BY SHEILA PURSGLOVE Legal News For more than 20 y ears, attorney Fred Acomb has prosecuted and defended inter- national arbitration and litigation matters around the globe. “This area of the la w is a g reat one for going places—literally,” says Acomb, a prin- cipal at Miller Canf ield in Detroit and chair of the Inter national Dispute Resolution Sec- tion. “I enjoy working with and against lawyers with legal and cultural traditions very different from my own. It keeps things fun, and the learning never stops.” The fun and lear ning also provides a slew of anecdotes: such as w hen Acomb flew to Kuwait City and cross-e xamined for eight hours a member of the r uling Al Sabah royal family, who was the former president of OPEC, a president of OAPEC, finance minis- ter of Kuwait, oil minister of K uwait, and CEO of the K uwait National Petroleum Co. “People called him. ‘Your Excellency,’ and there I was cross-examining him,” Acomb says. In Istanbul, he endured a hair -raising taxi ride where the driver missed his freeway exit, and sped backwards for nearly a mile, swerv- ing wildly to avoid the oncoming traffic. And in Shanghai, alone in a restaurant, Acomb tried to order from a menu that had no Eng- lish or pictures. “I didn’ t speak Mandarin, they didn’t speak English, and lord kno ws what I ate that da y. I still don’t know,” he says. His command of Ger man also leaves something to be desired. When giving a speech in Baden-Baden, and taking of f his jacket in a warm room, he used a local collo- quialism to explain why he was disrobing. As soon as the w ords left his lips his audi- ence erupted into laughter. “As I stood there red-f aced and confused, my host f inally had mercy and whispered in my ear that I’d just confessed to something of a highly intimate nature,” he explains. “Since then I’ve stuck to English.” Funny stories notwithstanding, Acomb proudly touts Miller Canf ield’s International Dispute Resolution (IDR) Section as the finest in the region. “But our aspirations are higher—our aim is to be kno wn globally as one of the f inest international arbitration boutiques in the world, and we’re well on our way,” he says. The IDR Section includes Professor Charles H. Brower II, who Acomb notes has a distinguished inter national reputation in the field, and a k een sense of strate gy and nuance in presenting inter national disputes. The team also includes Professor Troy Har- ris who, after years of practicing as an inter- national construction arbitration specialist at King and Spalding in Atlanta, co-authored the seminal book on the f ield. The section also includes Larry Saylor, Paul Hudson, and Jamie Woolard, lawyers who Acomb describes as “among the best I’ ve ever known anywhere. Our section includes extraordinary lawyers who have defended and prosecuted inter national arbitrations before arbitration tribunals around the world,” Acomb says. Routinely representing companies from outside the United States, most commonl y from Canada, Mexico, Germany, China, Fin- land, Sweden, France, the United Kingdom, Japan, and Poland, his own cases include suc- cessfully prosecuting and defending compet- ing claims for o wnership rights in the lar gest reserve of brown coal in the world, located in New South Wales, Australia; and oil, gas, coal bed methane, and coal mine methane reserves in the United States. The amounts at issue exceeded $300 million (U.S.). The adverse parties were energy companies in Australia and Canada, and Acomb’s client was an energy company in the United States. TAYLOR (AP) — A Detroit-area school district has won a k ey decision in a dispute over an unusual labor deal that w as struck before the state’s Right to Work law began last year. Three teachers in Taylor are challenging a 10-year agreement that forces teachers to pa y dues or a ser vice fee to a union. The deal between the district and the Taylor Federation of Teachers was made last year, shortly before a new Michigan law made union membership voluntary in various industries. An administrative law judge is recom- mending that the Michigan Employment Rela- tions Commission dismiss the complaint. Julia Stern says there’s nothing illegal about Taylor and the union reaching a deal before the new law began in late March. DETROIT (AP) — Se vere winter weather has forced the closing of federal cour ts in southeastern Michigan on Tuesday, postpon- ing closing arguments until next week in a bankruptcy court hearing on Detroit’ s agree- ment to pay off some bank debts. Bankruptcy court in Detroit was shut Mon- day amid heavy snow and sub-zero tempera- tures. Courts spokesman Rod Hansen said all federal courts in Ann Arbor, Bay City, Detroit, Flint and Port Huron were closed Tuesday. Hansen says the bankr uptcy case proceed- ings will resume sometime next week. State appointed Detroit emer gency manag- er Kevyn Orr testified last Friday that the pro- posal to ter minate the deal with UBS and Bank of America for $165 million is best for the city. The city pledged casino tax re venue in 2009 as collateral to a void defaulting on pen- sion debt payments. PONTIAC (AP) — A judge has issued the mandatory sentence of life in prison without parole to a man convicted of raping and stran- gling a 32-year-old mother of three, then dumping her body in a southeaster n Michigan lake. A boy fishing in Terry Lake in Pontiac on May 26 found the body of Rosaline Lee. The Detroit Free Press says police used DN A evi- dence to link 42-y ear-old Bobby L Taylor to the killing. Oakland County Circuit Judge Daniel O’Brien on Monday sentenced Taylor for first-degree murder. Assistant Prosecutor Paul Walton says Tay- lor saw Lee in her v an in the earl y morning when she parked in downtown Pontiac to pick up child support from the father of her youngest child. The Michigan Hall of Justice in Lansing, which houses the Supreme Cour t, Lansing office of the Cour t of Appeals, and State Court Administrative Office, was closed Mon- day. All Court of Appeals offices — in Detroit, Lansing, Grand Rapids and Troy — and the Court of Claims were also closed. According to state cour t spokeswoman Marcia McBrien, Cour t of Appeals or Cour t of Claims f ilings that were due Monday, Jan. 6, will be considered timel y if filed Tuesday. Any hearings scheduled for the Cour t of Claims for Monday were canceled and the parties will be notif ied of the rescheduled hearing date. The 36th District Cour t in Detroit w as closed except for felony arraignments and Wayne County Probate Court was also closed. U.S. District Court for the Easter n District of Michigan was closed and U .S. Bankruptcy Court for the Easter n District of Michigan also announced the cour t would be closed Monday because of the weather. Circuit Courts for Wayne, Oakland and Macomb Counties remained open and The Wayne County Prosecutor’s Office was open as well as the Third Circuit Cour t Criminal Division located in the F rank Murphy Hall of Justice. Lansing found itself right in the bullse ye and Mayor Virg Bernero declared a snow emergency that essentially shut down all Lansing city offices. University of Detroit Merc y Law School said on its website that it was closed Monday. All of the campuses of Thomas Cooley Law School were also closed. “Each campus makes an independent decision on w hether to cancel classes, ” said “This area of the law is a great one for going places— literally.” —FRED A COMB Company shows appreciation to legal community GRAND RAPIDS (AP) — A man w ho strangled his girl- friend to keep her from implicating him in a stabbing thre w a reading table Monday at a judge w ho’d just sentenced him to 50 to 100 years in prison. Jahleel Hoskins killed 26-y ear-old Latrice Maze, a mother of five, to prevent her from telling police about a non-f atal stabbing, according to Grand Rapids authorities. She disap- peared in March, and her body has never been found. Hoskins, 26, was in the middle of his trial in K ent County Circuit Court when he accepted a deal and pleaded guilty Dec. 11 to second-degree murder. He’d been charged with an open murder count, and the deal let him a void the risk of being con- victed of f irst-degree murder, which carries mandatory life imprisonment without parole. He already is ser ving 25 to 75 years for the stabbing. Before the sentencing, Maze’s mother, Wanda Rose, told the court that she has tried to e xplain to her g randchildren about their mom’s disappearance. Rose said shortly after her daughter went missing, Hoskins joined searches and vigils in honor of Maze. “After you killed her, you had a par ty in her house, ” Rose said. “What kind of person are you?” Hoskins also spoke before the sentencing, making a w eepy apology to Maze’s family and saying he didn’t mean to kill her. He told Judge James R. Redford that he deepl y loved Maze, MLive.com reported. “Before this happened, everybody looked at me as a good person,” Hoskins said. “In the b link of an e ye, I’m a mon- ster.” Redford told Hoskins that he made the crime w orse by dumping Maze’s body in the garbage for lik ely incineration. That denied the f amily the chance for a funeral and burial, the judge said before issuing the sentence. Hearing that he would spend at least a half-centur y behind bars, the handcuffed prisoner threw a reading tab le toward Redford’s bench and lumbered forw ard until court deputies dragged him from the cour troom, his face contorted in anger. Hoskins then started screaming at the victim’s family. No injuries were reported. WASHINGTON (AP) — U .S.factories orders climbed inNovember, led by a surge in air-craft demand. And businessesstepped up spending on machin-ery, computers and other long-last-ing goods, a sign of in vestmentthat could fuel economic growth.

