Canada Basketball and Wheelchair Basketball Canada are pleased to announce the release of “Back to Basketball”, a multi-phased guide to the safe resumption of basketball in Canada. The return to basketball will not be linear and will require flexibility, additional accommodations and responses as cases of COVID-19 in the community continue to develop.

The Canada Basketball Task Force states that "Our primary goal is to protect the health and safety of all players, coaches, officials, support staff, volunteers, spectators and everyone else returning to our cherished game, while preventing the spread of COVID-19, both on and off-the-court. This guide will provide relevant information for our Provincial/Territorial Sport Organizations (PTSO) members, sport partners and broader basketball community to safely resume basketball activities. In addition, the guide will utilize public gathering restrictions, social distancing and travel restrictions as outlined by local, provincial/territorial and federal guidelines, to determine the appropriate stages for the resumption of play."

PARTICIPANT SAFETY o Activities should not resume indoor/outdoor training sessions only as outlined in

these Return to Training Guidelines and in accordance with the public health guidance from the Department of Health and Community Services.

o All participants (athletes, coaches, etc.) must do the Self-Health questionnaire before they come to the venue (see appendix). This is not a one-time waiver; it should be done each time a participant comes to the venue. You (coaches, trainers, managers, athletes, etc.) will need to keep this waiver as a form of tracking your athletes if an outbreak occurs.

o Participants should be directed into the facility by a coach when it’s their time to enter the gym/facility. Players are encouraged to wait in their cars (with guardians), instead of forming a group (see appendix).

o Sport stakeholders should be aware of the non-medical mask (NMM) requirements that come into effect on August 24, 2020. Full information may be found at www.gov.nl.ca/covid-19/non-medical-masks-use-in-public/

o NMM must be worn inside the facility, however participants may remove their mask once the sport activity commences.

o Participants must not enter the court prior to the designated start time of their session to allow for the safe departure of the previous participants and the requisite cleaning.

o Participants must not enter the facility more than 5 minutes before their scheduled time on the court.

o All participants should be encouraged to arrive, train and depart in the most efficient way possible to minimize unnecessary contact.

o All participants must supply and use their own basketball. All basketballs are required to be sanitized before use.

o Sharing of basketballs or any equipment is now permitted in Alert Level 2. Basketballs and similar sport equipment may be shared during training as long as hand hygiene and equipment cleaning procedures are in place.

o Participants should limit the personal items they bring with them. Each item must be clearly marked, and not be shared with others:

o Basketball. o Water bottle(s) filled at home (Do not access water fountains or

bathroom/facility taps for filling water bottles). o Towel. o Sanitization product: Hydroalcoholic gel hand sanitizer and Disinfectant

wipes. o Areas where kit bags are stored should be disinfected between sessions. o All sessions are voluntary. Athletes cannot be suspended or punished if they do not

to attend.

Physical Distancing Measures o Two (2) meters of physical distancing (linear separation between individuals in all

directions) should be maintained at all times. This is equivalent to a minimum of 4 square meters of floor space per participant.

o Physical guides, such as signs and tape on floors, should be utilized, where possible, to encourage physical distancing in high traffic or waiting areas.

o No physical contact between any coach and any athlete. All instruction must be verbal and the coach needs to be at least 6 feet away from the athlete they are instructing.

o Unnecessary physical contact (high fives, handshakes, fist bumps, or hugs etc.) is prohibited.

Personal Hygiene o Participants must clean their hands with hydroalcoholic gel / hand sanitizer upon:

2. Entering/exiting the court; 3. During every break in training (water, rest etc.); 4. Upon departure from the facility, before entering their vehicle and arriving

home. o The use of personal protective equipment is mandatory (i.e. masks when arriving or

leaving, etc.) o Locker rooms are to remain closed until a later phase. Therefore, players should

arrive at the venue “dressed to play” and are encouraged to shower at home before and after each session.

o Participants are encouraged to use the washroom at home prior to leaving their homes. However, washrooms will be accessible, if required, but must be sanitized following each individual or group session.

