The representative of the DIPP present in the meeting informed the Committee that the firm had requested for enhancement in wastage allowed on some of the inputs in respect of the export product HPSV 70 Watt Lamp on the ground that wastage allowed on the inputs in respect of a similar export product viz. HPSV 250W Lamp in SION at C-224 of Engg. Group is on higher side. The request of the firm was not justified since the SION at C-224 of Engg. Group was applicable for another product. Before considering the individual cases of the agenda of this meeting, the Committee ratified the minutes of ALC M.Nos.4/06 held on 26.4.05, 5/06 held on 3.5.05 & 6/06 held on 10.5.2005 by making amendments in minutes of some of cases. The amended minutes of these cases were as under:-

The case regarding amendment in the input output norms fixed against advance license No.2210003403 dt.21.6.04 in ALC M.No.37/05 held on 30.11.04 was considered by the ALC-II as per the agenda. The representative of the DIPP present in the meeting informed the Committee that the firm had requested for enhancement in wastage allowed on some of the inputs in respect of the export product HPSV 70 Watt Lamp on the ground that wastage allowed on the inputs in respect of a similar export product viz. The representation regarding clarification about applicability of DEPB Entry No.353 of Engg. Group to export product Non Tip Anti Skid Bowl Belly (Pantone) with Rubber Rings was considered by the ALC-II as per the agenda. The Committee in its earlier meeting held on 23.3.04 found the weight of Bowl as 153 gm and the weight of Rubber Ring as 34 gm. from the sample of the export product. Since the weight of Rubber Ring was more than 5% of the total weight of export product, it would be treated as composite item. The Committee, therefore, at that time concluded that the DEPB rate on the export product would be calculated as per General Note No.11 of the current Schedule of DEPB Rates. The case was also referred to DEPB Committee which accepted the recommendation of ALC. Now the firm represented against the decision of Committees and argued that the Rubber Ring was detachable item and was not chemically fixed or moulded (composite) material as claimed by the Customs authorities and further they had not claimed benefits on the Rubber Rings. They added the concept regarding Rubber Rings had been accepted by Govt. of India vide Public Notice No.67 dt.21.6.04.The Committee also observed that export was made prior to issuance of the very public notice. The Committee took into account the amended DEPB Entry and the fact that separate price and invoice for Rubber Ring and Bowl had been given and decided on the recommendation of the representatives of technical authorities present in the meeting that their sample export product viz. Non Tip Anti Skid Bowl Belly (Pantone) with Rubber Rings would be covered under amended DEPB Entry No.353 of Engg. Group with admissibility of DEPB on Bowl entry.

The case may be referred to the DEPB Committee.

Case No.E-6 M/s. Man Industries (India) Pvt. Ltd., Mumbai. ALC M.No.6/06 F.No.01/80/162/720/AM.05/DES.I Dated 10.5.05 Export Product

The case regarding upward revision of DEPB rates and Value Cap in respect of DEPB Entry Nos.473, 474, 475 & 476 of Engg. Group was considered by the ALC-II as per the agenda. The representative of EEPC present in the meeting informed the Committee that proposal of the firm had the approval of Chairman, Steel Pipes, Tubes and fittings thereof and added that import & export data, CIF and FOB price had been verified and certified by them. On the recommendation of EEPC and as per quantities allowed in corresponding SION, the Committee accepted CIF value of all import items as Rs.43,910/- and FOB value as Rs.48,000/MT. The Actual value addition based on the above data was coming to 9.3%. However, the Committee, after deliberating upon the case, decided to fix value addition as 50% for revision of DEPB rates allowed against the said DEPB Entries. The Committee also recommended to enhance the value cap in respect of the said DEPB Entries to Rs.42000/-.

The representative of the DIPP present in the meeting informed the Committee that finished weight of Components now furnished by the firm did not match with the dimension and size of sheet used. This case was earlier also rejected by the ALC-II in its M.No.40/05 held on 24.1.05 on the same ground. Therefore, the Committee decided to reject the case once again and ask the RLA to take necessary action accordingly immediately.

On the recommendation of the representative of the DHI present in the meeting, it was decided to amend the said advance license as applied for by the firm vide its letter dt.7.12.04, a photocopy of which may be forwarded to the RLA.

