031507RG-Per the OCTAP Administrator, OCTAP decided to issue Konstantinos Roditis, President, 24/7 Yellow Cab an Administrative Action/Notice of Violation #10248, with $200 in fines (3rd occurrence within 12 months), for violating the following sections of the OCTAP Regulations:

"5.10.2. Allowing operation of a Taxicab by a Driver not possessing a valid OCTAP Driver Permit stating that the Driver is affiliated with the Permittee."

031507RG-OCTAP scheduled an Administrative Hearing for Konstantinos Roditis to determine further action against 24/7 Yellow Cab. The hearing is set for Thursday, April 12, 2007 at 10:00 am. A certified letter indicating the date/time/location of the hearing was sent to Mr. Roditis.

032107RG-Received a letter from Mr. Roditis asking that the Administrative Hearing be postponed due to previous travel plans. The OCTAP Administrator approved the postponement and rescheduled the Administrative Hearing for Thursday, May 10, 2007 at 10:00 am.

DRIVER SUSPENDED PENDING ADMIN HEARING FOR SEXUAL ASSAULT

080807RG-OCTAP Regulations, Sections 6.15.2 states that a Driver Permit may be suspended or revoked by the OCTAP Administrator for circumstances providing grounds for denial of a Driver Permit as outlined in the OCTAP Regulations. Also, the OCTAP Regulations, Section 6.14.10 states Driver Permit shall be denied, suspended, or revoked for good cause after an administrative hearing by OCTAP, subject to appeal pursuant to Section 12. OCTAP Received a Subsequent Arrest Report from the Department of Justice dated July 9, 2007. The Report indicates driver was arrested on July 7, 2007 for PC 243.4(E)(1) - Sexual Battery: Touch for Sexual Arousal. OCTAP also received additional information concerning the circumstances of the incident which led to the arrest. This information indicates that the incident took place during the course of driver's duties and responsibilities as an OCTAP Permitted taxicab driver. The circumstances which led to his arrest, as well as the arrest information contained in his Department of Justice Report, indicates that driver's continued possession of an OCTAP Driver Permit poses an immediate safety, health, and welfare hazard to the public. Therefore, to ensure the public’s safety, health and welfare, driver's OCTAP Driver Permit is hereby suspended, effective immediately, pending the outcome of an Administrative Hearing.

Driver's Administrative Hearing has been scheduled for Thursday, August 16, 2007 at 09:00 am. On 080107, OCTAP sent driver the suspension letter, which included the date/time/location of his Administrative Action Hearing: 1) regular mail 2) certified #7004 0750 0001 2821 5327. OCTAP also sent 24/7 Yellow Cab two suspension letters for driver: 1) regular mail 2) certified #7004 0750 0001 2821 5341. Also faxed the company a copy of the suspension letter.

011509RG-Anaheim Enforcement Night at Mimi's Café. Driver DP #1682 - (24/7 Yellow Cab)), was issued a written warning for violation of the OCTAP Regulations 6.15.1 and 9.4 - Not activating the meter while carrying passengers and Section 6.6 - Driving outside authorized zone, for picking up in the city of Anaheim with no franchise agreement while driving 24/7 Yellow Cab #751. DRIVER ALLEGED LEAVING CAB TO SOLICIT BUSINESS CAUSING DISTURBANCE

061509RG-last week on Wed, 6-10-09 at about 1045, GGPD (Mike Feher) received a call from a Bell man at the Crowne Plaza hotel about a taxi issue. The bell man told Officer Feher he was working that morning about 0630 am at the hotel, when a male middle eastern man in his mid to late 50's came in the hotel lobby and was soliciting guests for a taxi. when hotel staff told him nicely he can not do that in the hotel, the taxi driver became angry and was yelling in the lobby and out in front as he left in his taxi. it was a black toyota from 24/7 taxi cab #750.

RG-I called 24/7 Yellow Cab and spoke to Konstantinos; whom told me that the driver of that cab was Driver Permit #3743.

To 24/7 Yellow Cab Management. Please investigate and inform driver that: 1) leaving his taxicab to solicit business is a violation of the OCTAP Regulations, Section 9.3. 2) Such alleged behavior is not in the best interest of the taxicab industry or your company. Also, GGPD asked that I relay the message that such alleged actions will not be tolerated. Will leave incident open for company response.

061509RG-Officer Mike Feher made contact with the driver and counseled him. He denied soliciting anyone and was told if he had problems with hotel staff to contact a hotel supervisor, or me and to walk away without any verbal confrontation.

061609RG-Konstantinos Roditis stated that the facts of the incident were not correct (as giving by the bell man); and that he has spoken to the driver. No further action is needed. Incident closed.

020910RG-Received a letter from Mr. William Kennon, attorney for driver, stating his intention to represent driver in this matter. Mr. Kennon/Driver submitted his Appeals request to this office. Mr. Kennon also requested that all discovery materials be sent to him.

DRIVER TOOK WRONG ROUTE

070210KS- RP called on behalf of his companion who rode in cab # 731, from 24/7 Yellow Cab, on 061010. According to the RP, the companion was picked up around 1940 at the Irvine Station and asked the driver to take him to his home. RP states the driver went the wrong way and the customer ended up having to pay $20 plus a $3 tip for what should have been a 1.9 mile drive. According to the RP, the driver forced the companion to pay the tip since he said that that the minimum amount was $3.00 even though the companion only wanted to pay $1.00. The caller was frustrated that this happened since he feels 1.9 miles is not worth $23.00 for the ride. According to the RP, the caller tried to contact the driver directly and eventually found (and rode with) the driver, but when the caller confronted the driver and asked the driver for his information the driver said "f*** you" to the caller. At this point the caller decided to call the taxi company (1-888-247-TAXI) where he spoke to a representative named Angie. He states, the representative told him that a supervisor named Irene spoke to the driver about the issue and he claimed he did not remember this incident. RP said that Angie informed him they would pay back $9.00 to the caller for the incident. The caller did not like how the situation was handled since the driver did remember the incident when the companion rode with the same driver the second time. The caller wants something done with this driver since the companion was scared when he rode with this driver.

