GENERAL DESCRIPTION OF THE PROJECT

Project Name: 500 La Gonda Tenant Improvement Project Project Number: B-626

The Town’s construction budget limit is approximately five million dollars ($5,000,000).

Summary Description:

The Town envisions tenant improvements of approximately 18,878 SF to provide space for the Town of Danville Staff, services including:

• Administrative Offices

• Staff Offices

• Meeting Rooms

• Restrooms

Project Description:

Tenant improvements to existing building at 500 La Gonda Way. Providing new offices, bathrooms, and community room.

General other work within scope summary:

Fire sprinkler system.

Overview of Mechanical Scope of Work:

• Remove and dispose air-cooled chiller, pumps, and associated piping on adjacentoffice building roof.

• Remove and dispose air handling units from attic mechanical room aboveRotunda.

• Remove and dispose of incomplete sheet metal ductwork in building, mostly inbasement and lobby level.

• Furnish and install complete HVAC system for the tri-level building. HVACsystem shall include an inline exhaust fan system to serve the restroom groups onall three levels and locker rooms. Two small unisex restrooms shall have ceilingexhaust fans. Heating and air conditioning shall utilize variable refrigerant flow(VRF) type heat pump system with dedicated outside air system for pre-conditioning. Outdoor heat pump units shall be installed on roof of adjacent officebuilding. Dedicated outside air system with supply air plenum shall be housed inthe attic mechanical room. There will be approximately 30 indoor fan coil units

connected to 3 or 4 outdoor heat pumps. Indoor fan coil units will be various type: ducted horizontal, non-ducted wall mounted, ducted vertical floor mount, and ceiling cassette.

Overview of Electrical Scope of Work:

• Maintain existing 1000Amp Main switchboard 480y277V, 3ph, 4W and 1000A, 208y120v distribution board in main electrical room on Lobby level. Add additional breakers.

• Replace exterior 480 to 208Y120V transformer in yard with new.

• Add 277/480V lighting panels, 208Y120V power panels.

• Add Emergency diesel generator set with sound attenuated housing, base double walled fuel tank, remote annunciator, ATS NEMA 3R switch at rear of building by electric/gas enclosure, feeders.

• Add Emergency panels, feeders.

• Red emergency receptacles, occ sensors required on emergency power.

• Demolish all electrical stub ups in lower level, remove all old temp power, switching.

• New Digital Siemens Fire Alarm Panel with battery backup, notification, elevator recall, initiation devices per NFPA 72 and current 2019 CBC, CFC, CEC, CMC. Remove current Fire sprinkler system monitoring in the Office building signal room with connection to Pyrotronics Panel. Provide monitoring cross connect between panels as there is no fire barrier between buildings.

• New LED 0-10v dim lighting and 2019 title 24 lighting controls.

• Controlled tt24 receptacles in offices, etc. per 2019 Energy code.

• Relocate existing exterior lighting controls and transformers.

• Power to new HVAC system, re-use Rotunda 480V panel, replace roof 480V panel with new.

• Communications: provide data cabling, back boxes, and conduits.

• Security: provide low voltage cabling from access doors/card readers to IDF.

Overview of structural scope of work:

• Partial mezzanine infill on Lower Level, Lobby Level and Balcony Level.

• Mezzanine framing consists of metal floor joists and wall studs with wood floor and wall sheathing. The mezzanine has been designed to be structurally independent from the existing structure.

• There are also modifications to the shell building chevron brace frames at the Community Lobby level. The multi-level frame is only being modified at Lobby and Lower Levels. Retrofit includes replacing exterior steel columns and replacing existing steel beams and chevron bracing with moment frame connection hardware. The existing middle columns are being reinforced with additional

welded steel plates. Modifications to the shell also include removing existing floor support posts at the Police Security Entrance, at the Lobby Level, and at the Vestibule on the Lower Level. There will also be new saw-cut openings in the existing CMU shell.

Clarification: The above Project description is informational only and is not intended to define the Project scope of work. This information is presented to assist the Contractor with planning and assembling a qualified team of subcontractors. Revisions to the Project scope are inevitable as the design progresses. PROJECT SCHEDULE The anticipated bid schedule for the General Contractor is as follows:

Advertise Bid: October 1, 2020 Bids Due: October 20, 2020 Award Bid: November 4, 2020 Start Construction: January 1, 2021 Substantial Completion: August 1, 2021 Startup/Commissioning/Testing: September 1, 2021 Occupancy & Final Acceptance: January 1, 2022