FACILITIES o All facilities will have their own COVID-19 protocols and plan. Please make yourself

familiar with these before your first visit. o All training sessions must adhere to the indoor/outdoor recreation and sport

guidance established by the Provincial Government. o Physical distancing requirements must be met. Group size will depend on

facility/playing area size. o Activity can only take place if the organization has adequate supplies of hand

sanitizer, disinfectant wipes and, if specified, personal protective equipment. You will need to ensure this.

o Separate entry and exit routes, as well as corridor direction markings should be implemented. This applies to not only accessing the facility in general but also the court. Separate entry and exit routes will reduce the risk of contact between training groups.

o Dressing rooms and all common areas will remain inaccessible. o Toilet facilities may only be available for emergency cases and must be regularly

sanitized and monitored to ensure there are sufficient supplies. o Signage should be prominently displayed at the entrance(s) (based on government

issued materials where available) to inform participants of the health risks associated with COVID-19.

o Court scheduling for the departure of one group and the start of the next should be staggered by 30 minutes to allow time for sanitizing.

o Where possible, leave all doors open to remove/limit the use of touchpoints (door handles, push bars etc.). If this is not possible, touchpoints need to be cleaned following the conclusion of each session.

o While waiting to access the court, all participants should adhere to physical distancing requirements. These spaces should be clearly marked to ensure an orderly and safe space to wait.

Spectators o Spectators are prohibited at this time. o Where possible, participants should be dropped off and picked up outside of the

facility. Please note that this arrangement must not compromise safe sport guidelines (e.g. there must be 2 responsible and screened adults with a group of minors at any one time).

OUTBREAK PLAN Symptoms, Isolation and Reporting Early detection of symptoms will facilitate the immediate implementation of effective control measures.

The Group Leader must ensure that all participants are monitored for symptoms including the following of COVID-19:

o Fever (temperature ≥ 38°C) o New or worsening cough or shortness of breath o Runny nose, sore throat or diarrhea

Strategy for Participants showing symptoms:

o If ANY ONE of the symptoms related to COVID-19 are present, the individual must be immediately excluded from the group and sent home. (see protocol below)

o Siblings/family members who attend the same activity must also be excluded.

Group Leaders are required to:

o Isolate the individual with symptoms immediately from other members of the group into a designated health area.

o Move the others in the group to a safe space and ensure all equipment and shared spaces have been disinfected.

o Ensure supervision for the separated individual, while maintaining a physical distance of 2-meters if possible, by only one other designated person, until they leave. If necessary, although not required, both the individual showing symptoms and designated person should use PPE.

o The group leader will notify the parent(s) to arrange for immediate pick- up of the participant.

o Staff will document the symptoms observed, the date and time that symptoms occurred, and have the attendance log available for public health, if required.

o If isolation of the individual is required, ensure that measures are in place to inform parents/guardians and staff of the situation and of how important this control measure is. Proper isolation is one of the most important and effective measures in controlling the spread of disease to others. Parental and staff cooperation is critical.

If your association is notified that any participant has tested positive for COVID-19, the following steps should be taken:

o Call your local Public Health authority (if you haven’t already been contacted) to ensure an investigation is conducted and necessary measures are taken to notify each of the unwell individuals (i.e. other staff, children and close family). Public Health will provide advice and the steps necessary to control the outbreak.

o Notify the facility that was used to increase cleaning and disinfection practices. o Consult with Public Health to prepare and provide fact sheets and letters to

parents/guardians and staff about the situation and the response measures taken by the center.

FIRST AID AND COVID-19 o First aid providers caring for individuals with suspected COVID-19, should follow

standard precautions. If possible, have the unwell person place a mask over their nose and mouth and limit your contact by staying back at least 2 meters, if possible, until the individual is wearing a mask.

o Try to limit the number of individuals in contact with the unwell person, individuals who provide direct care for an individual who may have COVID-19 should wear a mask and gloves.

o Following care, first aid providers should discard masks and gloves and perform proper hand hygiene protocols.

o With respect to lifesaving, it should be noted that the Heart and Stroke guidelines state that hands-only CPR may be provided, if there are concerns about COVID-19 transmission. For more information visit www.heartandstroke.ca/articles/modification-to-hands-only-cpr-during-the-covid-19-pandemic.

COMMUNICATION o NLBA Back to Basketball Guidelines should be made available to all members and

participants in your program.

o Ensure participants are aware of any additional requirements for each facility they will be accessing.

o Updates should be sent to all participants any time new information or changes have been made.

o Restarting is not mandatory at this point- each club and organization must assess and decide for itself when and whether it is appropriate to restart operations.

o If your club is spot checked and these procedures are not in place, then you can be closed down, void your insurance policy and your standing with the NLBA.

