Section 1

Invitation for Financial Bid1. Background

Kerala Forest Development Corporation Ltd. (KFDC) is a Public Sector Company owned by the State of Kerala in India. The company was incorporated in 1975. The principal activity of the company is managing wood plantations and cash crop plantations on reserved forest land. The company is the only producer of sandalwood oil in the State. KFDC is the nodal agency for ecotourism in the forest areas of Kerala.

In the process of expanding ecotourism activities, projects for setting up of jungle camps have been taken up at Ponmudi , Kottoor Elephant Camp and Arippa in Thiruvananthapuram District, Vagamon and Munnar in Idukki district, Nelliampathy in Palakkad District, Kambamala and Kuruva island in Wayanad District etc. KFDC sticks to the use of eco-friendly materials and construction technology in all the ecotourism centres. Only temporary structures are proposed in the ecotourism locations. The most preferred building materials are metal, wood etc which can be easily dismantled and reassembled; but the structures should suite the locations and keep up the natural beauty of the destination. In this process KFDC has decided to set up a prefabricated amenity centre at Vagamon in connection with the proposed orchidarium. An expression of interest was invited by KFDC in the month of March 2013 for identifying firms in this field and to finalise the terms and conditions of executing the work on turn-key basis.

Now proposals are invited from experienced firms for the supply and erection of a prefabricated amenity centre as per the architectural drawing appended to this notification. The basement will be built separately by KFDC as per the design in consultation with the firm selected for the prefabrication work.

The location, Vagamon is a hill receiving torrential rains during south-west and north-east monsoons. Annual rainfall is more than 3500 millimetres. Very strong winds flow during monsoons. During the hot months of January to May, day temperature rises up to 35 degree Celsius. The design of the building and selection of material should suite the above climatic conditions.

3. Proposal

Detailed proposal consisting of estimated cost of work and detailed component-wise plan are invited for the supply and erection of prefabricated amenity centre using metal sandwiched PUF panel at KFDC orchidarium project, Vagamon in Idukki district from firms experienced in the related field.

The scope of work consists of supply and erection of a prefabricated amenity centre as per the architectural drawings attached herewith. The details are given below.Name of the works EMD by cash / DD(Rs.)Prefabricated amenity centre.

4. Submission of Bid documents

(1). Technical bid in two parts to be filled , sealed and superscripted as “technical bid documents”

Part-1

i. Earnest Money Deposit (EMD)ii. Power of attorney in favour of the person signing the Bidiii. IFB document in full signed on all pages by the person authorized to sign the bid.

Part-2

i. Duly filled in prequalification format in annexure 3ii. Architectural and structural designs and related drawings based on the drawings as

per annexure 2.iii. Project implementation schedule within the contract period with broad list of

activities, timelines and milestones. A detailed overall activity chart indicating the duration and timing of all major activities.

iv. Standards and specifications being followed in the design and for materials to be used in a consolidated tabular form.

v. Project Management Methodology and proposed Quality Planvi. Details of Project Team with assignment of each key staff member (identified by

name), duration and timing together with clear description of the responsibilities of each key staff member within the overall work programme.

(2). Financial bid filled and in a separate enclosure , sealed and superscripted as “financial bid”

Bids in two cover with necessary enclosures , EMD etc. to be enclosed in a common cover sealed, and superscribed “The tender for prefabricated building for amenity centre at Vagamon orchidarium project ”should reach the Divisional Manager (HO), Kottayam. on or before 1 pm on 10.10.2013.

5. Tender forms are available from the office of the Divisional Manager (HO), Kottayam up to 11 am on 10.10.2013 on payment of Rs.3000/-(Rupees three thousand only) together with VAT@ 5%.

6. Opening of the bid: the bids will be opened in the office of Managing Director, KFDC, Kottayam. Prequalification bid will be opened at 3.00 pm on 10.10.2013 in presence of those of the tenderers or their representatives present. After verifying the check list of documents to be submitted in the technical bid, financial bid of tentatively qualified firms will be opened at 4.00pm on 10.10.2013.After detailed evaluation of the technical bid and financial bid qualified bidders

will be intimated the date of detailed presentation, clarifications and techno commercial negotiation.