MINIMUM BONDING REQUIREMENTS The minimum bonding capacity must equal or exceed the construction budget ($5 million). Prospective Contractors that cannot provide bonding at that amount will not be considered qualified even though they may be qualified otherwise. NOTICE OF PRE-QUALIFICATION REQUIREMENTS Notice is hereby given that the Town has determined that all bidders on the Project must be pre- qualified prior to submitting a bid. It is mandatory that all Contractors who intend to submit a bid fully complete the Pre-Qualification Document, provide all materials requested herein, and be approved by the Town to be on the final qualified Bidders list. No bid will be accepted from a Contractor that has failed to comply with these requirements. If two or more business entities submit to be pre-qualified as a Joint Venture, each entity within the Joint Venture must be separately qualified to bid, or meet the following requirements:

1. Each business entity must submit Part I of the Pre-qualification Questionnaire. 2. Each business entity must meet the requirements of Part II of the Pre-qualification

Questionnaire. 3. The business entities comprising the Joint Venture may combine their experience

submitted for Parts III and IV of the Pre-qualification Questionnaire, provided a copy of the Joint Venture Agreement is submitted with the Pre-qualification Questionnaire.

Answers to questions contained in the Pre-Qualification Document, information about current bonding capacity, and notarized statement from surety, and the most recent reviewed or audited financial statements (Profit & Loss Statement and Balance Sheet), with accompanying notes and supplemental information, are required. The Town will use these documents and subsequent interviews as the basis of rating Contractors. The Town reserves the right to check other sources available. The Town’s decision will be based on objective evaluation criteria. The intent of the Pre-Qualification Documents and supporting information required is to assist the Town in determining bidder responsibility prior to submission of bids. Neither the fact of pre-qualification, nor any pre-qualification rating, will preclude the Town from a post-bid consideration and determination of whether a bidder has the quality, fitness, capacity and experience to satisfactorily perform the proposed work, and has demonstrated the requisite trustworthiness. A Contractor will not be considered as qualified for bidding on this Project until the Contractor has met the requirements of the Town. In addition, a Contractor will be deemed disqualified for either: (1) omission of requested information, or (2) falsification of information. IMPORTANT PROVISIONS OF THE PUBLIC CONTRACT CODE RELATED TO PRE-QUALIFICATION In 1999, the California Legislature enacted a law that allows many public agencies, including the Town of Danville, to require licensed Contractors that wish to bid for public works jobs to “pre-qualify” for the right to bid on a specific public work project, or on projects undertaken by a public agency during a specified period of time. Public Contract Code Section 20101 has the relevant provisions. The Town of Danville has chosen to adopt the pre-qualification process described in Public Contract Code Section 20101 for this Project. Section 20101 requires every public agency that creates a pre-qualification procedure to: (1) use a standardized questionnaire and financial statement in a form specified by the public entity, (2) adopt and apply a uniform system of rating bidders on objective criteria, on the basis of the completed

questionnaire and financial statements, and (3) create an appeals procedure, by which a Contractor that is denied pre-qualification may seek a reversal of that determination. PUBLIC RECORD / CONFIDENTIALITY The Pre-Qualification Documents (questionnaire answers and financial statements) submitted by Contractors are not public records and are not open to public inspection. All information provided will be kept confidential to the extent permitted by law. However, the contents may be disclosed to third parties for purpose of verification, or investigation of substantial allegations, or in an appeal hearing. State law requires that the names of Contractors applying for pre-qualification status shall be public records subject to disclosure; the Contact Information page of the questionnaire will be used for that purpose. TOWN OF DANVILLE RIGHTS The Town reserves the right to waive minor irregularities and omissions in the information contained in the pre-qualification application submitted, to make all final determinations, and to determine at any time that the pre-qualification procedures will not be applied to a specific future public works project. The Town may refuse to grant pre-qualification where the requested information and materials are not provided, or not provided by the date specified above. There is no appeal from a refusal for an incomplete or late application. The closing time for bids applications will not be changed in order to accommodate supplementation of incomplete submissions, or late submissions. The Town reserves the right to accept pre-qualification applications despite minor irregularities and omissions in the information that would otherwise serve to disqualify a Contractor. The Town reserves the right to make all final pre-qualification determinations and to determine at any time that the pre-qualification procedures will not be applied to the Project. The Town reserves the right to adjust, increase, limit, suspend or rescind the pre-qualification rating based on subsequently learned information. Contractors whose rating changes are sufficient enough to disqualify them will be notified and given an opportunity for a hearing consistent with the hearing procedures described for appealing a pre-qualification rating. The Town accepts no financial responsibility for any costs incurred by a Candidate in responding to this RFQ. Completed questionnaires and any other documents or materials submitted in response to this RFQ shall, upon submission, become the property of the Town and may be used by the Town in any way the Town deems appropriate.