Factory orders rose 1.8 percentin November, the CommerceDepartment said Monday. Thatfollows a 0.5 percent decrease inOctober.

Orders received by manufactur-ers totaled a seasonall y adjusted$497.8 billion in November, thehighest level on records dating to1992. Orders have increased 2.5percent over the past 12 months.

The improvements could signalaccelerating growth in 2014.Americans are buying more carsand homes, increasing demand forsteel, furniture and other goods.That has led factories to hire moreworkers, generating additionaleconomic momentum.

Still, overall economic g rowthremains modest by historical stan-dards. And though f actory ordershave strengthened in recentmonths, their g rowth rate hasslowed during the recovery fromthe 2008 financial crisis.

A 21.8 percent jump in v olatileaircraft orders drove the Novem-ber gains. But orders rose in man yother categories, a sign of strength

at factories and confidence amongcompanies.

Core capital goods, a pro xy forbusiness investment, rose 4.1 per-cent. Economists watch this cate-gory because it e xcludes volatileorders for aircraft and defenseequipment.

Demand also rose for constr uc-tion machinery, computers, com-munications equipment, fur nitureand motor vehicle parts.

Most of the gains occur red inlong-lasting goods, whichincreased 3.4 percent in No vem-ber. Orders for nondurab le goodssuch as food products, clothingand paper rose a modest 0.3 per-cent.

The trade groupsaid last week that its inde x ofmanufacturing activity slipped to57 in from 57.3 in No vember.That’s still the second-highestreading since April 2011. And anyreading above 50 signals growth.

Manufacturers have also bol-stered hiring in recent months.Factories added 66,000 jobs fromJuly through November, accordingto government’s employmentreports. The government releasesits December employment reporton Friday.

