Q: Can I install Solar Panels on the roof above my unit?

A: The external structure (incl roof) is ‘Common Property’. You require the written approval of the Owners Corporation before commencing any works relating to Common Property. An appropriate ‘exclusive use’ Bylaw is also required for this type of an installation. Bylaws must be registered on the Common Property Certificate of Title and are usually prepared by legal practitioners.

Q: Can I keep an animal within my Unit?

A: It depends on the Bylaws applicable for your property. The most common Bylaw adopted by Owners Corporations’ states that you cannot keep an animal without the written approval of the Owners Corporation. NB: The Owners Corporation cannot prevent a resident from keeping a seeing-eye dog.

Q: What is the difference between the Administrative and Sinking Fund?

A: The Administrative fund is used to cover the recurring day-to-day expenses of the Owners Corporation (insurances, lawn mowing, electricity, bank fees etc) whereas the Sinking Fund is similar to a ‘savings’ account. Monies are accrued into the Sinking fund annually to cover the larger one-off capital expenses (external painting, roof restoration, fence replacement etc).

Q: Why do I need a will if the law says my estate will be given to who I want it to go to anyway?