070610KS- The caller was able to obtain the taxi number which is #731 as well as the license plate number which is 8M53814. Kasey spoke with Konstantinos on 070210, the driver of cab #731 was DP # 2469.

070610KS- Betty from OCTA spoke with the companion on 061810. According to him, he spoke with 24/7 Yellow Cab and was told that the driver is an independent agent and there is nothing they can do. He strongly feels that OCTA regulates the taxis because of the emblem on the taxi and should be concerned that the taxi driver is not taking the most direct route from Point A to Point B and is rude to the customer. Betty explained OCTA is involved in the licensing of the driver. He wants a clearer explanation on OCTA's role with the taxi drivers.

070710RG-I asked Konstantinos Roditis to investigate and forward his results to OCTAP. I received an email from 24/7 Yellow Cab on this date. The following is taken directly from the email:

"I have talked to Angela Roditis regarding this matter and we are satisfied with our investigation. The customer stated that he was overcharged and we refunded $9.00 back to the customer. Approximately a week later this customer verbally harassed our driver at the Irvine Train Station and reached into the vehicle to try and steal our driver’s OCTAP permit. He then called our dispatch office and verbally harassed our dispatcher. We take complaints from customers seriously and without proof we refunded the customer back $9.00 because he stated that is how much he was overcharged. If he was overcharged or the driver didn’t take the most direct route then this issue has been remedied by the refunding of the $9.00. Above the refund, we will not take any further action. We consider this matter closed and we have nothing further to add to this investigation". The mailed was digitally signed as: Konstantinos Roditis, President/CEO.

Konstantinos Roditis stated that Irene Roditis, 24/7 Yellow Cab Manager, handled the incident with the driver. Mr. Roditis did state that the refund of $9 was accepted by RP, which indicates resolution was reached. Mr. Roditis also stated that the driver was counseled concerning the OCTAP Regulations Section 9.1 and that the most direct and accesible route must be used at all times when transporting passengers.

No further action is required at this time. Incident closed.

DRIVER POSTING "CASH ONLY" SIGN IN VIOLATION OF SECTION 9.8

080410RG-Driver was driving 24/7 Yellow Cab #758 on July 28, 2010 when he was stopped for a random inspection at the John Wayne Airport by Deputy Medina. Deputy Medina noticed that the driver was displaying a "Cash Only" sign near the meter. Deputy Medina called myself and I asked him to inform the driver to remove the sign and to remind the driver that per the Regulations, credits cards must be accepted (and electronically processed) if desired by the customer. As a result, written warning #10-032 has been issued to the driver and sent: 1) regular mail 2) certified #7004 1160 0005 5135 6901. No further action is required at this time. Incident closed.

MAY 2011 - DRIVER ISSUED NOV #10-098 WITH $100 FINE FOR NO DP

050911RG-Driver was issued a Notice of Violation #10-098 with a $100 fine for violations of 6.14.1 and 6.8. The Notice of Violation read:

"On May 1, 2011 at Harbor and Garden Grove Blvds, you were stopped by an Orange County Sheriff's Deputy while operating 24/7 Yellow Cab #720. During the stop, the Deputy confiscated your expired Driver Permit (expiration date of April 29, 2011) and you were not in possession of a valid Driver Permit required to operate a taxicab as outlined in the OCTAP Regulations Section 6.8. Notes: 1. at the time of the stop, "Not in Service" signs were not present in the vehicle windows (which would indicate an out of service taxicab). 2. You renewed your Driver Permit on April 19, 2011 but were not yet in possession of the new permit at the time of the stop. Driver stated to the Deputy that "Gus" from 24/7 Yellow Cab told him that he could operate his taxicab without his permit.

This Notice of violation serves as notice that any future violations may result in the denial, suspension, or revocation of your OCTAP Driver Permit. Also, the OCTAP Regulations Section 6.15 states that the OCTAP Administrator may, in lieu of revocation, impose a penalty in the form of a fine, a period of suspension, or both a fine and a period of suspension".

Driver was sent two copies of the Notice of Violation: 1) regular mail 2) certified #7010 0290 0000 8888 9778. Driver has 30 days to pay the fine.

060111RG-Received the Notice of violations back from the post office as NOT DELIVERABLE AS ADDRESSED; confirmed mailing address on envelopes with address on driver's application. I called the driver and spoke with him. I informed him of the Notice of Violation and that he needs to come into the OCTAP Office by 2:00 pm on Thursday, June 2, 2011 to pick up the Notice of Violation. Driver agreed and stated that he would show. Bella witnessed the phone call and heard the conversation.

060211RG-Driver showed today as he stated. I asked him to open the certified receipt letter and I had him sign and date the Notice of Violation. I made a copy for OCTAP records and gave him the original. I again stated that he would have to pay the fine by 061311 or that OCTAP will take steps to revoke his driver permit.