7. Late tenders will not be accepted. 8. Tender documents submitted electronically will not be accepted.9. If the tender date happens to be a declared holiday the tender process will be

conducted on the next working day at the same time and same place. The cost of the tender forms may be paid as cash/demand draft in favour of Managing Director, KFDC LTD, Kottayam and is not refundable under any circumstances. Cheque or any other type of remittance will not be accepted for the cost of tender forms. Tenders are to be accompanied with a preliminary agreement executed in Kerala Stamp paper worth Rs. 100/- in the format accompanying this notice and EMD at the rate of 2.5% of the quoted amount. For those firms situated outside Kerala, the stamp paper will be sent by KFDC on specific request after remittance of Rs 100/- to our bank account the details of which are given below.

10.Tender without EMD, cost of tender form, without specified details and signatures will not be considered. Further details can be had from the office of the Managing Director, KFDC LTD, Kottayam during working hours.

11. Procedure of selection and execution:1. The preliminary selection shall be based on prequalification and the design and layout

submitted by the bidder.

2. The short listed firms/ persons after preliminary selection procedure shall be invited for

a detailed presentation of the proposal. The final selection technically qualified firms is

based on financial bid

Section 2Instructions to Participating Firms

General Conditions1. Bid shall remain valid for a period of 120 days from the due date of receipt of tender. Prior

to the expiry of the original bid validity period, KFDC may, at its discretion request bidders to extend the bid validity period for a specified additional period.

2. The successful tenderer will have to enter into an agreement remitting security as given in this notice.

3. Contract will include the formal work order issued including schedule of rates and other schedules appended thereto, special conditions, general conditions brief specification, drawings and letter of award thereof including Invitation for Bid

4. Drawings mean the drawings referred to in the contract documents and/or appended with the contract documents, any modification of such drawings approved in writing by KFDC and shall include drawings issued for actual construction of the work from time to time by KFDC.

5. The work shall be executed properly and truly, set to perfect lines, plumbs and levels as indicated in drawings and as instructed.

6. It is deemed that the contractor has thoroughly read, studied and acquainted himself with drawings, specifications, nature and standard of work and other general/special conditions in respect of this work, besides site conditions, type of soil, water availability etc.

7. The contractor shall make regular payment to his labourers, employees, or sub-agencies and submit the account papers muster rolls duly signed and acknowledged by them regularly and periodically for the scrutiny and record of the owner or his officers.

8. Income tax, sales tax, entry tax, work contract tax, ESI contribution, Labour welfare fund or any other taxes/ duties put by the Government from time to time shall be deducted from all payments as applicable under the prevalent rules and law, applicable during each payment.

9. Prior to the expiry of the period of validity, Divisional Manager, KFDC, Kottayam will notify the successful bidder in writing by registered letter that his bid has been accepted. This letter, hereinafter referred as the letter of acceptance shall include the total contract value and a schedule of items rates and probable quantities. This letter of acceptance will constitute the formation of the contract.

10. Before commencing the work and within 20 days of the letter of acceptance, the tenderer shall make a security deposit as specified in the notice and furnish the same for the proper fulfilment of the contract and shall execute an agreement for the work in required non-judicial stamp paper.A further time of 10 days shall be allowed to execute the agreement by realizing a fine of 1% of P.A.C subject to a maximum of Rs.15,000/-.

Bids will be rejected if agreement is not executed within 30 days from the date of letter of acceptance and the work will be rearranged at the risk and cost of the original tenderer. The EMD of the defaulted tenderer will be forfeited to the Corporation.

The EMD of the unsuccessful bidders will be refunded after tabulating the tenders keeping only the earnest money of first three lowest tenders.