RETURN TO BASKETBALL PHASES PHASE 1: Education & Individual Training begins:

Clubs may resume outdoor training sessions only as outlined in these Return to Training Guidelines and in accordance with the public health guidance from the Department of Health and Community Services.

o Individual skills work:

o No sharing of equipment (“One player, one ball, one basket”). No passing.

o Non-contact training.

o Individual shooting / dribbling challenges at own baskets permitted. Players must retrieve their own basketball or use alternative methods (i.e. avoid touching with hands, use feet, etc.) to return basketballs to fellow players.

o No competition.

o Physical distancing (2 meters / 6 feet) measures maintained.

o The maximum number in this phase is restricted to 1 player per basket while maintaining physical distancing / adherence to local gathering restrictions.

o No spectators.

o Failure to meet these conditions may void your insurance policy and your standing with the NLBA.

PHASE 2: Individual Training Continues and Begin Small Group Training: Clubs may resume indoor/outdoor training sessions only as outlined in these Return to Training Guidelines and in accordance with the public health guidance from the Department of Health and Community Services.

o Small group skills and drills development:

o Basketballs and similar sport equipment may be shared during training, as long as hand hygiene and equipment cleaning procedures are in place.

o Non-contact training.

o Shooting / dribbling challenges at own baskets permitted. Players must retrieve their own basketball or use alternative methods (i.e. avoid touching with hands, use feet etc.) to return basketballs to fellow players.

o No competition.

o Adhere to local public gathering restrictions: Consistent training groups (to allow for contact tracing).

o Physical distancing (2 meters / 6 feet) measures maintained.

o No spectators.

o The maximum number in this phase is restricted to 2 players per basket while maintaining physical distancing / adherence to local gathering restrictions.

o Failure to meet these conditions may void your insurance policy and your standing with the NLBA.

PHASE 3: Whole Team Split Training Sessions Begin; Internal 3x3 Team Competition Permitted

o Divide the whole team into small, consistent groups for skills/concept development. o Maximum 2 hours per session. Consistent training groups for phase (to allow for

contact tracing) E.g. 2 baskets, 20 players + 2 coaches (2 separate groups of 10 players + 1 coach) E.g. 4 baskets, 24 players + 4 coaches (4 separate groups of 6 players + 1 coach).

o Drills or activities could include: Partner shooting, small sided games, 5v0 play

o Internal 3x3 drills / competition begins in preparation for internal 5v5 competition. Team divided in 2 training groups e.g. team of 12 divided into 4 teams of 3. Team A vs. Team B (consistent) and Team C vs. Team D (consistent)

o Appropriate warm up / cool down o Sharing of equipment within only the divided teams/ consistent groups begins;

passing allowed. o Physical distancing no longer required within divided teams; however, whenever

possible, is recommended (i.e. water/nutrition break, timeouts etc.). o Light contact during 3x3 games permitted within divided teams.

PHASE 4: Whole Team Training Sessions: Internal Team 5v5 Competition Permitted

Whole Team Training (Internal 5v5 team competition) begins. Progress to this phase is dependent on provincial regulations.

o Whole team is permitted to practice; no limit on players, coaches and staff. However, must continue to adhere to local public gathering restrictions. 25 people coaches included per court at Newfoundland and Labrador Sports Centre.

o Divide the whole team in half (based on internal teams) for skills/concept development. Maximum 2 hours per session. Drills or activities could include: Partner shooting, small sided games, 5v0 play, transition offence and defense. Internal 5v5 competition begins in preparation for local competition.

o Sharing of equipment continues; passing allowed. o Physical distancing no longer required; however, whenever possible, physical

distancing is recommended. o Contact permitted. o Essential basketball team staff/personnel only permitted in the gym, as determined

on a team-by team basis. Absolutely no spectators. o If someone in the consistent training group develops COVID-19 symptoms, they

should alert a designated member of the coaching staff and consult a COVID-19 assessment Centre. Other participants (athletes and coaches) within that consistent training group should monitor for symptoms and consult a COVID-19 assessment Centre. That training pod is shut down for 14 days or until all members are cleared to return.