During the field contact, the Administrator observed that you were not displaying your driver permit as required. When asked why your driver permit was not displayed, you stated that you were not in service (your vehicle was not displaying NOT IN SERVICE signs). After locating and presenting your driver permit from within a stack of papers, you snatched the driver permit back from the Administrators hands and threw it to the opposite side of the vehicle. The driver complained that he had been pulled from the airport. Upon arrival at my home (address above) the meter read $4.95. I handed the driver a $20 bill and asked for $12 change. He (the driver) then stated "We have an $8 minimum, you can have $10 back) and would only give me a $10 bill. Rather than cause a scene, I noted that the cab number was 645.

I assumed that since I often use this company for airport travel, contacting them would rectifiy the situation. When I called, I asked to speak to a supervisor, and after five minutes on hold was told there was no supervisor working, and if I had a complaint, they would call me back tomorrow, before 8 am, and would not be available after that time. When I stated that I would rather work with them than contact the county authority, I was told "Contact whoever you want, there's no one here for you to talk to". - End of RP statement.

OCTAP Received a Subsequent Arrest Report from the Department of Justice dated June 13, 2007. The Report indicates that DP#1471 was arrested on June 11, 2007 for PC 220 - Assault To Commit Rape. OCTAP Also received additional information concerning the circumstances of the incident which led to DP#1471's arrest. This information indicates that the incident took place in or involving an OCTAP permitted taxicab. The circumstances which led to DP#1471's arrest, as well as the arrest information contained in DP#1471's Department of Justice Report, indicates that DP#1471's continued possession of an OCTAP Driver Permit poses an immediate safety, health, and welfare hazard to the public. Therefore, to ensure the public’s safety, health and welfare, DP#1471's OCTAP Driver Permit is hereby suspended, effective immediately, pending the outcome of an Administrative Hearing. 060607RG-OCTAP conducted an OCTAP/JWA Enforcement Day at the John Wayne Airport. DP #609, A Taxi Cab, was stopped by law enforcement for a random inspection. DP#609 was cited for code violations at JWA, including picking up on the upper level and servicing the John Wayne Airport when A Taxi Cab is not authorized to do so. OCTAP issued DP#609 a Notice of Violation #10339, with a $100 fine, for violation of the OCTAP Regulations, Section 6.6:

6.6 "A Driver who has been issued an OCTAP Driver Permit may only pick up passengers in the Area of Jurisdiction of those Agencies that have approved the Permittee he/she represents".

062707RG-DP#609 came in to pay the fine and/or appeal. DP#609 stated that he would be leaving the country next week and wouldn't be back for 9 months. I informed DP#609 that I may not be able to hold his appeals hearing for that long; but that I would speak with the OCTAP Administrator to see if there was anything we could do. 111407RG-111407RG-While performing random inspections/enforcement stops at the John Wayne Airport, noticed , DP #3056, was operating his taxicab, A Taxi Cab #446, VP #5775, without displaying his driver permit and without being in possession of his driver permit. IssuedDP #3056 a Notice of Violation #10341 for violations of the OCTAP Regulations, Sections 8.10.3 with a $50 fine and Section 6.15.1 with a $100 fine. Vehicle Permit #5775 was also removed from the vehicle to ensure the driver did not continue to operate in service. Fines must be paid within 30 days unless appealed.

Issued Mr. Abukar a Notice of Violation #10342 for violation of the OCTAP Regulations Section 6.15.1 with a $100 fine and Section 8.10.3 with a $50 fine. Mr. Abukar has until 122007 to pay the fine or unless sooner appealed.

111407RG-Driver appealed the Notice of Violation #10342. Sent driver two Appeals Hearing Schedule Letters, along with the appeals procedures: 1) regular mail 2) certified #7004 0750 0001 2821 6348. Appeals hearing is scheduled for Thursday, January 10, 2008 at 1000. Driver's file is in active file cabinets.

020408RG-Decision of the Hearing Panel: The hearing panel unanimously agreed with the OCTAP cause for the issuance of the Notice of Violation. However, the hearing panel decided to dismiss the violation of the OCTAP Regulation Section 6.15.1 indicated on the Notice of Violation. The violation of the OCTAP Regulation Section 8.10.3 will stand, and the $50 fine associated with this violation must be paid within 30 days. Incident will remain open until fine is paid. OCTAP received drivers State of California Department of Justice Criminal History Report dated December 17, 2007. This report indicates a November 1, 2007 misdemeanor conviction for PC 242 - Battery. DP #186 IN CAB #530 THREATENED VALET STAFF AT GRAND CALIF HOTEL

041508RG-Received a Security and Emergency Services Security Report from Valet Services (Bell Services). The incident took place on April 2, 2008 at 0837 am hours at the Grand California Hotel at the Disney Resort in Anaheim. RPs stated that after allowing him (DP #186) to drop off his passenger,DP #186, A Taxicab, was approached by Adam Burt (valet) and Cruz Braulio (Lead) and was reminded that he is not allowed on the property; that he was banned from the property months earlier. RPs stated that DP #186 became very angry and began to raise his voice; stating that he was not banned and does not have to leave; asking for a manager. RPs stated that DP #186 began to accuse them of hating him and of racism. RPs stated that they informed DP #186 to leave before they called security and the Anaheim Police Department. RPs also stated that DP #186 was using profanity towards them; but that they, at no time, used profanity towards DP #186; and that they never used any racist remarks towards DP #186. RP stated that as DP #186 was starting to leave, that he (DP #186) began to say "I'm going to get you" to RPs. RPs stated that they told DP #186 he should watch what he says because it's coming across as a threat. RPs stated that DP #186 continued to use profanity and say "I'm going to get you" until and as he was driving off.

