BY Road Process Order made on 28 July 2010, the Development Assessment Commission ordered that:

1. Portions of the public roads (Ely Street, Gateshead Street, Gateshead Crescent, Gladstone Crescent, Haddington Crescent and Kimberley Street) situate generally between Hanson Road and Trafford Street and adjoining allotment 58 in Filed Plan 126226, allotments 171 to 175 and 251 in Deposited Plan 7518, allotments 135, 257 and 258 in Deposited Plan 7514, allotments 15, 27, 28 and 162 in Deposited Plan 7515 and allotments 189, 193 and 210 in Deposited Plan 7517, more particularly delineated and lettered ‘A’ to ‘H’ (inclusive), ‘J’, ‘K’, the greater portion of ‘L’, ‘M’, ‘N’ and ‘P’ to ‘T’ (inclusive) in Preliminary Plan No. 08/0104 be closed.

2. Issue Certificates of Title to the City of Port Adelaide Enfield for the whole of the land subject to closure lettered ‘A’, ‘D’, ‘E’, ‘K’, ‘M’, ‘N’, ‘R’, ‘S’ and the greater portion of ‘L’, which lands are being retained by Council for merging with the adjoining Council reserves.

3. Issue a Certificate of Title to the City of Port Adelaide Enfield for the whole of the land subject to closure lettered ‘H’, which land is being retained by Council for public purposes.

4. Transfer the whole of the land subject to closure lettered ‘B’, ‘C’, ‘F’, ‘G’, ‘J’, ‘P’ and ‘Q’ to the South Australian Housing Trust in accordance with the agreement for transfer dated 26 May 2010 entered into between the City of Port Adelaide Enfield and South Australian Housing Trust.

5. Transfer the whole of the land subject to closure lettered ‘T’ to Santosh-Kumar Gupta and Amita Gupta in accordance with the agreement for transfer dated 1 April 2010 entered into between the City Port Adelaide Enfield and Santosh-Kumar Gupta and Amita Gupta.

6. The following easements are granted over portions of the roads closed by this order:

Grant to South Australian Water Corporation easements for water supply and sewerage purposes.

Grant to Envestra (SA) Limited an easement for gas supply purposes.

On 9 August 2010 that order was confirmed by the Minister for Infrastructure conditionally upon the

deposit by the Registrar-General of Deposited Plan 84661 being the authority for the new boundaries.

Pursuant to section 24 (5) of the Roads (Opening and Closing) Act 1991, NOTICE of the order referred to above and its confirmation is hereby given.Dated 24 February 2011.

RULES OF COURTDistrict Court Civil Rules 2006

(Amendment No. 15)BY virtue and in pursuance of Section 51 of the District Court Act 1991 and all other enabling powers, we, Terence Anthony Worthington, Chief Judge, Dean Ernest Clayton, and Kevin Gordon Nicholson, Judges of the District Court of South Australia, make the following Rules of Court:

1. These Rules may be cited as the District Court Civil Rules 2006 (Amendment No. 15).

2. The District Court Civil Rules 2006 are amended as set out below.

3. This amendment will commence on 1 February 2011, or upon its gazettal, whichever is the later.

4. Rule 272 is amended by:4.1 deleting sub-rule (1) and replacing it with:

  ‘(1) An application for an adjudication of costs under Section 35 (1) of the Commercial Arbitration and Industrial Referral Agreements Act 1986, or some other law, is to be made by filing an application in an approved form.’

4.2 deleting the words ‘The letter’ in subrule (2) and replacing them with ‘The application’.

4.3 adding a new sub-rule (5) as follows:   ‘(5) On the conclusion of an adjudication under this Rule

the Court may direct that a certificate be issued by the Court setting out the result of the adjudication.’

5. Rule 303 is amended by:(1) inserting in subrule (4) after the words ‘the alleged

contempt,’ first appearing, the words ‘subject to subrule (7),’;

(2) inserting a new subrule (7) as follows:‘Despite subrule (4), the Court may, if satisfied that there are reasonable grounds to suspect the accused of the alleged contempt and that the relief sought by the applicant is in substance remedial or coercive and not punitive, grant permission to the applicant to issue a summons requiring the accused to appear before the Court at a nominated time and place to answer the charge and, in that event, the applicant:(a) must, within the time fixed by the Court, issue and

serve a summons in an approved form requiring the accused to appear before the Court at the nominated time and place to answer the charge;

(b) must be named as the prosecuting party in the summons;

(c) will have the carriage of the prosecution of the charge;

(d) must prosecute the charge at its own expense and satisfy any costs orders made in favour of the accused;

6. Rule 305 is amended by:(i) deleting subrule (1) and inserting in its place the

following:‘Apart from those cases to which Rule 303 (7) applies, the Registrar will have the carriage of the prosecution of a charge of contempt, and the Registrar may retain solicitors and counsel for that purpose.’;

(ii) inserting a new subrule (2) to read as follows:‘In relation to proceedings for contempt which were initiated by an application under Rule 303 (1), the Court may direct the applicant to indemnify the Registrar in respect of the costs incurred by the Registrar or ordered to be paid by the Registrar.Note: this right of cost recovery is additional to that contained in Rule 306 (3).’;

 (iii) renumbering subrules (2), (3), and (4) as subrules (3), (4) and (5) respectively.