11. Performance security: The successful bidder shall furnish to KFDC, towards performance security, an unconditional Bank Guarantee or a Demand Draft for a value equivalent to 10 percent of the total contract price. The performance security shall be in favour of the Managing Director, Kerala Forest Development Corporation Ltd, and must be furnished within fourteen days from the date of receipt of the Letter of Award, either as a bank Guarantee from a scheduled/nationalized bank having branch in Kottayam, Kerala or as a demand draft in favour of Managing Director, KFDC payable at Kottayam, Kerala. All incidental charges whatsoever such as commission, premium etc with respect to the Performance security shall be borne by the selected firm. The validity of the Bank Guarantee shall cover the entire duration of the agreement in addition to six months thereafter and shall be suitably extended in case of delays/additional requirements. The performance security shall be released within four weeks of expiry provided there are no outstanding claims by KFDC on the selected firm. However no interest shall be payable on the performance security.

12. In the event of the firm not able to service the contract for whatever reason, KFDC would evoke the performance security. Notwithstanding and without prejudice to any rights whatsoever of KFDC under the contract in the matter, the proceeds of the performance security shall be payable to KFDC as compensation for any loss resulting from the firm’s failure to perform or comply with its obligations under the contract. KFDC shall notify the firm in writing of the exercise of its rights to receive such compensation indicating the contractual obligation(s) from which the firm is in default.

13. The contract period will be 60 days from the date of agreement excluding the time taken by KFDC for completing the foundation and basement.

14. ALL THE DEPOSITS OF E.M.D, SECURITY AND RETENTION MONEY WILL NOT BEAR ANY INTEREST WHATSOEVER.

15. Before passing of the final bill the contractor has to produce up to date Agriculture Income tax and Income tax clearance certificates.

16. (i) KVATTaxes as per KVAT will be recovered at prevailing rates. In the case of compounded work contract tax, contractors not having CST registration the compounded rate is 3%. In the case of contractors having CST registration under compounded method tax is payable on materials purchased/brought from outside the state at local rate 5% or 14.5% as the case may be.

(ii) Income Tax – Income Tax will be recovered at the prevailing rates as per the section 194 C of the Income Tax Act. The rates are:(a) If contractor is an individual @1%(b) If contractor is not an individual @2%(c) If not having PAN @20%

17. Contribution to labour welfare fund will be deducted at 1% of the gross value of the work and remitted to labour welfare fund board.

18. The work shall be carried out to the entire satisfaction of the site in-charge and the owners instructions shall be followed strictly.

19. The contractor shall indemnify the owner against any claim of payment of his labourers engaged by him directly and indirectly.

20. Work shall not be considered as finished and completed unless the contractor obtains the completion certificate from the Project In-charge of the work duly approved by architects/ consultants.

21. To take care of any institutional delays or delay occurring due to unexpected technical problems faced during execution of a work, a grace period of 20% of this original time of completions will be allowed if found necessary to complete the work. For extension of time of completion beyond the grace period, fine will be imposed at the following rates.Period of Extension Rate of fineFirst 15 days 1% (one percent) of the PAC

22. The contractor shall also be expected to remain within the framework of labour laws and maintain the necessary records as per legal requirement of labour laws. In case of any casualty the contractor should indemnify the owner from all claims, damages arising of that account.

23. The completion time of the work shall be the essence of the contract. The contractor shall carry out and complete the entire project according to the programs and progress chart laid down by the project in-charge.

24. In case if any work is found unsatisfactory from the point of program and progress and found not upto the mark from the point of quality, then the contract can be terminated without any notice and without assigning any reasons whatsoever. No compensation, therefore shall be payable under any reasons or circumstances and the balance work left incomplete by the contractor shall be got executed and completed at his risk and cost through any other agencies appointed by the owner as deemed fit.

25. All skilled and unskilled labour employed by the contractor shall be fully experienced and of class required for the nature of work to be executed by him.