OCTAP Received the Security and Emergency Services Security Report via email on April 14, 2008. The report has a category of "Incident" with a disposition of "Report Only". The report has a CAD number of: 20080402-27640. The report indicates that DP #186 was issued another "Trespass Warning" and that he is at no time to enter the property. No police report was filed. Talked with Lynn Strong, A Taxi Cab Manager, and verified thatDP #186 was driving Cab #530 on that day.

041608RG-The OCTAP Administrator's decision was to immediately suspend DP #186's Driver Permit pending the outcome of an administrative hearing, scheduled for Tuesday, Aprill 22, 2008 at 0900 at the OCTAP Office. Notified DP #186 to come in to receive his Suspension/Notice of Administrative Hearing Letter. DP #186 came into the office, signed and dated the letter. Made copy for driver file and gave original to DP #186. Also faxed and mailed A Taxi Cab two (2) suspension letters: 1) regular mail 2) certified #7004 0750 0001 2821 4245.

041708RG-A driver, not identified, called asking why we suspended DP #186's permit. I explained to the driver that I would not discuss the situation with him. The driver was using profanity (not directed towards me) and was telling me that we can only suspend for drugs or alcohol. I again explained to the driver that I would not discuss it with him any further.

041708RG-DP #186 called shortly after and began to argue the suspension. I explained to DP #186 that the paperwork he was looking at was the Appeals Hearing Procedures and that the process outlined therein would not apply at the administrative hearing. I also explained to DP #186 that he can appeal the suspension. DP #186 refused my statement and began to state the he was going to spend $10,000 on a lawyer. DP #186 also stated that he was going to organize a "protest", of sorts, and bring 50 or 60 of his buddies, with their vehicles, to the OCTAP office. I tried to explain to DP #186 that any reports and paperwork may be available for him to view, at the Administrator's descretion, at the Administrative Hearing. DP #186 began to accuse me personally of suspending his permit. The phone conversation became redundant and unreasonable; to the point where I had to inform DP #186 that I would not discuss this with him any further and again reminded DP #186 of the date/time/location of the hearing.

041708RG-Received response from A Taxi Cab, as follows:

"RE: DP #186 OCTAP # 186 / Background Information on Complaint - OCTAP - DP #186 #186. To Whom It May Concern: About a month ago, our lease driver DP #186 approached me with a complaint about hotel staff at the Disney Grand California. He explained that certain staff at the hotel and another driver were "ganging" up on him to keep him from servicing the hotel. He indicated that they were trying to kick him out from the hotel. I called the hotel myself and asked for the Guest Services Manager. I asked if there were any problems with our drivers and he did not indicate any major or ongoing issues. I asked if there was anyone that had been banned from the hotel and he did not indicate so. I then called DP #186 and informed him of the results. DP #186 was concerned that his reputation was being affected and wanted to confirm whether or not he had been banned from the hotel. This was about a month ago. At that time, either shortly before my action or shortly after my action, I asked our public relations representative, John Boyland, to investigate and follow-up. Mr. Boyland mentioned that he met with the Guest Services Manager. Mr. Boyland indicated he did not receive any mention of DP #186 at all during that visit. Mr. Boyland can be contacted at (714)276-5755. I then received the OCTAP complaint dated 4-15-2008. I have been on vacation since April 4 - 14, 2008 and just returned on this day. My understanding is that Jim Carlson or another manager handled the initial complaint. I have opened our official investigation as of this day. DP #186 denies that he exhibited the behavior and/or was misinterpreted in the OCTAP complaint and disagrees with the suspension of his permit. - William Gray - A White and Yellow Cab Inc.

042208RG-DP #186's hearing was held. Many driver's showed along with DP #186 the morning of his hearing. One driver, whom refused to identify himself or to admit that he was a permitted driver, attempted to enter the hearing room several times and was told that he was not allowed. Many cabs were driving up and down the street and drivers were standing in the street. For safety reasons, OCTAP Staff called TPS and had a deputy on hand in case things got out of control. The hearing ended and everyone left with no further incidents.

042908RG-Received an email from Bill Gray, A Taxi Cab, which stated that A Taxi Cab is closing this investigation concerning this incident and defers to OCTAP.

042408RG-The decision of the administrator, after the administrative hearing, was to revoke DP #186's Driver Permit with no stay granted. Sent DP #186 two revocation letters, along with the required appeals forms: 1) regular mail 2) certified #7003 2260 0003 5051 6114.

042408RG-Received a letter from Mr. Alan Forester, Attorney, whom will be representing DP #186. The letter asked for a transcript of the admin hearing be sent to him. OCTAP staff forwarded the letter to Omar Sandoval, OCTA Legal Counsel.

050208RG-Mr. Forester requested a copy of the Admin Hearing Decision (revocation) Letter so that he may help DP #186 fill out his appeals form. Per the Administrator, faxed a copy of the letter to the attorney along with all the appeals forms and procedures.

050508RG-Received two requests from DP #186's attorney asking for a copy of the transcripts from DP #186's administrative hearing of April 22, 2008. Contacted OCTAP IS Department to ask if they could make copies of the recorded tape from the administrative hearing. IS stated that they could make two copies for us; one for DP #186's attorney and one for OCTA Legal Counsel.

050608RG-Per Omar Sandoval, the previous letter from DP #186's attorney constitutes an appeal. OK to schedule DP #186 for his appeals hearing. Sent DP #186 two Appeals Hearing Schedule Letters (dated 050508), along with the required appeals hearing procedures: 1) regular mail 2) certified #7003 2260 0003 5051 6220. 051508RG-Again called Mr. Forester that his requested materials are ready for pickup. I also informed him that I would place materials in the mail tommorrow morning if I did not hear from him. Received a fax from Mr. Forester authorizing his client, DP #186, to pick up the requested materials. DP #186 arrived at approximately 1330. DP #186 signed a letter indicating he accounted for all materials. Made a copy of the letter and included it in the package. The letter asked that Mr. Forester sign, date, and fax to OCTAP upon taking receipt of the requested materials.