Tobacco Products (Exemption—Red) Proclamation 2011under section 71 of the Tobacco Products Regulation Act 1997

1—Short titleThis proclamation may be cited as the Tobacco Products (Exemption—Red) Proclamation 2011.

2—CommencementThis proclamation comes into operation on the day on which it is made.

3—InterpretationIn this proclamation—

Act means the Tobacco Products Regulation Act   1997 ;

prescribed period means the period commencing on 13 April 2011 and ending on 27 April 2011;

prescribed production means the stage production of Red produced by Independent Theatre Inc.

4—Application of proclamationThis proclamation applies to the following persons:

(a) a person employed by, or in relation to, the prescribed production;

(b) an occupier of the Space Theatre at the Adelaide Festival Centre;

(c) an employer with responsibility for a workplace consisting of the Adelaide Festival Centre Space Theatre in relation to the prescribed production.

5—Exemption from section 46 of the Act(1) A person to whom this proclamation applies is exempt from the operation of section 46 of

the Act in relation to smoking occurring in the course of a performance or rehearsal of the prescribed production during the prescribed period.

(2) An exemption under this clause is subject to the following conditions:

(a) smoking may only occur on a stage on which the prescribed production is being performed or rehearsed, or in a rehearsal room used in relation to the prescribed production;

(b) the area in which smoking may occur under the exemption must be well ventilated;

(c) a person may only smoke a tobacco product of a kind contemplated by paragraph (g) of the definition of tobacco product in section 4 of the Act.

(3) If a person contravenes or fails to comply with a condition of an exemption specified in subclause   (2) , the exemption does not, while the contravention or non-compliance continues, operate in that person's favour.

The Amendment will change the Development Plan by proposing to:

• Introduce policy adopted from the relevant General BDP modules guiding development within the Residential zone and residential development generally throughout the council area and reformat the existing council wide section in line with the BDP format.

• Replace existing Residential zone policies with the Residential Zone BDP module.

• Rezone residential land within the Eastern Residential Policy Area to Residential (Regeneration) zone and introduce associated policy.

• Rezone the Residential (Industrial Transition) zone to Residential.

• Rezone the Public Purposes (Show Grounds) zone to Residential.

• Amend the zone boundary of the Commercial zone fronting Pick Avenue.

• Delete reference to Single Storey Detached Dwellings within Table MtG(C)/1 in order to provide consistent policy with the recently adopted Residential Code.

The DPA report will be on public consultation from Thursday, 24 February 2011 until Friday, 6 May 2011.

By-Law No. 1—Permits and PenaltiesA by-law to create a permit system for Council by-laws, to fix maximum and continuing penalties for offences, and for the construction of Council by-laws.PART 1—PRELIMINARY1. Interpretation

In this by-law, unless the contrary intention appears;

1.1 Act means the Local Government Act 1999;1.2 council means the District Council of Tumby

Bay;1.3 person includes a natural person, body

corporate, an unincorporated association and an incorporated association.

2. Construction of By-laws Generally2.1 Every by-law of the Council is subject to any

Act of Parliament and Regulations made thereunder.

2.2 In any by-law of the Council, unless the contrary intention appears permission means permission of the Council, or such other person as the Council may by resolution authorise for that purpose granted in writing prior to the act, event or activity to which it relates.

PART 2—PERMITS AND PENALTIES3. Permits

3.1 Where a by-law of the Council requires that permission be obtained any person seeking the grant of permission must submit a written application to the Council in the form (if any) and accompanied by the fee (if any) prescribed by the Council.

3.2 The Council or such other person as the Council may by resolution authorise for that purpose may attach such conditions as it thinks fit to a grant of permission, and may vary or revoke such conditions or impose new conditions by notice in writing to the person granted permission.

3.3 A person granted permission must comply with every such condition.

3.4 The Council or such other person as the Council may by resolution authorise for that purpose may suspend or revoke a grant of permission at any time by notice in writing to the person granted permission.

4. Offences and Penalties4.1 A person who commits a breach of any by-law

of the Council is guilty of an offence and is liable to a maximum penalty being the maximum penalty referred to in the Act that may be fixed by a by-law for any breach of a by-law.

4.2 A person who commits a breach of a by-law of the Council of a continuing nature is guilty of an offence and, in addition to any other penalty that may be imposed, is liable to a further penalty for every day on which the offence or breach continues, such penalty being the maximum amount referred to in the Act that may be fixed by a by-law for a breach of a by-law of a continuing nature.

This by-law was duly made and passed at a meeting of the District Council of Tumby Bay held on 14 February 2011, by an absolute majority of the members for the time being constituting the Council, there being at least two-thirds of the members present.

By-law No. 2—DogsA by-law to limit the number of dogs kept on premises and for the management and control of dogs in the Council’s area.

