SUNNYMEDE IT CENTER, 1614 Quezon Ave., South Triangle, Quezon City www.hlurb.gov.ph WHEREAS, there is a need to train personnel to enable them to effectively and efficiently perform their functions towards the realization of the objectives of the said Rules, which are, to ensure the strict observance by the owners/developers of their obligation to fully develop the project on time and in accordance with the approved development plan as well as comply with other conditions imposed on clearances, permits and licenses; to ensure that strict monitoring of all activities involving the real estate business should be strengthened to protect legitimate real estate developers and the buying public to achieve a conducive business atmosphere and stability of the real estate trade; to adopt procedural guidelines for uniformity and consistency in the monitoring and, if violations are present, the imposition of fines, penalties and sanctions; and to ensure the protection of and respect for private rights through the formulation of WHEREAS, the "Rules of Procedure in the Conduct of Administrative Inspections and Investigations," upon its resubmission, was approved and adopted by the Board of Commissioners in this their 43oth Meeting, on this 161h day of November 2017; WHEREAS, the Board of Commissioners deferred the approval and adoption of the said TWG draft for further study by the members thereof; WHEREAS, a Technical Working Group has been created and has been working since last year for the purpose of compiling, amending and/or instituting new Rules, the output of which was the draft subsequently submitted for approval and adoption by the Board of Commissioners in its 429th Meeting on September 14, 2017; WHEREAS, there is a need to revise the present Board Resolution No, R- 611, Series of 1998, otherwise known as the "Administrative Rules of Procedure in the Monitoring of Projects and Imposition of Sanctions" and several companion memoranda, guidelines and circulars, due to the passage of several laws, and the promulgation of various rules and regulations, which had rendered the said Rules outdated or otherwise unresponsive to the current needs and aspirations of HLURB's clientele; WHEREAS, pursuant to Section 5 (c) and 0), Executive Order No. 648, Series of 1981, as amended by Executive Order No. 90, Series of 1986, and Executive Order No. 535, Series of 1979, as amended by Section 26 of Republic Act No. 8763, and Republic Act No. 9904, the HLURB has rule-making powers in the conduct of administrative inspections and personnel; APPROPRIATING BUDGET FOR THE TRAINING OF PERSONNEL RESPONSIBLE FOR THE IMPLEMENTATION OF THE RULES OF PROCEDURE IN THE CONDUCT OF ADMINISTRATIVE INSPECTIONS AND INVESTIGATIONS BOARD RESOLUTION NO. 961 Series of 2017 Republic of the Philippines Office of the President Housing and Urban Development Coordinating Council HOUSING AND LAND USE REGULATORY BOARD

BE IT RESOLVED, AS IT IS HEREBY RESOLVED, That the amount of NINE HUNDRED NINETY THOUSAND PESOS (P990,000.00) be appropriated from the service income, as authorized under Section 9 of Executive Order No. 648, for expenses to be incurred in the training of personnel involved in the monitoring processes in real estate developments and homeowners associations to enable them to effectively and efficiently perform their duties under the "Rules of Procedure in the Conduct of Administrative Inspections and Investigations."

NOW, THEREFORE, for and in consideration of the foregoing, the Board of Commissioners has resolved as follows:

WHEREAS, there is no budget allocation in the General Appropriations Act for the expenses to be incurred in the training of personnel, thereby compelling the HLURB to tap into its service income as authorized under Section 9 of Executive Order No. 648 dated February 7, 1981;

definitive rules of procedure in the monitoring of development projects and imposition of sanctions for violation of laws, rules and regulations being enforced by the Board to provide guidance to both the staff and the public;