Talked with Mao Shiokura, Mr. Forester's law clerk, whom verified that the pdf files were received and have already been printed out for review. 061008RG-Called the Grand California Hotel and talked with Mr. Adam Burt. I asked if I could meet with him to discuss his report, but he stated that he would not have time and asked if I could discuss his statement over the phone. I agreed. I first read his statement back to him (word for word) and asked him to verify the truthfulness of the statement. Mr. Burt stated that the statement was accurate. I asked Mr. Burt if he would be willing to show at the appeals hearing on Thursday, June 12, 2008 to give his statement in person. Mr. Burt stated that he could not miss work to attend the hearing. I did encourage him to attend and stated that we might try and call again sometime today. As to his statement, I asked Mr. Burt if he felt threatened by DP #186's actions on April 2, 2008. Mr. Burt stated that he didn't necessarily feel threatened, even though DP #186 did verbally threaten him. Mr. Burt also stated that there are numerous occasions where he has seen DP #186 and that DP #186 will try and intimidate Mr. Burt and other cast members. Mr. Burt stated that he does not get intimidated by DP #186 even though DP #186 attempts to do so. The phone call between myself and Mr. Burt was approximately five (5) minutes long. I felt completely satisfied that the hand-written statement given by Mr. Burt on April 2, 2008 was accurate and truthful. Mr. Burt did not seem to have the time or the inclination to fabricate any portion of the information contained in his statement.

061008RG-Called the Grand California Hotel to speak with Braulio Cruz; spoke with Greg (cast member). Greg stated that Mr. Braulio Cruz is off until Friday. I asked Greg if he could take my name and phone number and contact Mr. Cruz and ask him to give us a call. Greg stated that he would.

061008RG/JG-Spoke with Mr. Jose-Ignacio Obando (714-956-6555, Security Lead for Grand California Hotel). Mr. Obando interviewed Mr. Adam Burt and Mr. Braulio Cruz (cast members, Grand California Hotel) concerning the incident on April 2, 2008 (DP #186) at the Grand California Hotel in the Anaheim/Disney Resort Area. Mr. Obando stated that he normally gets called to respond to Out of Control/Emergency situations only; and is responsible to document an incident where someone feels their life is or has been threatened. Mr. Obando stated that DP #186 was using an angry, combative tone and that Mr. Adam Burt felt threatened by DP #186's behavior. Mr. Obando stated that DP #186 continually wants to do things his way and does not want to adhere to, or comply with, property (resort) policies. Mr. Obando stated that Wolde drove away cursing and threatening at a very high tone. Mr. Obando drafted the Security and Emergency Services Security Report (on file).

Mr. Obando was asked about trespass warnings. Mr. Obando stated that trespass warnings are given to individuals whom have become out of control, abrasive, refusing to leave, etc. DP #186 was again given a tresspass warning on April 2, 2008 and informed that if he did not leave, Anaheim PD would be called and that he would be arrested. Also, Mr. Obando stated that if an individual returns after being issued a tresspass warning, they may call police to have that individual removed from resort property and/or arrested. Mr. Obando also stated that when a tresspass warning is given to a taxicab driver, that the taxicab company, at the security lead's descretion, may be contacted and informed that the driver is not welcomed back onto hotel/resort property. This recent tresspass warning given to DP #186 was due to multiple incidents/occasions of refusing to adhere to property/resort policies. Mr. Obando stated that if DP #186 returns, that he would be asked to leave.

Mr. Obando stated that after the incident was over and after his investigation, he confirmed and was confident that the statements given by Mr. Adam Burt and Mr. Braulio Cruz were true and accurate. OCTAP feels that after discussing the incident with Mr. Obando, that the official security report made for the incident on April 2, 2008 (concerning DP #186) at the Grand California Hotel is true and accurate.

061208RG (0900 hrs)RG/JG-Spoke with Mr. Cruz Braulio (via phone call). OCTAP (RG/JG) asked Mr. Braulio to verify the truthfulness and accuracy of his handwritten statement conatined in the Security and Emergency Services Security Report. Mr. Braulio gave us his explanation of the incident concerning DP #186 on April 2, 2008 at the Grand California Hotel in Anaheim. Mr. Braulio's statement of events which occurred on that day completely concur with his handwritten statement contained in the report and received at OCTAP on April 11, 2008.

We (JG/RG) were completely satisfied that the account given (both his handwritten statement and per phone call) of the incident concerning DP #186 on April 2, 2008 at the Grand California Hotel is true and accurate.

061208RG-The decision of the appeals panel is as follows:

"The hearing panel unanimously agreed with the OCTAP cause for the revocation of appellant’s OCTAP Driver Permit. The decision of the hearing panel is that appellant’s OCTAP Driver Permit shall be suspended for a period of six (6) months from the date of the hearing. Additionally, after the six month suspension, appellant shall be issued a Conditional Permit for a period of twelve (12) months."

063008RG-Received a faxed letter from DP #186's attorney, Mr. Alan Forester. In the letter, Mr. Forester requested a compromise to the decision of the appeals panel. Mr. Forester asked OCTAP to forego the six month suspension while retaining the conditional permit.

071608RG-The decision of the OCTAP Administrator was to reduce the suspension period to four (4) months; with the start date of the suspension as April 16, 2008 rather than June 12, 2008. If this compromise is accepted, DP #186 can be reinstated and issued his OCTAP Driver Permit on August 16, 2008. A letter stating this proposed compromised was faxed and mailed to Mr. Forester: Certified #7003 2260 00063 5051 7098. OCTAP is waiting to hear from Mr. Forester.