PART 1—PRELIMINARY1. Interpretation

In this by-law, unless the contrary intention appears:

1.1 Approved Kennel Establishment means a building, structure, premises or area approved by the relevant authority, pursuant to the Development Act 1993 for the keeping of dogs on a temporary or permanent basis;

1.2 Assistant Dog means a hearing dog, a guide dog or a disability dog as defined in section 4 of the Dog and Cat Management Act 1995;

1.3 Children’s Playground means any enclosed area in which there is equipment or other installed devices for the purpose of children’s play (or within 3 metres of such devices if there is no enclosed area);

1.4 Dog has the same meaning as in the Dog and Cat Management Act 1995;

1.5 Dog Management Officer is a person appointed by the Council as such, pursuant to the Dog and Cat Management Act 1995;

1.6 Keep includes the provision of food or shelter;1.7 Local Government Land means all land owned

by the Council or under the Council’s care, control and management;

1.8 Park means land reserved or delineated as a park or designated by the Council as a park;

1.9 Premises includes land and a part of any premises or land whether used or occupied for domestic or non-domestic purposes except an approved kennel establishment

 1.10 Public Place has the same meaning as in the Local Government Act, 1999;

 1.11 Reserve means land reserved or dedicated as a reserve or designated by the Council as a reserve;

 1.12 Small Dwelling means a self-contained residence that is:1.12.1 a residential flat building; or1.12.2 contained in a separate strata unit; or 1.12.3 on an allotment less than 500 m2 in area; or1.12.4 without a secure yard of at least 100 m2 in area;

 1.13 Township has the same meaning as in the Local Government Act 1999;

 1.14 Working Dog means a dog primarily used for the purposes of herding stock.

PART 2 – LIMITS ON DOG NUMBERS2. Limits on Dog Numbers in Private Premises

2.1 Subject to Clauses 2.2 and 2.4, a person must not, without the Council’s permission Keep:2.1.1 in a Township, more than one Dog in a

Small Dwelling;2.1.2 in a Township, more than two Dogs in

Premises other than a Small Dwelling;2.1.3 outside of a Township, more than four

Dogs;

2.2 Clause 2.1 does not apply to:2.2.1 approved Kennel Establishments

operating in accordance with all required approvals and consents, provided any business involving Dogs operating from those premises is also registered in accordance with the Dog and Cat Management Act 1995; or

2.2.2 any dogs which are Working Dogs, provided that the number of Working Dogs on any Premises shall not exceed five unless permission of the Council is obtained.

2.3 The Council may require that Premises which are the subject of an application for permission to keep additional dogs, must be inspected by a Dog Management Officer for the purpose of assessing the suitability of the Premises for housing Dogs.

2.4 No Dog is to be kept on any Premises where in the opinion of a Dog Management Officer, there is no secure area where a Dog may be effectively confined.

PART 3—DOG CONTROLS3. Dog Exercise Areas

3.1 A person must not without the Council’s permission enter a public place or any part of Local Government Land to exercise a Dog under that person’s control except a Public Place or Local Government Land to which this paragraph applies.

3.2 Where a person enters upon such Public Place or Local Government Land for the purpose of exercising a Dog under that person’s control, that person must ensure that the Dog or Dogs remain under effective control either by means of a physical restraint or by command, the Dog being in close proximity to the person and the person being able to see the Dog at all times while on that land.

4. Dog on Leash Areas4.1 A person must not, without the Council’s

permission, cause, suffer or permit a Dog under that persons control, charge or authority (except an Assistant Dog) to be or remain:4.1.1 on Local Government Land or Public

Place to which this subparagraph applies; and

4.1.2 on any Park or Reserve during times when organised entertainment or sport is being played;

unless the Dog is secured by a strong leash not exceeding 2 m in length which is either tethered securely to a fixed object capable of securing the Dog or held by a person capable of controlling the Dog and preventing it from being a nuisance or a danger to other persons.

5. Dog prohibited areas5.1 A person must not allow a Dog under that

persons control, charge or authority (except Assistant Dog) to enter or remain:5.1.1 on any Children’s Playground on Local

Government Land;5.1.2 on any other Local Government Land or

Public Place to which this subparagraph applies.

6. Application of ParagraphsAny of the paragraphs 3, 4 or 5 of this by-law shall

apply only in such portion or portions of the area as the Council may determine from time to time in accordance with section 246 (3) (e) of the Local Government Act 1999.

