The 24th Annual Four Corners Board of REALTORS Parade of Lights will be held December 7th, 2013 on Main Street Cortez. The theme for this year’s Parade is “BRINGING LIFE TO CHRISTMAS” and this year’s Grand Marshal is Southwest Health System in recognition of all the people involved in providing health care to the area. The Four Corners Board of REALTORS presents the Parade each year as our gift back to the communities in which we live and work. There is no entry fee to have a float in the parade but an entry form is required to be submitted. The floats are judged based upon Lights and Music, theme development, and originality, and 3 prizes are awarded to each of 3 different entry categories. MLSs grapple with new business model

'Paper brokerages' flying under the radar

Editor’s note: This is the second in a four-part series examining website operators who use brokeragelicenses to obtain shared listing feeds from multiple listing services to generate leads for other brokerages.See Part 1. Part 2 looks at how MLSs are struggling to interpret whether their rules allow “paperbrokerages” and fears that denying them listings could violate antitrust law. Part 3 will examine whetherwebsite operators that obtain Internet Data Exchange (IDX) listings are complying with MLS rulesgoverning their display. Part 4 will look at whether widespread adoption of the paper brokerage businessmodel could undermine participation in IDX, and the MLS system itself.

Companies that join multiple listing services to gain access to MLS listings data but don’t provide brokerageservices to buyers and sellers pose a dilemma for MLSs — if they’re aware of the practice at all, an InmanNews investigation has found.

So-called “paper brokerages” have cropped up to take advantage of MLSs’ efforts to help their memberscompete with national listing portals.

By managing a feed of pooled listings in their market that brokers have agreed can be displayed on eachother’s websites, MLSs have sought to help their members land more business by making them the bestsource of listing information in their markets.

But some brokers who seek access to MLS Internet Data Exchange (IDX) listing feeds that can attractconsumers to their websites don’t always represent buyers and sellers. Their goal is often to instead capturethe consumers’ contact information and sell it as a “lead” or referral to a brokerage that actively representsbuyers and sellers.

Who can participate?

A key issue in determining who has the right to display IDX listings has been whether a company qualifiesas an “MLS participant.”

Obtaining a brokerage license and joining an MLS without providing brokerage services is a relativelysimple way for a website operator to gain access to an IDX listing “feed” — all of the listings in a givenmarket represented by brokers who have agreed to publicize each other’s listings.

The IDX feeds are available only to “MLS participants” — defined by the National Association of Realtorsas individual brokers and real estate firms that “offer or accept cooperation and compensation to and fromother participants.”

In other words, only brokers who “actively endeavor” to list properties for sale and offer compensation to abroker who brings a buyer to a sale, or brokers who accept such offers of compensation for representingbuyers, can join an MLS and display IDX listings on their websites.NAR’s 2005 definition of an MLS participant — enshrined in the language of a 2008 settlement with theU.S. Department of Justice, which had filed an antitrust suit against the trade group – was intended to keep“referral only” brokers from joining an MLS.

Single Family Market Overviewindustry analysts would describe as normal market conditions.

New Listings were up 21.0 percent for single family homes and 13.4 percent for townhouse-condo properties. Pending sales clocked in at 494 for single family homes and 99 for townhouse-condo properties.

The Median Sales Price was up 10.1 percent to $240,000 for single family homes but decreased 12.3 percent to $174,950 for townhouse-condo properties. Months Supply of Inventory stood at 16.1 for single family units and 10.6 months for townhouse-condo units.

Of course two rounds of natural disasters in our state – fires and flooding – over the summer months will have significant impact on housing in the areas most directly affected and perhaps some ripple effects elsewhere. This means that not everyone is enjoying normal market conditions.

From there look over your 2014 Invoice, your RPAC contribution is voluntary and can be adjusted or removed. You can adjust the amount by typing in the amount in the current payment field next to the RPAC Voluntary Dues, then click Apply Changes at the bottom of the page. If you wish to remove this from your invoice, click the Pay Later button and then click Apply Changes at the bottom of the page.5. When the invoice total is correct, click Pay Invoice at the bottom of the page. 6. This will give you the option to pay with a credit card or electronic check. Select which payment method and follow the instructions.

DEDUCTIBILITY OF DUES FOR TAX INFORMATION For the 2014 dues billing statements the non-deductible dues breakout is as follows, $25.00 RPAC voluntary dues, $20.40 of CAR dues and $55.00 of NAR dues are non-deductible. Payments to the Four Corners Board of REALTORS are not deductible as charitable contributions; however, such payments may be deductible as ordinary business expenses in accordance with IRS rules and regulations. The $75.40 of your year 2014 dues and $25.00 for RPAC voluntary dues is not deductible as a business expense because this portion is used for lobbying or the support of candidates at the local, state and/or national levels. CAR estimates that $5.00 in CAR dues will be used to reach the RPAC goal set by NAR. A portion of your RPAC voluntary fair share amount may be used to support federal candidates and will be charged against your limits under 2 U.S.C. 441a. No later than April 1st 2014, you may check ColoradoREALTORS.com to determine the portion. After CAR reaches its RPAC goal it may elect to retain your entire contribution for use in supporting state and local candidates and issues. You may contribute more or less than the suggested RPAC amount. You may refuse to contribute the $25.00 RPAC voluntary fair share amount without reprisal and the National Association of REALTORS® or any of its state associations or local boards will not favor or disfavor any member because of the amount contributed.

Until the state PAC reaches its RPAC goal, 30% is sent to National RPAC to support federal candidates and is charged against your limits under 2 U.S.C. 441a; after the state PAC reaches its RPAC goal it may elect to retain your entire contribution for use in supporting state and local candidates.