26. No escalation of labour wages or market rate of materials is payable to the contractor.

27. The Contractor shall make his own arrangements of electricity and water supply. However, the same as available at site may be made use of by the contactor without affecting the work of other agencies in any way. The owner takes no responsibility for the supply of either electricity or water.

28. Materials required for labour toilets of temporary construction shall be provided by the contractor at sites for the work without any extra cost.

29. The selected firm will be paid on achievement of each milestone as per the schedule of payments mentioned below:

30. Warranty: All the construction materials, fixtures and fittings forming part of the building provided by eth selected firm shall be guaranteed for satisfactory operation for a period of 24 months from the date of handing over of the building to KFDC. If any of the building components are found defective in material or workmanship during these 24 months, the selected firm shall rectify it within a reasonable time

31. Disputes: If a dispute of any kind arises between KFDC and the selected firm in connection with or arising out of the IFB or the execution of the project, whether during the execution of the project or after its completion and whether before or after repudiation or termination of the project agreement, including any dispute as to any decision, opinion, consent, expression of satisfaction, approval, determination of value, action or instruction of KFDC, the matter in dispute shall be referred to in writing to the Managing Director. Not later than one month after the day on which the Managing Director receives such reference he shall give notice of his decision of the same to the selected firm

32. Litigation; Litigation, if any, shall be subject to the jurisdiction of the Courts at Kottayam, Kerala, India and will be governed by the laws in India.

Special Conditions

33. The proposal should include all works in a turnkey basis, except the anchoring basement.

The procedure for evaluation of price bid will be based on the cost of components.

34. The construction shall be based on the architectural unit drawings provided by KFDC finalised during technical negotiation.

35. . Selected agency shall design the structure, complying with the architectural drawing provided by KFDC. Site specific foundation is to be designed and got approved from KFDC. The foundation will be constructed by KFDC with the technical assistance of the selected firm.

36. Selected firm has to submit a detailed work methodology related to their production of components, transportation of components to site, erection of units and project Management, within the timelines specified by KFDC.

37. Prefab structures should be Fire Resistant.

38. Prefab units shall maintain ideal room temperature for using it as accommodation and public utility facility.

39. The plinth height shall as decided in the technical negotiation with KFDC.

40. All water supply and drainage network inside the amenity centre shall be of GI pipes as per specification.

41. All sanitary fittings shall be provided with standard size and make.

Section 3

Technical Specifications1. External Wall Panel

° The wall panels should be 50mm thick continuous sandwich panels having 0.5 mm thick hot dip galvanized pre-painted steel sheets on both sides of the CFC free Polyurethane Foam of density 40 kg+/-2 kg/CUM.

° The sheets should have 150 gsm of Zinc coating on both sides followed by a 25 micron polyester coating. The exposed surface of the sheets should have a polyethylene coating. The painting shall be in accordance with the Class-1 as per Table-1 of IS: 14246:1995.

° The steel sheets should have formed grooves of suitable pattern to provide extra strength and to enhance the appearance of cladding.

° The material, both PUF block and panel should be fire retardant type and should have excellent self-extinguishing characteristics

° The panels shall be joined together by Tongue and Groove interlocking method.

° The properties of PUF shall be as follows

The Roof panels should be 50mm thick panels having 0.5mm thick hot dip galvanized pre-painted steel sheets on both sides of the CFC free Polyurethane Foam. The steel sheets should be of corrugated type.

3. Door

° Door material should be the same as that of wall panel.° All doors shall be provided with Anodized Aluminium framework, hinges, rubber seal, door handle (150mm size), door closure and door latch.

All door shutters shall be hinged panel type using 50 mm PUF panel (Same as that of Wall Panel) with anodized dipping on all sides.

The doors and window frames shall be Aluminum/PVC/FRP/powder coated GI sections with PVC/PUF/FRP door shutters or equivalent material.

4. Floor ° For Rooms and Corridors

Ceramic tiles of thickness 6 mm and size 200*300 mm to 450*450 as per approved Colour and design.