PROTEST PROCESS Where the scoring of a timely and complete Pre-Qualification Document results in a rating below that necessary to pre-qualify, a protest may be made. Upon request, the Town will provide to the non-qualifying Contractor in writing the basis for its disqualification and any copies of supporting evidence that has been received from others or adduced as a result of Town’s own investigation. Any protest must be submitted in writing to the Town of Danville, located at 510 La Gonda Way, Danville, CA 94526, Fax: (925) 838-0360, before 5:00 p.m. of the FIFTH (5th) business day following the date of issuance of notification of non-qualification, not the date such notice is received by the Contractor. Any protest received after 5:00 p.m. is considered received as of the next business day. The protest must contain a complete statement of the reasons and facts for the protest, must refer to the specific portions of all documents that form the basis for the protest, and must include the name, address, email address, fax number and telephone number of the person representing the protesting party. Upon receipt of a written protest, the City Engineer, or designee will review and evaluate the protest and issue a written decision. The protesting Contractor shall be given an opportunity to rebut any evidence used as a basis for disqualification and to present evidence to the City Engineer as to why the protesting Contractor should be found qualified. The City Engineer, may, at his or her discretion, investigate the protest, obtain additional information, provide an opportunity to settle the protest by mutual agreement, and/or schedule a meeting(s) with the protesting Contractor and others (as appropriate) to discuss the protest. The decision on the protest will be issued at least ten (10) business days prior to the closing time for receipt of bids on the Project. The decision will be communicated by e-mail or fax, and certified mail, and will inform the Contractor whether or not the protest is going to be granted or denied. The decision of the City Engineer may be further appealed to the Town Manager, located at 510 La Gonda Way, Danville, CA 94526, Fax: (925) 838-0360. All appeals to the Assistant Town Manager shall be in writing and submitted within five (5) business days following the issuance of the decision by the City Engineer, not the date received by the Contractor. An appeal received after 5:00 p.m. is considered received as of the next business day. The Town Manager appeal shall specify the decision being appealed and all the facts and circumstances relied upon in support of the further appeal. In reviewing appeals, the Town Manager will not re-judge the determination of non-qualification. The appeal to the Town Manager shall be limited to review of the prequalification process to determine

if the Town materially erred in following the Pre-Qualification Document or, where appropriate, Town contracting policies or other laws and regulations. The appeal to the Town Manager also shall be limited to the grounds raised in the original appeal and the decision by the City Engineer. As such, a Contractor is prohibited from stating new grounds for an appeal in its appeal to the Town Manager. The decision of the Town Manager is the final step of the appeal process. The Town will complete the appeal process and a decision on the appeal will be issued by the Town Manager at least ten (10) business days prior to the closing time for receipt of bids on the Project. The procedures and time limits set forth in this paragraph are mandatory and are each Contractor’s sole and exclusive remedy in the event of a determination of non-qualification. A Contractor’s failure to timely complete both the original and second appeal procedures shall be deemed a failure to exhaust administrative remedies. Failure to exhaust administrative remedies, or failure to comply otherwise with these procedures, shall constitute a waiver of any right to further pursue the appeal, including filing a Government Code Claim or legal proceedings. An application is complete only if these attachments are included in the submitted packet. Label each envelope according to descriptions above. INTRODUCTION AND OVERVIEW OF THE PRE-QUALIFICATION PROCESS SUBMISSION REQUIREMENTS, DELIVERY Candidates will be asked to identify the General Contractor and the Specialty Subcontractor entities that make up the Team in their Pre-Qualification Packages (“Team Members”). The Specialty Subcontractors that make up the Team will include the following work divisions 1) HVAC mechanical and control systems installer, 2) electrical work, and 3) Structural work. Up to three (3) Specialty Subcontractors may be submitted within each work division. The lowest scoring Specialty Subcontractor in each work division will be the basis for the Team’s qualification rating, which may result in the disqualification of the Team. Once a General Contractor has been identified as a Qualified Candidate, no changes or additions to the Team Members or identified Key Personnel will be allowed without the Town’s prior written consent. All Team Members shall participate in the completion of the Pre-Qualification Questionnaire jointly. In addition to the requirements listed herein, a Candidate must be willing and able to comply with the contracting requirements of the Town as provided in the Attachments.