PHASE 5: Whole Team Training Sessions; Local Competition Resumes

Whole Team Training Continues; Local Competition begins. Progress to this phase is dependent on provincial regulations.

o Whole team is permitted to practice without restrictions. Local public gathering restrictions removed.

o Local 5v5 competition permitted. Teams develop a pool of consistent opponents to face and ensure each team has: Followed a phased approach: Have not travelled outside Canada. No players, staff etc. with COVID-19 symptoms. Ensure appropriate training to competition ratios are in place.

o Safe integration of officials when competition resumes. Additional details specifically on official’s safety will be integrated in a future version of this document that addresses competition safety protocols.

o Sharing of equipment continues; passing allowed. o Physical distancing no longer required. o No Spectators permitted for competition at this point. o If someone in the consistent training group develops COVID-19 symptoms, they

should alert a designated member of the coaching staff and consult a COVID-19 assessment Centre. Other participants (athletes and coaches) within that consistent training group should monitor for symptoms and consult a COVID-19 assessment Centre. That training pod is shut down for 14 days or until all members are cleared to return.

IMPORTANT REMINDERS o Take part in a COVID-19 information session with the NLBA prior to resuming NLBA Club

programming. o Adhere to ALL public health restrictions in your community (e.g. maximum group

gatherings, facility access). o Review the Training Checklist. o Complete the Club Risk Assessment and Club Mitigation Checklist? (see appendix) o Participants and Guardians should complete participation waiver (Declaration of

Compliance and Informed consent and assumption of risk agreement). (see appendix)

o Obtain contact information for all participants prior to the start of any programming to ensure ease of contact can be made by Public Health in case of the need for contact tracing.

o All participants (athletes and coaches) should complete a Self-Heath Check prior to activity (see appendix)

o Keep self-health cards as a form of attendance which must be kept for tracking purposes for Public Health records.

o Educate all staff and coaches on COVID-19 symptoms and the Return to Play procedures.

o Consult with each facility you will be using to find out what their operational plan entails in terms of expectations for movement and travel in and out of building and shared spaces? All facilities will have their own COVID-19 protocols and plan. Please make yourself familiar with these before your first visit.

o Basketball activities should be skill development only. Competition will return at a later phase.

o NLBA Back to Basketball Guidelines should be made available to all members and participants in your program.

o Clear instructions, guidelines and all relevant information required for the safe participation should be sent to all members prior to the beginning of any programming.

o Ensure participants are aware of any additional requirements for each facility they will be accessing.

o Updates should be sent to all participants any time new information or changes have been made.

o Restarting is not mandatory at this point- each club and organization must assess and decide for itself when and whether it is appropriate to restart operations.

DAILY CHECKLIST FOR TRAINING

� Follow all national, provincial health and NLBA Return to Basketball Guidelines. � In order to participate, all athletes must sign a participation waiver that makes it clear

they and their parents understand the dangers associated with participation in a sport and the dangers presented by the pandemic. This would be outside any waivers that the provincial sport organization or the specific facility may require.

� Gather contact information for all participants, prior to the start of any programming to ensure ease of contact can be made by Public Health, in case of the need for contact tracing.

� All sessions are voluntary, athletes cannot be suspended or disciplined if they choose not to attend.

� All activities must have a 30-minute break between them, which allows for athletes to enter and exit without there being a commotion or a large number of individuals in any common space.

� Athletes must respect start times and not arrive more than 5 minutes before start time, parents must respect departure times and arrive within 5 minutes of that time. If for any reason you are not able to respect this, it is better that the athlete does not attend on that day.

� Follow all facility regulations regarding flow of participants, cleaning etc. Ensure a safe flow of people in and out, that maintains physical distancing throughout. All facilities will have their own COVID-19 protocols and plan. Please make yourself familiar with these before your first visit.

� Parents may walk athletes to the door of the facility but may not enter. If the athletes are older, it is preferred that the parent remains in their vehicle upon drop off and pick up.

� You must have a coach or representative at the door to help all athletes enter safely, restrict non-participants from entering and collect daily health check cards or attestation forms.

� In order to take part in any session, an athlete must present a completed self-health check card or attestation form when they enter the facility. No athlete is permitted to participate if they do not. The self-health check card, represents an immediate attendance check and must be saved and the date and time referenced, in case contact tracing becomes necessary. Anyone who answers yes to any question, must refrain from attending until they can answer no for all questions, or if they have COVID-19, until they are fully recovered and have a medical clearance from a doctor to return. The same is true, if anyone in their household has the virus or a symptom(s).