My hus-band and I ha ve argued aboutthis, and he refuses because hethinks the broker is a crook. Butlife is good, and we decided thatwe want to speculate with$10,000 from savings. Because Ithink that 3-D printing is the nexttrillion-dollar industry (thoughmy husband thinks it’s a fad), wewould like to speculate with a listof 3-D stocks that you would rec-ommend for us.

less than their spouses mak e bet-ter financial decisions than theirwives. In this instance, your hus-band’s right as a pra yer aboutyour broker. And prayer is whatyou’d need if y ou followed thatbroker’s malodorous advice. Ifyou transfer a 401(k) balance (onwhich you’ve not paid taxes) to aregular IRA, there are no federaltaxes involved until you begintaking income upon retirement.

But if you were to move that401(k) balance to a Roth IRA,the entire amount w ould becometaxable as ordinary income thisyear. The tax consequences couldbe huge, and you’d be screamingbloody murder at tax time nextyear. That takes the cupcake forthe most oxydacious f inancialadvice I’ve heard.

I’m familiar with your 401(k)plan choices because I’m familiarwith the company that employsyou. Yep, you’re right that y ourmutual fund choices really stink,and management knows it. I also believe that 3-D printingcan be a trillion-dollar industry.The medical and industr ial appli-cations are beyond the scope ofour imagination. This is an exam-ple of “creative destruction,” inwhich new technology willdestroy the old manuf acturingtechnologies, creating massivepockets of obsolescence andcausing millions of w orkers tolose their jobs in the process.This process of industrial muta-tion will impact industr y andlabor as did the adv ent of thesteam engine, electricity and theautomobile. So consider the fol-lowing issues: Proto Labs(PRLB-$71), Stratasys (SSYS-$133), 3D Systems (DDD-$92),ExOne (XONE-$60), Voxeljet(VJET-$39) and Dassault Sys-temes (DASTY-$124).

These issues are e xtremelyvolatile and trading at numbersso high that e ven angels fear tofly there. Few folks (includingme) know enough to put theirimprimatur on any specific issue.But if you’re comfortable gar-gling with Drano or leapfroggingover unicorns, these issues couldbe for you.

WASHINGTON (AP) — TheSenate confirmed Janet Yellen onMonday as the f irst woman tolead the U.S. Federal Reserve, ele-vating an advocate of f ightingunemployment and a back er ofthe central bank’s efforts to spurthe economy with low interestrates and massive bond purchases.

Yellen, 67, will replace BenBernanke, who is stepping do wnafter serving as chairman for eightyears dominated by the GreatRecession and the Fed’s efforts tocombat it.

Senators voted to conf irm herby 56-26 margin, with numerousabsences caused by airline flightdelays forced by arctic tempera-tures around much of the country.All 45 voting Democrats werejoined by 11 Republicans in sup-porting Yellen, while 26 Republi-cans voted “no.”

Vice chair of the F ed since2010, Yellen begins her four-yearterm as leader of the centur y-oldbank on Feb. 1. With the economyrebounding from the depths of therecession but only modestly sofar, many economists expect herto focus on how to nurture growthwithout putting it into o verdrive,which could risk fueling inflation.

“The big debate will be w henthe Fed should tighten and ho wmuch, rather than when to step onthe gas pedal and ho w hard,” pre-dicted Bill Cheney, chief econo-mist for John Hancock F inancialServices, who envisions a g row-ing economy this year.

Under Bernanke, the Fed hasdriven short-term interest ratesdown to near zero and flushedmoney into the econom y withhuge bond purchases, which it hasjust star ted to ease. Yellen, astrong Bernanke ally, has support-ed those policies and is e xpectedto continue them until concretesigns emerge of sustainedimprovement of the economy andjob market.

In a written statement, Presi-dent Barack Obama said Yellen’sapproval means “the Americanpeople will have a f ierce champi-on” who will protect them.

“I am conf ident that Janet willstand up for American workers,protect consumers, foster the sta-bility of our financial system andhelp keep our economy growingfor years to come,” Obama said.

Lobbyists for the banking and

financial services sectors issuedstatements pledging to w ork withYellen. Both industries ha ve led afight to water down restrictionsimposed by Obama’s 2010 lawoverhauling how the U.S. finan-cial system is regulated.

A native of Brooklyn, NewYork, Yellen previously headed theFederal Reserve Bank of SanFrancisco, chaired President BillClinton’s Council of EconomicAdvisers and has been an eco-nomics professor at the Universityof California at Berkeley.

Yellen, who as an academic hasfocused on unemployment and itscauses, is considered a “do ve”who wants the Fed more focusedon creating jobs because un em-ployment is high and inflation islow. “Hawks” on these issues pre-fer a stronger emphasis on pre-venting inflation.

In brief debate on her nomina-tion, Democratic Sen. Sher rodBrown, lauded Yellen, who wasone of the f irst to warn in 2007 ofa housing bubble that could burstand damage the entire economy.

“She understands how riskyfinancial practices deep inside thelargest Wall Street banks can havea terrible and terrifying impact onAmerican families,” Brown said.

But Republican Sen. CharlesGrassley criticized Yellen for sup-porting the Fed’s “easy money”policies of low interest rates andbond purchases.

