It’s already that time of year when we say “I can’t believe it’s already this time of year!. I hope you have had a chance to participate in a Bar activity in the past few months—if not, no worries because we have a lot to look forward to in the months to come. Mark your calendar for the events in bold letters described below:

Many members have said they would like to have an evening social instead of a luncheon—MARK YOUR CALANDAR FOR FEBRUARY 13th 2020. We will be meeting at the new Beachwood Seafood Kitchen and Bar for drinks and heavy hors d’ oeuvres from 5:30 to 7:30.   Members will attend at no charge. This will give us a chance to have meet and mingle with other members informally, and thank our Sponsors. Those of you who have trouble getting away from the office for luncheons must make it a point to join us that evening!!

Now for the giving back part. The Clearwater Bar has been giving back to the community this fall in a lot of different ways, and we want to continue to do so by helping the Young Lawyers with their Holidays in January project. I hope to see all of you at the HOLIDAY PARTY AT Bon Appetit on December 11th at 5:30. If you weren’t there last year I’m sure you heard about it. Past President Brandon Bellew had a goal to have “a very nice holiday party” in 2018-- and with the help of the board he definitely succeeded. We hope to repeat that success at the beautiful Bon Appetit venue. It will be free for members. We are asking that you bring a toy(s) or make a donation (if you are shopping challenged like me) so that the young lawyers can help make

January a better month for kids who didn’t get to have great holidays in December.

This issue of Res Ipsa includes some pictures of the Bench and Bar Seminar that was held at Stetson Law School on November 15th. This is always a great event and the focus this year was on pro bono. The Sixth Judicial Circuit Pro Bono Committee lead by Judge St. John (soon to be taken over by Judge Kim Campbell) includes representatives from several organizations (including the Clearwater Bar) and government agencies. We should all be proud of the effort being made in this circuit to help those who otherwise would not have access to legal representation or assistance.

There are still a few spaces left for the CLE trip to Cuba, on February 6-9, 2020. If you are thinking about going, you are running out of time to register- so do that now. Looking forward to seeing all of you for the Holiday party on December 11, 5:30 at Bon Appetit, and at the January 9, 2020 Membership Luncheon at Ruth Eckerd Hall when Florida Bar President John Stewart will join and address us (1 CLE). Our Professionalism Symposium, chaired by Connelly McArthur, will follow our luncheon from 1:30-4 pm (2 CLE).

Finally, on behalf of myself and the board, and the staff I want to wish each and every one of you, and your families a happy and healthy holiday season, as we look forward to 2020!

November is the beginning of the holiday season and by early December the days seem to have picked up speed and reached an unsustainable pace. I don’t know about you, but for me the plethora of “25 days ‘til Christmas” and there are “only shopping 15 days left before Christmas” signs, messages and commercials only serve to increase my anxiety and stress.

I have been married to an attorney for more than 35 years. Based on my lived experience, it appears that the holiday season (November – January) can be particularly stressful for attorneys. The year-end often brings the added concerns and questions around billable hours, meeting deadlines, closing transactions, and settling cases. The pull to work more hours to meet all of the year-end demands is even more difficult due to the need to entertain clients, attend holiday parties, shop for gifts, and spend more time with family and friends. Below are a list of 3 tips for relieving stress during the holiday and into the New Year.

Practice Positive Self-talkSelf-talk is your internal dialogue. Take

a minute and think about what you have said to yourself today? Positive self-talk is a powerful tool for improving how one

approaches stressful situations. Instead of allowing negative self-talk “I will never get all of the things done that need to be done” practice the use of positive self-talk “I always figure out a way to get the important things done”. Positive self-talk is supportive and affirming. Without even realizing it many of us routinely use negative self-talk throughout the day. With practice, you can train yourself to think good thoughts rather than negative ones about yourself, about others and about the tasks ahead of you.

Gratitude List (Oprah swears by this)

According to a recent article in the Harvard Health Publication “gratitude is strongly and consistently associated with greater happiness”. Specifically the article outlines that “the simple act (of making a daily gratitude list) helps people not only feel more positive, but also improves their health, helps them handle adversity, and helps them build strong relationships”. How to get started. First, invest in a journal or notebook that would motivate you to spend 5-15 minutes each day to write down what you are grateful or thankful for. Second, commit to dedicating 5-15 minutes each

morning or evening to making a list of 5 things, people, experiences or observations that you are grateful/thankful for that day. For example: I am grateful that I have good friends, I saw a beautiful sunset on my way home from work today, I am thankful for the weather, etc. Next, keep it simple. You can simply make a list of 5 words, or 5 incomplete sentences, or a 5 full thought narratives. Whatever works for you. You can write it down the old fashion way (I recommend this way) or do it electronically on your computer, in your phone or on a tablet. Make a commitment to begin doing this for the next 21 days. Then at the end of 21 days revisit your daily gratitude lists and if they make you smile then recommit to the practice of making a gratitude list for another 30 days.