By-law No. 3—Local Government LandA by-law to regulate access to and use of Local Government Land (other than roads), and certain public places.1. Interpretation

In this by-law, unless the contrary intention appears;

1.1 Authorised Person means a person appointed an authorised person pursuant to section 260 of the Local Government Act 1999;

1.2 Boat includes a raft, pontoon or personal watercraft or other similar device;

1.3 Camp includes setting up a camp, or causing a tent, caravan or motor home to remain on the land for the purpose of staying overnight, whether or not any person is in attendance or sleeps on the land;

1.4 Children’s Playground means an enclosed area in which there is equipment or other devices installed for the purpose of children’s play (or within 3 metres of such devices if there is no enclosed area);

1.5 Electoral Matter has the same meaning as in the Electoral Act 1985, provided that such electoral matter is not capable of causing physical damage or injury to any person within its immediate vicinity;

1.6 Effective Control means a person exercising effective control of an animal either:1.6.1 by means of a physical restraint; or1.6.2 by command, the animal being in close

proximity to the person and the person being able to see the animal at all times;

1.7 Emergency Worker has the same meaning as in the Road Traffic (Road Rules—Ancillary and Miscellaneous Provisions) Regulations 1999;

1.8 Foreshore means the area between the Low Water Mark on the seashore and the nearest boundary of:1.8.1 a road;1.8.2 a section;1.8.3 a public reserve; or1.8.4 land comprised in a land grant, Crown

Land or Crown Licence;1.9 Funeral Ceremony means a ceremony only

(i.e. a memorial service) and does not include a burial;

 1.10 Liquor has the same meaning as in the Liquor Licensing Act 1997;

 1.11 Local Government Land means all land owned by the Council or under the Council’s care, control and management (except roads);

 1.12 Low Water Mark means the lowest meteorological tide;

 1.13 Offensive includes threatening, abusive, insulting or annoying behaviour and offend has a complimentary meaning;

 1.14 Park means land reserved or delineated as a park or designated by the Council as a park;

 1.15 Reserve means land reserved or dedicated as a reserve or designated by the Council as a reserve;

 1.16 Tobacco Product has the same meaning as in the Tobacco Products Regulation Act 1997;

 1.17 Vehicle has the same meaning as in the Road Traffic Act 1961;

 1.18 Waters includes a body of water, including a pond, lake, river, creek or wetlands under the care, control and management of the Council.

2. Activities Requiring PermissionA person must not without permission, do any of

the following on Local Government Land.2.1 Advertising

Subject to paragraph 6.2 of this by-law, display, paint or erect any sign or hoarding for the purpose of commercial advertising or any other purpose.

2.2 AircraftSubject to the Civil Aviation Act 1988, land any aircraft on, or take off any aircraft from the land except on an area properly constructed for that purpose;

2.3 AlcoholConsume, carry or be in possession or in charge of any Liquor on Local Government Land comprising Parks or Reserves to which this subparagraph applies.

2.4 AmplificationUse an amplifier or other mechanical or electrical device for the purpose of broadcasting or magnifying sound.

2.5 Animals2.5.1 On Local Government Land other than

the Foreshore:(a) cause or allow an animal to stray

onto, move over, graze or be left unattended on Local Government Land;

(b) cause or allow an animal to enter, swim, bathe or remain in any waters located on Local Government Land; or

(c) lead, herd or exercise an animal, except where the Council has set aside a track or other area for use by or in connection with an animal of that kind, and provided that the animal or animals are under Effective Control.

2.5.2 On Local Government Land comprising the Foreshore:(a) cause or allow a sheep, cow, goat or

horse to enter, swim, bath or remain in any water on land to which this subparagraph applies; or

(b) lead, herd or exercise a sheep, cow, goat or horse.

2.6 AnnoyanceDo anything likely to offend or unreasonably interfere with any other person:(a) using that land; or(b) occupying nearby premises,

by making a noise or creating a disturbance.2.7 Attachments

Subject to paragraph 6.2 of this by-law, attach anything to a tree, plant, equipment, fence, post, structure or fixture on Local Government Land.

2.8 BeesPlace a hive of bees on such land, or allow it to remain thereon.

2.9 BoatsSubject to the provisions of the Harbours and Navigation Act 1993, on land to which this subparagraph applies:2.9.1 launch or retrieve a boat to or from any

waters;

2.9.2 launch or retrieve a boat other than from a boat ramp constructed for that purpose;

2.9.3 propel, float or otherwise use a boat on or in any waters;

2.9.4 hire out a boat or otherwise use a boat for commercial purposes; or

2.9.5 moor a boat on any waters or to a pontoon attached to Local Government Land.

any human or animal remains.2.12.2 Erect any memorial.

 2.13 Camping and Tents2.13.1 Erect a tent or other structure of

calico, canvas, plastic or similar material as a place of habitation except on land which the Council has by resolution exempted from the application of this subparagraph.

2.13.2 Camp or sleep overnight except where a person is in a caravan park or motor home park on local government land, the proprietor of which has been given permission to operate the caravan park or motor home park on that land except on land which the Council has by resolution exempted from the application of this subparagraph.

 2.14 CanvassingConvey any advertising, religious or other message to any bystander, passer by or other.

 2.15 Defacing PropertyDeface, paint, spray, write, cut names, letters or make marks on any tree, rock, gate, fence, building, sign, bridge or property of the Council.

 2.16 DistributionSubject to paragraph 6.2 of this by-law, place on a vehicle (without the consent of the owner of the vehicle), or give out or distribute any hand bill, book, notice, leaflet, or other printed matter to any bystander, passer-by or other person.