“No one can deny that the risksare real and could be de vastating”if those policies continue for toolong, Grassley said.

Yellen’s Republican criticshave said the F ed has inflatedstock and real estate prices b ypumping money into the mark ets,creating investment bubbles thatcould burst and wound the econo-my anew.

Some also warn that as the Fedstarts to trim its bond holdings, itcould spook f inancial markets,threatening the economy’s recov-ery by causing stock prices todrop and interest rates to rise.

Last month, the Fed announcedthat it will star t gradually reduc-ing its $85 billion in monthl ybond purchases, trimming themback initially to $75 billion thismonth and t aking “further mea-sured steps” as economic condi-tions improve.

But the Fed also indicated thatit will keep supporting an econo-my that it considers less than fullyhealthy. It said it will continue to

keep interest rates lo w and tr y toboost unusually low inflation,which can slow spending and bor-rowing.

During her November confir-mation hearing before the SenateBanking Committee, Yellen saidthe Fed’s bond buying pro gramhas successfully supported theeconomy by keeping long-termborrowing rates low.

The Fed’s holdings ha vereached $4 trillion, more thanquadruple their level before thefinancial crisis hit in late 2008.

The U.S. economy has g rownonly modestly since the GreatRecession officially ended in June2009, though it has shown encour-aging signs in recent months.

Unemployment fell to 7 per-cent last month, do wn from arecent peak of 10 percent in Octo-ber 2009. The economy grew atan annual rate of 4.1 percent fromJuly through September and hasadded an average 200,000 jobsmonthly since August.

President Barack Obama nomi-nated Yellen in October after con-sidering selecting Lawrence Sum-mers, a former Treasury secretarywho had been a close Obamaadviser early in his presidenc y.Summers withdrew after oppo-nents complained about his tem-perament and past suppor t forbank deregulation.

Obama called Yellen a “provenleader” and hailed her frequentfocus on the unemployed, saying,“She understands the human costwhen people can’t find a job.”

She will be the f irst Fed chairnewly appointed by a Democraticpresident since P aul Volcker,picked by President Jimmy Carter,left the post in 1987. Clintonreappointed Alan Greenspan andObama gave Bernanke a secondterm, though both w ere initiallychosen by Republican presidents.

Yellen will preside o ver herf irst Fed meetings as chair onMarch 18 and 19.

The Federal Reserve was creat-ed as the U.S. central banking sys-tem in 1913 at a time when theU.S. was undergoing a series off inancial panics. It sets thenation’s monetary policy —including raising or lo weringinterest rates — with the goals ofmaximizing employment and sta-bilizing prices. It also super visesand regulates banking institutions.

Acomb and his wife, MandyFishburn—a copywriter supervisorat Lowe Campbell Ewald—maketheir home in Bir mingham, wherehe unwinds from work by learningto play guitar, practicing nearlyevery night. The couple has f ivechildren, ranging in age from 3 to24.

Acomb’s service to the commu-nity includes ser ving on theDetroit Central City CommunityMental Health Advisory Board.

“I have a sister w ho suffersfrom bipolar disorder. MORRIS TOWNSHIP, N.J. (AP) — Honeywell is selling its frictionmaterials business to Federal Mogul Corp. for about $155 million.

The friction materials unit mak es disc brake pads and braking sys-tem components for original equipment manuf acturers and the after-market covering passenger car, light truck, commercial vehicle, railway,and other industrial applications. The deal includes two manufacturingplants in China and Romania.

Honeywell Chairman and CEO Da ve Cote said in a statement thatthe division doesn’t fit with the compan y’s “core differentiated tech-nologies focus” and its long-term growth plans.

The Morris Township, N.J., company said it will continue to r un theGlinde, Germany-based business as usual and has no planned changesin staffing or production through the closing of the deal. The unit hasmore than 2,000 employees worldwide.

Federal Mogul, based in Southf ield, Mich., said that the dealstrengthens the manufacturing and engineering technology componentsof its brake business.

Honeywell International Inc. said Tuesday that the transaction isexpected to produce an after-tax loss of about 4 cents per share that willbe recorded in 2013’s fourth quarter. The loss is not anticipated toimpact the company’s 2014 guidance.

The deal is targeted to close during 2014’s second half.

WASHINGTON (AP) — TheSupreme Court has refused agroup of doctors’ request to blockimplementation of the nation’snew health care law.

Chief Justice John Rober tsturned away without commentMonday an emer gency stayrequest from the Association ofAmerican Physicians & Surgeons,Inc. and the Alliance for NaturalHealth USA.

They asked the chief justicelast Friday to temporarily blockthe law, saying Congress hadpassed it incor rectly by starting itin the Senate instead of theHouse. Revenue-raising bills aresupposed to originate in the lo werchamber. They also w antedblocked doctor re gistrationrequirements they say will make itharder for independent non-Medicare physicians to treatMedicare-eligible patients.

Still pending is a decision on atemporary block on the law’s con-traceptive coverage requirements,which was challenged by a groupof nuns.

WASHINGTON (AP) — TheSupreme Court on Monday putsame-sex marriages on hold inUtah, at least w hile a federalappeals court more fully considersthe issue.

The court issued a brief orderblocking any new same-sexunions in the state.