For Toilets:a, Anti skid ceramic tiles of thickness 6 mm and size 200*300 mm to 450*450 as per approved

Colour and design.b, Tile joints to be finished with tile grout of approved make and thickness as directed by the

corporation.5. Joints

The panel to panel jointing in the walls is to be achieved by tongue and groove configuration with the use of minimum three Nos. of eccentric cam locks. The strengthening of joints shall be ensured by suitable measures such as Tie rods/flashings/corner panels etc.

6. Windows & Ventilator

a, All windows and Ventilators shall be provided as per the drawings of Windows and Ventilators finalised during technical negotiation.b, All windows and Ventilators shall be High impact Resistance uPVC with three walled structure having EPDM Gasket.c, uPVC frames are reinforced with galvanized steel where additional structural strength is needed.d, 1 * 10 mm Multi walled Poly Carbonate sheets shall be provided in all Windows and Ventilators.

7. Electrical a• Conduits

a, All conduits shall be of minimum 20mm P.V.C rigid type.b, Conduits shall be conforming to IS: 2509 – 1973 and IS: 3419- 1989.c The conduits shall be placed on the surface of PUF panels. Saddles for clamping shall be of a heavy

gauge non metallic type with base.

b. Boxes

a. All boxes shall be of surface mounted type and shall be confirming to IS14772-2000 b. Boxes shall be of rigid PVC moulding type an all sides except for front side. The minimum thickness of walls shall not be less than 2.00 mm and clear depth shall not be less than 60 mm.

c. PVC boxes shall be free from burrs, fins and internal roughness .

c. Wires

a. All internal wires shall be multi stand copper conductor type b. Minimum size of wiring to be followedc. Light and 5A socket wiring – 1.5 sq.mm.d. Power – 15A socket wiring- 4.0 sq. mme. Circuit with 1000 W power – 6.00 mmf. Copper conductor cable shall be PVC insulated, fire retardant, low smoke (FRLS) type confirming to BIS specification g. Internal wiring shall be of Finolex/Polycab or equivalent make.

d. Switches and face plates

a. All switches and face plates shall be of modular type.b. the switches and plates shall be ISI marked .c. Switches and switch plates shall be of Anchor/Crabtree or equivalent make.

e. Switch gear

Switch gear shall be of Havell’s or equivalent make.

f. Light Fixtures

a. All light fixtures shall be CFL lamp based.b. Light fixture area, passage, kitchen and outside on the walls

Format of Preliminary Agreement(To be executed in Kerala non judicial Stamp paper worth Rs 100/-)

Preliminary agreement “Preliminary agreement” entered in to on the ..................... day of 2013 between Kerala Forest development corporation Ltd, a company registered under the Indian Companies Act, 1956 having its registered office at “Aaranyakom’. Karapuzha, Kottayam (herein after called KFDC) represented by the Managing Director of the one part and .............................................................................................................. Bids will be rejected if agreement is not executed within 30 days from the date of letter of acceptance and the work will be rearranged at the risk and cost of the original tenderer. The EMD of the defaulted tenderer will be forfeited to the Corporation.”

If the contractor does not come forward to execute the agreement after the said work is awarded and selection notice issued in his favour or commits breach of any of the conditions of the contract as stipulated in para ……. Of the instructions to intending bidders, then KFDC may rearrange the work otherwise at the risk and cost of the contractor and loss so sustained by KFDC as assessed, quantified and fixed by the Managing Director can be realized from the contractor under the Revenue Recovery Act as if arrears of land revenue after giving due notice to the contractor. The decision taken by the Managing Director shall be final and conclusive and shall be binding on the contractor.

The contractor further agrees that any amount found due to KFDC under or by virtue of this agreement shall be recoverable from the contractor from his EMD and his properties movable and immovable as arrears of land revenue under the provisions of the Revenue Recovery Act for the time being in force or in any other manner as KFDC may deem fit in this regard.
