1,000 Cruise Tourists Arrive Kenya To Boost Economy

Kenya Tourism Cabinet Secretary, Najib Balala said that the New Year has started on a high note after he received a luxury cruise ship docked at the Port of Mombasa with more than 1,000 tourists and crew members. Balala who received the Ms SEVEN SEAS VOVAGER, a US owned liner registered in Nassau in the Bahamas said that Kenya will participate in the 31st Annual Cruise Shipping Miami Convention slated for March 16- 19 in the US.He said that the Ministry of Tourism and key industry stakeholders will participate in the event to market Mombasa as a cruise port of call in the Eastern rim of the Indian Ocean. Ms SEVEN SEAS VOYAGER, a regular at the Port of Mombasa, docked with 1,139 passengers plus crew for a day-long stay. The luxury ship docked at Mombasa port some time last year.

“We have had a relative good season in 2015 and expect to have an equally good new year for the cruise tourism industry. We shall be participating in the annual Miami Cruise Convention this year,” Balala who was flanked by Principal Secretary Fatuma Hirsi said. Balala said cruise tourism has shown great potential for growth in recent months following years of decline caused by sea piracy in the Indian Ocean.“I urge all players in the sector to explore ways of ensuring that cruise tourism is frequent business,” he said. The CS added that the resumption of cruise will give the much needed impetus to the coastal tourism whose numbers have dipped recently due to travel advisories imposed by tourist source markets. Balala said they are banking on partnership with all stakeholders including neighbouring nations that border the Indian Ocean to come up with a joint marketing of this part of the globe as a popular cruise destination.“We have some of the best beaches, ports and idyllic tourist attractions in Kenya, Tanzania, Zanzibar, Seychelles, Mozambique, the Comoros and South Africa which we could sell as a combined product,’’ Balala said. General Manager in charge of Operations, Captain Twalib Khamis expressed excitement at the prospects of a resurgence in cruise ship rotations into Mombasa.“This year we shall be starting work in construction of a modern terminal dedicated to handling of cruise liners that dock at the Port,” Khamis said. Abecrombie & Kent who are the official tour ground handling agents for cruse liners calling at the Port of Mombasa confirmed that they expect four more ships to call at the Mombasa port.“We expect to have at least 10 cruise calls this year up from the six we had in 2015,’’ Mr Anthony Chege, General Manager Touring, Mombasa division said.Tourists who arrived aboard Ms Voyager were of mixed nationalities. Majority are from the US and UK. Other passengers came from Germany, South Africa, Sweden, Canada, France, Switzerland, Netherlands, Portugal, Brazil, New Zealand, Mexico, Denmark, Australia and Italy. American tourist, Mr Brad Shearers from Florida, Miami who visited Kenya a decade ago said he was delighted to be back on Kenyan soil in the New Year.“When I first toured Kenya, I visited the Masai Mara and even flew to Lamu where I encountered donkeys,’’ Shearers said. Some of the tourists visited Bombolulu, Haller Park, Amboseli (by air), Mwalughanje, Shimba Hills National Reserve and Mombasa town. World Maritime Day 2016

The World Maritime Day theme for 2016 is "Shipping: indispensable to the world".

The theme was chosen to focus on the critical link between shipping and global society and to raise awareness of the relevance of the role of IMO as the global regulatory body for international shipping. The importance of shipping to support and sustain today's global society gives IMO's work a significance that reaches far beyond the industry itself.

Today, around 90% of world trade is carried by the international shipping industry. Without shipping the import and export of goods on the scale necessary to sustain the modern world would not be possible. Seaborne trade continues to expand, bringing benefits for consumers across the world through competitive freight costs. There are more than 50,000 merchant ships trading internationally, transporting every kind of cargo. The world fleet is registered in over 150 nations and manned by more than a million seafarers of virtually every nationality.

Over the past 50 years and more, IMO has developed and adopted a comprehensive framework of global regulations covering maritime safety, environmental protection, legal matters and other areas. Under this regulatory framework, shipping has become progressively safer, more efficient and more environment-friendly.

World Maritime Day celebrations

World Maritime Day will be celebrated at IMO Headquarters on 29 September 2016, but other events and activities focusing on the theme will be held throughout the year.

Parallel Event 2016 The World Maritime Day Parallel Event will be held in Turkey in November 2016.

Bijdrage Alphatron Marine aan opening pand Schmidt Zeevis

Op 8 december jongstleden opende Hare Majesteit Koningin Máxima in Rotterdam aan de Matlingeweg (Spaanse Polder) het bijzondere nieuwe pand van Schmidt Zeevis. De basis van het ontwerp van de hand van Alsemgeest Design &Build,

is een schip dat ligt afgemeerd met aan de rechterkant een kadeen aan de linkerkant een containerterminal. Het ‘schip’ bestaat uit twee verdiepingen en een ‘stuurhut’ die functioneert als representatieve ontvangstruimte.In nauw overleg met de directie van Schmidt Zeevis en architect Alsemgeest werd door Alphatron Marine uit Rotterdam een mast voorgesteld naar voorbeeld van Damen Shipyards die zou passen bij de gehele uitstraling en waarop door Alphatron Marine een werkende radar zou kunnen worden geleverd om het scheepse karakter te onderstrepen.Van Noorloos Cascobouw uit Werkendam zorgde voor een complete en tijdige levering van de mast die op 4 december, precies op tijd voor de koninklijke opening, op het dak gehesen werd. De 180 kilo zware S-band radar van het merk JRC (Japan Radio Company) werd daarna gehesen en geïnstalleerd, evenals een bakboord- en een stuurboordlicht en een toplicht, om het geheel af te maken.Namens Alphatron Marine B.V. feliciteert Luuk Vroombout Schmidt Zeevis met het prachtige resultaat en hij geeft aan ‘trots te zijn om op zo’n goed zichtbare locatie aan de A20 op een dergelijk bijzonder pand een kleine bijdrage te hebben kunnen leveren’.

