UnderthePaulD.CoverdellTeacherProtectionActof2001,noteacherinaschoolshallbeliableforharmcausedbyanactoromissionoftheteacheronbehalfoftheschoolif—

 

(1)theteacherwasactingwithinthescopeoftheteacher'semploymentorresponsibilitiestoaschoolorgovernmentalentity;

(2)theactionsoftheteacherwerecarriedoutinconformitywithFederal,State,andlocallaws(includingrulesandregulations)infurtheranceofeffortstocontrol,discipline,expel,orsuspendastudentormaintainorderorcontrolintheclassroomorschool;

(3) appropriateorrequired,theteacherwasproperlylicensed,certified,orauthorizedbytheappropriateauthoritiesfortheactivitiesorpracticeinvolvedintheStateinwhichtheharmoccurred,wheretheactivitieswereorpracticewasundertakenwithinthescopeoftheteacher'sresponsibilities;

(4)theharmwasnotcausedbywillfulorcriminalmisconduct,grossnegligence,recklessmisconduct,oraconscious,flagrantindifferencetotherightsorsafetyoftheindividualharmedbytheteacher;and

(5)theharmwasnotcausedbytheteacheroperatingamotorvehicle,vessel,aircraft,orothervehicleforwhichtheStaterequirestheoperatorortheownerofthevehicle,craft,orvesseltopossessanoperator’slicenseormaintaininsurance.

entityunlesstheclaimantestablishesbyclearandconvincingevidencethattheharmwasproximatelycausedbyanactoromissionofsuchteacherthatconstituteswillfulorcriminalmisconduct,oraconscious,flagrantindifferencetotherightsorsafetyoftheindividualharmed. 20U.S.C.§7946(c). Inanycivilactionagainstateacherthatisbasedonanactoromissionofateacheractingwithinthescopeoftheteacher'semploymentorresponsibilitiestoaschoolorgovernmentalentity,eachdefendantwhoisateachershallbeliableonlyfortheamountofnoneconomiclossallocatedtothatteacherindirectproportiontothepercentageofresponsibilityforwhichtheteacherisfoundliablefortheharmtotheclaimant. Thecourtshallrenderaseparatejudgmentagainsteachdefendant. Forpurposesofdeterminingtheamountofnoneconomiclossallocatedtoateacherdefendant,thetrieroffactshalldeterminethepercentageofresponsibilityofthatdefendantfortheharmtotheclaimanttowhomtheteacherdefendantisliable. 20U.S.C.§7947.

Wheneverateacher(asdefinedinI.C.20–18–2–22)ismadeapartytoacivilsuit,andtheAttorneyGeneraldeterminesthatthesuithasarisenoutofanactthattheteacheringoodfaithbelievedwaswithinthescopeoftheteacher'sdutiesinenforcingdisciplinepoliciesdevelopedunderI.C.20–33–8–12,theAttorneyGeneralshalldefendtheteacherthroughouttheaction.I.C.4‐6‐2‐1.5(b). Theteacherretainstherighttoselectcounselofhisorherownchoiceattheteacher’sownexpense. (a)chargedwithacrimeoraninfraction,butallchargeshavebeendismissedortheteacherhasbeenfoundnotguiltyofallcharges;

(b)thetargetofagrandjuryinvestigation,butthegrandjuryfailstoindicttheteacher;or(c) adefendantincertaincivilactionsifallclaimsthatformedthebasisofthecivilactionhavebeendismissedora

judgmentisrenderedinfavoroftheteacheronallcountsinthecivilaction.

Theschoolcorporationmayactonsucharequestwithoutahearing,andrequiretheteacherseekingreimbursementto:

(a)answerquestionsunderoath;or(b)provideinformationordocumentsconcerningthecaseorinvestigationforwhichtheteacherisseeking

 Thegoverningbodyofaschoolcorporationhasthespecificpowertodefendateacherinanysuitarisingoutoftheperformanceoftheteacher’sduties,providedtheteacher’sactionwastakeningoodfaith. Thegoverningbodymayholdtheteacherharmlessfromanyliability,cost,ordamageinconnectionwiththeteacher’sperformance. Thiswouldincludethepaymentoflegalfees. Ateachermayberesponsibleforanyliability,cost,ordamagewheretheteacheractedinbadfaithorcommittedmalfeasanceinofficeorintheteacher’semployment.

