Background about the NWB

Institution of Public Government (IPG) established under Article 13 of the Nunavut Land Claims Agreement (NLCA)

Objects of the NWB are to provide for the conservation and utilization of waters in Nunavut, except in a national park, in a manner that will provide the optimum benefit from those waters for Nunavut’s resident in particular and Canadians in general

NWB has responsibilities and powers over the regulation, use, and management of freshwater in the Nunavut Settlement Area

Licences Issued to the Project

Northwest Territories Water Board (NWTWB) issued the initial licences to the project prior to Nunavut becoming a separate territory

Details on the scope of the licences issued by the NWTWB are not readily available (historical files)

NWB has issued three (3) Licences and two (2) amendments to the Project

Licences Issued to the Project Cont.

Licence NWB1NAN9702: o Issued to Nanisivik Mines Ltd. on July 1, 1997 and

expired on June 30, 2002 .

o February 20, 2001, the Licence was assigned from Nanisivik Mines Ltd. to Nanisivik Mine (a division of CanZinco Ltd.)

o Allowed for the use of 180,000 m3/year of water and deposit of waste for mining activities

o Amendment No.1 was issued in December 1999 and Amendment No. 2 was issued in March 2000 for operational changes

Licence NWB1NAN0208: o Issued to Canzinco Ltd. on October 1, 2002 and

expired on May 1, 2008

o Allowed for the use of 180,000 m3/year of water and the deposit of waste during closure, reclamation, and monitoring activities

Licence 1AR-NAN0914: o Issued to Canzinco Ltd. on April 1, 2009 and

expired on March 31, 2014

o Allowed for the use of 100 m3/year of water and the deposit of waste during closure, reclamation, and monitoring activities

Scope of Current Application

Application before the Board is by CanZinco Mines Ltd. (CanZinco) for a Five (5) year renewal-amendment Licence

Scope of the application includes:o Water use and waste deposit for continued closure,

reclamation and post-closure monitoring activities

o Proposed changes to geotechnical and water quality monitoring requirements under Part I / Schedule I of the Licence

Scope of the application continues:o Conduct studies pertaining to the development of

Site Specific Soil Remedial Objectives (SSQRO) for Petroleum Hydrocarbon Impacted soil

o Continued treatment and management of contaminated soil

o Continued soil and water quality monitoring

o Establishment of a non-hazardous waste landfill facility

NWB received an application to renew and amend Licence 1AR-NAN0914 (on behalf of CanZinco Ltd.)

o November 20, 2013

NWB acknowledged receipt of the application

o January 29, 2014

NWB distributed the application for completeness check and initial technical assessment

o March 3, 2014

NWB received comments on completeness from AANDC, DFO, DND, EC and CanZinco

o April 10, 2014

NWB received written request from the proponent to amend the licence term to allow for on-site activities in June 2014

o April 13. 2014

CanZinco provided its response to intervener’s submissions on completeness and initial technical assessment.

o May 2, 2014

NWB distributed the application publicly for a 30 day technical review period with June 2, 2014 set as the deadline for submission; submissions were received from AANDC, DFO, DND, and EC.

o June 18, 2014

TM/PHC was held for the application through teleconference

o June 27, 2014

NWB distributed the draft list of commitments generate during the TM/PHC for comments

o June 30, 2014

NWB received feedback on the draft commitment list from the Applicant, DFO, and DND.

NWB distributed correspondence indicating that that submission of the updated Abandonment and Reclamation Plan had been delayed

o September 8, 2014

NWB received submissions from the proponent in response to the TM/PHC commitments

o September 10- 17, 2014

NWB received final interveners’ submissions from AANDC, DFO, DND, EC by the submission deadline

Next Steps for the Type “A” Application

Public Hearing for the Application began earlier today and will continue on Thursday of this week

Information filled with the Board and provide during the Public Hearing will assist the Board in determining whether all substantive issues have been sufficiently addressed prior to the Board’s decision on the Application

TM/PHC was conducted by the Board's staff; for the entire Public Hearing a Panel of Board Members, led by the Board's Chair are here to listen to elders, the parties, community members/ the public regarding their views on the water licence

Next Steps for the Type “A” Application

Following the Public Hearing, the Panel will take some time (usually about 30 days) to consider all the submissions received and will write to the Minister of AANDC summarizing the Board's decision regarding whether a licence should be issued

If the Board recommends that a licence should be issued, a draft licence will be also attached to the decision submitted to the Minister of AANDC for his consideration

Interveners’ Participation

The parties present here today, AANDC, EC, DFO, NRCan, and the QIA, have participated throughout the licensing process for the Mary River Project Type “A” water licence application

They have provided the Board and the proponent with valuable technical information on issues that relate water use and waste disposal activities

They have also participated in both formal and informal discussions with the proponent and the Board with the aim of resolving the issues that they have identified during the review process

NWB encourages all community members to participate in the Public Hearing and this community session for the Application; The Public Hearing will continue tomorrow and everyone is welcome to attend