The order grants an emergencyappeal by the state follo wing theDec. 20 r uling by U.S. DistrictJudge Robert Shelby that thestate’s ban on same-se x marriageviolates gay and lesbian couples’constitutional rights.

More than 900 gay and lesbiancouples have married since then.

The high cour t order willremain in effect until the Den ver-based 10th U.S. Circuit Cour t ofAppeals decides w hether touphold Shelby’s ruling.

The state’s request to theSupreme Court was f iled withJustice Sonia Sotomayor, whohandles emergency appeals fromUtah and the f ive other states inthe 10th Circuit. Sotoma yorturned the matter o ver to theentire court.

The action now shifts to Den-ver, where the appeals court willconsider arguments from the stateagainst same-sex marriage as wellas from the three ga y and lesbiancouples who challenged the ban insupport of Shelby’s ruling. Shelbyand the appeals court had previ-ously rebuffed the state’s plea tostop gay weddings pendingappeal.

The 10th Circuit has set shor tdeadlines for both sides to f iletheir written arguments, with thestate’s first brief due on January27. No date for argument has beenset yet.

“Every day that goes by, same-sex couples and their children arebeing harmed by not being able tomarry and be treated equall y,”Magleby said in a statement thatalso proclaimed conf idence in hisside’s case before the appellatejudges.

Utah changed its constitutionto prohibit same-sex marriage in2004.

Nearly two-thirds of Utah’s 2.8million residents are members ofThe Church of Jesus Christ ofLatter-day Saints, and Mor monsdominate the state’s legal andpolitical circles. The Mormonchurch was one of the leadingforces behind Califor nia’s short-lived ban on same-sex marriage,Proposition 8.

Though the church has soft-ened its stance to ward gays andlesbians in recent y ears, it stillteaches that homosexual activityis a sin and stands by its supportfor “traditional marriage.” Churchofficials say they hope a highercourt validates its belief that mar-riage is between a man andwoman.

The Supreme Court’s unsignedorder did not indicate that an yonedissented from the decision not toallow any more same-sex mar-riages in Utah, at least for no w.Nor did the order reveal anythingabout the justices’ views on same-sex marriage.

Shelby was the f irst federaljudge to overturn a state mar riageban since the high cour t issuedtwo decisions on same-se x mar-riage in June.

The justices at that time struckdown a provision of the federalDefense of Marriage Act that pre-vented legally married gay andlesbian couples from recei ving arange of tax, health, pension andother federal benefits.

Shelby cited the decision in hisruling that the state failed to showthat allowing same-sex marriageswould affect opposite-sex mar-riages in any way.

“In the absence of such e vi-dence, the State’s unsupportedfears and speculations are insuf fi-cient to justify the State’ s refusalto dignify the family relationshipsof its gay and lesbian citizens, ”Shelby wrote.

On the same day, the court leftin place a trial cour t’s decisionthat struck down California’s con-stitutional ban on same-se x mar-riage. That decision paved the wayfor same-sex unions to resume inCalifornia.

The nation’s most populousstate is among 17 st ates and theDistrict of Columbia that allow, orsoon will allow, gay and lesbiancouples to wed.

The others are: Connecticut,Delaware, Hawaii, Illinois, Iowa,Maine, Maryland, Massachusetts,Minnesota, New Hampshire, NewJersey, New Mexico, New York,Rhode Island, Vermont and Wash-ington state.

Utah had been the 18th, for 17days.

WASHINGTON (AP) — ARepublican senator on Monda ysued to stop the go vernment frompaying most of the medical insur-ance premiums for members ofCongress and their aides w ho arenow required to obtain c overagethrough the new health care la w’sstate exchanges.

Sen. Ron Johnson, R-W is.,f iled a lawsuit Monday in U.S.District Court in Green Bay, Wis.,challenging a September ruling bythe Office of Personnel Manage-ment. The agency ruled that law-makers and their staf fs shouldcontinue to receive health carebenefits covering about 75 per-cent of their premium costs afterleaving the health insurance pro-gram for federal workers.

Johnson said the OPM r ulingon the application of PresidentBarrack Obama’s health careoverhaul to lawmakers and theiraides amounted to special treat-ment for Cong ress: “It’s a basicissue of fairness,” he said.

The lawsuit marks a ne w frontin some Republicans’ attempt tostop what they say is a specialcarve-out for political elites in theAffordable Care Act. Last year,Johnson joined other Repub licansin backing an effort by Sen. DavidVitter, R-La., to halt federal con-tributions toward health coveragefor members of Cong ress, theirstaffs and other politicalappointees in the federal go vern-ment.

The health care o verhaul lawsometimes referred to as “Oba-macare” requires members ofCongress and their staf fs to leavethe federal health plan and buyinsurance through exchanges cre-ated by the law. But only low-income Americans are eligible forsubsides on the exchanges.

The federal subsidies that

members of Cong ress and theirstaff currently receive are in linewith those paid b y most privateemployers and are the same asother federal employees who arecontinuing in the federal plan.But Johnson argues that theywere not specif ically detailed inthe health care la w and thereforeare illegal.

“This lawsuit is about enforc-ing the law,” Johnson said at aCapitol press conference on Mon-day.