TheemployermustcomplywiththeoccupationalhealthandsafetystandardspromulgatedundertheIndianaOccupationalSafetyandHealthAct(IOSHA),andpursuanttoanydirectionsinsuchstandards,keepemployeesinformedoftheirprotectionsandobligationsunderthechapter,thehazardsoftheworkplaceandsuitableprecautions,relevantsymptoms,andemergencytreatmentforsuchhazards. I.C.22‐8‐1.1‐3.1. NopersonshalldischargeorinanywaydiscriminateagainstateacherbecauseheorshehasfiledacomplaintorinstitutedorcausedtobeinstitutedanyproceedingunderorrelatedtoIOSHAorhastestifiedorisabouttotestifyinanysuchproceeding,orbecauseoftheexercisebytheteacheronbehalfofhimselforothersofanyrightaffordedbyIOSHA. I.C.22‐8‐1.1‐38.1. Inthecaseofawrittenrequesttothecommissioneroflaborforaninspectionbyateacherorateacher’srepresentativewhobelievesthataviolationofasafetyorhealthstandardexiststhatthreatensphysicalharmorthatanimminentdangerexists,acopyshallbeprovidedtheemployeratthetimeofinspection,exceptthat,uponrequestofthecomplainantorbyadecisionbythecommissioner:

 

(1)thenameofthecomplainantandanyidentifyinginformation;and(2)thenameandidentifyinginformationofindividualemployeesreferredtotherein;

 

shallnotappearinsuchcopyoronanyrecordpublished,released,ormadeavailablebythecommissioner.Thecommissionershallmaketheinspection,orshallreplyinwritingwithintwenty(20)daysgivingthereasonswhythecommissionerisnotmakingtherequestedinspection.Intheeventarequestedinspectionismade,andnosafetyorderissued,thecommissionermustreplyinwritingwithintwenty(20)daysgivingthereasonforthedecision. Ateacherwhohasstudentsunderhisorherchargemaytakeanyactionsthatarereasonablynecessarytocarryoutortopreventaninterferencewithaneducationalfunctionthattheteachersupervises. Removalfromclassshouldbealastresortandshouldlastonlyaslongasnecessarytocontrolthestudentandsecureappropriateinterventionsandsupports,consistentwithpositivedisciplinepractices. Ifateacherremovesastudentfromaclass,theprincipalmayplacethestudentinanotherappropriateclassorplacementorintoin‐schoolsuspension.Theprincipalmaynotreturnthestudenttotheclassfromwhichthestudentwasremoveduntiltheprincipalhasmetwiththestudent,thestudent’steacher,andthestudent’sparentstodetermineanappropriatebehaviorplanforthestudent.Ifthestudent’sparentsdonotmeetwiththeprincipalandthestudent’steacherwithinareasonableamountoftime,thestudentmaybemovedtoanotherclassattheprincipal’sdiscretion.

TheFamilyEducationalRightsandPrivacyAct(FERPA)isaFederallawthatprotectstheprivacyofstudenteducationrecords.ThelawappliestoallschoolsthatreceivefundsunderanapplicableprogramoftheU.S.DepartmentofEducation.Parentsoreligiblestudentshavetherighttoinspectandreviewthestudent'seducationrecordsmaintainedbytheschool.Generally,schools(includingtheirteachers)musthavewrittenpermissionfromtheparentoreligiblestudentinordertoreleaseanypersonallyidentifiableinformationfromastudent'seducationrecord. However,FERPAallowsschoolstodisclosethoserecords,withoutconsent,tothefollowingpartiesorunderthefollowingconditions:

 Schoolsmaydisclose,withoutconsent,"directory"informationsuchasastudent'sname,address,telephonenumber,dateandplaceofbirth,honorsandawards,anddatesofattendance.However,schoolsmustinformparentsandeligiblestudentswhatconstitutesdirectoryinformationandallowparentsandeligiblestudentsareasonableamountoftimetorequestthattheschoolnotdisclosedirectoryinformationaboutthem.

TheStateBoardandtheDOEmayrecommendadditionalfactors,butneithermayrequireadditionalfactorsunlessdirectedtodosobytheGeneralAssembly(thestatelegislature).