071808RG-Received a letter dated 071808 from Mr. Alan Forester. The letter rejected the compromise offered by OCTAP; stating severe financial hardship on behalf of his client. After talking with Iain Fairweather and OCTA Legal Counsel, it was decided that OCTAP would allow DP #186 to return to wotk on Monday, July 21, 2008 and be issued a Conditional Permit for a period of 14 months.

072108RG-The final decision (compromise) of the OCTAP Administrator was to reduce the suspension period to three (3) months; with the start date of the suspension as April 16, 2008 rather than June 12, 2008. Also, DP #186 will be on probationary (conditional) status for a period of fourteen (14) months. If this compromise is accepted, DP #186 can be reinstated and issued his OCTAP Driver Permit on August 16, 2008. A letter stating this proposed compromised was faxed and mailed to Mr. Forester: Certified #7003 2260 0003 5051 7104. This proposal was informally accepted through a phone conversation between Mr. Forester and Mr. Fairweather.

#4502 REVOKED FOR REFUSAL TO TEST - ALCOHOL ON 081409

081809RG-OCTAP Regulations, Section 6.15.6 states that a Driver Permit may be revoked for a Positive drug/alcohol screening test or failure to submit to random testing pursuant to the Drug and Alcohol Certification Program required in Section 5.2.2.

OCTAP received letters from A Taxi Cab and Norton Medical Industries that on Friday, August 14, 2009 driver was directed by Jim Carlson, A Taxi Cab, and refused, to immediately proceed to a testing facility, for a probable cause alcohol screen. Refusal to test is considered a positive test by Norton Medical and a violation of the OCTAP Regulations, Section 6.15.6.

The collission report stated the following: After leaving the scene of the accident, DP #4230 was contacted and eventually escorted back to the scene by an Irvine Police Officer. In the Traffic Collision Report, the driver acknowledged knowing that he had initially impacted another vehicle and also acknowledged that he knew the requirements for the mandatory exchange of information after a traffic collision. In summary, DP #4230 knew that he had collided with another vehicle, that he must stop to exchange information, but chose rather to ignore the mandatory requirements, proceeding to pick up a fare instead. DP #4230 proceeded back to the scene only after being directed to do so by his company and by the Irvine Police Department. The traffic collission report stated and recommended that due to the driver’s actions, that DP #4230 be charged with VC 20002(A)-Hit and Run.

1. Driver Permit will remain suspended pending the District Attorney’s decision to file charges.

2(a). If no charges are filed, OCTAP will reissue Driver Permit (if not expired) with the applicable replacement fee, along with the issuance of a warning notice and a $100 fine.

Officer Ostrowski stated that he received a notice from the District Attorney stating that he would not file charges against DP #4230due to the fact that the woman could not positively identify the driver upon his return to the scene; even though positive identification on the vehicle itself could be made. Officer Ostrowski is going to contact the DA sometime tommorrow or Thursday to find out if anything can be done to justify filing charges, and he (Officer Ostrowski) will notify OCTAP of the outcome no later than Thursday Afternoon or Friday morning. Also, I performed a case search on DP #4230 on the OC Superior Court website, with no results concerning this case.

The witness/victim inability to identify DP #4230 as the other driver, and the fact that DP #4230 returned to the Irvine Police Dept after he was contacted by his dispatch is the reason for not filing. They do not feel comfortable with the case if it went to court so they are choosing not to file. I attempted to persuade the DA due to the fact DP #4230 is a professional driver and knows he has to exchange information per OCTAP regulations as well as the fact he left so he could pick up a fair putting his financial gain ahead of his responsibility to exchange information with the vehicle he hit. The OCTAP Regulations Section 6.7 states that each Driver Permit issued by OCTAP shall be valid only for the Driver to operate a Taxicab for the Permittee indicated on the Driver Permit. No Driver may operate a Taxicab for a Company other than the Company listed on the Driver's Driver Permit. The OCTAP Regulations Section 6.14.7 states that A Driver Permit may be suspended or revoked by the OCTAP Administrator for Notification of any matter requiring such action by OCTAP. The OCTAP Regulations Section 6.15 states that In lieu of revocation, the OCTAP Administrator may impose a penalty in the form of a fine, a period of suspension, or both a fine and a period of suspension. OCTAP Received notification from A Taxi Cab that on October 31, 2010, driver allowed operation of his taxicab by a Driver (DP #3344, who is not permitted or affiliated with A Taxi Cab. This action jeopardized the health, welfare, and safety of the public and was in violation of driver's company’s vehicle leasing policy and a violation of the OCTAP Regulations 6.14.1.

As a result, driver was issued a Notice of Violation #10-037 with a $100 fine. Driver mailed the Notice of Violation: 1) regular mail 2) certified #7004 2510 0002 8760 9645. Driver must pay fine before a reinstatement, transfer, or renewal permit can be issued.

