AT a meeting of the Executive Council held in the ExecutiveCouncil Chambers, at Perth, this 28th day of January 1986,the following Order in Council was authorised to beissued:-
Water Authority Act 1984 .ORDER IN COUNCIL.
WHEREAS by section 86 (e) of the Water Authority Act1984, it is made lawful for the Governor to direct that worksserving the aboriginal communities be declared exempt asper the following schedule .
Schedule .Water Supply and Sewerage Works serving aboriginal
communities where:(a) all the works are on land which is controlled by a
legally incorporated aboriginal community or onthe community's behalf by the Aboriginal LandsTrust;
(b) the community has specifically requested the WaterAuthority to carry out works ; and
(c) the works are funded in total by the Common-wealth Department of Aboriginal Affairs .
Now therefore, His Excellency the Governor acting withthe advice and consent of the Executive Council and inexercise of the powers conferred by the Act, doth herebyexempt the works to aboriginal communities from the oper-ation of section 86 (e) of the Water Authority Act 1984 .

MADE by His Excellency the Governor in Executive Council .Citation
1 . These regulations maybe cited as the Navigable Waters Amendment Regu-lations 1986.
2 . In these regulations the Navigable Waters Regulations* are referred to asthe principal regulations .
3 . Regulations 45A of the principal regulations is amended in subregulation(2), by inserting after the definition of "owner" the following definition-
"registered"registered interstate pleasure vessel" means a registrable vessel which iscurrently registered in any State or Territory under a system of regis-tration equivalent to that under this Part ; ' .

4 . Regulation 45B of the principal regulations is amended-(a) in subregulation (1), by deleting "subregulation (2)" and substituting the
following-•
subregulations (2) and (2a) and to regulation 45BAA '(b) by inserting after subregulation (2) the following subregulation-
(2a) A person may, within the period of 3 months immediately suc-ceeding the day of entry of a registered interstate pleasure vessel intoany navigable waters, use or have in navigable waters a registered in-terstate pleasure vessel that is not registered with the department inaccordance with this regulation. " ;
(c) in the Table to subregulation (3), by deleting "(iii) 10 metres orover38" and substituting the following-

regulation are inserted-RegistrationRegistration of Foreign Pleasure Vessels.45BAA . (1) In this regulation-
"foreign pleasure vessel" means a registrable vessel which is owned bya person who is not a permanent resident of the State and whichis temporarily within navigable waters but does not include a regis-tered interstate pleasure vessel;
"proposed departure date" in relation to a foreign pleasure vesselmeans the date notified to the department pursuant tosubregulation (4) (g) in respect of that vessel .
NAVIGABLE WATERS REGULATIONS .Water Ski Areas .

ACTING pursuant to the powers conferred by Regulation48A of the Navigable Waters Regulations, the Departmentof Marine and Harbours by this Notice defines and setsaside the following area of navigable waters for water skiingand use by those members of the West Australian Water SkiAssociation and Albany Water Ski Club involved in a SkiShow, only between 0800 hours to 1430 hours Sunday 2March 1986-
A course depicted by buoys in Princess Royal Har-bour commencing at a point 100 metres south of TownJetty, thence 350 metres southwest, thence 600 metresin a generally northwestern direction, thence 250 metresto the northeast thence to the starting point .

(2) Subject to subregulation (3), a person shall not use or have in anynavigable waters a foreign pleasure vessel unless the vessel is registered withthe department in accordance with this regulation .
(3) A person may, within the period of 30 days immediately succeedingthe day of entry of the foreign pleasure vessel into any navigable waters, useor have in navigable waters a foreign pleasure vessel that is not registeredwith the department in accordance with this regulation .
(4) Every application for the registration of a foreign pleasure vesselshall be made to the department in writing on a form specified by the Minis-ter and shall include particulars of-
(a) the full name and residential address of the owner of the vessel andthe telephone number of any telephone installed at that addressfor the owner;
(b) the full name and residential address of the master of the vessel ;(c) the overall length of the vessel expressed in metres expressed to 2
decimal places;(d) the type of construction of the vessel and its colour ;(e) the power in kilowatts and name of the manufacturer of the engine
fitted to the vessel or carried as an auxiliary in the vessel and astatement as to whether the engine is of the inboard or outboardtype ;
(f) the date of entry of the vessel into navigable waters ; and(g) the proposed date of departure of the vessel from navigable waters,
and the application shall be accompanied by a recording fee of $7 .50 and theappropriate fee ascertained in accordance with the following table for eachthree month period or part of a three-month period for which it is proposedthe vessel will be in navigable waters-

