"(1) The secretary shall establish a procedure for theadministrative agency review of citations issued by weights andstandards stationary scale police The secretary officers and may takeappropriate actions based on the findings of any administrative theagency's review held under the provisions of this Subsection. Thesecretary shall adopt rules in accordance with the AdministrativeProcedure Act to govern administrative agency review and any actionstaken based on the findings of an administrative review the agency. Allrules shall be adopted in accordance with the Administrative ProcedureAct.

(2) Following conclusion of the agency's review, the operator orresponsible party issued the citation by the weights and standardsstationary scale police officer may request a hearing conducted by areview panel comprised of five members. One member of the reviewpanel shall be appointed by the secretary of the Department ofTransportation and Development, two members shall be appointed bythe Louisiana Motor Transport Association, one member shall beappointed by the chairman of the House Transportation, Highways andPublic Works Committee, and one member shall be appointed by thechairman of the Senate Transportation, Highways and Public WorksCommittee. Decisions of the review panel shall be binding upon theDepartment of Transportation and Development. The secretary shalladopt rules and regulations in accordance with the AdministrativeProcedure Act regarding the hearing conducted by the review panelincluding but not limited to rules and regulations regarding thenotification and procedure for requesting a hearing by the review paneland deadlines for request for a hearing before the review panel."