ExerciseExercise and physical activity are great

ways to feel better, improve your mood, and have fun. Many of you may be thinking “yes I would love to exercise, but who has the time?. I hear you. However, a 15 minute brisk walk can be a game changer. There are easy strategies to get in more walking. For example, park further away from the front door to your office, walk to your favorite lunch spot, meet up with friends on the weekend to walk across a bridge (we have many beautiful walking bridges in Pinellas and Hillsborough counties). Last Christmas I purchased a fitness tracker (Fitbit) for my husband, Joe and I and for the past year we have had daily informal competitions to see who can get the most steps. It has been a motivator for both him and I – Joe has been known to earn 5,000 steps before 8:00 am. The list of exercise opportunities are endless. I recommend starting with something that is more easily achieved than making a financial commitment to a gym. . .

With a little planning and some positive thinking, you can find peace and joy during the holidays.

The Oyster Roast Turns

80!!! by Stephanie Libbey

Mark your calendars for the

Clearwater Bar’s 80th Annual

Oyster Roast, which will be held

from 5:00 p.m. to 9:00 p.m. on

Saturday, March 23, 2019, on the

grounds of Florin Roebig at 777

Alderman Road in Palm Harbor.

The first Oyster Roast was held

in 1939 and has remained an annual

Clearwater Bar tradition ever since. If

you have never been to the Oyster Roast,

make this year your first. It is an opportunity

to socialize with other attorneys, judges, and

guests, and to eat, drink, and be merry. You

do not have to like oysters to attend, but it

is always fun to watch our judges take turns

shucking them during their obligatory oyster

shifts. Your ticket buys you unlimited food

and drinks and entertainment by the Bubba

G Band. There are typically between 15-20

food stations sponsored by attorneys and

law firms. If you have never sponsored a food

station, now is your chance. Don’t be afraid if

you can’t cook, we will find a local restaurant

for you to partner with. Sponsoring a food

booth is a great way to get involved, interact

with everyone in attendance, and market

your firm. Decking out your food station is

highly encouraged as the competition for

the coveted Oyster Roast Cup is fierce. The

Oyster Roast Cup is awarded to the food

station with the most votes at the end of the

night and guarantees bragging rights until

next year. If you are in it to win it and want

The 2019 Certification Review in Orlando was a success. It was a great time to brush up on your knowledge of family law, reconnect with colleagues and have a little fun, all in the beautiful setting of Gaylord Palms Hotel. As I heard more than one person exclaim, “It’s impossible to attend and not get one perfect, ‘on point’ case that will benefit at least one of your clients.. If you didn’t go, consider going next year.

The Supreme Court of Florida has “tweaked” the Florida Family Law Rules of Procedure a bit regarding testimony and attendance of minor children at hearing or deposition. Rule 12.407(a) previously provided that “no minor child shall be brought to court to appear as a witness or to attend a hearing or subpoenaed to appear at hearing without prior order of the court or good cause shown unless in an emergency situation..

The new Rule 12.407(a) now specifically includes and forbids the deposition of a minor, or even attendance at a deposition, if the minor is a “witness, potential witness, or related to a family

law case.. Also, the previous exception “unless in an emergency situation” has been removed. Going forward, it appears an attorney will not have any discretion whatsoever in deposing or bringing a minor to court.

It appears alimony reform is dead in Florida for 2019. An alimony reform bill was submitted in March, 2019, however the bill has failed to appear on the sub-committee’s calendar, and with the end of the legislative session approaching, it looks like we won’t see any substantive changes until at least 2020.

What a great end to the year. Our section had a social at Thirsty Marlin that had over 40 attendees back on October 15th. There were several judges in attendance. It was a great time to relax and get to know everyone a little better. Our CLE meeting on November 7th was also well received. Dale Swope spoke to everyone on autonomous vehicles and what the future legal landscape may look like down the road. Mark your calendars for January 7th. We will be having our next social at the Rusty Lyon in Dunedin from 5:30-7:30pm. Everyone is welcome to attend! Please also mark your calendars for February 20th. We will be planning another lunch and learn - location and time TBA. If you have any ideas on a subject matter that you are interested in learning a little more about or are needing a refresher, please email me at [email protected]. Here’s to an amazing 2020!

Civil Trial Court Changes

By now, most of you may have heard that HB 337 was signed into law in the 2019 legislative session. What, do you ask, is HB 337? It is a law that gradually increases the maximum jurisdictional amounts for civil cases demanding money. Currently, our maximum jurisdictional amount in county courts is $15,000. Starting on January 1, 2020, that amount will be raised to $30,000. Starting on January 1, 2023, that amount will be raised to $50,000.

Of course, this has an impact on circuit court jurisdictional amounts. Starting January 1, 2020, everyone filing a circuit court action demanding money must assert that their damages exceed $30,000. Starting January 1, 2023, everyone must assert that their damages exceed $50,000.