Danish delegation in Iran eyes shipping, energy deals Danish companies are eyeing a series of energy and shipping projects in Iran following a visit this week by the country’s foreign minister, local news agencies and officials said on Tuesday. The Danish foreign ministry said its minister, Kristian Jensen, travelled to Tehran with a delegation representing 58 companies on Monday and that exports could increase by 500 million Danish crowns ($72 million) once sanctions against Iran’s nuclear programme are lifted. News agency Shana cited Iranian Petroleum Minister Bijan Zanganeh as saying Danish companies were interested in developing oil fields in the Caspian Sea including the South Pars gas field, which also produces condensates. conglomerate A.P. Moller-Maersk is in the oil industry through its Maersk Oil unit. The company declined to give details of any talks it had with Iranian officials. The Mehr news agency also cited the Islamic Republic of Iran Shipping Lines (IRISL) as saying that Maersk Line, the world’s largest container shipping company, would begin services to Iranian ports. “We can confirm that we have met with representatives from the Iranian government to discuss possible projects. Nothing has been agreed and we cannot share further details,” Maersk said in a statement. Mehr also cited Energy Minister Hamid Chitchian as saying that Denmark offered to invest in the construction of a wind turbine factory. Denmark’s Vestas, the world’s largest wind turbine maker, said its representatives were present in Tehran and the company was looking into opportunities there but would not elaborate on any talks.One early Danish mover on Iran was drug maker Novo Nordisk which said in September it would build a $78 million manufacturing plant in the country, signalling what it called a “long-term commitment to Iran”.The Danish foreign ministry directed questions to its delegation in Iran, which confirmed a memorandum had been signed with Tehran on insuring Danish exports to Iran but declined to comment on other individual business talks.Source: Reuters (Editing by Tom Heneghan)

Brazil And Norway Sign A Memorandum Of Understanding On Maritime Transport Cooperation

Brazil and Norway signed, on 16/11/2015, a memorandum of understanding with a view to expand and enhance the cooperation of the parties in matters related to maritime transport. The areas of cooperation contemplated in the MoU are: the international maritime transport, port support services, offshore support services, maritime transport auxiliary services; vessels charter, as well the inclusion of any other areas according to the parties mutual agreement.The MoA sets forth that the cooperation will take place, among other forms of cooperation, through the exchange of information, expertize and best practices, provision of technical and administrative cooperation, capacity building and training, development of joint projects, and facilitation of cooperation among companies and/or organizations of both parties. The constitution of a coordination committee has already been scheduled which will regularly meet in order to define future activities, evaluate the progress and the results obtained as of the MoA. The Foreign Ministry, the Ministry of Transports, the Brazilian Navy, and the National Agency for Waterway Transportation (ANTAQ) are the Brazilian representatives in the coordination committee.The MoA came into force as of the date of its signature, having an undetermined term, with the possibility of being terminated at any time by means of a six-month prior notice. Peace Boat volunteers clean up Maldives capital beach

Volunteers of the Japanese PEACE BOAT cruise, currently anchored at capital Male, carried out a clean-up programme at Artificial Beach in the capital’s east coast.The clean-up was jointly organised by PEACE BOAT and Junior Chamber International, with 20 passengers and several volunteers participating in the activity. Junior Chamber’s media and marketing director Adam Migdhadh told Haveeruthat the objective of the clean-up was to raise awareness of the effects of environmental changes on the delicate nature of the Maldives.“We delivered information on the

Tanker operator Odfjell has appointed former submarine commander Øistein Jensen as its new chief of staff.Norwegian Jensen, served as a submariner after graduating from the Royal Norwegian Naval Academy. He will take up his new role on February 29 after leaving his role as a director at PwC. He also holds an MBA from the Norwegian School of Economics (NHH). South Korea Orders Registration of All Bunker Tankers

A new order from South Korea's Ministry of Oceans and Fisheries means by mid-2017 all bunker tankers, and petroleum, oil, and lubricants (POL) tankers dedicated providing marine fuel at the country's ports will have be registered, IHS Maritime reports. Unregistered tankers will be barred from performing bunkering activities. The new requirement, which was made official with a December 31 amendment of the Harbor Transport Business Act, is said to be intended to re-establish market fairness and order, as well as to tackle spills and price dumping. The Korea Coast Guard and other relevant agencies are set to begin enforcing the new requirement following an 18 month grace period."This amendment to the law is an example of how regulations improved after the ministry's discovery of bottleneck problems, by making provisions for sufficient safety measures in view of port-specific conditions," Jung Do-hyun, port operations manager for the Ministry of Oceans and Fisheries, was quoted as saying.Earlier this week, the South Korean government announced plans to develop a $1.2 billion investment fund intended to provide support to the country's shipping industry. Stakeholders onboard for Polarcus restructuring plan

