emergency rather than eliminating parking all together. All on-street parking could be eliminated during severe snow events. An alternate side snow emergency policy would be consistent with overnight parking and would alleviate issues with people who do not have anywhere else to park. Rasmussen said this is a discussion she wants to have and wants to pave the way for Lindman or the Police Chief to have an expedited solution when there is a real problem. She is hoping there is a way to amend the ordinance to substitute public notice for physical posting. She hopes a media release, notice on the website and Facebook, would work as a substitute to posted signage in an emergency situation. The public is getting more of its information electronically than ever before. Lindman stated staff will work on this and bring options back. Future agenda items Gisselman noted that the parking issue will be brought back at some point as well as the detour route for 1st Avenue. Wesolowski added that a construction update will be provided at the next meeting. Adjourn Thao moved to adjourn the meeting. Kellbach seconded and the motion carried unanimously 5-0. Discussion and possible action on approving a 55 foot wide driveway for 141 West Thomas Street exiting onto South 3rd Avenue (Kolbe & Kolbe) BACKGROUND Kolbe and Kolbe is requesting to install a 55 foot wide driveway at 141 West Thomas Street. See the attached plan. Section 12.20.040 of the Wausau Municipal code requires Common Council approval on driveways in excess of 42 feet. This entrance/exit onto S. 3rd Avenue will become the primary exit out of the Kolbe & Kolbe facility during and after the reconstruction of Thomas Street. The current driveway for Kolbe & Kolbe onto Thomas Street will become a right in-right out only driveway when the project is completed. Kolbe & Kolbe requires this large of a driveway to accommodate truck turning movement. FISCAL IMPACT Engineering is working with Kolbe & Kolbe on the costs for this driveway. WPS will need to move electrical poles, the Parks Department will need to remove a tree and the driveway will need to be constructed. The exact costs of each of these elements in unknown at this point. STAFF RECOMMENDATION Staff recommends approving the 55 foot wide driveway at this location. Engineering is proposing to place the above no parking restrictions on S. 3rd Avenue. See the attached map. Kolbe and Kolbe is requesting to install a 55 foot wide driveway at 141 West Thomas Street. AGENDA ITEM Discussion and possible action on a preliminary resolution to hold a public hearing to vacate the alley bounded by West Bridge Street, Quaw Street, North 1st Avenue and North 2nd Avenue BACKGROUND Petitioner is requesting vacation of the above referenced alley. He has purchase agreements with the property owners except the two at 621 N 2nd Ave and 624 N 1st Ave. The petitioner is proposing to redevelop the property. The two homes that will remain will each be given ½ of the alley abutting their property, neither of these homes have driveways to the alley as they both exit out to their respective avenues.

This is action today recommends a public hearing be held to gain public input related to the proposed vacation. The following is the process for street vacation:

AGENDA ITEM Discussion and possible action regarding renewal of the Stormwater Memorandum of Agreement with surrounding municipalities BACKGROUND

Marathon County owns facilities throughout the County in various municipalities. The county owned facilities are required to meet Wisconsin Department of Natural Resources stormwater regulations. Rather than adopt its own stormwater ordinance, Marathon County has elected to comply with the applicable stormwater ordinances in each of the municipalities with county owned facilities. The agreement amongst Marathon County and neighboring communities (City of Wausau; Villages of Weston, Kronenwetter, and Rothschild; and Town of Rib Mountain) holds Marathon County responsible for meeting DNR and municipal stormwater regulations. The agreement also works to achieve uniform stormwater requirements throughout the participating communities and an effort to collaborate together to implement a single information and outreach stormwater program. The current Memorandum of Agreement is set to expire on December 31, 2019.

MEMORANDUM OF AGREEMENT

BETWEEN MARATHON COUNTY, THE CITY OF WAUSAU, THE VILLAGES OF WESTON, KRONENWETTER, AND ROTHSCHILD, AND THE TOWN OF RIB

MOUNTAIN I. PURPOSE THIS MEMORANDUM OF AGREEMENT is entered into for the purpose of minimizing discharge of pollutants carried by stormwater runoff and to develop and implement a single information and outreach program for all participating municipalities. The Agreement allows the parties to work together on a program that meets permit requirements of Wis. Admin. Code NR 216. II. TERM OF AGREEMENT This Agreement shall run January 1, 2020 to December 31, 2026. The terms of the Agreement may be reviewed and amended if necessary. This Agreement may be terminated by any party on thirty (30) days written notice to the group, subject only to the payment of any obligations due to the group under this Agreement up to the point of said termination. III. APPLICABILITY The process defined by this MOA addresses the requirements of Section 402 of the Federal Clean Water Act and the Storm Water Discharge Permit Program under Wis. Admin. Code NR 216. Through the Wisconsin Pollutant Discharge Elimination System (WPDES) permit program, the DNR regulates municipal, industrial, and animal waste operations discharging water to surface or groundwaters. IV. SUMMARY OF THE PERMIT PARTNERSHIP PROCESS Each of the participating municipalities and Marathon County will hold a municipal separate storm sewer system (MS4) permit. Marathon County will be responsible for achieving and maintaining compliance of its MS4 eligible facilities within each community. V. PROGRAM SUMMARY The program is designed to fulfill the permit requirements 1-9 as defined in of Wis. Admin. Code NR 216.07 as efficiently and effectively as possible through intergovernmental cooperation. VI. ALLOCATION OF RESPONSIBILITY For and in consideration of the terms and conditions in this Memorandum of Agreement, Marathon County and the participating municipalities have the following responsibilities:

1. PUBLIC EDUCATION AND OUTREACH Marathon County will: Coordinate the development and updates of the Wausau Urban Area Stormwater

Education and Outreach Plan and future plan updates at no cost to the municipalities;

Coordinate the implementation of the Wausau Urban Area Stormwater Education and Outreach Plan.