(5) When the department registers a foreign pleasure vessel under thisregulation the department shall, if the vessel has not previously been regis-tered under this regulation, allot a registration number for the vessel andissue to the owner for whom the application was made-
(a) an identification card, which identification card shall include theregistration number allotted by the department for the vessel atthe time when the vessel was first registered under this regulation ;and
(b) a certificate of registration for the vessel, which certificate shall in-dicate the date of expiry of the registration of the vessel .
(6) A person shall not use or have in any navigable waters a foreignpleasure vessel unless both the identification card and the certificate ofregistration referred to in subregulation (5) are carried upon the vessel anddisplayed when required for identification of the vessel .
(7) Where an application for registration as a foreign pleasure vessel isduly made under this regulation and is accompanied by the prescribed feesthe department shall issue a certificate of registration for a period com-mencing on the date shown on the receipt imprinted on the certificate andexpiring on the proposed departure date .
(8) Where a foreign pleasure vessel previously registered under this regu-lation does not leave navigable waters on the proposed departure date andapplication for registration of the vessel under this regulation is duly madeunder subregulation (4) and is accompanied by the prescribed fee beforethat registration expires or within 30 days immediately succeeding the dayon which that registration expires the department shall register the vesselfor a period expiring on the proposed departure date shown in that appli-cation and the registration shall be deemed to be a continuation of the pre-vious registration and to have effect on and from the day next succeedingthe day on which that registration expires . ' .

Schedule .1 . Adding where appropriate in Clause 1 .8 the following
definitions :
"Marina Frontage" means the boundary line betweenthe marina and adjacent lots as defined on thedevelopment guide plan .
"Marina Wall" means a retaining wall constructed ina marina to retain a stabilised surface level at ornear the marina frontage .
"Marine Installations" means premises at whichberths or pens for servicing repairing, storage(including storage on land) and other facilitiesfor boats are provided, with or without the sale ofboating gear and equipment, and includes all jet-ties, piers, embankments, quays and mooringsappurtenant thereto and all offices, workshopsand storerooms used in connection therewith .
"Stabilised surface level" means the land surface levelestablished by the development of a marina andadjacent lots in accordance with the developmentguide plan.
2 . Adding to Clause 3 .2 a new Zone as follows :(21) Marina Development Zone .
3 . Adding a new Clause 5 .38 as follows:5.38 Marina Development Zone.
The Council's intention in controlling developmentwithin the Marina Development Zone is to :
(i) ensure suitable standards of developmentand maintenance in the zone ; and
(ii) control and safeguard health, safety, con-venience and the general welfare and amen-ity of the locality .
The following provisions shall apply to all land in-cluded in the Marina Development Zone in additionto any provisions which are more generally applicableto such land under this Scheme .
(a) The documents to be provided before anyproposal to include land in the Marina De-velopment Zone is considered shall include aDevelopment Guide Plan showing:
(i) the proposed final staged subdivisionof the land including lot sizes, lot di-mensions, contours, and all suchother information as is set out inregulation 6 of the Town PlanningBoard Regulations 1962 (asamended) ;
(ii) the proposed land use or developmenton each lot ;
(iii) areas proposed to be set aside for pub-lic open space, pedestrian accesswaysand community facilities as may beconsidered appropriate by the Coun-cil ; and
(iv) the proposed staging of thesubdivision/development where rel-evant .
(b) The subdivision and development relating toa specific Marina Development Zone shallaccord with the Development Guide Plan forthe specified area referred to in Schedule 7and such Development Guide Plan shallform part of the Scheme.
(c) In addition to all other provisions of theScheme relating thereto the general pro-visions set out in this part apply to any landwithin a Marina Development Zone . Thespecial provisions contained in Schedule 7set against the land within each particularMarina Development Zone shall applythereto but if there is any conflict the specialprovisions prevail .
(d) Notwithstanding the provisions of theScheme and what may be shown in the De-velopment Guide Plan specified in Schedule7 the Town Planning Board may approve aminor variation to the subdivisional designbut further subdivision of the lots so createdshall be contrary to the provisions of theScheme .
(e) All existing Marina walls along a marinafrontage shall be kept in a structurally soundcondition to the satisfaction of the Counciland shall not be altered, extended or re-moved without the written approval of theCouncil being first applied for and obtained.
(f) All clothes drying areas and utility areaswhich in the opinion of the Council detractfrom the amenity of either the marina front-age or the road frontage shall be screenedfrom view . In submitting designs for build-ings, clothes drying areas and utility areasshall be shown in the plans .
4. Amending Table 1 by:1 . Adding a new use class "Marine Installations"
where appropriate as a "P" use in the MarinaDevelopment Zone and "X" in all other zones .
2 . Adding a new column 21 as follows :21. Marina Development.
5 . Adding under Column 21 in Table 1 the symbols relatingto various use classes as listed below and where a useclass listed in Table 1 is not mentioned hereunder, theuse shall be regarded as prohibited .