Polarcus says it has secured the support it needs to continue operations Marine seismic company Polarcus Limited has reached agreement with key stakeholders for a long-term restructuring of its balance sheet. The stakeholders – the company’s banks, certain bondholders and shareholders – have entered into written agreements with the company committing them to support the restructuring.Through implementation of

the restructuring, the balance sheet of the company will be significantly improved. It will reduce the company's debt level significantly, with renegotiated lease terms and the introduction of new call option prices for the bonds corresponding to a potential debt reduction of US$280 million. In addition, debt service payments during the next two years will be reduced by approximately US$140 million.The company’s bank facility will be extended from 30 June 2017 to 30 June 2022. There will be no amortisation until 1 January 2018 and interest payments will continue as normal. The liquidity covenant will be reduced from US$25 million to US$10 million, providing the company with additional financial flexibility in future. A working capital facility is to be extended to 1 July 2018, and a credit facility will be amended to make it more accessible. Adjustments will also be made to the company’s bonds and unsecured bonds.Charter rates for Polarcus Nadia and Polarcus Naila will be reduced by approximately 75 per cent from current levels until 1 January 2018 with an increase thereafter representing a reduction of approximately 20 per cent from current levels, subject to the company being able to service its bank debt in full at the time of any such increase. The purchase options will be removed from the sale-leaseback agreements, which will permit a reclassification from financial leases to operational leases, reducing the group’s financial indebtedness by US$167 million. The term of the charter periods for the vessels will be extended by two years. The restructuring provides that all trade creditors will be unimpaired and will continue to be paid in full. Completion of the restructuring proposal is subject to the approval of an EGM of the company where a majority of the shareholders present and voting must vote in favour of the proposal. 2015 Containership Market Review

The cellular containership fleet reached a total slot capacity of 19.94 Mteu at the end of 2015, growing by 8.5% over a period of 12 months. A record level of vessel deliveries saw 214 new containerships enter the market in 2015. These new ships added 1.72 Mteu to the global fleet, while only 0.20 Mteu were deleted as a result of scrapping, vessel conversions or casualties. The year’s high fleet growth proved to be unsustainable, as idle containership capacity soared to 1.36 Mteu at the end of 2015, compared to only 0.23 Mteu at the beginning of the year.

At the end of December, average CCFI freight rates from China were 32% lower than one year ago, while charter rates fell by 23% year-on-year, as both the freight and charter markets crumbled under the pressure of the severe imbalance between demand and supply.However, these weak market conditions failed to deter owners from ordering more containerships. A total of 255 vessels was ordered last year with a total capacity of 2.34 Mteu. The value all containerships contracted over the course of the last year reached an estimated $20.2 Bn, 98% higher than in 2014. A fair number of these newbuilding contracts was driven by the new IMO Tier III requirements, which prompted some owners to bring forward planned orders. New Wave of Bankruptcies for China’s Dry Bulk Companies

The overall business climate in China continues to deteriorate and dry bulk shipping companies, being hit the hardest, are likely to be swept by a new wave of bankruptcies, according to the latest report from the Shanghai International Shipping Institute (SISI).In the fourth quarter of 2015, shipping business climate index was at 82.04 points, the report shows, which is still a relatively depressed level. The shipping business confidence index was at 34.42 points, also slumping heavily. Shipping companies’ transport capacity, space utilization, freight revenue, profitability, corporate finance and loan capabilities were all down due to deteriorating business conditions. The oversupply plaguing the container and dry bulk shipping sectors pulling down freight rates have pushed companies to the end of their tethers, especially in the dry bulk sector.According to the Chinese shipping sentiment survey, more than 60% of the 50 dry bulk shipping companies surveyed were coping with long-term losses and nearly forty percent of the companies were facing long-term liquidity problems.What is more, a considerable number of dry bulk shipping companies are stretched to the edge of bankruptcy.Furthermore, as the sector enters 2016 in a very weak condition, dry bulk owners are expected to experience further financial losses as the year unravels. The turbulent seas in the sector coupled with tough capital market and inability to secure financing are likely to bring a new wave of bankruptcies for dry bulk shipping companies, SISI said. The announcement comes on the heels of the new record low of the Baltic Dry Index (BDI) which on Tuesday reached 468 points, down from its previous record low of 471 points posted in December last year.A number of companies in the sector resorted to bankruptcy in 2015 having succumbed to relentless market conditions, including Winland Ocean Shipping Corp, which filed for bankruptcy protection in February last year, and state-backer shipbuilder Wuzhou Ship Repairing & Building Co Ltd, which filed for bankruptcy in December.Source : World Maritime News Staff

towards the prevention of accidents at sea. Drawing directly from the experience of seafarers, CASCADe has developed a new adaptive bridge design methodology that treats both human agents and electronic equipment as parts of a cooperative system. This allows for the sharing of information to be optimised. In addition, CASCADe has developed a set of adaptive bridge displays. A touch screen ‘Shared Display’ is intended to aid communication and co-operation on the bridge. This tool is fully customisable and allows one screen to show multiple sources of information in whatever configuration is most suitable for a particular situation. The ‘Shared Display’ provides functionality to graphically annotate maps, leave notes for other crew members or complete checklists electronically.Moreover, the CASCADe console was integrated with tools used by pilots in their Portable Pilot Units (PPUs). Firstly, CASCADe developed a protocol to share pilotage routes between the PPU and the ship’s electronic charts. Secondly, a link was established between the PPU and the bridge screens to allow mirroring of information from the PPU screen, enabling crew members to see extra information normally only available to the pilot. All of these CASCADe tools were tested on both a physical simulator (a ship simulator used for training) and a virtual simulator (a software-based simulation of a ship bridge). The virtual simulation platform makes it possible to test new bridge designs at the earliest stages of development, based purely on computational models. By simulating human-machine interaction, it is possible to analyse information flow and optimise the information exchange between seafarers and bridge equipment. Through innovative research techniques such as modelling and simulation, listening to the experience of seafarers, cross-discipline collaboration and forward thinking ideas, CASCADe has produced new concepts in bridge console design. By improving communication and co-operation and providing adaptive features on the bridge, CASCADe has contributed towards the prevention of accidents and the improvement of efficiency on board – impacts that will be felt by both individual seafarers and the maritime world as a whole. Under the coordination of OFFIS (Oldenburg Research and Development Institute for Information Technology Tools and Systems), CASCADe included a consortium of seven project partners from five EU countries including BMT Group Ltd, Raytheon Anschuetz GmbH, Mastermind Shipmanagement Ltd, the University of Cardiff, Marimatech AS and Symbio Concepts & Products SPRL. BMT Nigel Gee Designs First UK Flagged HS-OSC Wind Farm Vessel