 2.17 DonationsAsk for or receive or indicate that he or she desires a donation of money or any other thing.

 2.18 Entertainment and Busking2.18.1 Sing, busk or play a recording or use

a musical instrument for the apparent purpose of either entertaining others or receiving money.

2.18.2 Conduct or hold a concert, festival, show, public gathering, circus, meeting, performance or any other similar activity.

 2.19 EquipmentUse an item of equipment, facilities or property belonging to the Council if that person is of or over the age indicated by a sign or notice as the age limit for using such equipment, facility or property.

 2.20 FiresSubject to the Fire and Emergency Services Act 2005, light a fire except:2.20.1 in a place provided by the Council

for that purpose; or2.20.2 in a portable barbeque, as long as

the barbeque is used in an area that is

clear of flammable material for a distance of at least 4 m.

2.20.3 in a place determined by Council. 2.21 Fireworks

Ignite or discharge any fireworks. 2.22 Flora and Fauna

Subject to the Native Vegetation Act 1991 and the National Parks and Wildlife Act 1972:2.22.1 damage, pick, disturb, interfere with

or remove any plant or flower thereon;

2.22.2 cause or allow an animal to stand or walk on any flower bed or garden plot;

2.22.3 deposit, dig, damage, disturb, interfere with or remove any soil, stone, wood, clay, gravel, pebbles, timber, bark or any part of the land;

2.22.4 take, interfere with, tease, harm or disturb any animal, bird or marine creature or the eggs or young of any animal, bird or marine creature;

2.22.5 pick, collect, take, interfere with or disturb any fruit, nuts, berries or native seeds;

2.22.6 disturb, interfere with or damage any burrow, nest or habitat of any animal or bird;

2.22.7 use, possess or have control of any device for the purpose of killing or capturing any animal, bird or marine creature; or

2.22.8 burn any timber or dead wood. 2.23 Foreshore

On Local Government Land comprising the Foreshore:

2.23.1 to which this subparagraph applies, launch or retrieve a boat from the foreshore without using a boat ramp or thoroughfare constructed or set aside by the Council for that purpose;

2.23.2 allow a vehicle to remain stationary on a boat ramp longer than is necessary to launch or retrieve a boat; or

2.23.3 hire out a boat on or from the foreshore.

 2.24 Games2.24.1 Participate in, promote or organise

any organised competition or sport, as distinct from organised social play.

2.24.2 Play or practice any game which involves kicking, hitting or throwing a ball or other object on Local Government Land which may cause or be likely to cause injury or discomfort to a person being on or in the vicinity of that lands or detract from or be likely to detract from another person’s lawful use and enjoyment of that land.

2.24.3 Play or practice the game of golf on Local Government Land to which this subparagraph applies.

 2.25 Litter2.25.1 Throw, cast, place, deposit or leave

any rubbish, dirt or refuse of any kind whatsoever except in a garbage container provided for that purpose.

2.25.2 Deposit any soil, clay, stone, gravel, green waste or other putrescible waste or any other matter.

 2.26 Marine LifeIntroduce any marine life to any waters located on Local Government Land.

 2.27 Model Aircraft, Boats and CarsFly or operate a model aircraft, boat or model or remote control vehicle in a manner may cause or be likely to cause injury or discomfort to a person being on or in the vicinity of the land or detract from or be likely to detract from another person’s lawful use of and enjoyment of the land.

 2.28 Overhanging Articles or Displaying Personal ItemsSuspend or hang an article or object from a building, verandah, pergola, post or other structure on Local Government Land where it might present a nuisance or danger to a person using the land or be of an unsightly nature.

 2.29 Playing AreaUse or occupy a playing area:2.29.1 in such a manner as to damage or

be likely to damage the surface of the playing area or infrastructure (above and under ground level);

2.29.2 in a manner contrary to the purpose for which the playing area was intended to be used or occupied; or

2.29.3 contrary to directions of the Council made by resolution and indicated on a sign displayed adjacent to the playing area.

 2.30 PontoonsInstall or maintain a pontoon or jetty in any

waters. 2.31 Posting of Bills

Subject to paragraph 6.2 of this by-law, post or allow or cause to be posted any bills, advertisements or other papers or items on a building or structure on Local Government Land or in a Public Place.

 2.32 PreachingPreach, harangue or solicit for religious purposes.

 2.33 RopesPlace a buoy, cable, chain, hawser, rope or net in or across any waters.

 2.34 SwimmingSubject to the provisions of the Harbors and Navigation Act 1993, swim in, bathe or enter any waters except:2.34.1 Waters on land which the Council

has by resolution exempted from the application of this paragraph; and

2.34.2 in accordance with any conditions that the Council may have determined by resolution apply to such use.

 2.35 ToiletsIn any public convenience on Local

Government Land:2.35.1 urinate other than in a urinal or pan

or defecate other than in a pan set apart for that purpose;

2.35.2 deposit anything in a pan, urinal or drain which is likely to cause a blockage;

2.35.3 use it for a purpose for which it was not designed or constructed;

2.35.4 enter a toilet that is set aside for use of the opposite sex except:(a) where a child under the age of

eight years is accompanied by an adult parent or guardian of that sex; or

(b) to provide assistance to a disabled person; or

(c) in the case of a genuine emergency.