The proponents of this change argue that circuit courts are overwhelmed with cases and that this shift would help relieve their caseload. Many argue, however, that the county courts are not as equipped to handle the jury trials that would likely come their way due to this change. Come what may, the law has changed, so be ready to change your pleadings as of the new year.

This article will discuss the ethics issues and lawyer obligations when a client is missing (or refuses to communicate) and the statute of limitations is about to expire. Florida Bar Ethics Opinion 72-36 (Reconsideration July 1, 1987) and ABA Informal Opinion 1467 address this issue and provide guidance to lawyers.

In the initial Florida Bar Ethics Opinion 72-36 (published in 1972), the facts were that “the inquiring attorney was retained by his client under a contingent fee contract in a personal injury matter. The client disappeared sometime after retaining the attorney and before suit was filed. Two years passed and, despite his diligent efforts, the attorney was unable to locate the client. The attorney asked whether he was ethically obligated to file suit before

the limitations period expired.”The initial opinion stated that “the

attorney’s duty of zealous representation required him to take whatever action was necessary to prevent loss of the client’s rights due to the passage of time. Specifically, the attorney was obligated to file suit unless he could obtain the opposing party’s agreement to waive the statute of limitations.”  Emphasis supplied.

After the Ethics Opinion was published in 1972, ABA Informal Opinion 1467 was published, which stated that the ABA Committee on Ethics and Professional Responsibility had determined that an attorney has no duty to file suit to toll the statute of limitations if the client’s unavailability was not caused by the attorney’s neglect.

After ABA Informal Opinion 1467 was published, the Florida Bar’s Professional Ethics Committee (PEC) reconsidered Ethics Opinion 72-36.  After reviewing the facts and Informal Opinion 1467, the PEC revised the opinion and stated:

“The Committee is now in accord with the conclusions reached in ABA Informal Opinion 1467. There, the attorney’s reasonable efforts to locate the client had been unsuccessful and the attorney believed there was no reasonable likelihood that the client would return. The ABA Committee on Ethics and Professional Responsibility determined that the attorney had no duty to file suit to toll the statute of limitations if the client’s unavailability was not caused by the attorney’s neglect. The ABA committee further stated that it was not improper for an attorney to include in his employment agreement a provision requiring the client to promptly notify the attorney of any change in address and providing that, if the client failed to so notify the attorney, the attorney was not obligated to proceed with the case.

“In view of ABA Opinion 1467, the Professional Ethics Committee is now of the opinion that an attorney whose client cannot be located despite the attorney’s reasonable efforts is not obligated to file

suit to toll the running of the statute of limitations if the client’s unavailability is not caused by the attorney’s neglect or inaction (see Rule 4-1.3, Rules Regulating The Florida Bar, requiring an attorney to act with reasonable diligence and promptness in representing a client) and: (1) the attorney believes there is no reasonable chance the client will return; or (2) the client’s unavailability is a breach of the attorney-client employment agreement. However, even in these situations it would not be unethical for the attorney to file suit in order to toll the statute of limitations.”

The executive summary of Ethics Opinion 72-36 (Reconsideration)) states:  “A lawyer retained for litigation by a client who has since disappeared is not obligated to file suit to toll the running of the statute of limitations if the lawyer has made a reasonable effort to locate the client and the client’s unavailability is not the result of neglect on the part of the lawyer.”

Bottom line:  Although ethics opinions are for guidance to lawyers and are not binding, the Florida Ethics Opinion and the ABA Informal Opinion make it clear that al lawyer is not required to file a lawsuit on behalf of a client when the client is unavailable and cannot be located, even if the statute of limitations will run; however, the lawyer is also not ethically prohibited from filing the lawsuit. 

Be careful out there.

I can honestly say, without hyperbole, that I am about to share with you the biggest news to hit Pinellas and Pasco Counties in our lifetime.  Updates on Marsy’s Law, you ask?  Not even close.  A substantial change in Death Penalty cases?  Nice try.  Changes in the sentencing guidelines?  Child, please!  I am talking about Bernie McCabe›s new policy utilizing email accounts for correspondence regarding case materials, including offers to resolve cases.  

This is not fake news.  I have the actual letter on actual letterhead actually signed by Bernie McCabe, effective September 12, 2019 (hereinafter known as the day pigs flew and hell hath frozen).  For those of you considered “old timers,” have no fear.  If you so choose, mailing correspondence is still a reasonable and acceptable form of communication regarding cases.  For those brazen enough, or for anyone who thinks of the 1980’s as “vintage,” you may email the Division Directors and Lead Trial Attorneys for the respective divisions and an Assistant State Attorney will follow up with a phone call and/or email response.

fundraiser for the Clearwater Bar during which local judges, lawyers and members of the community mix and mingle under the oak trees of the gorgeous Florin Roebig grounds in Palm Harbor with good food, music, and drinks. The Oyster Roast is a beloved Bar tradition, but it takes a village to pull it off. So, I’m asking for your help. The Oyster Roast committee needs volunteers to help with stuffing goodie bags, setting up, and cleaning after the event.