BMT Nigel Gee, the leading independent naval architecture and marine engineering design

consultancy, is proud to announce the delivery of Sure Diamond, which is the first ever UK flagged vessel to be certified under the Interim Code for High Speed Offshore Service Craft (HS-OSC). Virginia Strikes First US-Cuba Trade Deal In a bid to establish a direct service and increase trade with Cuba, the Virginia Port Authority has signed a cooperation agreement with Cuba, which will be a first for a US port operator, according to Reuters. Terry McAuliffe, Governor of Virginia, said: "We are going to sign an agreement tomorrow between the Port of Mariel and our Port of Virginia which will be a strategic alliance.”Thomas Capozzi, Chief Sales Officer for the Port of Virginia, said: "As Cuba and the US normalise relationships, we'd like to see the Cuban companies establish Virginia as their distribution point for the United States.”It was previously reported that historic hostility between the US and Cuba was beginning to thaw, with suggestions that this could improve the relationship between the two countries and help Cuba’s Mariel Port expand at a much faster rate.Ports in the South Atlantic and US Gulf could also see benefits if the trade embargo is lifted on Cuba.Virginia International Terminals has also recently made the move to select and implement Versiant’s LYNX Customer Service Portal (CSP), which integrates with the Navis SPARCS/Express and N4 TOS. Wilhelmsen Group names Christian Berg as new CFO

Christian Berg is to join Wilh. Wilhelmsen Holding as its new CFO in April, succeeding Nils P Dyvik, who plans to retire.Berg will join the Oslo-listed company from his position as senior partner and head of credit in HitecVision, a European private-equity company focused on the offshore oil and gas industry.Previously, he held the positions of CEO and CFO of Hafslund, one of Scandinavia’s largest listed utility companies.“I have had the great pleasure and privilege of working with Nils P Dyvik for many years. Nevertheless, the dry bulk sector will probably have to reduce the newbuilding orderbook and increase ship recycling in 2016 in order to restore the balance. “The same is true of the container ship sector, where reducing capacity is seen as the best way to drive up rates. CMA CGM's move to buy NOL, meanwhile, although subject to regulatory approval, is an indication of further consolidation. It would be no surprise to see more still in 2016.“By comparison, the tanker markets enjoyed a stronger year in 2015, not least because of falling oil prices. In contrast, this has presented major challenges in the offshore maritime space. Some experts are predicting a slide to $20 a barrel in 2016, which may be just as well since a recent decision of the English High Court left a shipowner claiming that it had been asked to pay twice for the same fuel from bankrupt OW Bunkers. In 2016, owners will be monitoring a possible appeal against this decision to the Supreme Court, while keeping an eye on disputes elsewhere. “Shipping will remain volatile and uncertain throughout 2016. Operating costs will go up, as will the cost of regulation - for example, implementation of the Ballast Water Management Convention. The threat from cyber security will rise. Interest in refinancing, as a means of getting cash out of the business, is likely to increase, as are calls for accelerated ship recycling and a cap on newbuildings. The effect of geopolitical developments should not be under-estimated, while speculation about the UK’s planned Brexit referendum in 2017 will add spice to the pot.“Now is nevertheless a good time to invest if you have access to finance and a credible business plan, preferably one with the badge of green approval. The ITF (International Transport Workers’ Federation) and its affiliated unions are keeping a close eye on the MV Portland dispute in south-eastern Australia, with key international unions now backing the local campaign to protect jobs. ITF affiliate the MUA (Maritime Union of Australia) has been in dispute with Alcoa for nearly two months over the global miner’s plan to sack 40 local seafarers, sell their ship after 27 years of continuous service, and replace them with cheap, exploited foreign labour on board flag-of-convenience (FOC) vessels. The MV Portland has moved to anchor ahead of the arrival on Thursday of the P&O cruise liner Pacific Jewel. All parties have agreed have agreed that the MV Portland can return to the port on the day after the Pacific Jewel’s visit. The influential Nautilus International, which represents officers and seafarers in Great Britain, Switzerland and the Netherlands, has members on board the UK-registered Pacific Jewel. Nautilus International General Secretary Mark Dickinson, who is based in Great Britain, today said his union supports the plight of the MV Portland workers. “We have been closely following the developments arising from the move by Alcoa to use a foreign-crewed ship in place of the MV Portland,” Mr Dickinson said. “Nautilus pays tribute to the high level of cooperation displayed by the MV Portland’s crew in working around the dispute to facilitate the visit of the Pacific Jewel into the port of Portland.“The issues surrounding this case have immense resonance on this side of the world, as we have witnessed a long-term decline of our coastal shipping fleet as a consequence of the ‘open coast’ policies pursued by governments and the failure of measures to support our national shipping. “We support the campaign to uphold safety and security in Australian waters by opposing the increased use of often substandard and low-cost flag-of-convenience shipping. “We are appalled by the actions of Alcoa as well as the Australian Government’s lack of progressive shipping policies in favour of the lowest common denominator approach.”Alcoa has been allowed to make these plans due to the granting of a ‘temporary licence’ from the conservative Australian government, whose policy it is to deregulate the local shipping industry. ITF President Paddy Crumlin said: “The ITF and international unions continue to show their solidarity with the workers on the front line at Portland because if it can happen to them it can happen to any of us.“It beggars belief that the company and the Government have allowed this to develop, rather than show leadership and find a mutually agreeable solution to protect local jobs. “The Australian Senate has so-far rightly blocked the Government’s deregulation agenda with the Government’s own figures saying this would result in more than 1,000 direct job losses. “The combination of corporate greed, complicit governments and the flag-of-convenience system - which encourages international tax avoidance and exploitative employment standards – will ultimately hurt the local community and economy.”