 2.36 TradingSell, buy, offer or display anything for sale.

 2.37 Vehicles2.37.1 Repair, wash, paint, panel beat or

carry out other work to a vehicle, except for running repairs in the case of a breakdown.

 2.38 Weddings, Functions and Special Events

2.38.1 Hold, conduct or participate in a marriage ceremony, funeral or special event.

2.38.2 Erect a marquee, stage or structure for the purpose of holding or conducting a wedding, funeral or special event.

2.38.3 Hold or conduct any filming where the filming is for a commercial purpose.

 2.39 Closed Lands2.39.1 Enter or remain on any part of Local

Government Land at any time during which the Council (or a person authorised by the Council by resolution for that purpose) has declared that part to be closed to the public and which is indicated by a sign to that effect;

2.39.2 where entry fees or charges are payable, without paying those fees or charges; or

2.39.3 where the land has been enclosed by fences and/or walls and gates that have been closed and locked.

3. Prohibited ActivitiesA person must not do any of the following on Local

Government Land.3.1 Animals

3.1.1 Cause or allow any animal to enter, swim, bathe or remain in any waters to the inconvenience, annoyance or danger of any other person bathing or swimming.

3.1.2 Cause or allow an animal to damage a flowerbed, garden plot, tree, lawn or like thing or place.

3.1.3 Lead, herd or exercise a horse in such manner as to cause a nuisance or endanger the safety of a person.

3.2 EquipmentUse any item of equipment, facilities or property belonging to the Council other than in the manner and for the purpose for which it was designed, constructed or intended to be used or in such manner as is likely to damage or destroy it.

3.3 Fishing3.3.1 Fish in any Waters on land to which this

subparagraph applies. 3.3.2 Fish from a bridge or other structure on

land to which this subparagraph applies3.4 Glass

Wilfully break any glass, china or other brittle material.

3.5 Interference with LandInterfere with, alter or damage the land (including a building, structure or fixture located on the land) including:3.5.1 altering the construction or arrangement

of the land to permit or facilitate access from an adjacent property;

3.5.2 erecting or installing a structure in, on, across, under or over the land;

3.5.3 changing or interfering with the construction, arrangement or materials of the land;

3.5.4 planting a tree of other vegetation on the land, interfering with the vegetation on the land or removing vegetation from the land; or

3.5.5 otherwise use the land in a manner contrary to the purpose for which the land was designed to be used.

3.6 Interference with Permitted UseInterrupt, disrupt or interfere with any other person’s use of Local Government Land which is permitted or for which permission has been granted.

3.7 Nuisance

Behave in such a manner as to cause discomfort, inconvenience, annoyance or offence to any other person.

3.8 Playing GamesPlay or practice a game:3.8.1 which is likely to cause damage to the

lands or anything in it;

3.8.2 in any area where a sign indicates that the game is prohibited.

3.9 SmokingSmoke, hold or otherwise have control over an ignited Tobacco Product: 3.9.1 in any building;3.9.2 in any Children’s Playground; or3.9.3 on any land to which this subparagraph

applies. 3.10 Throwing objects

Throw, roll, project or discharge a stone substance or other missile, excluding sport and recreational equipment designed to be used in that way.

 3.11 SolicitationTout or solicit customers for the parking of vehicles or for any other purpose whatsoever.

 3.12 Waste3.12.1 Deposit or leave thereon:

(a) anything obnoxious or offensive;(b) any offal, dead animal, dung or

filth; or(c) any mineral, mineral waste,

industrial waste or bi-products.3.12.2 Foul or pollute any waters situated

thereon.3.12.3 Deposit any rubbish other than in

receptacles provided by the Council for that purpose.

3.12.4 Deposit in a receptacle any rubbish emanating from domestic or trade purposes, unless designated by a sign or signs.

4. Directions4.1 A person on Local Government Land must

comply with a reasonable direction from an authorised person relating to:4.1.1 that person’s use of the land;4.1.2 that person’s conduct and behaviour on

the land;4.1.3 that person’s safety on the land; or4.1.4 the safety and enjoyment of other

persons on the land.4.2 A person who, in the opinion of an authorised

person, is likely to commit or has committed, a breach of this by-law must immediately comply with a direction of an authorised person to leave that part of local government land.

5. Removal of Animals and ObjectsAn authorised person may remove an animal or

object that is on Local Government Land in breach of a by-law if no person is in charge of, or apparently in charge of, the animal or object.6. Exemptions

6.1 The restrictions in this by-law do not apply to a police officer, emergency worker, Council officer or employee acting in the course and within the scope of that persons normal duties, or to a contractor while performing work for the Council and while acting under the supervision of a Council officer.

