NOTICE REGARDING FOURTH CIRCUIT MOTION DOCKET FOR FRIDAY, JUNE 26, 2020 PLEASE BE ADVISED THAT INSTRUCTIONS FOR HEARING YOUR MOTIONS IN 4 TH CIRCUIT DIFFER FROM THOSE IN 3 RD CIRCUIT Below is the Staggered Motion Docket for the Fourth Circuit Court for Friday, June 26, 2020. Please remember that attorneys and/or litigants who are suffering from the Covid-19 virus, have recently been exposed to the virus, are experiencing symptoms of the virus, or running a temperature will not be allowed in the courthouse. Each individual must submit to a temperature check before they will be allowed to proceed into the building. Further, counsel, litigants and any witnesses are required to bring their own face mask or they will not be allowed to enter the building. While in the building, maintain social distance from other individuals at all times. Please proceed to the 6th floor. A staff member will meet you at the elevators to be certain your case is being heard that morning. You will be directed to social distance seating in the hall or, if you are early or there are no seats available, you will be directed to another part of the building where there is additional social distance seating available. If you are seated on another floor, you will be invited back to the 6th floor when seating becomes available or your case is ready to be heard. Both Third and Fourth Circuit Court are experimenting with ways to hopefully expeditiously deal with our Motion Docket and minimize the number of people in the courthouse at any one time. NOTICE REGARDING FOURTH CIRCUIT MOTION DOCKET FOR FRIDAY, JUNE 26, 2020

Below is the Staggered Motion Docket for the Fourth Circuit Court for Friday, June 26, 2020.

Please remember that attorneys and/or litigants who are suffering from the Covid-19 virus, have recently been exposed to the virus, are experiencing

symptoms of the virus, or running a temperature will not be allowed in the courthouse. Each individual must submit to a temperature check before they

will be allowed to proceed into the building. Further, counsel, litigants and any witnesses are required to bring their own face mask or they will not be

allowed to enter the building.

While in the building, maintain social distance from other individuals at all times. Please proceed to the 6th floor. A staff member will meet you at the

elevators to be certain your case is being heard that morning. You will be directed to social distance seating in the hall or, if you are early or there are

no seats available, you will be directed to another part of the building where there is additional social distance seating available. If you are seated on

another floor, you will be invited back to the 6th floor when seating becomes available or your case is ready to be heard.

Both Third and Fourth Circuit Court are experimenting with ways to hopefully expeditiously deal with our Motion Docket and minimize the

Fourth Circuit Court will be addressing its motions as follows:

1. Absent extraordinary circumstances and advance approval by the Court, ALL motions shall be heard in-person.

2. Motions for default judgments will be taken up first, promptly at 9:00 a.m. Counsel and litigants involved in these motions shall remain in the

hall until the motion is called. At that time, counsel and litigants shall be invited into the courtroom, not to exceed 10 people at a time. Please be present

and ready to proceed at 9:00am.

3. Those matters which the Court anticipates will be shorter shall be designated and be taken up next, which will begin at 9:30am. All attorneys,

litigants, witnesses and court reporters are directed to be present and ready to proceed at 9:30am. Court staff will call your motion in the hall and the

attorneys and litigants shall be allowed to enter the courtroom at that time, not to exceed 10 people at a time. Any witnesses are requested to remain in

ready to proceed at 10:30am. Court staff will call your motion in the hall and the attorneys and litigants shall be allowed to enter the courtroom at that

time, not to exceed 10 people at a time. Any witnesses are requested to remain in the hall until they are called to testify. Please note that you will be

directed to an overflow area in the courthouse if you arrive before 10:20am.

5. The next set of cases will be heard beginning at 11:30am. All attorneys, litigants, witnesses and court reporters are directed to be present and

ready to proceed at 11:30am. Court staff will call your motion in the hall and the attorneys and litigants shall be allowed to enter the courtroom at that

time, not to exceed 10 people at a time. Any witnesses are requested to remain in the hall until they are called to testify. Please note that you will be

directed to an overflow area in the courthouse if you arrive before 11:20am.

6. The last set of cases will be heard beginning at 12:30pm. All attorneys, litigants, witnesses and court reporters are directed to be present and ready

to proceed at 12:30pm. Court staff will call your motion in the hall and the attorneys and litigants shall be allowed to enter the courtroom at that time,

not to exceed 10 people at a time. Any witnesses are requested to remain in the hall until they are called to testify. Please note that you will be directed

to an overflow area in the courthouse if you arrive before 12:20pm.

In the event an interpreter is necessary, the use of the State Trial Court interpreter, an interpreter approved by the Administrative Office of the Court

or approved by the AOC guidelines, is required for motion hearings and it is incumbent on the party requiring the interpreter to secure the same.

As always, attorneys and self-represented litigants are encouraged to communicate prior to the motion docket in an effort to reach in agreement on

any pending motion. This is VERY important. PLEASE be mindful about trying to resolve your motions BEFORE appearing in court as this will

aid in limiting exposure to all who are present in the courthouse.

The Court will continue to accept announcements for agreed orders, continuance and strikes via telephone or email correspondence with the Court’s

staff.