Judge tosses $21.5M verdict in Holland America cruise-injury case

A judge in Seattle has thrown out a $21.5 million jury verdict awarded to an Illinois man who claimed he was injured during an around-the-world cruise in 2011.

By GENE JOHNSON A federal judge Tuesday in Seattle threw out a $21.5 million jury verdict awarded to an Illinois man who claimed he was injured during an around-the-world cruise in 2011, after the man’s former assistant came forward to say he had intentionally deleted emails that could have hurt his case.U.S. District Judge Barbara Rothstein ordered a new trial, saying she found the assistant’s testimony at a hearing last month credible — and that newly uncovered emails expose “grave inconsistencies” with James R. Hausman’s story.

Hausman, of Springfield, Ill., sued Seattle-based Holland America Line in 2013. He said he had dizziness and seizures after an automatic sliding-glass door improperly closed and struck his head as the vessel approached Honolulu. After a two-week trial in October, a Seattle jury awarded him $21.5 million. But soon afterward, Hausman’s former personal assistant, Amy Mizeur, came forward to say she had watched him spend several days deleting emails that he should have turned over to Holland America lawyers before the trial. He also failed to disclose the existence of one of his email accounts, she said.Mizeur worked for Hausman at The Gold Center, a precious-metals dealer in Springfield. The allegations prompted Rothstein to hold a hearing last month. She found Mizeur credible; her former boss not.

“As a witness, he came across evasive and untrustworthy,” the judge wrote. “He appeared to weigh each answer, not for its truthfulness, but to assess whether it would damage his case. Mr. Hausman also seemed to capitalize on his alleged brain injury when it was convenient for him. He was confused or claimed memory loss when confronted with a question or exhibit that appeared to undermine his claims, yet was animated and full or information when his testimony supported his case.” Further, Rothstein noted, some of the emails Mizeur was able to recover — even after Hausman told her to delete them — “cast doubt on his veracity.”For example, he testified he avoids using ladders since his injury because he is afraid of falling. But in one of the deleted emails, he wrote to Mizeur to say he was sore after spending most of the day on a 10-foot ladder chopping ice that had built up on his front porch.Nor did the judge believe Hausman’s claims that he did not delete the emails to frustrate Holland America’s defense, but simply as part of his routine practice of clearing out his inbox.The actions were deliberate and “substantially interfered with defendants’ ability to fully and fairly prepare for and proceed to trial,” Rothstein said.Hausman portrayed Mizeur during the hearing as a disgruntled former employee who had been fired for forging a check. But the judge accepted Mizeur’s explanation for why she signed his name to the check — that he had given her permission to do so.Hausman also said Mizeur had tried to extort him. She testified she was simply shocked about having been accused of forgery and fired when she sent him a message suggesting she would ruin his life if he didn’t pay her off.One of Hausman’s attorneys, Richard Friedman, called the decision “frustrating and disappointing” but said it cannot be appealed. “I’ve done a lot of retrials in my time, and often the verdict the second time around is bigger than the first,” he said. He added that Rothstein’s ruling “doesn’t address Holland America’s conduct that caused the injuries in the first place or the extent of his injuries.”The company’s lawyers did not immediately return an email seeking comment Tuesday. BDI Hits 468 Points, Operators Offload More Bulkers

On Tuesday, the benchmark Baltic Dry Index hit a new all-time low of 468 points, in what analysts at Deutche Bank described as a “perfect storm” for bulker operators. The firm lost $150 million in 2015 and its stock has plummeted, but its share price rose on the announcement, to $0.63. Star Bulk is said to be considering a reverse share split. The firm has been steadily offloading its fleet for months amid persistently weak BDI rates. In November, the firm sold two Capesizes for $80 million; in December, it sold two Capesizes and two Kamsarmaxes for $122 million, then three additional Capesizes for $110 million. Star Bulk now operates a total of 66 ships, with 19 more newbuilds on the way. Separately, carrier operator Scorpio Bulkers has sold five Capesizes – three second-hand and two newbuildings – for $167 million. The sales represent the last of Scorpio's ships in the vessel class. Media reports have listed shipping magnates John Fredriksen and John Angelicoussis as involved parties, but Scorpio has not confirmed the names of the buyers. The sale reduces Scorpio's fleet to 25 smaller vessels, with 24 newbuilds on the way.New York-listed Scorpio has also been trading below $1, and it recently received warning notice from the NYSE for the low performance of its shares. Like Star Bulk, Scorpio is said to be considering a reverse share split.In a report Tuesday, Deutche Bank had a warning regarding vessel sales in the current weak market, suggesting that offloading ships could force some operators into bankruptcy as large asset reductions would violate their loan covenants.“We believe a number of dry bulk companies are contemplating asset sales to raise liquidity, lower daily cash burn, and reduce capital commitments . . . [But] the majority of publically listed dry bulk companies are already near max allowable loan-to-value levels. The move to sell assets in unison can lead to a downward spiral, where the decline in values leads to an immediate need for additional equity to cure LTV breaches,” the bank said. Ukraine may lose its navy if no new ships are built

Ukraine may lose its sea power status if it doesn't build warships and supply vessels for its navy, Chief of the Naval Forces of Ukraine's Armed Forces, Vice-Admiral, Serhiy Hayduk has said. "Ukraine can't be a successful sea power, unless its Naval Forces develop," the Defense Ministry press service cited Hayduk as saying on Tuesday.He noted that the maritime nation status was not an end in itself, but an important factor of economic and defense potential of the country. Besides, in the current situation, the urgent construction of warships, boats and supply vessels is a top priority, as otherwise Ukraine may lose its status of the sea power, the vice-admiral said. "It's clear that construction and maintenance of the fleet is not a cheap undertaking, however, we have no way of developing the national Naval Forces," the commander said. The Mexican Navy (Secretaria de Marina - SEMAR)and Dutch shipbuilder Damen Shipyards Group have signed contracts for three, 42-metre patrol vessels in addition to their existing fleet. All ships will be of the Damen Stan Patrol 4207 design.