On February 23, 2011, OCTAP received a POSITIVE Controlled Substance Test Results Report from Norton Medical with a drug screen date of February 22, 2011. The POSITIVE result is due to driver's failure to submit to random testing when directed by his taxicab company on Sunday, February 20, 2011. Additional and admissible information indicates that driver did not proceed to the clinic to fulfill the random test until Tuesday, February 22, 2011. The Code Administrators observed a passenger in the back seat, the meter was not activated, the driver permit was not displayed, and there was no "Not in Service" signs in the vehicle. On February 24, 2011, the Deputy OCTAP Administrator called driver for an Administrative Hearing to determine the facts of the incident. Driver stated during the hearing that he was transporting family members, and was not operating the taxicab in service. 032811RG-An Administrative Hearing was scheduled and conducted on March 24, 2011. The reason for the hearing was to fulfill due process, as outlined in the OCTAP Regulations, regarding the following incident:

On March 16, 2011, OCTAP received a Preliminary Kidnapping Investigation Report from the Newport Beach Police Department. The report indicates that on March 5, 2011 while driving A Taxi Cab# 563, driver detained a passenger inside her taxicab, against her will, for the purpose of resolving a fare dispute.

The result of the Administrative Hearing is that the Administrator concluded that driver’s intent was not one of malice, and that she does not pose an immediate threat to public safety. Driver may retain her Driver Permit at this time. However, if charges of KIDNAPPING (or equivalent) are filed, OCTAP will be required to suspend driver’s Driver Permit until the charges are adjudicated.

Would not accept credit cards and had a "CASH ONLY" sign posted on the inside of the taxicab (driver did eventually take RP's credit card). 2. Was not displaying his driver permit. Both are violations of the OCTAP Regulations Sections 8.10.3 and 9.8. After speaking with A Taxi management, found driver to be: Ricardo Crisantos, DP #4646. RP also provided photos of the inside of the taxicab.

050311RG-OCTAP received a report from the Orange County Sheriff’s Department (OCSD) that on April 27, 2011 at approximately 0630 hours, A Taxi Cab #806 was stopped for a random inspection, by an OCSD Officer, at the John Wayne Airport during the JWA Enforcement Operation. The report indicates that the cab was being driven by a DP #2666, who has not applied for nor has been issued an OCTAP Driver Permit. The OCSD Report indicates that DP #2666 was in possession of Driver Permit #2666 and that the permit had been altered that would falsely identify DP #2666 as an OCTAP permitted driver. DP #2666 stated to the officer that he is driver's brother and that he drives his taxi on Alfredo's days off so he can make extra money. Also, A Taxi Cab confirmed that cab #806 was leased to Alfredo on April 27, 2011 and that the lease agreement did not allow for additional drivers.

Driver's actions to allow operation of his taxi cab by an individual who does not possess an OCTAP Driver Permit, has not been cleared with the Department of Justice and local municipalities, is not subject to random drug and alcohol testing, and has not been approved by his company’s insurance carrier caused an undue risk to the health, welfare, and safety of the public. As a result, OCTAP Driver Permit #2666 is hereby REVOKED.

021712RG-OCTAP received the following incident through the Orange County Health and Human Services 211 system: "Mr. Edward Adamson was assisting 81 year old Hope Johnson. After Ms. Johnson was in the cab the driver said, "Get out, I’m not going to take you. You need s special cab. The cab number is #591, company is 1-800- 4 My Taxi. Mr. Adamson called right away and spoke to Brenda. She said he needed to speak with Bill. After multiple calls and being told Bill was in meetings and then gone to lunch, Mr. Adamson called 211 to file a complaint and was referred to me. He and Ms. Johnson took Yellow Cab to several locations at a cost of $60."

080807RG-OCTAP received notification from the City of Anaheim that DP #687 was driving a taxicab, CABCO #634 with a suspended driver's license and an expired OCTAP Driver Permit. The taxicab belongs to DP #686. CABCO Management notified OCTAP that DP 687 was terminated from their company in February 2007, and that Konstantinos Karafotis was instructed to not allow his son to drive his taxicab; that driver must be the sole operator of taxicab #634.

CABCO notified OCTAP on July 17, 2007 that due to this incident in Anaheim, that DP# 687 was now being terminated from employment and is no longer authorized to operate a taxicab for California Yellow Cab. Both drivers have since transferred (renewed) with 24/7 Yellow Cab.

On July 07, 2007, OCTAP issued DP# 687 a Notice of Violation #10357 for violation of the OCTAP Regulations Section 6.15.1 (Failure to comply with the applicable provisions of the OCTAP Regulations) with a $100 fine. DP# 687 appealed the Notice of Violation #10357, submitting his appeals form to OCTAP on July 30, 2007. Dp# 687 was hand delivered an Appeals Hearing Schedule Letter on July 30, 2007. DP 687 appeals hearing is set for August 9, 2007 at 0930 am.

Per the OCTAP Administrator, the driver was issued a Conditional renewal permit on this date; pending the outcome of his requested appeals hearing and/or payment of the fine.

California Yellow Cab (CABCO Yellow, Inc.) was immediately notified, via telephone with Tim Conlon, to remove the driver from service and to confiscate his OCTAP Driver Permit. I explained the nature of the incident to him and he told me that he would issue the $15.00 discrepancy to the RP. I told Mr. Conlon that I would call him back with the RP’s address.@ 1425hrs, I spoke to the RP and told her that the taxicab company will be sending her the $15.00 re-imbursement, RP provided a mailing address. 7751 Crystal Village Lane, Las Vegas, NV 89113. I also told the RP to call me back if she does not receive the check within few weeks. RP was very happy and appreciative.

042709RG-Driver was suspended pending an admin hearing per the OCTAP Regulations Section 6.14.10 and Section 6.15.2, concerning the incident which took place on Saturday, April 25, 2009 where driver allegedly struck another vehicle with his taxicab.

The voice message received on this date at OCTAP by Irvine Police Officer Ostrowski stated that the driver struck the vehicle (after running a red light) at McArthur Blvd and the John Wayne Airport and continued traveling without slowing down or without stopping to check on the welfare of the occupants of the other vehicle. The message received stated that the damage to the front end of the other vehicle was moderate to severe. The message stated that the driver was pursued by witnesses and that he were eventually apprehended by police and charged with Hit and Run.