6.2 The restrictions in Clauses 8.1, 8.7, 8.16 and 8.31 of this by-law do not apply to electoral matter authorised by a candidate and which is:6.2.1 related to a Commonwealth or State

election and occurs during the period

commencing on the issue of the writ or writs for the election and ending at the close of polls on polling day; or

6.2.2 related to an election under the Act or the Local Government (Elections) Act 1999 and occurs during the period commencing four weeks immediately before the date that has been set (either by or under either Act) for polling day and ending at the close of voting on polling day; or

6.2.3 related to, and occurs during the course of and for the purpose of a referendum.

by-law only apply in such part or parts of the Council area as the Council may by resolution direct in accordance with section 246 (3) (e) of the Act.

By-law No. 4—RoadsA by-law to regulate certain activities on roads in the Council’s area.1. Interpretation

In this by-law, unless the contrary intention appears:

1.1 Camp includes setting up a camp, or causing a tent, caravan or motor home to remain on the land for the purpose of staying overnight, whether or not any person is in attendance or sleeps on the land;

1.2 Effective Control means a person exercising effective control of an animal either:1.2.1 by means of a physical restraint;1.2.2 by command, the animal being in close

proximity to the person, and the person being able to see the animal at all times;

1.3 Electoral Matter has the same meaning as in the Electoral Act 1995 provided that such electoral matter is not capable of causing physical damage or injury to a person within its immediate vicinity;

1.4 Emergency Worker has the same meaning as in the Road Traffic (Road Rules—Ancillary and Miscellaneous Provisions) Regulations 1999;

1.5 Vehicle has the same meaning as in the Road Traffic Act 1961.

2. Activities Requiring PermissionA person must not do any of the following activities

on a Road without the permission of the Council:2.1 Advertising

Display any sign other than a moveable sign which is displayed on a Road in accordance with the Council’s Moveable Signs By-law.

2.2 AmplificationUse an amplifier or other device whether mechanical or electrical for the purpose of broadcasting announcements or advertisements.

2.3 Animals2.3.1 Cause or allow any animal to stray onto,

move over, graze or be left unattended on any road.

2.3.2 Lead, herd or exercise any animal in such a manner as to cause a nuisance or endanger the safety of any person.

2.3.3 Lead or drive any horse, cattle, sheep or other like animal except on a road where the Council as set aside a track or other area for the use by or in connection with an animal of that kind.

2.4 Camping and Tents

By-law No. 5—Moveable SignsA by-law to set standards for Moveable Signs on roads and to provide conditions for the placement of such signs.

PART 1—PRELIMINARY1. Interpretation

In this by-law, unless the contrary intention appears:

1.1 Authorised Person has the same meaning as in the Local Government Act 1999;

1.2 Banner means a strip of cloth hung up or carried on a pole, fence or other structure and includes a feather banner;

1.3 Boundary means that line between private property and the Road or Road Related Area;

1.4 Business Premises means premises from which a business is being conducted;

1.5 Footpath Area means:1.5.1 that part of a road between the property

boundary of the road and the edge of the carriageway on the same side as that boundary;

1.5.2 a footway, lane or other place made or constructed for the use of pedestrians and not for the use of vehicle;

1.6 Local Government Land means land owned by the Council or under the Council’s care, control and management;

1.7 Moveable Sign has the same meaning as in the Local Government Act 1999;

1.8 Road has the same meaning as in the Local Government Act 1999;

1.9 Road Related Area has the same meaning as in the Road Traffic Act 1961 and the Australian Road Rules 1999;

 1.10 Vehicle has the same meaning as in the Road Traffic Act 1961.

PART 2—MOVEABLE SIGNS2. Construction and Design

A Moveable Sign displayed on a Road must:2.1 be of kind known as a ‘A’ frame or sandwich

board sign, an ‘inverted ‘T’ sign, or a flat sign or, with the permission of the Council, a sign of some other kind;

2.2 be designed, constructed and maintained in good quality and condition so as not to present a hazard;

2.3 be of strong construction and sufficiently stable so as to be able to keep its position in adverse weather conditions;

2.4 have no sharp or jagged edges or corners;2.5 not be unsightly or offensive in appearance or

content;2.6 not rotate or contain flashing parts;2.7 be constructed of timber, metal, plastic or

plastic coated cardboard, or a mixture of such materials;

2.8 not exceed 1 200 mm in height, 800 mm in width and 800 mm in depth;

2.9 in the case of an ‘A’ frame or sandwich board sign:2.9.1 be hinged or joined at the top;2.9.2 be of such construction that its sides are

securely fixed or locked in position when erected; and

 2.10 in the case of an ‘inverted ‘T’ sign, not contain struts or members that run between the display area and the base of the sign.

