AUPCoverage

TheAT&TAcceptableUsePolicy(“AUP”)appliestotheservicesthatprovide

(orinclude)accesstotheInternet,servicesprovidedovertheInternet,andHostingservices(collectively“IPServices”).CustomerisresponsiblefortheactionsofotherswhomaybeusingtheIPService(s)underCustomer’saccount.ItisCustomer’sobligationtotakewhatevermeasuresarenecessarytoprotectaccesstoCus-tomer’saccount(e.g.,tokeeptheaccesspasswordsecure).IfaCustomeroritsUser(s)violatetheAUP,AT&Tmay,dependingonthenatureandseverityoftheviolation,suspendorterminateservice,asspecifiedbelow.

CustomermayhaveaccessthroughtheAT&Tnetwork(s)andService(s)tosearchengines,subscriptionwebservices,chatareas,bul-letinboards,webpages,USENET,orotherservicesthatpromulgaterules,guidelinesoragreementstogoverntheiruse.Failuretoadheretoanysuchrules,guidelines,oragreementsshallbeaviolationofthisAUP.

AT&TisawarethatsomeofitsCustomersare,themselves,providersofInternetbasedservices,andthatinformationreachingAT&Tnetwork(s)orfacilitiesfromthoseCustomersmayhaveoriginatedfromtheAT&TCustomerorfromanotherthird-party.AT&Tre-servestherighttotakeactionagainstAT&TCustomeranddirectlyagainstsuchCustomers’subscribers,eventhoughtheAT&T’scor-rectiveactionmayaffectothernon-offendingsubscribersoftheAT&TCustomer.

AUPEnforcementandNotice

Customer’sfailuretoobservetheguidelinessetforthinthisAUPmayresultinAT&Ttakingactionsanywherefromawarningtoasus-pensionofprivilegesorterminationofyourService(s).AT&Treservestheright,butdoesnotassumetheobligation,tostrictlyenforcetheAUP.Whenfeasible,AT&TmayprovideCustomerwithnoticeofanAUPviolationviae-mailorotherwiseanddemandthatsuchviolationisimmediatelycorrected.

However,AT&TreservestherighttoactimmediatelyandwithoutnoticetosuspendorterminateIPService(s)inresponsetoacourtorderorotherlegalrequirementthatcertainconductshouldbestoppedorwhenAT&Tdetermines,initssolediscretion,thatthecon-ductmay:(1)exposeAT&Ttosanctions,prosecution,civilactionoranyotherliability,(2)causeharmtoorinterferewiththeintegrityornormaloperationsofAT&T’snetwork(s)orfacilities,(3)interferewithanotherperson’suseofAT&T’sIPService(s)ortheInternet,or

(4)otherwisepresentariskofharmtoAT&TorAT&TCustomersorotherpartiesAT&Tinterconnectswith.

AT&T’sdecisionswithrespecttointerpretationoftheAUPandappropriateremedialactionsarefinalanddeterminedbyAT&Tinitssolediscretion.AT&Tmayreferpotentialviolationsoflaw(s)totheproperauthorities,maycooperateintheinvestigationofanysus-pectedcriminalorcivilwrongdoing,andwillcooperatewithauthoritieswhenrequiredtodosobylaw,subpoena,orwhenthepublicsafetyisatstake.AT&Tassumesnoobligationtoinformyouthatyourinformationhasbeendisclosed,and,insomecases,maybeprohibitedbylawfromprovidingsuchnotice.

AT&Tdoesnot,asanordinarypractice,proactivelymonitortheactivitiesofthosewhouseitsIPService(s)orexerciseanyeditorialcontroloveranymaterialtransmitted,hostedorpostedusingIPServicestoensurethatitsCustomerscomplywiththeAUPand/orthelaw,althoughitreservestherighttodoso.IfAT&TisalertedtoviolationsorpotentialviolationsofthisAUP,AT&TwilltakewhatevermeasuresitdeemsnecessaryandappropriatetostoporpreventsuchviolationsincludingtheactionsdescribedinthisAUP.Forexam-ple,AT&Tmayinitssolediscretionrefusetotransmit,screen,oreditingcontentpriortodeliveryoftheIPService(s),blockaccesstocertaincategoriesofnumbersorcertainsitesasAT&Tdeterminesneededtoenforcethesepolicies.