The municipalities will: Appoint one representative to the Northcentral Wisconsin Stormwater Coalition;

2. PUBLIC INVOLVEMENT AND PARTICIPATION Marathon County will: Develop and maintain a stormwater management website at no cost to the

municipalities; Public notice all meetings of the Northcentral Wisconsin Stormwater Coalition and

any public informational meetings hosted by Marathon County. The municipalities will: Public notice all meetings hosted by the municipality; Contribute towards costs of public notices, meetings, and other public involvement

and participation activities (each community will contribute an equal share of the cost).

3. ILLICIT DISCHARGE DETECTION AND ELIMINATION

Marathon County will: Assist the participating municipalities to develop and update as necessary,

municipal illicit discharge ordinances in accordance with NR 216; Comply with municipal illicit discharge ordinances as they apply to MS4 eligible

County facilities; Pay actual sampling and field screening costs of outfalls serving county owned

facilities; Follow appropriate procedures to eliminate illicit discharges as defined by Wisconsin

Department of Natural Resources regulations or other sources of non-storm water on MS4 eligible County facilities.

The municipalities will: Adopt and update as necessary, a municipal illicit discharge ordinance; Conduct field screening analysis for illicit connections and discharges at all municipal

and county outfalls within their respective MS4 boundaries; Follow the procedures to eliminate illicit discharges as defined by Wisconsin

Department of Natural Resources regulations or other sources of non-storm water on municipal facilities.

4. CONSTRUCTION SITE POLLUTION CONTROL

Marathon County will: Assist the participating municipalities to develop and update as necessary, municipal

construction site erosion control ordinances in accordance with NR 216; Comply with municipal construction site erosion control ordinance as they apply to

MS4 eligible County facilities as defined in NR 216.

5. POST-CONSTRUCTION SITE STORM WATER MANAGEMENT Marathon County will: Work with the participating municipalities to develop and update as necessary, post

construction storm water management ordinances in accordance with NR 216; Comply with municipal post construction storm water management ordinance as they

apply to MS4 eligible County facilities as defined in NR 216. The municipalities will: Adopt and update as necessary, a municipal post construction storm water

management ordinance.

6. POLLUTION PREVENTION Marathon County will perform the following tasks on MS-4 eligible county owned facilities to the specifications of the individual municipalities in which the facilities exist: Install and maintain source area controls and regional best management practices; Roadway maintenance including street sweeping and de-icer management; Collection and management of leaf and grass clippings; Management of county garages, storage areas and other potential sources of

pollution; Management of the application of lawn and garden fertilizers on county controlled

properties in accordance with s. NR 151.13 (1) (b) 3; Implement inspection, surveillance and monitoring procedures necessary to

determine compliance and noncompliance with municipal permit conditions; Conduct an assessment of the actions taken using a pollutant loading analysis model

(SLAMM). The municipalities will perform the following tasks on municipal facilities:

RESOLUTION

WHEREAS, the Wisconsin Department of Natural Resources regulates municipal storm sewer systems discharging water to surface or ground waters through the Wisconsin Pollutant Discharge Elimination System (WPDES) permit program, and

WHEREAS, the goal of the WPDES Stormwater Program is to prevent the transportation of

pollutants to Wisconsin’s water resources via stormwater runoff, and WHEREAS, the City of Wausau owns stormwater facilities that are required to be permitted under

the Wisconsin Pollutant Discharge Elimination System (WPDES), and WHEREAS, the Memorandum of Agreement is between Marathon County; the City of Wausau; the

Villages of Kronenwetter, Rothschild, and Weston; and the Town of Rib Mountain, and WHEREAS, the purpose of the Memorandum of Agreement, which is authorized pursuant to

AGENDA ITEM Discussion and possible action regarding parking restrictions on Rosecrans Street in blocks 1200 through 1500 Proposed parking restrictions would be toward improving the conditions for student arrival and departure associated with G.D. Jones Elementary School. BACKGROUND INTRODUCTION: A request for certain “No Parking” restrictions on Rosecrans Street in blocks 1200 through 1400 (location) was initiated by Robin Franks, Principal of G.D. Jones Elementary School. Ms. Franks advised the heavy traffic volume associated with student arrival and departure times (A/D) has created a challenge for G.D. Jones staff to monitor students at these peak times. Traffic at the location is heavy and congested during A/D times, requiring daily staff oversight and direction to parents. Wausau Police Department parking enforcement staff has been on site when available but cannot monitor the location on a daily basis. Past practice by staff in providing information and direction to parents can help to alleviate the issue, but it takes several weeks each new school year to achieve even basic compliance. Parents access the G.D. Jones parking lot from Rosecrans St. Restrictions posted on street signs limits entry to the lot via the western-most entrance (see figure A1). Vehicles are allowed to park on the north side of Rosecrans Street between S. 12th Avenue and S. 14th Avenue. The parked vehicles add to the congestion of two way traffic on Rosecrans Street attempting to access the parking lot at peak A/D times. Additionally, students attempting to cross Rosecrans Street to the waiting parked cars create further safety concern. REQUEST:

1. Location 1: north side of Rosecrans Street between S. 12th Ave. and S. 14th Ave. a) No Parking, Stopping or Standing: Monday through Friday 7:30AM-9:00AM and 2:30PM-4:00PM.

(see figure A1) b) Remove signs currently posted on the north side of 1300 block of Rosecrans St. stating “No

Parking between Signs”: the posted restrictions at this location are not listed in municipal ordinance. (see photo 1)