Johnson was joined b y hislawyers, Paul Clement, w hoargued against the AffordableCare Act in front of the U .S.Supreme Court, and Rick Esen-berg, the founder, president andgeneral counsel of the WisconsinInstitute for Law & Liber ty. Theywould be paid through a mix ofpersonal funds and Johnson’scampaign fund, Johnson said.

According to the la wsuit, theOPM ruling “does not treat mem-bers of Cong ress and their staf fslike members’ constituents.Instead, it puts them in a betterposition by providing them with acontinuing tax-free subsidy.”

The lawsuit could take monthsor even years to move through thelegal system. Johnson said hefiled in Wisconsin because that iswhere he lives.

Democrats have criticizedRepublican efforts to kill the sub-sidy for la wmakers and theiraides, saying it is petty and politi-cal. Johnson also came underimmediate criticism from a fellowRepublican.

Rep. James Sensenbrenner ofWisconsin called Johnson’s law-suit an “unfor tunate politicalstunt.”

All Republicans want to repealObamacare, Sensenbrenner said,but the la wsuit “takes publicattention away from how bad allof Obamacare really is and focus-es it on a trivial issue.”

Under thislaw, TVs, desktop and laptopcomputers, tablets, computermonitors and printers from resi-dents and businesses with fe werthan 10 employees can be rec y-cled without charge.

“Recycling is a simple w ay forall of us to do our par t in protect-ing our environment and support-ing our economy,” DEQ DirectorDan Wyant said. “Let’s make this

holiday season a little bit g reenerby properly recycling our unwant-ed electronic devices.”

There are several ways con-sumers can easily recycle elec-tronic items:

Laf ayette in downtownRoyal Oak.

The ornery ogre Shrek(played by Matt Scharlau),shunned by the world, is contentwith a solitary life in his swamp.However, one day he f inds hishome over-run with a ragtaggroup of misfit fairy tale charac-ters cast off from the kingdom ofDuloc by the land’s pint-sizedruler, Lord Farquaad (played byChristopher Anderson). Heoffers a challenge for Shrek toregain his home: rescue theminiature monarch’s future bridefrom a lava-surrounded tower.

With Donkey (played by DezWalker), a lovably annoying newfriend, as his tr usty steed, Shrekrescues the beautiful maidenFiona (played by KristenZublick) from the to wer and theclutches of a torch song-beltingdragon (played by ChristianaPerrault). While Fiona is initial-ly unimpressed with the seem-ingly odious ogre, a romancebegins to b lossom between thetwo. But, unbeknownst to Shrek,Fiona has a secret and is not whoshe seems. Shrek, no w in lovewith Fiona, attempts to break upher wedding to Farquaad. Mean-while, Gingy (played by JennyBoyle), Pinocchio (played byJeff Weiner) and the motley crewof fairy tale characters storm thecastle in revolt against Farquaadand have the last laugh as the yeach let their “freak flag fl y”while Fiona’s true identity isrevealed to Shrek’s delight.

“Shrek is all about accep-tance. It is about accepting peo-ple for who they are, despitetheir differences, and about see-ing through the outer surf ace tof ind the inner beauty of each

person. As the song ‘F reakFlag’ says ‘What makes us spe-cial makes us strong!’ The showidentifies the inner strength andbeauty in everyone,” says direc-tor Linda Zublick of Royal Oak.

At the helm of this three-ringcircus of a show, Zublick has thetask of mar rying Shrek’s com-pelling story and score with themyriad of sight gags and specialeffects the show calls for—allwhile respecting the iconicmovie.

“The book for ‘Shrek TheMusical’ is very true to the origi-nal movie, so Shrek fans will notbe disappointed. The music isfunny, poignant, silly, sweet andtoe-tapping all at the same time,”says Zublick. “The Broadwaymusical allows wide room forinterpretation. We are trying tocreate unique characters that area combination of some of thefeatures and characteristics ofthe movie characters and theBroadway characters. We wantStagecrafters' representation ofShrek to be a production e very-one will enjoy!” she says.

To bring Shrek’s characters tolife requires some for midablespecial effects and a steadf astcommitment from many of theperformers. Zublick lists a fe whighlights. The group is buildinga 20-foot dragon that can mo ve,and requires puppeteers to mak eher alive as she moves across thestage. Several actors have pros-thetic pieces to attach to theirfaces, which required specialmolds to be made. Lord F ar-quaad needs to appear shor t andactually wears a costume thatmakes him look shor t while hewalks on his knees. “Not an easyfeat for an y actor,” remarksZublick. Two of the f airy talecharacters, Gingy and Pinocchio,have humorous quirks, w hichrequire unique costuming: Gingyis actually a puppet and Pinoc-chio's nose must g row. “Theseunique special effects, while pro-viding interesting challenges forStagecrafters, were ones theactors were well aware of whenthey auditioned. They make theshow fun and engaging,” saysZublick.

The technical-heavy show haseven affected the rehearsalprocess. “There are quite a fe wscenes we cannot b lock without

having our special ef fects readyto go, which changes the w ayrehearsals are handled comparedto a usual rehearsal schedule, ”says Zublick. “We have somerehearsals just to focus on thecharacters and others to focus onspecial effects, music anddance.”