 Thecontractmayprovidefortheannualdeterminationoftheteacher'sannualcompensationbasedonalocalcompensationplanspecifyingasalaryrange,whichispartofthecontract.ThecompensationplanmaybechangedbytheschoolcorporationbeforeMay1ofayear,withthechangeseffectivethenextschoolyear,orthedatespecifiedinacollectivebargainingagreementapplicabletothenextschoolyear.Ateacheraffectedbythechangesshallbefurnishedwithprintedcopiesofthechangedcompensationplannotlaterthanthirty(30)daysaftertheadoptionofthecompensationplan. I.C.20‐28‐6‐2.RegularTeacher’sContract Back

 

Aregularteacher’scontractmustincludethemannerofsalarypaymentandanyprovisionsrelatingtothegovernmentoftheschoolthatthestatesuperintendentincludes. I.C.20‐28‐6‐5 TemporaryTeacher’sContract Back

 

Atemporaryteacher’scontractshallbeusedonlyforemploying(1)ateachertoserveintheabsenceofateacherwhohasbeengrantedaleaveofabsencebytheschoolcorporationfor

engagingindefense(orauxiliary)service,professionalstudyoradvancement,exchangeteaching,extendeddisability,orservingintheGeneralAssembly;or

(2)anewteacherforapositionthatisa. fundedbyagrantoutsidetheschoolfundingformulaforwhichfundingisavailableonlyforaspecifiedperiod

orpurpose,orb. vacatedbyateacherwhoisunderaregularcontractandwhotemporarilyacceptsateacherpositionfunded

bysuchagrant. Thetemporaryteacher’scontractmustcontainthefollowing:

(1)theprovisionsoftheregularteacher’scontractexceptthoseprovidingforcontinuedtenureofposition,(2)ablankspaceforthenameoftheteachergrantedtheleave,and(3)anexpirationdatethatisthedateofthereturnoftheteacheronleaveandisnotlaterthantheendoftheschoolyear.

I.C.20‐28‐6‐6.

Ifateacherisemployedonthetemporaryteacher'scontractforatleastsixty(60)daysinaschoolyear,theteachermay,onrequest,receivetheservicecreditthattheteacherwouldotherwisereceiveregardingtheIndianastateteachers'retirementfund. I.C.20‐28‐7.5‐1(b)

Inadditiontothereasonssetforthabove,aprobationaryteacher'scontractmaybecanceledforanyreasonrelevanttotheschoolcorporation'sinterest.I.C.20‐28‐7.5‐1(c). Thecancellationofteacher'scontractsduetoajustifiabledecreaseinthenumberofteachingpositionsshallbedeterminedonthebasisofperformanceratherthanseniority.1Incaseswhereteachersareplacedinthesameperformancecategory,anyofthefollowingitemsmaybeconsidered:

 

(1)thenumberofyearsofateacher'sexperience.(2)thepossessionofeither:

conferencewiththesuperintendentortheassistantsuperintendent.Thesuperintendentortheassistantsuperintendent,asapplicable,mustsettherequestedmeetingnotlaterthanten(10)daysaftertherequest. Attheconferencebetweenthesuperintendentorassistantsuperintendent,asapplicable,andtheteacher,theteachermaybeaccompaniedbyarepresentative. Aftertheconferencebetweenthesuperintendentortheassistantsuperintendent,asapplicable,andtheteacher,thesuperintendentortheassistantsuperintendentshallmakeawrittenrecommendationtothegoverningbodyoftheschoolcorporationregardingthecancellationoftheteacher'scontract. Iftheteacherdoesnotrequestaconference,theprincipal'sorthesuperintendent’spreliminarydecisionisconsideredfinal. I.C.20‐28‐7.5‐2(b)‐(e). Ifaprobationary,professional,orestablishedteacherfilesarequestwiththeschoolcorporationforanadditionalprivateconferencenotlaterthanfive(5)daysaftertheinitialprivateconferencewiththesuperintendentortheassistantsuperintendent,asapplicable,theteacherisentitledtoanadditionalprivateconferencewiththegoverningbodyoftheschoolcorporationbeforethegoverningbodymakesafinaldecision.Thefinaldecisionmustbeinwritingandmustbemadenotmorethanthirty(30)daysafterthegoverningbodyreceivestheteacher'srequestfortheadditionalprivateconference.Attheprivateconferencethegoverningbodyshalldothefollowing:

 

(1) Allowtheteachertopresentevidencetorefutethereasonorreasonsforcontractcancellationandsupportingevidenceprovidedbytheschoolcorporation.Anyevidencepresentedattheprivateconferencemusthavebeenexchangedbythepartiesatleastseven(7)daysbeforetheprivateconference.

