We can all agree that growth is good; that new jobs and a vibrant economy are important for our community and future generations. There are 2,700 approved home sites in the Hebron area north of I-275 that will not be built
unless SD1 funds the needs for growth. If it took ten years to build these homes it would support 2,900 jobs. 2,000 of those jobs would be there forever at the end of ten years as new neighborhoods would support such jobs. Perhaps one of these jobs would be there for your son, daughter or grandchild. It would mean $135 million in people’s personal income. $91 million in personal income would be available annually for these ongoing jobs. Maybe these wages would be earned by your family to live in Northern Kentucky and send your grandchild to little league. $3.1 million in taxes and fees paid for by construction jobs would be available to Boone County government every year for those ten years. An additional $16.2 million in taxes would be generated after these homes were built and lived in every year; paying for roads, schools, libraries, fire and police services, water and SD1. Perhaps your family would attend these schools, visit the library, and enjoy healthy drinking water and safe sanitation services.
The best economic years in our history have taken place during years of growth. Without growth what would Northern Kentucky look like? The same fate awaits Kenton County between the Richwood Road exit spanning to Independence and in Campbell County around Route 27 and the AA Highway unless SD1 funds growth. In total, SD1 is standing in the way of 33,000 jobs, not in construction, but as a result of new homeowners and companies moving into Northern Kentucky. That annually represents $141 million in unrealized taxes that could be used to improve current infrastructure including the sanitary sewer system. Without growth, the economy has no resources to pay for repair and replacement. New buildings and new jobs create the mechanism to pay for ailing infrastructure for 50 years. After 50 years that infrastructure needs repairs and replacement and the only way to pay for it is by growth. These are economic truths that cannot be disputed. Don’t let anyone tell you different. If they do it’s a numbers game or they are quoting a short sighted study focusing only on real estate taxes.
If SD1 is to get out of the way of growth they need to dedicate $50 million over the next ten years. To do this they need only to do a few things. First, they should renegotiate the EPA Consent Decree; substantially extending the deadline. Second, they should dedicate a portion of fees paid by developers to a restricted account to fund growth. Third,
they should cut expenses wherever possible. A few changes to their budget without any layoffs can achieve SD1’s needs for growth. Fourth, they should avoid rate shock caused by continually requesting huge rate increases. After they don’t get their huge increases they shut down growth and harming our economy; causing pain on Northern Kentuckians. Five, they should approach the problems in their system and in the older cities in a balanced approach by focusing on growth as the solution to fix ailing systems. In order to do this they should use a portion of their expense cuts to accelerate payment of their debt service to get them out of the hole they have created for themselves sooner and help older and ailing systems long term. It is irresponsible to only focus on existing systems and short sighted. As explained earlier it takes growth to pay for repairs and replacement. Without growth it is not going to happen.
Every other utility in Northern Kentucky is clamoring for growth so they can add ratepayers to the system to pay for upgrades, repairs and replacement; not SD1. The Hebron Area Sewer Study Committee delivered a clear message to SD1. We need a balanced plan delivered by those tasked with providing sanitary sewer service to Northern Kentucky. That means the management of SD1. Perhaps if the management is unable to deliver a solution we need to look to other means in order to keep Northern Kentucky growing. Perhaps SD1 should answer not to an appointed board but to another entity. Perhaps it would be better run by a private company.
If we don’t change the path SD1 is on now we will look back years from now and wonder why our children don’t live in Northern Kentucky, why we can only see our grandchildren during the holidays and how the economy of Northern Kentucky came grinding to a halt. I shudder to think our best days are behind us. It is our responsibility as Northern Kentuckians to demand a bright future and a healthy economy by growing and benefitting from growth to make all of Northern Kentucky a place in which to call home and for our future neighbors and companies to do the same. Without growth… perhaps not.

The Home Builders Association of Kentucky’s (HBAK) Anthem Association Health Plan will offer significant savings for a majority of qualified HBANKY members with small group health plans. Qualified members include those who are actively involved in on-site construction and those who the majority of. The Health Care Reform Law requires small businesses, with 50 or fewer total employees, to be “community rated” based only on age, location and tobacco-use. However, “bona fide” association health plans, such as the HBAK plan, will be treated as a large group and will continue to be “risk rated” on multiple factors, including gender and health status. The Annual HBA Golf Outing proved to be a memorable event! The weather was great until about 3:00 pm when Mother Nature
made herself known by sending a thunderstorm complete with heavy thunder, lighting, rain and hail. Everyone scrambled to take cover. All were safe, a little wet, but continued playing after the storm.
Our theme was Caddyshack which the Golf Outing Committee had a lot of fun with. Some were dressed in appropriate attire and thanks to Ginger Morris, Nielson & Sherry, PSC we even had Carl’s bombs (to take care of the gophers) in the shapes of mice, rabbits and other animals.