� Start every session with a reminder about: o no physical contact

o no sharing o no touching of the face or nose o during every water break, all athletes must sanitize their hands and towel

dry all sweat. o Avoid touching, leaning or sitting on any surface during the session that is

not necessary. � All athletes must have and not share – a basketball, a towel, hand sanitizer and a water

bottle. Breaks for cleaning and water must be provided at least every 20 minutes. All items brought in must be stored in one’s own basketball bag and never laid down on any surface. There needs to be a separate space for bag storage that allows for proper spacing. It is preferable if this area can be identified.

� No physical contact between any coach and any athlete is permitted, all instruction must be verbal and coaches need to be at least 6 feet away from the athlete they are instructing.

� No spectators are permitted. � Post session, ensure that the bag storage area, any equipment and any area that comes

in contact with athletes is adequately cleaned using Health Canada approved products. If possible, sanitizing the floor between sessions is advisable.

FREQUENTLY ASKED QUESTIONS 1. Is outdoor training safer than indoor training?

o Yes, droplet transmission is more likely to happen in contact in an indoor setting. Transmission is less likely in an outdoor setting, where there is more space to maintain physical distance.

2. How often do participants and staff, coaches etc. need to complete a Health Declaration?

o Prior to every session

3. Why do we have to fill out a Health Check form every time we go to basketball?

o Symptoms and individual situations are changing daily, you could be feeling fine one day and not the next. It is important to monitor and assess your health every day.

4. What types of activities are not allowed during this phase (Level 2)?

o Activities that cannot maintain physical distancing (e.g. contact activities) Activities that have a higher risk of injury. Activities that encourage or require a large group gathering. Activities that require travel

5. Is it better for a player to use their own ball or have the organization provide one?

7) The Participant has not, nor has any member of the Participant’s household, travelled to or had a

lay-over in any country outside Canada, or in any Province outside of NL in the past 14 days. If the Participant travels, or if anyone in the Participant’s household travels, outside the Province of NL after submitting this Declaration of Compliance, the Participant will not attend any of the Organization’s activities, programs or services until at least 14 days have passed since the date of return.

8) The Participant is following recommended guidelines, including but not limited to, practicing physical distancing, trying to maintain separation of six feet from others, frequent handwashing, and otherwise limiting exposure to COVID-19.

9) The Participant will follow the safety, physical distancing and hygiene protocols of the Organization.

10) This document will remain in effect until the Organization, per the direction of the provincial government and provincial health officials, determines that the acknowledgements in this Declaration of Compliance are no longer required.

11) The Organization may remove the Participant from participation in the activities, programs or services of the Organization at any time and for any reason if the Organization believes, in its sole discretion, that the Participant is no longer in compliance with any of the compliance standards described in this document.

b) The Organization may offer or promote online programming (such as webinars, remote conferences, workshops, and online training) which have different foreseeable and unforeseeable risks than in-person programming;

c) The Organization has a difficult task to ensure safety and it is not infallible. The Organization may be unaware of my fitness or abilities, may misjudge weather or environmental conditions, may give incomplete warnings or instructions, and the equipment being used might malfunction; and

COVID-19 d) The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health

Organization and COVID-19 is extremely contagious. The Organization has put in place preventative measures to reduce the spread of COVID-19; however, the Organization cannot guarantee that I will not become infected with COVID-19. Further, participating in the Activities could increase my risk of contracting COVID-19.

4. I am participating voluntarily in the Activities. In consideration of my participation, I hereby acknowledge that I am aware of the risks, dangers and hazards associated with or related to the Activities. The risks, dangers and hazards include, but are not limited to:

a) Contracting COVID-19 or any other contagious disease; b) The sport of basketball; c) Privacy breaches, hacking, technology malfunction or damage while interacting with online training; d) Executing strenuous and demanding physical techniques;

equipment; k) Serious injury to virtually all bones, joints, ligaments, muscles, tendons and other aspects of my body or

to my general health and well-being; l) Abrasions, sprains, strains, fractures, or dislocations; m) Concussion or other head injuries, including but not limited to, closed head injury or blunt head trauma; n) Spinal cord injuries which may render me permanently paralyzed; o) Negligence of other persons, including other spectators or, participants, or employees; p) Travel to and from competitive events and associated non-competitive events which are an integral part

of the Activities; and q) Negligence on the part of the Organization, including failure by the Organization to take reasonable steps

to safeguard or protect me from the risks, dangers and hazards associated with my participation in the Activities.