IfyourServiceissuspendedorterminatedforanyAUPviolation,youmustgetwrittenapprovalfromtheAT&TAbuseTeam(outsideofthenormalorderingprocess)priortoreactivatingororderingnewservice.Inanycase,AT&Tmay,initsdiscretion,declinetoreinstateyourService.IfAT&Tapprovesyouforreinstatementornewservice,set-upfees,reactivationfeesordepositsmayapply.IfAT&TdiscoversthatyouhaverenewedService,ororderednewService,followingterminationforanAUPviolationwithoutthepriorwrittenconsentoftheAT&Tabuseteam,itmayterminateyourServicewithoutfurthernotice.Insuchcase,youareresponsibleforanyappli-cableearlyterminationcharges.

AT&Twillnotissueanyrefunds,creditsorotherformsofcompensationfortheperiodwhenIPService(s)havebeensuspendedasaresultofviolation(s)orallegedviolation(s)ofthisAUP.

AT&TshallnotbeliableforanydamagesofanynaturesufferedbyanyCustomer,User,orthirdpartyresultinginwholeorinpartfromAT&T’sexerciseofitsrightsunderthisAUP.

ItisCustomer’sresponsibilitytoensurethesecurityofitsnetworkandthemachinesthatconnecttoanduseIPService(s).YouareresponsibleforconfiguringandsecuringyourservicestopreventdamagetotheAT&Tnetworkand/orthedisruptionofService(s)toothercustomers,andensuringthatyourcustomersandusersusetheService(s)inanappropriatemanner.CustomerisrequiredtotakeallnecessarystepstomanagetheuseoftheIPService(s)insuchamannerthatnetworkabuseispreventedorminimizedtothegreatestextentpossible.ItisCustomer’sresponsibilitytotakecorrectiveactionsonvulnerableorexploitedsystemstopreventcontin-uedabuse.Violationsofsystemornetworksecurityareprohibitedandmayresultincriminaland/orcivilliability.

AT&TIPServicesmaynotbeusedtointerferewith,togainunauthorizedaccessto,orotherwiseviolatethesecurityofAT&T’soran-otherparty’sserver,network,personalcomputer,networkaccessorcontroldevices,softwareordata,orothersystem,ortoat-tempttodoanyoftheforegoing.Examplesofviolationsofsystemornetworksecurityincludebutarenotlimitedto:

NetworkUsage

WhereanAT&TServiceaccount,serviceorfeaturedescriptionspecifieslimitsonbandwidth,diskutilization,simultaneousconnections,and/oraggregatedatadownloadorupload,useinexcessofthoselimitsisnotpermittedwithoutanappropriatechangeinaccounttypeorstatusandmayincuradditionalchargesforsuchusage.

Bandwidth,diskutilization,simultaneousconnections,andaggregatedatadownloads/uploadswillbecomputedordeterminedbyAT&Tfromtimetotimeindevelopingitsproductandserviceofferings.IntheeventAT&Tdeterminesthatanaccountisexceedingtherele-vantbandwidth,diskutilization,aggregatedatadownload/uploadlimits,simultaneousconnections,orreasonablesessiontimes,theaccountownerwillgenerallybenotifiedbyE-mail.Iftheexcessusecontinuesaftersuchnotification,theownermayberequestedtoupgradethetypeofaccountortomodifytheactivitycreatingtheexcessuse,ortheaccount

Customerremainssolelyandfullyresponsibleforthecontentofanymaterialposted,hosted,downloaded/uploaded,created,accessedortransmittedusingtheIPServices.AT&TtakesnoresponsibilityandassumesnoliabilityforanymaterialcreatedoraccessibleonorthroughtheAT&Tnetwork(s)usingIPService(s),orforanymistakes,defamation,slander,libel,omissions,falsehoods,obscenity,pornography,orprofanityCustomer(oritsUsers)mayencounter.AstheproviderofIPService(s),AT&Tisonlyaforumandisnotliableforanystatements,representations,orcontentprovidedbytheusersofIPServicesinanypublicforum.AT&Tshallnotbeobli-gatedtomonitororexerciseanyeditorialcontroloversuchmaterial,butreservestherighttodoso.IntheeventthatAT&TbecomesawarethatanysuchmaterialmayviolatethisAUP,otherapplicabletermsofuseorcontractprovisions,and/orexposeAT&Ttocivilorcriminalliability,AT&TreservestherighttoblockaccesstosuchmaterialandsuspendorterminatetheServiceofanyusercreating,storingordisseminatingsuchmaterial.AT&Tfurtherreservestherighttoconductinvestigationsintofraud,violationsoftheTermsofService,thisAUPorotherlawsorregulations,andtocooperatewithlegalauthoritiesandthirdpartiesintheinvestigationofallegedwrongdoing,includingdisclosingtheidentityoftheuserthatAT&Tdeemsresponsibleforthewrongdoing.