(2) Considerwhetherapreponderanceoftheevidencesupportsthecancellationoftheteacher'scontract.I.C.20‐28‐7.5‐2(f).

Atthefirstpublicmeetingfollowingaprivateconferencewiththegoverningbodyoftheschoolcorporationorsuperintendent(ifnoconferencewiththegoverningbodyisrequested),thegoverningbodymaycancelacontractwithateacherbyamajorityvoteevidencedbyasignedstatementintheminutesoftheboard. IC20‐28‐7.5‐6 VoidContracts Back

 

Acontractbetweenaschoolcorporationandateacherisvoidiftheteacher,atthetimeofsigningthecontract,isboundbyapreviouscontracttoteachinapublicschoolandthecontractisenteredintolessthanfourteen(14)daysbeforethedayonwhichtheteachermustreportforworkatthatschool.However,anothercontractmaybesignedbytheteacherthatwillbeeffectiveiftheteacher:

 

(1)furnishestheprincipalareleasebythefirstemployer;or(2)showsproofthatthirty(30)dayswrittennoticewasdeliveredbytheteachertothefirstemployer.

 Aprincipalmayrequestfromateacher,atthetimeofcontracting,awrittenstatementaddressingwhethertheteacherhassignedanotherteachingcontract.However,theteacher'sfailuretoprovidethestatementisnotacauseforsubsequentlyvoidingthecontract.2

Uponateacher'swrittenrequest,aschoolcorporationshallwithholdtherequestedamountofmoneyfromthesalaryoftheteacherforinsuranceorotherprotection,orfortheestablishmentoforpaymentonanannuityaccount. UponawrittenrequestfromabeneficiaryoftheIndianastateteachers'retirementfund,aschoolcorporationmayreceiveagivenamountofmoneyforthesepurposes. Theschoolcorporationshallholdandpaytheamounts,asrequestedbytheteacherorthebeneficiary,toaninsurancecompanyorotheragencyororganizationinIndianathatprovides,extends,supervises,orpaysfor:

 

(1)insuranceorotherprotection;or(2)theestablishmentoforpaymentonanannuityaccount;

 

fortheteacher. Ifadividendaccruesonapolicy,thedividendshallbepaidorcreditedtotheteacher.Iflessthantwentypercent(20%)oftheteachersemployedbyaschoolcorporationrequestpaymentoftheamountsdescribedaboveforinsuranceorannuityaccountstoasinglerecipient,withholdingtheamountsofmoneyforinsurance,dues,orotherpurposesisdiscretionarywiththegoverningbody. I.C.20‐28‐9‐21 Ateachermaybesuspendedwithoutpayonlyunderthefollowingprocedure:

(1)Theprincipalshallnotifytheteacheroftheprincipal'spreliminarydecision.Thenotificationmustbe:

(A)inwriting;and(B)deliveredinpersonormailedbyregisteredorcertifiedmailtotheteacherattheteacher'slastknown

address. 

(2)Thenoticeinsubdivision(1)mustincludeawrittenstatement,subjecttoI.C.5–14–3–4,givingthereasonsforthepreliminarydecision.

 Therequirednoticemustinformtheteacherthat,notlaterthanfive(5)daysaftertheteacher'sreceiptofthenotice,theteachermayrequestaprivateconferencewiththesuperintendent.Thesuperintendentmustsettherequestedmeetingnotlaterthanten(10)daysaftertherequest. (1)Allowtheteachertopresentevidencetorefutethereasonorreasonsforsuspensionwithoutpayandsupportingevidenceprovidedbytheschoolcorporation.Anyevidencepresentedattheprivateconferencemusthavebeenexchangedbythepartiesatleastseven(7)daysbeforetheprivateconference.

(2)Considerwhetherapreponderanceoftheevidencesupportstheteacher'ssuspensionwithoutpay. Atthefirstpublicmeetingfollowingaprivateconferencewiththegoverningbodyorthesuperintendent(ifnoconferencewiththegoverningbodyisrequested),thegoverningbodymaysuspendateacherwithoutpayforareasonabletimebyamajorityvoteevidencedbyasignedstatementintheminutesoftheboard.Thedecisionofthegoverningbodyisfinal. Thetimeperiodsconcerningnoticeandconferencesshallbeextendedforareasonableperiodwhenateacherorschoolofficialisillorabsentfromtheschoolcorporationorforotherreasonablecause.