“Shrek The Musical” is basedon the motion picture b y Dream-Works Animation with book andlyrics by David Lindsay-Abaire,and music by Jeanine Tesori. Themusical opened on December 14,2008 at the Broadway Theatre. Itran for 441 perfor mances beforeclosing on January 3, 2010. Theproduction featured Detroit-areanative Sutton Foster as Fiona.Foster appeared in Stagecrafters’1992 production of “A ChorusLine.” “Shrek The Musical” wasnominated for eight 2009 TonyAwards including Best Musicaland Best Actress in a Musical(Foster) and won for Best Cos-tume Design of a Musical (T imHatley).

DETROIT (AP) — A Michi-gan university has issued its annu-al list of anno ying words, andthose flexible enough to take self-ies of themselves twerking shouldtake note.

In addition to “self ie” and“twerking,” there was a strongsense among those w ho nominat-ed words to this year’s list that theword “hashtag” and ter m “Mr.Mom” had both run their course.

“Selfie,” a ter m that describesa self-taken photo, often from asmartphone, led the w ay amongthe more than 2,000 nominationssubmitted to Lake Superior StateUniversity’s 39th annual batch ofwords to banish due to o veruse,overreliance and overall fatigue.Even President Barack Obama gotinto the act w hen he took a w ell-publicized selfie with other world

leaders in South Africa for NelsonMandela’s memorial service.

“It’s a lame word. It’s all aboutme, me, me,” wrote David Kriegeof Lake Mills, Wis. “Put thesmartphone away. Nobody caresabout you.”

Since 1975, the list has g rownto more than 800 w ords, manyfrom the worlds of politics, spor tsand popular — maybe too popular— culture.

“The list is made up complete-ly from nominations. We don’tjust sit around and think of w ordsthat bug us,” said Tom Pink, aspokesman for the school in SaultSte. Marie, in Michigan’s UpperPeninsula.

“Twerk” or “twerking,” a sexu-ally provocative way of dancing,found a dominant place in par-lance due to Mile y Cyrus’ perfor-mance at the MTV Video MusicAwards.

“Time to dance this one of f the

stage,” said Jim Connell y, ofFlagstaff, Ariz.

“Hashtag” refers to a w ord orphrase with no spaces precededby the pound sign on themicroblogging website Twitter.

Others on the banned listinclude “Twittersphere,” “t-bone,”“Obamacare” “intellectually/moral-ly bankrupt” and anything “onsteroids.” People also tired of thesuffixes “-pocalypse” and “-aged-don” used to mak e words such as“snow-pocalypse” or “ice-aged-don.”

And enough already with “Mr .Mom,” a reference to f athers whotake care of kids. It’ s also thename of a 1983 mo vie starringMichael Keaton, although manystay-at-home dads these da ysdon’t like the movie stereotype ofa clueless male.

“There were almost as man ynominations for ‘Mr. Mom’ as‘selfie’ and ‘twerk,’” Pink said.

He believes the title got trac-tion again in 2013 due to ne wsstories about the 30th anni versaryof the movie.

“The phrase should refer onl yto the f ilm, not to men in the realworld,” wrote P at Byrnes ofChicago. “It is an insult to themillions of dads w ho are the pri-mary caregivers for their children.Would we tolerate calling workingwomen, ‘Mrs. Dad?’”

“Adversity” and “f an base” —terms often used w hen discussingsports — got booed. Kyle Melton,of White Lake, Mich., said per-spective is needed w hen referringto a millionaire athlete tr ying toget a first down in football.

“Facing adversity is working50 hours a w eek and still str ug-gling to feed y our kids,” Meltonwrote.

WASHINGTON (AP) — Nolonger taboo, living together hasbecome a more common ar range-ment for America’s couples whobecome pregnant while dating.

Soon-to-be-released govern-ment figures show a major cultur-al shift since the days of “shotgunweddings” aimed at avoiding fam-ily embarrassment. With marriageon the decline, the shift is helpingredefine the traditional notion offamily.

“The emergence of cohabita-tion as an acceptab le context forchildbearing has changed thefamily-formation landscape,”said Christina Gibson-Davis, asociology professor at Duke Uni-versity. “Individuals still valuethe idea of a tw o-parent familybut no longer consider it neces-sary for the parents to be mar-ried.”

Still, she cautions that childrenin cohabiting households ma yface more difficulties growing upif their unmar ried parents are athigher risk of breaking up.

In all, the share of unmar riedcouples who opted to ha ve “shot-gun cohabitations” — mo ving intogether after a pregnancy — sur-passed “shotgun mar riages” forthe first time over the last decade,according to a for thcoming paperfrom the National Center forHealth Statistics, par t of the Cen-ters for Disease Control and Pre-vention. The trend was affirmedby three demographers who con-ducted separate research on thetopic.

It’s the latest demo graphic tip-ping point as cohabitations tur nmainstream — a f ar cry from thedays when the father of a pregnantdaughter might use coercion, suchas a shotgun, to mak e sure the

boyfriend followed through on awedding.

“I want to mar ry when I’mready, not because I’m beingforced into it. Whenever I seecouples do that, things don’t workout,” said Amanda Leigh Pulte,22, of Austin, Texas, as her 11-month-old daughter Zoey cooedin her ar ms. Pulte previously haddelayed moving in with Matthe wGage, a 29-year-old shippingmanager and her bo yfriend forthree years, wishing to w ait untilshe could earn a bachelor’s degreein film and start a full-time job.

