Homelessness is an extremely complex social problem that has become a

pervasive problem throughout not only our own community, but is impacting communities throughout California. Some individuals have found themselves in a temporary homeless situation through no real fault of their own, other than having fallen on economic hard times. However, others may be living on the street as a result of substance abuse, mental illness, or both.

Being homeless is not a crime. However, certain types of unbecoming conduct sometimes associated with the transient population are illegal, can have a detrimental impact on local businesses, and should be reported to the Atascadero Police Department (APD). Such conduct includes public intoxication, loitering, prowling, fighting, trespassing, aggressive panhandling, soliciting, camping or sleeping in parks, littering, obstructing sidewalks, living in a vehicle parked on a public street, disturbing the peace, or behaving in a threatening manner.

If these types of issues are affecting your business, please speak with the APD. If warranted, file an annual “Letter of Authority“, which will authorize officers to enter your property to investigate suspicious activity and to arrest people who are trespassing or committing a crime. If you do file a Letter of Authority, you must also be sure to post highly visible no trespassing signs. The APD can provide information regarding the legal specifications required for these signs.

When dealing with homeless citizens and transients, guidelines from the APD ask that you use caution and avoid confrontations. Do not offer food or money, which may only encourage additional panhandling. It is much better to contribute to local charities, missions, food banks, or social service organizations that provide services to assist those in need. Do not permit anyone to camp, loiter or store personal belongings on your property.

APD also suggests restricting overnight access to outdoor areas that are protected from inclement weather; locking or removing handles from water spigots; keeping trash dumpsters locked when not being filled or emptied; securing outside storage sheds or containers; locking exterior power outlets; locking gates after hours; installing motion-activated exterior lighting and trimming landscaping which blocks views, lighting, or camera coverage.

In addition, maintain the property and keep it free of litter and junk. Design outdoor public amenities such as benches to be comfortable for sitting but not for sleeping. Post signs detailing nighttime curfews and prohibitions of loitering, illegal lodging, drinking alcoholic beverages and drug activities which state that anyone engaged in prohibited conduct will be asked to leave the property, and that failure to do so will result in a call to the APD. If feasible, install surveillance cameras and have security personnel patrol the property at random times.

I’m happy to report that the Board of Supervisors unanimously voted to select

Wade Horton as our new County Administrative Officer. I’ve had the distinct pleasure of working with Wade as he has served as the County’s Public Works Director since 2014. Wade has shown exceptional leadership skills and I’m confident he will continue to cultivate a service-oriented culture in our staff through his management.

As I mentioned in the last Chamber newsletter, the Board of Supervisors has continued to work on the Permanent Cannabis Ordinance. Up until December of 2015, the County had no land use regulations for cannabis activities other than for medical marijuana dispensaries in the inland areas of the County. Since then, we will have held twelve meetings in regards to this issue. The complexity of cannabis touches a vast array of issues beyond our standard land use deliberations - we have had to take such things as cultivation, manufacturing, distribution, public safety, environmental health, and taxation into account. I appreciate hearing from several of you that have contacted me to share your concerns as well as those who have

shown interest in a new legal commodity. Rest assured, I am weighing all the input I’ve received and am working hard to bring structure to an everchanging regulation as it is being implemented by the State.

On a positive note, Supervisor Peschong and I have been working with Mayor Tom O’Malley and City Manager Rachelle Rickard of the City of Atascadero, and Mayor Steve Martin and City Manager Tom Frutchey of the City of Paso Robles to come up with a more affordable way to provide animal services for the North County. I believe we all have the same goal in mind and will work diligently to find a solution for an animal shelter.

I want to wish everyone a happy holiday season. I myself am looking forward to spending time with family and friends as we celebrate the Christmas season. It has been a complete honor to serve you all this year.

VACATION ACCRUAL DURING LEAVE DEPENDS ON POLICY, NATURE OF LEAVE

Does the law require us to continue to accrue vacation for

an employee while he/she is on a leave of absence?

Whether an employee accrues vacation while on a leave of absence will normally depend on two factors:

• Whether the leave is legally protected (such as pregnancy disability leave, family leave, or a reasonable accommodation under the Americans with Disabilities Act) or simply a personal leave granted by the company but not required by law; and

• An employer’s policy for vacation accrual when employees take days off that are not part of a protected leave of absence.

If the leave is simply a personal leave granted by the employer, and therefore not legally protected, the employer is not required by law to continue vacation accrual during the leave.

If the leave is legally protected, vacation accrual during the leave will depend on the employer’s vacation policy. An employee on legally protected leave must be treated at

least as well as other employees in terms of vacation accrual during any other paid or unpaid time off.

Examples

• ABC Corporation’s policy is to continue accruing vacation when an employee uses paid vacation time, but not to continue to accrue during any unpaid time off.

Thus when Joe uses a week of paid vacation to go to Hawaii, he continues to accrue vacation during that week. If Suzy uses one week of protected family leave to take care of her seriously ill mother and collects paid vacation during that week, she should also continue to accrue vacation during that time.

If Joe exhausts his vacation time but is granted an unpaid week off to go on a cruise, under ABC’s policy he would not accrue vacation during that unpaid week. Similarly, if Suzy exhausts her vacation time and takes another week of family leave without pay to care for her mother, she too would not accrue vacation during that week.

• XYZ Corporation’s policy accrues vacation based only on hours actually worked, so when employees take time off (whether paid or unpaid) they do not accrue any vacation time.

Preventing Litigation

Treating employees on a protected leave of absence at least as well as employees taking vacation time for more traditional purposes (i.e., a trip to Hawaii) can help to prevent claims that the employer discriminated against those employees for using legally protected leaves.

In addition, a well-crafted vacation policy that clearly lays out accrual rules can go a long way toward preventing litigation.