Each Pre-Qualification Document must be signed under penalty of perjury in the manner designated on the certification page, by an individual who has the legal authority to bind the Contractor on whose behalf that person is signing. If any information provided by a Contractor becomes inaccurate, the Contractor must immediately notify the Town and provide updated accurate information in writing, under penalty of perjury. A complete submission will be comprised of an electronic copy (PDF format) on a flash drive and five (5) fully completed, signed, and printed hard copies with required attachments. The Pre-Qualification Submission (Flash drive and four hard copies categorized into three envelopes) must be submitted in an encompassing sealed envelope with the project name printed on the outside, marked “CONFIDENTIAL”, addressed to Guillermo Santolaya, Town of Danville, 510 La Gonda Way, Danville, CA 94526. SCORING APPROACH To be pre-qualified, Contractor Teams must submit the information requested in Part I, achieve a passing score in Parts II, III, and IV of the Questionnaire. The scores achieved for the three scored parts are not aggregated to a “total score,” rather, each part is a stand-alone threshold and must be passed individually. Minimum scoring is as follows: Part II. Essential Requirements for Qualification of the Contractor Team (Disqualified if any item is scored “Fail”) Part III. Scored Questions for the Contractor Team (Minimum qualifying score is 140 points total out of a maximum possible 240 points) Part IV. Recent Construction Projects Completed (Reference Interview Questions) (Minimum qualifying score is 285 points total out of maximum possible 435 points) Upon completion of each sequential step, non-responsive or unqualified proposers, if any, will be notified in writing and the remainder of the submission will not be reviewed for qualification. The Town reserves the right to disqualify the Team as a whole, due to the disqualification of an individual Team Member, without regard to the status of the Team Member as a General Contractor or Specialty Subcontractor.

PART I: INFORMATION ABOUT THE TEAM MEMBER This part applies to the Contractor Team and is for identification purposes only. There is no scoring value to Part I. However, any omission in this section can be the basis for disqualification. Each Team Member shall complete Part I independently with the information of that Team Member. Questions 12 and 13 need to be completed by the General Contractor only. Include a Statement of Performance from each Specialty Subcontractor on company letterhead confirming intent to self-perform the associated trade work. Indicate in this Statement any divisions of work which may potentially be delegated or subcontracted to other entities. Each Team Member should fill out Part I separately. PART II: ESSENTIAL REQUIREMENTS FOR QUALIFICATION OF THE CONTRACTOR TEAM This part applies to the Contractor Team and is a Pass/Fail series of questions. All questions must be answered correctly, or the Contractor will be disqualified. If the Contractor Team is able to correctly answer each of these questions, its consideration of qualifications will proceed to the next part. If the Contractor Team is unable to correctly answer each of these questions, it will be disqualified regardless of the results of the scored questions. PART III: SCORED QUESTIONS FOR THE CONTRACTOR TEAM This part consists of a series of questions that must be answered by the Contractor Team. Each question has an established numerical value. This part is comprised of the qualifications and experience that the Contractor Team should possess. Each question has a pre-assigned score value. To pass this part, the Contractor Team must be able to answer the questions so that the aggregate score for all questions in this part is equal to or greater than 160 points of the possible maximum score of 260. If the Contractor Team passes Part III, consideration of its qualifications will proceed to the next part. PART IV: RECENT TENANT IMPROVEMENT CONSTRUCTION PROJECTS COMPLETED This part is comprised of a series of questions relating to Team Members’ performance on recently completed tenant improvement projects. A minimum if two (2) projects shall have a minimum construction value of $5 million. Three projects will be selected by the Town from the total list of six projects submitted for the General Contractor. Additionally, one project will be selected by the Town from the total list of three projects submitted for each Specialty Subcontractor. Team Members are allowed to submit information from reference projects used by other Team Members as long as the Team Member worked on the reference project it is submitting.

The questions will be asked by the Town’s staff and answered by an owner’s representative for each project. To effectuate the candid completion of information requested in the Reference Interview Questionnaire, candidates are required to execute and submit the attached Release and Waiver of Liability in favor of each individual furnishing information requested in the Questionnaire. Each question has a possible score value ranging from 1 to 10. The Contractor must be given a score value for each question so that the aggregate score for all questions in this part is equal to or greater than 285 points of the possible maximum score of 435. If the Contractor passes Part IV, after having also passed Parts II and III, it will be rated Qualified. Contractor Teams that submit a reference construction project where three or more of the Team Members worked together will receive a 10% point-bonus to the Team’s overall computed score. This is a maximum, one-time bonus that will not be increased for submitting more than one project that satisfies this criterion. REVIEW AND NOTIFICATION PROCESS The completed Pre-Qualification Submission must be submitted by the deadline specified. Once received, the review and notification process will be as follows:

1. The Pre-Qualification Documents will be date stamped upon receipt. 2. It will be reviewed for completeness by Town staff within ten (10) working days

from the submission deadline date. The Contractor will be notified as to completeness. If the Pre-Qualification Document is not deemed complete, the Town reserves the right to either disqualify the Team or allow the Team two (2) working days to add whatever information is needed to make the Document complete. The Town will have sole authority to determine whether to disqualify incomplete submissions or allow for resubmittal, but such decision shall be equally effective for all incomplete submissions responding to this RFQ. If the Pre-Qualification Document is complete, it will proceed to be reviewed and scored.