An unplanned pre gnancyquickly changed that. Completingan associate degree, she agreed tohave Gage move in so the couplecould work and save on rent whileraising Zoey together. Eventhough they didn’t see marriage asa serious option for now — in partto avoid the additional stress ofplanning and paying for a w ed-ding, she says — neither was hav-ing Pulte live on her own as a sin-gle mother.

“For a while, my father waskind of shocked about the w holething, but ultimately he was justexcited to be a g randfather,” shesaid with a chuckle. The couple isgetting child care tips from thenonprofit Any Baby Can, whichalso helps them with ph ysicaltherapy for Zoey, who was bornwith health ailments.

The numbers are based on thegovernment’s National Sur vey ofFamily Growth, typically issuedevery four years. It provides theonly government data on cohabit-ing mothers by asking questionson a woman’s relationship statusbefore and after conception andchildbirth. Women who say theywere single before conception andthen married before childbirth arecounted as someone w ho had apost-conception, or “shotgun”

marriage; those who moved inwith their boyfriends after preg-nancy had a post-conception or“shotgun” cohabitation.

Demographers say the cohabit-ing trend among ne w parents islikely to continue. Social stigmaregarding out-of-wedlock births isloosening, and economic f actorsplay a role. Man y couples, espe-cially those who lack a bachelor’sdegree, are postponing mar riageuntil their f inances are more sta-ble. But because of globalization,automation and outsourcing,good-paying middle-income jobsare harder to come by.

“Because marriages arebecoming more polarized b y eco-nomic status, I don’t see the trendof shotgun cohabitations reversingany time soon, ” said Case yCopen, a demographer at the gov-ernment’s National Center forHealth Statistics, which adminis-ters the government survey.

About 18.1 percent of all sin-gle women who became pregnantopted to mo ve in with theirboyfriends before the child w asborn, according to 2006-2010data from the go vernment’sNational Survey of F amilyGrowth, the latest a vailable. Thatis compared to 5.3 percent w hochose a post-conception marriage,according to calculations b yDaniel Lichter, a Cornell sociolo-gist.

As recently as the earl y 1990s,25 percent of such couples gotmarried.

Cohabiting mothers arespurring increases in out-of-w ed-lock births, now at a high of 41percent. In all, about 60 percent ofall births during the 2000s were tomarried mothers, compared to 24percent to cohabiting mothers and16 percent to non-cohabitingmothers. That was the f irst timethat cohabiting bir ths exceeded

births from single mothers w howeren’t living with their child’sfather.

Since the earl y 1990s, theshare of out-of-wedlock, cohabit-ing births has grown from 11 per-cent to 24 percent, w hile those tononcohabiting, single mothers hasremained steady at 16 percent.

Sometimes referred to as the“poor person’s marriage,” cohab-itation is g rowing fastest amonghigh school g raduates with chil-dren. Between the 1997-2001 and2002-2009 periods, it g rew from23 percent to 32 percent, accord-ing to Sheela K ennedy, aresearcher at the Uni versity ofMinnesota. For mothers withsome college attendance, it g rewfrom 15 percent to 23 percentover that period. Among thosewith four-year college degrees,the share has changed little, from3 percent to 5 percent.

Lichter, a past president of thePopulation Association of Ameri-ca, said the go vernment needs todo more to reflect increasingcohabitation in statistics. Cohabi-tation status is not included onbirth certif icates, and that canskew policy debates over the gov-ernment safety net for poorhouseholds. It also means a g row-ing trend of fragile f amilies inwhich cohabitating parents ma ybe more likely to break up can beneglected, he said.

Researchers at Har vard andCornell universities have foundthat only about half of motherswho were cohabiting when theirchild was born were still in rela-tionships with the biolo gicalfather five years later. “The latestresults seem to indicate that mar-riage, as a conte xt for childbear-ing and childrearing, is increas-ingly reserved for America’s mid-dle- and upper-class populations,”Lichter said.

LOWELL TOWNSHIP, Mich. (AP) — TheMichigan Department of Transportation is test-ing a new way to replace bridges without caus-ing long traffic delays during construction. Thetrick? Build the new bridge next to the old one,then slide it into place.

The department said it will use the “bridgeslide” technique for the f irst time on a projectto widen the Michigan 50 bridge over Interstate96 in Lowell Township, southeast of GrandRapids.

Using the bridge slide process means theoverpass will be out of ser vice for less timethan it would under a typical replacement, said

department spokesman John Richard.“You basically build that new bridge next to

the existing one and then y ou demolish the oldone,” he said. “The new bridge is built on skids.Sometimes they just use Da wn dish soap tolubricate them, and then the y slide the bridgeinto place. It reall y cuts down on the time thebridge is out of service.

“You’ll definitely see a lot more bridge slidestaking place just because of the less impact ontraffic. It’s really changing the industr y. All theengineers at MDOT are very excited.”

At least one other bridge slide project isplanned in Michigan this y ear. It involves the

northbound and southbound U .S. 131 bridgesover Three Mile Road in Mecosta County, northof Howard City.

Kentucky transportation officials used thebridge slide technique in 2013 on an Ohio Riverbridge connecting Milton, K y., and Madison,Ind. In Nevada, it was used in 2012 on I-15 atMesquite between Las Vegas and Salt Lak eCity.