This contract is again proof of the good, ongoing relationship between the Mexican Navy and Damen. The three SPa 4207 vessels, known in Mexico as the Ténochtitlan class, will be built by the Mexican Navy Yard ASTIMAR 1 in Tampico. Damen will provide the engineering, material package, technical assistance and crew training.The vessels will be named after Mexican historical sites and are expected to be launched in 2016. Hambantota to Restart Bunkering to Assist with Debt Repayment

The SLPA says it will restart bunkering at the Port of Hambantota to help repay debt accrued through loans taken for the harbor's construction. Sri Lanka Ports Authority (SLPA) says it will restart bunkering at the Port of Hambantota and increase vehicle transshipment activities in an effort to help repay debt accrued through loans taken for the port's construction, Sri Lankan media reports."It is expected to minimize the pressure to the financial flow at the Port of Colombo through these procedures," the SLPA was quoted as saying.It is reported that loan installment and interest charges for Hambantota's first stage, as well as interest and commitment charges for the port's second stage, are both due to be paid this year.SLPA said this was "the main financial challenge" it has to face in the new year. Bunkering at Hambantota, which had been run by the SLPA, was suspended last year after it was eventually revealed that they had overpaid for a large quantity of low demand product, the quality of which was also questioned - a scenario exacerbated by bunker prices being in virtual free-fall on the back of collapsing oil prices.The "bunkering irregularity" was said to have resulted in a $19.9 million loss for the port, While it is unclear if the planned restart of bunkering at Hambantota will once again be run by the SLPA or if it will involve private sector players, last April Ship & Bunker reported that SLPA was urgently looking for joint venture partners to run bunkering services at the Port. One thing that is clear is that Sri Lanka's Ports Minister, Arjuna Ranatunga, says that the port "has to be converted to a profitable venture.""The second phase of the Hambantota port is scheduled to be completed by April," said Ranatunga, adding that several investors are already "keen" on investing in the port."We also plan to utilise the dockyard and the fuel refinery of the port so as to get the best outcome of the investments," added the minister.Last month Ship & Bunker reported that bunkering at the country's port of Colombo was prospering having received a boost from an increase in vessel traffic. Five trends in 2016 will shape the maritime industry over the next decade, according to a recent report from business information provider IHS.The report, titled IHS Global Maritime Trends 2016, says that the commodity supercycle, a slowdown in China’s domestic demand, the lifting of Iranian sanctions, the continued rise of big data and long-term demographic shifts are issues that will set the tone for the industry. “What’s past is no longer prologue as the maritime sector undergoes profound changes amidst these turbulent and unprecedented times,” Richard Clayton, chief analyst at IHS Maritime & Trade, said in a news release. “Understanding how the industry will evolve in response to economic, political, demographic and technological trends – from shipbuilding to cargo routes, to the future of seafaring – is going to be an essential endeavor for businesses, policymakers and investors alike.”

Port of Virginia spokesman Joe Harris said four of those issues are likely to affect the maritime industry in Hampton Roads.Regarding China’s economic slowdown, “This is still playing out, but as a port, our work in developing and implementing a sustainable business model prepares us for these kinds of eventualities,” Harris said in an email. “A sustainable business model allows us to continue to move forward even when there are these types of challenges, things will happen that are beyond our control, so it is our effort to remain nimble and ready to pivot if necessary.”Art Moye, executive vice president of the Virginia Maritime Association, said the second trend identified by IHS “draws conclusions about China’s domestic demand faltering and its failing (gross national product), which will have little effect on the Hampton Roads maritime industry.” However, Moye added, lower freight rates could help stabilize consumer goods pricing, which would fuel more demand for Chinese imports, and in turn, support a projected 8 percent container volume increase.

Meanwhile, the lifting of sanctions on Iran “does open up a new potential market, but the health of that market is dependent on the strength of that nation’s economy,” Harris said.And while the commodity supercycle is not applicable, the use of big data and metrics, Harris said, also is an important part of the port’s business plan. “Use of measurable performance metrics removes the guesswork from the task of analysis and provides the necessary information to make those strategic investments that will allow us to improve and grow,” Harris said.Finally, demographic and population shifts are “well documented and as a port we are doing those things necessary to implement a sustainable business model that will capitalize on these shifts. The port’s 10-year capital improvements plan will put Virginia in a position to handle these large vessels that will carry goods to and from these emerging markets.”The IHS announcement indicates the trends are “critical to improving the performance of the maritime industry’s capital investment.” Harris said the Port of Virginia has started to execute a 10-year capital plan that covers all terminals and phases of the operation.“Our area of emphasis now is the renovation of the South Berth at Norfolk International Terminals, namely the upland operation there. Broadly speaking, this project that would help increase the efficiency and capacity at that terminal,” Harris said. “Presently, we are working on the new North Gate project that will double the gate capacity at NIT, create safe, direct interstate access for trucks using the North Gate and help to reduce truck trips on Hampton Boulevard.”Throughout 2015, the port continued to set and break volume records for the number of 20-foot equivalent units handled. The port last year also dealt with volume-related delays that were exacerbated by snow days. The snow days brought operations to a halt and forced the closure of the port’s terminals. Moye said the port’s congestion issues were not exclusive to 2015 but instead developed over several years, culminating to a crisis point.“The Virginia Maritime Association (VMA), working with the Virginia Port Authority, brought all affected stakeholders together during 2015 for a series of resolution discussions that resulted in action items that improved efficiency and productivity,” Moye said. “While we approve of this collaborative effort and the steps taken by the VPA, we would consider the issue much improved, rather than resolved. Solutions include long-term projects and capital improvements that are not yet in place. Improvements should continue.”Harris said: “Last winter’s weather presented some significant challenges, and we took several steps in almost every phase of the operation to expedite the volume and return to a consistent level of service.“Though we cannot control the weather, we are in a far better position to recover from delays brought about by snow or vessels off schedule than we were in early 2015. We learned a lot during that period, and we have made the necessary strategic investments that have made us a much more nimble and adaptable operation. Thus, we are optimistic that 2016 will be smooth, but we know it will not be without its challenges.”

