In compliance of the order dated 08.10.2013 passed by theHon'ble Punjab and Haryana High Court in Civil Writ Petition No.22380 of 2013 titled as Raj Singh and others Versus State of Haryanaand others, the Governor of Haryana is pleased to promote the followingLecturers to the post of Headmasters in officiating capacity in the payscale of Rs. 9300-34800 plus grade pay of Rs. 5400/- on provisionalbasis w.e.f. 28.082009, the date when the persons junior to them werepromoted subject to the conditions mentioned below:-

Terms'and Conditions:-

They will be entitled for benefits of promotion w.e.f. 28.8.2009only for notional pay fixation and seniority and actual fmancialbenefits will be admissible to them from the date of joining dutyas Headmasters

If the integrity of the prornotee is found doubtful he will bereverted without giving any notice.

3. The inter-se-seniority of the promotee is subject to the claim oftheir seniors, who have not been promoted in these order due tovarious reasons.

If any official is found senior to the above official at any stagedue to refixation of his/her seniority in his/her feeder cadre, thejunior most promotee shall be,reverted without giving any notice.

If at any stage it is found that any official has been promoted inthese orders inadvertently who was otherwise actually not eligiblefor promotion will be reverted to his/her feeder cadre original postwithout any notice.

That these promotions are subject to the condition that all theparticulars and data supplied by the concerned employee and fieldoffices are correct. In the event of any information found to befactually incorrect, erroneous or misrepresented, the promotion sogranted shall be withdrawn forthwith without affording anyfurther opportunity.

If the seniority of any official is fixed later on in accordance withthe instructions contained in Govt letter No 22/73/92-3GS-III,dated 14.10.1999, he/she will be reverted without any notice.

That they will remain on probation for a period of one year, whichcan be extended if their services are not found satisfactory as perthe rules.

9. The District Education Officer concerned shall personally ensurethe followhig:-

(a) That these promotion orders are being issued against vacantpost. The Headmaster so promoted is advised to report in theDirectorate through the concerned District Education Officer ifhe finds that the post against which he is being appointed isnot vacant in the school so that he is adjusted at some otherplace.

(b)That no male Headmaster below the age of 50 years will beallowed to join in any Girls' School.

(c) That the Headmaster is not being posted at any urban place bydefault or any oversight on the part of Directorate.

(d)That these promotions are subject to the condition that there isno adverse remark pertaining to integrity in the ACRs of thenewly promoted Headmaster.

(e) That the concerned District Education Officers will not allowthe promotee to join his duties if any complaint/enquiry underRule-7 of the Haryana Civil Services (Punishment & Appeal)Rules-1987 is pending against him.

recognize/affiliate beyond Class VIII.The school shall by the provisions of Right of Children to Free and Compulsory Education Act, 2009

and the Haryana State Right of Children to Free and Compulsory Education Rules 2011.3. The school shall admit in class I, to the extent of the Strength of that class. Children belonging to weakersection and disadvantaged group in the neighborhood and provide free and compulsory elementary educationtill its completion :

Provided, that in case of pre primary classes also, this norm shall be followed.

4.For the children referred to in paragraph 3, the school shall be reimbursed as per sub section (2) ofsection 12. To receive such reimbursements school shall provide a separate bank account.5. The school shall not collect any capitation fee and subject the child or his or her parents or guardians to anyscreening procedure.6.The school shall not deny admission to any child for lack of age proof. If such admission is soughtsubsequent to the extended period specified for admission, the same shall not be denied and the child shall notbe discriminated on the ground of religion, caste or race, place of birth or any of them.

The school shall ensure that :-no child admitted shall be held back in any class or expelled from school till the completion ofelementary education in a school;no child shall be subjected to physical punishment or mental harassment;no child is required to pass any board examination till the completion of elementary education.every child completing elementary education shall be awarded a certificate as laid down underrule 22;inclusion of students with disabilities /special needs as per provision of the Act;the teachers are recruited with minimum qualifications as laid under section 23(1) of the Act.Provided further that the current teachers who, at the commencement of this Act do notposses minimum qualifications shall acquire such minimum qualification within a period of 5years;the teacher performs its duties specified under section 24(1) of the Act; and

(viii) the teachers shall not engage himself or herself for private teaching activities.The school shall follow the syllabus on the basis of curriculum laid down by academic authority.The school shall enroll students proportionate to the facilities available in the school as prescribed 19.