(ii) The reasons for selecting the particulararea the subject of the proposed zonewith particular reference as to how this
(a) Localityrelates to the Council's planningobjectives for the locality.
(iii) A plan or plans showing contours atsuch intervals as to adequately depictthe land form of the area and thephysical features such as existing build-ings, rock outcrops, trees or groups oftrees, lakes, rivers, creeks, swamps, or-chards, wells and significant improve-ments.
(iv) The proposed staging of the subdivisionand development and the criteria to bemet before successive stages areimplemented .
(b) The scheme provisions for a specific SpecialResidential Zone shall include a Plan ofsubdivision, which shall form part of theScheme, showing:
(i) The proposed ultimate subdivision in-cluding lot sizes and dimensions .
(ii) Areas to be set aside for Public OpenSpace, and other community facilities asmay be considered appropriate .
(iii) All physical features it is desirable toconserve, if any .
(iv) The proposed staging of the subdivisionwhere relevant.
(v) Any stands or single specimens of treesor native flora which should be retainedto preserve the environment .
(vi) Notwithstanding the provisions of theScheme and what may be shown in thePlan of Subdivision the Town PlanningBoard after consultation with the LocalAuthority may approve a minor vari-ation to the subdivisional design butfurther breakdown of the lots so createdshall be deemed to be contrary to theprovisions of the Scheme and shall notbe approved.
(c) In addition to the Plan of Subdivision, theScheme provisions for a specific Special Resi-dential Zone shall specify any special pro-visions appropriate to secure the objectives ofthe zone .
(d) In addition to such other provisions of theScheme as may affect it, any land which isincluded in a "Special Residential Zone" shallbe subject to the following provisions :
(i) No signs, hoardings or advertisementshaving an area greater than 0 .2 metresquare will be permitted to be erected .
(ii) All fencing around the boundaries oflots shall comply with the Council's re-quirements.
(iii) The responsible Authority may imposeadditional conditions to its consent thatin its opinion are necessary to preservethe concept of the zone .

Auditors Report.As the Auditors appointed by the Eastern Metropolitan Regional Council we
advise that we have carried out an Audit of the Council's financial statements forthe period 1 July 1984 to 30 June 1985 in accordance with the Local GovernmentAct.We would advise that in our opinion the receipts summary and payments
summary for the period are properly drawn up in accordance with generallyaccepted accounting principles and that the balance sheet as at 30 June 1985represents fairly and truly the financial position of the Council at that dateexcept for the following matters :
1 . Accounting policy for depreciation has been changed from traditionaltax values to an amortization procedure relating to the life of therelevant plant . As some substantial plant items have a short life spanthis has created an abnormal expenditure change in this financial year,and has placed the Municipal Accumulation Account in deficit . In ouropinion the change implemented is reasonable, but it affects otherreporting periods also .
2 . We note the asset adjustment entry of $52 856 .94 to the debit of theCouncil's Accumulation Account . We are unable to express an opinionas to its reasonableness without the assistance of a valuation report onthe whole of the land and buildings owned by the Council .
