DEFINITIONS

a) “private interest” does not include an interest in a decision: i. that is of general public application or ii. that affects a person as one of a broad class of persons

b) “controlling interest” means an interest that a person has in a corporation if the person

beneficially owns, directly or indirectly, or exercises control or direction over shares of the corporation carrying more than 25% of the voting rights attached to all issued shares of the corporation

c) “family” means the spouse and dependent children of a member of a candidate

d) “senior officer” means the chair or vice-chair of the board of directors, the president, any

vice-president, the secretary, the treasurer or the general manager of a corporation or any other person who performs functions for the corporation similar to those normally performed by a person occupying any of those offices

e) “council, council committee, controlled corporation, or other body” includes any

Executive Summary

The Election Sign Guide provides an overview of the regulations on election signage. Regulations on election signage are outlined in the following civic bylaws and federal acts.

• City of Saskatoon Bylaw No. 8770 (Zoning Bylaw);

• City of Saskatoon Bylaw No. 7491 (Temporary Sign Bylaw);

• City of Saskatoon Bylaw No. 7565 (Poster Bylaw); and

• The Local Government Election Act, 2015.

These bylaws regulate sign placement, duration and other standards including size and height.

4 | ELECTION SIGN GUIDE

1.0 DefinitionsAn “Election Sign” and “Election Poster” means a temporary sign/poster which is designed or intended to be displayed in connection with the following:

(i) a federal election or referendum;

(ii) a provincial election, referendum or plebiscite;

(iii) a local government election; or

(iv) a Saskatoon Health Authority election.

2.0 Duration of Election Signs and PostersElection signs and posters may be installed after the following:

• Federal or provincial election - after an election writ has been issued.

• Federal referendum - after a proclamation has been issued.

• Provincial referendum - after an order by the Lieutenant Governor in Council.

• Provincial plebiscite - after a direction by the Assembly or the Minister.

• Civic election or Saskatoon Health Authority election - forty-five (45) days before the election.

3.0 Private Property vs Right-of-Way (ROW)Figure 1 identifies the typical delineation between private property and City boulevard area. Election signage on private property is regulated by the standards established in the City’s Zoning Bylaw. The placement of election signage on City boulevards, referred to as City right-of-way (ROW), and buffer strips are regulated by the standards established in the City’s Temporary Sign Bylaw.

4.0 Election Signs on Private PropertyElection signs may be placed on a residential site (“R” zoning) by a resident of the property.

Election signs may also be placed on commercial or industrial sites that are zoned to accommodate third party advertising.

Interested parties can access property zoning details via the City’s Development Portal on saskatoon.ca/zoningbylaw.

Alternatively, to verify if a site is zoned appropriately for election signage, interested parties can contact Bylaw Compliance at 306-657-8766 or by email at [email protected].

4.1 Private Property – StandardsSign Size – Within residential areas, the maximum allowable sign face area is 0.84 m2 (9 ft2). Within commercial and industrial areas that are zoned appropriately for election signage, the maximum allowable sign face area is 18 m2 (193.75 ft2).

Sign Setbacks – On corner lots, election signs must be a minimum of 6 m (19.69 ft) from the front property corner, which is closest to the street. General Provisions – The placement of election signs must not create a hazard for vehicles or pedestrians, or obstruct the view or any portion of a traffic control device or signal.

5.0 Election Signs on City Right-of-Way (ROW)Elections Signs are not permitted on any centre medians, traffic islands or roundabouts. Election signs are permitted on all City of Saskatoon boulevards and buffer strips, except those noted in Figure 4 (next page), which are generally higher speed roadways.

5.1 ROW – StandardsSign Size – On City ROW, the maximum allowable sign face area is 0.6 m2 (6.45 ft2).

Sign Setbacks – On City ROW, election signs must adhere to the following minimum setbacks which are identified in Figure 5:

• 2 m (6.56 ft) from any curb

• 6 m (19.69 ft) from any driving lane, where no curb exists

• 2 m (6.56 ft) from any fire hydrant

• 5 m (16.4 ft) from any private driveway

• 30 m (98.4 ft) from an intersection measured from the outer most curb face

• Temporary signs must be placed a minimum of one (1.0) metre from any City sidewalk or pathway

Sign Height – The top of the sign must be less than one 1 m (3.28 ft) above grade.

6.0 Removal and Recovery of SignsInstallation and removal of signs is the responsibility of election candidates.Election signs must be removed within seven (7) days after the date of the election, referendum or plebiscite.

The City may remove signs without prior notice if the sign is considered to be a safety hazard, is located on prohibited roadway boulevards, medians or buffer strips, or if the candidate has not removed the sign after being notified.

If you believe your signs have been removed by the City, please contact Bylaw Compliance at 306-657-8766 or [email protected] and you will be directed to the appropriate person.

Any signs removed by the City will be held for three (3) business days, during which time signs may be reclaimed. The City may without notice, dispose of any signs which are not reclaimed after three (3) business days. The City is not responsible for the loss or damage to any signs removed or stored.

7.0 Election PostersWithin the Downtown, Riversdale, Broadway and Sutherland business districts the placement of elections posters are restricted to the community bulletin board areas as shown in Figure 6 (next page).

In other areas of the city, election posters must not be attached to any public property, with the exception of street light poles, traffic signal poles, telephone poles or power poles. In no case shall a poster be attached to any public property located within a traffic island or median.

7.1 Election Posters – StandardsThe following standards apply to the placement of election posters:

• The size of an election poster must not exceed dimensions of 11 in x 17 in.

• Election posters must indicate the date upon which the poster is attached.

• Election posters may only be attached with clear tape or other easily removable tape.

Election posters must be removed within seven (7) days after the date of the election, referendum or plebiscite.

8.0 Related Standards• Election advertising on bus benches, buses or billboards where third

party advertising is permitted is not considered to be third party advertising and are not bound by the regulations outlined in this document.

• Licensed portable signs may be used for election advertising if it is located on private property in a zoning district which permits third party signage (Signage Group 5). The portable sign must maintain all required bylaw regulations, including setbacks from other portable signs.

• Persons holding election signs on ROW or buffer strips are bound by the regulations outlined in Section 5.0 of this document.

• In accordance with Section 176 of the Local Government Election Act, 2015, during the hours that a poll is open election signage must not be placed within 100 m (328 ft) of the building in which a poll is held.

9.0 Safety PrecautionsWhen installing/removing election signs, take proper safety precautions to ensure your safety and the safety of the public, including reducing driver distractions. Safety tips include:

• All persons working near roadways shall wear reflective vests/bright clothing and safety footwear.

• Signs should be installed and removed between 9:30 a.m. and 3:30 p.m. outside of peak travel times.

• Ensure that signs are properly secured to avoid being blown away.