� I have read and agree to be bound by paragraphs 3-4

Terms 5. In consideration of the Organization allowing me to participate in the Activities, I agree:

a) That when I practice or train in my own space, I am responsible for my surroundings and the location and equipment that I select;

b) That my mental and physical condition is appropriate to participate in the Activities and I assume all risks related to my mental and physical condition;

c) To comply with the rules and regulations for participation in the Activities; d) To comply with the rules of the facility or equipment; e) That if I observe an unusual significant hazard or risk, I will remove myself from participation and bring my

observations to a representative of the Organization immediately; f) The risks associated with the Activities are increased when I am impaired and I will not to participate if

impaired in any way; g) That it is my sole responsibility to assess whether any Activities are too difficult for me. By commencing an

Activity, I acknowledge and accept the suitability and conditions of the Activity; h) That COVID-19 is contagious in nature and I may be exposed to, or infected by, COVID-19 and such

exposure may result in personal injury, illness, permanent disability, or death; and i) That I am responsible for my choice of safety or protective equipment and the secure fitting of that

equipment.

Release of Liability and Disclaimer

6. In consideration of the Organization allowing me to participate, I agree: a) That the sole responsibility for my safety remains with me; b) To ASSUME all risks arising out of, associated with or related to my participation; c) That I am not relying on any oral or written statements made by the Organization or its agents, whether in

a brochure or advertisement or in individual conversations, to agree to participate in the Activities; d) To WAIVE any and all claims that I may have now or in the future against the Organization;

f) To FOREVER RELEASE AND INDEMNIFY the Organization from any and all liability for any and all claims, demands, actions, damages (including direct, indirect, special and/or consequential), losses, actions, judgments, and costs (including legal fees) (collectively, the “Claims”) which I have or may have in the future, that might arise out of, result from, or relate to my participation in the Activities, even though such Claims may have been caused by any manner whatsoever, including but not limited to, the negligence, gross negligence, negligent rescue, omissions, carelessness, breach of contract and/or breach of any statutory duty of care of the Organization;

g) To FOREVER RELEASE AND INDEMNIFY the Organization from any action related to my becoming exposed to or infected by COVID-19 as a result of, or from, any action, omission or negligence of myself or others, including but not limited to the Organization;

h) That the Organization is not responsible or liable for any damage to my vehicle, property, or equipment that may occur as a result of the Activities;

i) That negligence includes failure on the part of the Organization to take reasonable steps to safeguard or protect me from the risks, dangers and hazards associated with the Activities; and

j) This release, waiver and indemnity is intended to be as broad and inclusive as is permitted by law of the Province of Newfoundland and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Jurisdiction 7. I agree that in the event that I file a lawsuit against the Organization, I will do so solely in the Province of

Newfoundland Labrador and further agree that the substantive law of the Province of Newfoundland Labrador will apply without regard to conflict of law rules.

b) That the Participant’s mental and physical condition is appropriate to participate in the Activities and the Parties assume all risks related to the Participant’s mental and physical condition;

c) To comply with the rules and regulations for participation in the Activities; d) To comply with the rules of the facility or equipment; e) That if the Participant observes an unusual significant hazard or risk, the Participant will remove

themselves from participation and bring their observations to a representative of the Organization immediately;

f) The risks associated with the Activities are increased when the Participant is impaired and the Participant will not participate if impaired in any way;

g) That it is their sole responsibility to assess whether any Activities are too difficult for the Participant. By the Participant commencing an Activity, they acknowledge and accept the suitability and conditions of the Activity;

6. In consideration of the Organization allowing the Participant to participate, the Parties agree: a) That the Parties are not relying on any oral or written statements made by the Organization or

their agents, whether in brochure or advertisement or in individual conversations, to agree to participate in the Activities;

b) That the Organization is not responsible or liable for any damage to the Participant’s vehicle, property, or equipment that may occur as a result of the Activities; and

c) That this Agreement is intended to be as broad and inclusive as is permitted by law of the Province of Newfoundland and if any portion thereof is held invalid, the balance shall, notwithstanding, continue in full legal force and effect.

Jurisdiction

7. The Parties agree that in the event that they file a lawsuit against the Organization, they agree to do so solely in the Province of Newfoundland and they further agree that the substantive law of the Province of Newfoundland will apply without regard to conflict of law rules.