Daling in droge bulk De daling in Amsterdam is met name veroorzaakt door een lagere overslag in droge bulk. Bij de kolen was sprake van een daling van 11% tot 17,3 miljoen ton. Ook de overslag van agribulk daalde, met 6% tot 7,4 miljoen ton. Overige droge bulk, waaronder ertsen en meststoffen, steeg wel met 9% tot 8 miljoen ton.In de overige ladingsstromen bleef het resultaat dit jaar ten opzichte van vorig jaar ongeveer gelijk of steeg deze licht. De overslag van olieproducten bedroeg in 2015 39,4 miljoen ton tegen 38,9 miljoen ton in 2014 (+1%). Overige natte bulk steeg met 11% naar 3,4 miljoen ton. De overslag van containers daalde licht van 633 duizend ton in 2014 naar 615 duizend ton (= 51.634 TEU) in 2015. Ro/Ro, auto’s en overige stukgoed daalde in 2015 met 8% tot 2,3 miljoen ton.

Gronduitgifte In 2015 werd ca 18,5 hectare grond uitgegeven aan bedrijven. De verwachting is dat deze trend zich voortzet.

Import en export De import in de Amsterdamse haven daalde met 4% tot 50,8 miljoen ton in 2015. De export groeide daarentegen met 3% tot 27,6 miljoen ton.

Cruisecalls In totaal heeft Amsterdam in 2015 van 134 zee cruiseschepen bezoek gehad en van 1768 riviercruiseschepen. Dit zijn respectievelijk 8 en 83 meer dan vorig jaar in dezelfde periode. Het aantal zee cruise bezoeken aan IJmuiden bedroeg in 2015 44 (2014: 56).

Tug boat strike to shut eastern ports Tug boat crews in eastern Australia plan strikes next Tuesday and Wednesday for 12 hours, halting all coal carriers, fuel carriers and bulk container vessels into the ports of Brisbane, Newcastle, Sydney, Botany, Melbourne and Geelong. The strike action will effectively shut down Australia's eastern ports for 12 hours from next Tuesday, January 12, in the first of a series of planned strikes. The strike threat is likely to be taken to the Fair Work Commission this weekend by the company running the container tugs.Tug boat crews plan to strike in Brisbane and Melbourne ports on Wednesday, January 13, while they plan to strike the day before in Sydney, Botany, Geelong and Newcastle ports. The surprise planned strike comes after the company that manages tug boats in these Australian cities tried to force the three-person crews onto a new industrial agreement. For 25 years the three-person crews – the skipper, the deckhand and the engineer – have been represented by three different agreements recognising different sets of skills. However,

Svitzer, the Danish company that operates tugs in Australian ports, wants the crew under a new single agreement. A vote on Wednesday morning by members of the Australian Institute of Marine and Power Engineers, the union representing tug boat engineers, has backed the strike action.The strike would bring ports in these cities to a 12-hour halt, because they are dependent on tugs manoeuvring bulk carriers into position at container wharves. Svitzer was last night is surprised by the potential strike action and believes it may be linked to the union fear it is at risk of being absorbed into the Maritime Union of Australia. Brisbane has six tugs; four run by Svitzer and two run by Dutch company Smit Brisbane tugs, most frequently used as pairs per large ship, performed 4000 ship assists – or 400 a month - between January and October 2015.There were twice as many operations in the larger port of Newcastle (8000) and more at the larger ports at Sydney, Melbourne and Geelong; where Svitzer is the sole tugboat operator. The tug boat strike does not apply to cruise ships or to defence ships. Three Chinese Navy ships berthed in Brisbane over last weekend for a five-day training and recreation break and after anti-piracy operations in the Gulf of Oman. The Australian Institute of Marine and Power Engineers said they have been negotiating with Svitzer for several months over their planned change to the work place agreements.AIMPE federal secretary Martin Byrne said workers hoped the issue could be resolved without the need to strike."AIMPE has not made any outrageous pay claims and our members hope that the company sees good sense and agrees with AIMPE to settle on a separate agreement to cover Engineers," Mr Byrne said."AIMPE has as late as Tuesday sought further discussions with Svitzer with this objective in mind," he said."It is important to note that holiday makers on cruise vessels will not be affected by any protected action. Also national security operations will be exempt from any action."Svitzer on Wednesday night expressed surprise at the potential strike by AIMPE tug boat crews and said it had already reached agreement with the two other unions involved."We have the in-principle support of two of the three unions – the Australian Maritime Officers Union (AMOU) and the Maritime Union of Australia (MUA) – for a new four-year enterprise agreement (EA) that will provide industrial stability and certainty," a Svitzer spokesman said."AIMPE has chosen to put all that at risk," he said. "Together the MUA and AMOU represent two thirds of our workforce."In the maritime industry of 2016 one agreement simply makes common sense – one tug, one crew and therefore one agreement. SSI: Financial Pressure to Reduce Bunker Bills "Simply Not There"