3. PlacementA Moveable Sign must not be:

3.1 placed on any part of a Road apart from the Footpath Area;

3.2 placed on a Footpath Area that is less than 2.5 m wide;

3.3 placed closer than 1 200 mm from another structure, fixed object, tree, bush, plant or thing (including another Moveable Sign);

3.4 placed within 1 m of an entrance to any Business Premises;

3.5 placed on the sealed part of a Footpath Area, if there is an unsealed part on which the sign can be placed in accordance with this by-law;

3.6 placed so as to interfere with the reasonable movement of persons or Vehicles using the Footpath Area or Road in the vicinity of where the Moveable Sign is placed;

3.7 placed closer than 500 mm to the kerb (or, if there is no kerb, to the edge of the carriageway of the Road or the shoulder of the Road, whichever is the greater;

3.8 placed on a landscaped area, other than landscaping that comprises only lawn;

3.9 placed within 6 m of an intersection of two or more Roads;

 3.10 placed on a Footpath Area with a minimum height clearance from a structure above it of less than 2 m;

 3.11 placed on a designated parking area or within 1 m of an entrance to premises;

 3.12 tied, fixed or attached to, any other structure, object or thing (including another Moveable Sign);

 3.13 displayed during the hours of darkness unless it is clearly lit; or

 3.14 placed in such a position or in such circumstances that the safety of a user of the Footpath Area or Road is at risk.

4. Restrictions4.1 The owner or operator of a business must not

cause or allow to be displayed on the Footpath Area of a Road at any time more than one Moveable Sign for each business premises of the owner or operator.

4.2 A person must not without the Council’s permission on Local Government Land display a Moveable Sign on or attached to or leaning against a vehicle that is parked primarily for the purpose for advertising (including for sale) a product or business to which the sign relates.

4.3 A person must not cause or allow a Moveable Sign to be placed on a Footpath Area unless:4.3.1 it only displays material which

advertises a business being conducted on premises adjacent to the Moveable Sign or the goods and services available from that business; and

4.3.2 the business premises to which it relates is open to the public.

4.4 If in the opinion of the Council a Footpath Area is unsafe for a Moveable Sign to be displayed the Council may prohibit or restrict the display of a Moveable Sign on such conditions as the Council thinks fit.

5. Exemptions5.1 Subclauses 3.11, 3.12, 4.3.1 and 4.3.2 of this

by-law do not apply to a Moveable Sign which:5.1.1 advertises a garage sale taking place

from residential premises;5.1.2 is a directional sign to an event run by a

community organisation or charitable body;

5.2 Subclauses 3.11 and 3.12 of this by-law do not apply to a flat sign which only contains a newspaper headline and the name of a newspaper or magazine.

5.3 A requirement of this by-law will not apply where the Council has granted permission for the Moveable Sign to be displayed contrary to that requirement.

5.4 This by-law will not apply to a Moveable Sign which is:5.4.1 placed on a road pursuant to an

authorisation under the Local Government Act 1999 or another Act; or

5.4.2 designed to direct people to the open inspection of any land or building that is available for purchase or lease; or

5.4.3 related to a State or Commonwealth election and is displayed during the period commencing on the issue of writ or writs for the election and ending at the close of polls on polling day; or

5.4.4 related to an election held under the Local Government Act 1999 or the Local Government (Elections) Act 1999 and is displayed during the period commencing four weeks immediately before the date that has been set (either by or under either Act) for polling day and ending at the close of voting on polling day.

PART 3—ENFORCEMENT6. Removal of Movable Signs

6.1 A person must immediately comply with an order of an Authorised Person made pursuant to section 227 (1) of the Act to remove a Moveable Sign.

6.2 The owner of or other person entitled to recover a Moveable Sign removed by an Authorised Person pursuant to section 227 (2) of the Act, may be required to pay to the Council any reasonable costs incurred by the Council in removing, storing, and disposing of the Moveable Sign before being entitled to recover the Moveable Sign.

6.3 The owner, or other person responsible for a Moveable Sign must remove or relocate the movable sign at the request of an Authorised Person:6.3.1 if, in the opinion of an Authorised

Person, and not withstanding compliance with this by-law, there is any hazard or obstruction or there is likely to be a hazard or obstruction arising out of the location of the Moveable Sign; or

6.3.2 for the purpose of special events, parades, roadwork’s or in any other circumstances which, in the opinion of the Authorised Person, require relocation or removal of the Moveable Sign to protect public safety.

This by-law was duly made and passed at a meeting of the District Council of Tumby Bay held on 14 February 2011, by an absolute majority of the members for the time being constituting the Council, there being at least two-thirds of the members present.

Port Vincent Development Plan Amendment—Draft for Public Consultation

NOTICE is hereby given that the District Council of Yorke Peninsula Port Vincent Development Plan Amendment (DPA) has been prepared by Council under the provisions of the Development Act 1993 and is now available for comment.

The draft DPA proposes the following changes to Port Vincent:

• Expanding the residential zone boundary approximately 350 m to the west of the existing boundary to allow the creation of some 700 additional allotments.

• Providing for a Light Industry zone of some 15-20 allotments adjacent to the existing water supply dam on Main Road.

• Introducing a concept plan for the above to ensure the rational development of the land and its integration with the existing township.

• Allowing land division to occur on land to the west of Marina Drive in the Port Vincent Marina. Land division in this zone is presently non-complying.

The draft Development Plan Amendment and Investigations will be available for public inspection from Thursday, 24 February 2011 until Wednesday, 27 April 2011 during normal office hours