How does an employer keep a good worker
engaged and productive, even after a work injury? The answer has often been to offer the employee a
temporary light-duty job. That remains a good option, but a recent court decision raises a caution flag for employers.
The Kentucky Court of Appeals has ruled that an employer cannot offset the wages it paid for light-duty work against temporary total disability benefits. In other words, the court ruled that the injured worker, who accepted the light-duty job and was paid wages for it, also could collect workers’ comp income benefits. The result is that the employee was allowed, effectively, to double-dip and actually rake in more money than his average weekly wage.
The case is Quad/Graphics, Inc. v. Holguin, 2013-CA-002063-WC (June 6, 2014). Holguin’s fingertip was severed by a machine at work. He underwent surgery to reattach it. The next day, Quad/Graphics gave him light-duty work checking books, painting, and performing odd jobs. His
average weekly wage as a machine operator was $725.75. During the light-duty period he averaged $532.87 a week. A workers’ comp administrative law judge awarded him TTD benefits of $483.83 a week -- and also ruled that the light-duty wages could not offset the TTD.
The result was that Holguin earned about $275 more per week while injured than he did performing his regular job.
The Court of Appeals ruled that this double-dipping was legal because Kentucky statutes provide for only two offsets against temporary total disability payments. One permissible offset is for unemployment benefits, and the second is for payments under disability plans that are wholly-funded by the employer.
Thus, if employers and their worker’s comp carriers want to guard against double-dipping, they must coordinate work hours and TTD payments. First, they should calculate the employee’s weekly TTD comp benefit. Next, they should place a cap on the light-duty hours to ensure that the employee earns no more than the difference between his TTD benefits and his average weekly wage.
It may come as a surprise that a worker can be awarded TTD benefits while doing light-duty
work. However, the rule of thumb in Kentucky is that a worker is entitled to such benefits if he/she cannot perform the essential day-to-day tasks of his usual job, because of an injury. Thus, TTD benefits must be paid even during a stretch of light-duty work, due to the inability to perform the regular job tasks.
In Ohio, the law is quite different. Ohio law mandates payment of TTD until employment is made available that is within the worker’s physical restrictions, which often is lighter-duty work. If the employee earns less than the TTD rate on light-duty, he/she is allowed to file for wage-loss benefits to make up the difference.
Of course, there is no legal penalty for any employer that allows such double-dipping. In fact, some employers may allow it simply to keep good workers productive, even if it means a few more dollars off the bottom line. However, the Holguin case should serve as a warning that employers cannot shirk their legal TTD responsibilities merely by offering light-duty work – and that injured workers can obtain a windfall.

to great food, beverages and a wonderful place to network with one another. Thank you to Keller Williams for opening their offices to us. Our Fall Member Mix & Mingle will be held at Arcadia, a Fischer Homes Community in Campbell County.
The Home Builders Association of Northern Kentucky has lost a true believer and avid cheerleader for the Building Industry. She thrived on her involvement with the HBANKY as she performed many roles and served on numerous committees over the past couple of decades.
Her proudest moment was serving as President of the HBANKY Women’s Council in 1997. She loved inspiring other women to get involved and believed you should support the industry that “put bread on the table”. That leadership role was a jewel in her crown.
Since she loved being around people, her work in the Title Industry was a perfect match for her personality – vivacious is a mild description of how she could work a room. We all loved and admired her for that. She could put a smile on the grumpiest face. She was a natural for encouraging others while mentoring and befriending those who needed a little boost.
Her involvement with other associations, organizations and charities is mind boggling. She could always bring people together for good causes. Those who worked with her, served committee time with her or were just her friend can testify to how much she will be missed. Rest in peace dear friend.

Recently the Board of Housing, Buildings and Construction published an advisory letter and code amendment dealing with a section of the Energy portion of the Residential Code.
Instead of having to insulate basement walls to the foundation it allows contractors to only insulate to the frost line. This was initially left out of the code amendments when they were promulgated, and although the process has begun to correct this it will be until October until the regulation is approved.
This omission in the code has caused much confusion with the builders and inspectors so this letter is meant to alleviate that confusion.