Alastair Fischbacher, CEO of SSI, says low bunker prices are preventing the shipping industry from feeling pressure to boost operational efficiency.Ship operators are under no pressure to reduce their bunker bills, and low fuel prices are preventing the shipping industry from adopting operational and environmental efficiency measures, Alastair Fischbacher, CEO of the Sustainable Shipping Initiative (SSI), has told Maritime CEO in a New Year's interview. "The real financial pressure to reduce fuel costs is simply not there at the moment, as against 18 months ago when distillates were trading at $1,000 per tonne," said Fischbacher.Indeed, Ship & Bunker data shows that the average price for MGO across Singapore, Rotterdam, Houston, and Fujairah rose above $900 per metric tonne (pmt) on July 3, 2012 and did not fall below the $900 pmt threshold again until over two years later - on September 11, 2014. During that time the average price across the four ports hit a high of $1035 pmt, but on Wednesday had fallen to $383 pmt.Fischbacher, pointing to the new CO2 emissions Monitoring, Reporting and Verification (MRV) regulation that is set to come into force in 2018, said "regulations like this keep sustainability front of mind within the industry, but also

raises concerns about how to ensure a level playing field."Emissions Control Area (ECA) regulations are an example of an unlevel playing field within the shipping industry, says Fischbacher."There is real concern within the industry that current practice does not ensure shipowners and operators are all adhering to new regulations, which creates the foundation for, and danger of a two-tier system, where those that invest in compliance are worse off than those that do not," he explains.Fischbacher's views have been shared by many since the introduction of ECAs, with Niels Bjorn Mortensen, head of regulatory affairs at AP Møller-Mærsk, saying in October that current efforts to uphold Northern Europe ECA rules has left much to be desired.However last year it was reported that compliance is actually higher than many expected, with data from the Danish Environmental Protection Agency indicating only 6 percent of spot checked vessels were not in compliance, of which only 2 percent indicated sulfur levels above 0.3 percent.Ship & Bunker observed that, given there are no residual fuel products with a 0.3 percent or lower sulfur content, the data suggests the majority of those in non-compliance are unlikely to be seeing any financial gain as a result. Abu Dhabi Ports sets annual cargo volume record for 2015

Abu Dhabi Ports, the master developer, operator and manager of ports and Khalifa Industrial Zone in the Emirate, set a new annual cargo-volume record in 2015, surpassing the previous record set in 2014. The company witnessed significant surge in volumes during the year in all major sectors, namely container cargo, general and bulk cargo, Roll-on-roll-off (RORO), and cruise tourism; and saw increased investments in Khalifa Industrial Zone. Khalifa Port Container Terminal, which is operated by Abu Dhabi Terminals – a subsidiary of Abu Dhabi Ports – handled 32 per cent more containers. The terminal moved 1,504,293 TEUs (twenty foot equivalent units/containers), up from 1,137,679 TEUs in 2014.Roll-on-roll-off (RORO) traffic had 27 per cent upturn with 134,272 vehicles, up from 106,071 vehicles previous year. All roll-on-roll-off (RORO) operations were transferred to Khalifa Port from Zayed Port in 2015 to meet the rising demand. Better yard and terminal facilities, and services at Khalifa Port have contributed to the upsurge in volumes.General and bulk cargo saw 20 per cent upswing to 15,310,847 million freight tonnes (FT) from 12,804,248 million FT in 2014. The surge in general and bulk cargo volumes across Abu Dhabi Ports indicates rising import and export activities related to industrial and infrastructure development projects in the Emirate. Abu Dhabi’s rapidly expanding cruise industry witnessed 16 per cent growth with 170,360 cruise passengers visiting the Emirate in 2015, up from 146,997 cruisers previous year. The newly opened state-of-the-art Abu Dhabi Cruise Terminal at Zayed Port, a premier cruise hub in the region, is expected to further catalyse this growth.At Khalifa Industrial Zone (Kizad), Abu Dhabi Ports saw a total of 21 Standard Musataha Agreements (SMAs) signed this year with national and international investors, and three plot-extension SMAs with existing investors. These projects represent over 1,384,017 million square metres of land leased in 2015. Memoranda of understanding (MOUs) were signed with Industrial Development Bureau (IDB) of Abu Dhabi’s Department of Economic Development (DED), and SACE Group–Italian Export Credit Agency, to further attract investments into the integrated trade and industrial hub of Abu Dhabi. These MOUs explore ways to enhance the services and support offered to customers through collaborated efforts. Commenting on the positive results, Captain Mohamed Juma Al Shamisi, CEO of Abu Dhabi Ports, said that Abu Dhabi Ports’ success is due to the ongoing investments in equipment, technology and workforce capabilities. “Abu Dhabi Ports’ business focus is to deliver value to customers by supporting their thriving businesses through its integrated services and offerings. We are proud to be in a position to support the economic growth being witnessed in the Emirate and intend to continuously invest in enabling the nation’s maritime trade and industrial development,” he said.Praising the projects and operations team at Abu Dhabi Ports, comprised of a large number of strong Emirati talent, Khalifa Port Container Terminal management, and the team at Kizad, Captain Al Shamisi continued, “With the support of our wise leadership, and dedicated efforts of our employees, stakeholders and partners; we are able to meet the changing requirements of our customers.”Abu Dhabi Ports’ heavy investments in the world-class infrastructure, the latest technologies and equipment have considerably attracted more customers to the ports in the Emirate. The company officially inaugurated Al Mirfa Port in the Western Region of Abu Dhabi recently, after completing extensive redevelopment work. Three other ports in the region – Mugharrag Port, Delma Port and Sir Bani Yas – are also being redeveloped as part of the master development plan.