Driver came into the OCTAP Office to surrender his OCTAP Driver Permit. I informed driver that he would be contacted with a date/time/location of an administrative hearing. I called driver and informed him that his Admin Hearing will be scheduled for Wed, April 29, 2009 at 1000 am. I asked the driver to come in to the office on 042809 to sign the paperwork. Driver stated that he would come into the office as directed.

042909RG-DP# 726 brought in vehicle #714 for annual inspection. I found multiple minor items that would require a reinspection. I respectfully advised DP# 726 that his vehicle would require a reinspection and he became very angry. At first he refused to sign the inspection sheet, but did so when I indicated that I would be removing the Vehicle Permit. I explained to DP# 726 that his inspection was performed fairly and that any vehicle which has more than three minor defects listed is required to be reinspected, per OCTAP policy. I pointed out the defects I found and he was refuting everything that I was saying; so I stopped the conversation and wished him a good day. DP# 726 began to speak about other companies that don’t have insurance, etc. DP# 726 then followed me into the OCTAP office to file a complaint. I asked Elizabeth to give DP# 726 a complaint form. DP# 726 then said that he wanted a number to OCTA but that he did not want the Administrator's (Iain's) number. DP# 726 also stated that he was going to go to the paper and he was also accusing me of not being fair and that I just wanted the money. DP# 726 attempted to be intimidating and his accusations were unfounded, saying that I was "picking on him". Honestly, I did not want to find the defects that I did (that would require a reinspection) because I knew that it would cause this type of situation; but I did not feel that I could compromise my inspection standards to avoid a confrontation. 111009RG-A Taxi Driver called (DP #3748) and left message concerning an incident which took place at Disneyland at the bus parking area concerning a elderly couple and daughter. Later on that day, I talked to the customer whom was involved in the incident, as follows:

On November 7, 2009 at approximately 10:00 - 11:00 pm, an elderly couple, accompanied by their daughter (hereafter refered to as RP) was leaving Disneyland. They approached CABCO #822 for the ride. One of the customers is disabled and uses a scooter. RP stated that when they approached the driver of Cab #822, the driver began to "freak out" and said that he would not transport the scooter. RP stated that she told the driver that he would not have to transport the scooter, just her parents, and that she would make other arrangements for the scooter. RP stated that the driver continued to refuse service. RP then stated that another cab driver approached the driver of Cab #822 and stated that he would help put the scooter in the vehicle. RP stated (as well as DP #3748) that the driver of Cab #822 became violent with the driver whom was trying to help. RP stated that the driver of Cab #822 pushed the other driver more than once; and the the driver of Cab #822, at one point, grabbed the other driver by the throat and pushed him, which caused the driver difficulty in breathing/eating for a couple of days due to the injury received to his throat. RP stated that at some point, the Driver of Cab #822 agreed to transport, but that RP decided that she did not want to go with this driver because he was out of control. RP stated that she began to ask other cab drivers to transport them; but that the driver of Cab #822 was following her to these other cabs and would not allow them to transport the customers. RP stated that another cab pulled up, and she was able to quickly put her parents in that cab.

110909RG-Per Tim Conlon, the driver of Cab #822 was Driver Permit #186. Also, the other driver called RP and left a voicemail concerning the vehicle and the driver. The information left on RP's voicemail was that the cab was CABCO #822 and that the driver's name was disclosed and confirmed that it was DP#186.112409RG-Due to the circumstances of the incident, DP#186 has been scheduled for an Administrtive Hearing on Wednesday, December 2, 2009 at 1000. The report states that the driver was questioned and issued a citation for Health & Safety 11357(b)-Possession of Marijuana Less Than an Ounce. The report indicated that the marijuana was found in his possession and that the driver admitted use (smokes when he is depressed).

123010RG- DP #371 called last week and I spoke with him and he also called back yesterday and spoke with Jo-Ann. The driver stated that he went to court and that the charges of marijuana possession were dismissed; and that he would like to get his permit back. However, we explained to the driver that he was revoked and that he did not appeal the revocation within the required ten (10) days. The final revocation letter was sent on 122910; but we attempted to explain to the driver that he missed his window for appeal and that the revocation process must be completed. Also, per the OCTAP Regulations Section 6.14.10, a driver who has had their permit revoked shall be prohibited from reapplying for a period of one year. When Jo-Ann asked why he didn’t appeal, the driver stated that he was told to wait until he goes to court. Both me and Jo-Ann answers were the same to him; that he missed his window for appeal and that the revocation process was to be completed. The driver was given Patrick's phone number and he would like to call and speak with Patrick when he comes back next week.

010311RG-Per Patrick's email sent 123110, driver will be afforded an admin hearing via phone. Reason: It is considered reasonable for the driver to want to wait until his court date to request an appeals hearing; it strengthens his position. Once the admin hearing is complete, OCTAP will uphold the revocation (in the interest of public safety, based on the fact that (1) drugs were involved and (2) it happened in a taxicab vehicle) and give the driver the opportunity to appeal.

RP stated that the driver stated that he was a part time driver and that he could not access the needed systems to process RP's credit card. RP stated that the driver did run the meter and that the total fare came to $66, which he paid in cash.

After speaking with Matt from CABCO, found driver of cab #736 to be DP #5142. The driver called this morning and stated that he did not refuse the credit card but that RPs credit card was declined; and that he routinely accepts credit cards as payment. I advised the driver to discuss the situation with his company who will respond to this incident.