The case regarding availing DEPB benefit under S.No.324 of Engg. Group by misdeclaring the export product Slack Adjuster Assembly as Roller for Auto Break Shoe was considered by the ALC-II as per the agenda. The Committee observed that Slack Adjuster Assembly was a complete assembly. The inputs allowed in corresponding SION No.C-1079 of DEPB Entry No. 324 of Engg. Group for export product Roller for Auto Break Shoe were different from the inputs required for manufacture of Slack Adjuster Assembly . The Committee, therefore, concluded that Slack Adjuster Assembly would not be covered under S.No.324 of Engg. Group.

The case may be referred to the DEPB Committee.

Case No.E-10 M/s. Metal India, Moradabad. ALC M.No.8/06 F.No. 01/80/162/141/AM06/DES-I Dated 24.5.05 Export Product

The case regarding clarification about applicability of DEPB Entry No.353 of Engg. Group to the export product various Table & Kitchen articles made of Stainless Steel which include fittings of Bakelite, Plastic, Rubber, in the shape of Handle, Lid and Anti Gasket etc. was considered by the ALC-II as per the agenda. The Committee in consultation with the representatives of the Technical Authorities present in the meeting and after deliberating upon the case decided that

1. DEPB credit under Sl.No.353 & 354 would be admissible on the item even if the weight of the material, the handle / lid may have been made of, exceeds the 5% of total weight.

2. The value cap will be applicable to the weight of the whole items. 3. If the weight of extraneous material in any item under any Sl.No. exceeds 5% of total weight,

the DEPB credit would be admissible as per the provisions for composite products specified at General Instruction No.11 of DEPB rates.

The case may be referred to DEPB Committee.

Case No.E-11 M/s. Amiya Commerce & Construction Co. Pvt. Ltd., Kolkata.

The case regarding clarification about items exported under DEPB Entry No.431 of Engg. Group was considered by the ALC-II as per the agenda. The Committee in consultation with the representatives of the Technical Authorities present in the meeting and after deliberating upon the case decided that the product in question can not be considered as an assembly of various items covered under Para 11 of General Instructions of DEPB rates, therefore the export item under DEPB Sl.No.513 of Engineering Group would not be covered. The Committee decided to maintain its earlier decision and decided to reject the representation of the firm for re-consideration of DEPB benefit on export item Pre-fabricated Steel Buildings.

The case regarding clarification about clubbing of advance license Nos.0710018371 dt.7.1.03, 0710018505 dt.13.1.03 & 0710021873 dt.19.6.03 was considered by the ALC-II as per the agenda. The Committee, after deliberating upon the case, decided to defer the consideration of the case for want of report from the RLA. The case may be re-listed on receipt of the report of RLA.

Case No.C-50 M/s. Hindustan Platinum Pvt. Ltd., Navi Mumbai. ALC M.No.8/06 F.No.01/80/162/648/AM.05/DES.I Dated 24.5.05 Export Product Gold/Silver/Platinum/Palladium/Rhodium/Iridium/Ruthenium &

Osmium all in the form of Salts / Compounds / Catalysts / Chemicals / Resinate / Paste / in Solution / and as Supported Catalysts.

The case regarding fixation of SION for the above export product was considered by the ALC-II as per the agenda. The Committee, after deliberating upon the case, decided to transfer the file relating to this case to JDG, ALC-I as the export product was related to Chemical Division. Case No.C-51 M/s. Indo-US MM Tec Pvt. Ltd., Bangalore. ALC M.No.8/06 F.No.01/80/162/37/AM.06/DES.I Dated 24.5.05 Export Product Complex Shaped Metal Components manufactured through

MIM.

The case regarding fixation of SION for the above export product was considered by the ALC-II as per the agenda. The representative of the DIPP informed the Committee that the case was under study. The Committee, therefore, decided to defer the consideration of the case for 28.6.05.

The case regarding ratification of advance license No.0710014940 dt.16.7.02 was considered by the ALC-II as per the agenda. The representative of DIPP present in the meeting appraised the Committee of the fact that in a personal hearing held earlier with the representative of the firm in regard to some other case, they were advised to club the subject license with some other licenses to solve the problem. The Committee, after deliberating upon the case, decided to call for report from the RLA on the representation of the firm. The case may be re-listed on 28.6.05.
