Gandhi Dear Members, A recent communication from the President of ICAI mentions that the current growth trend in the profession is more towards industry and less towards practice. As per the statistics available, during 2005, out of 7,455 Chartered Accountants who qualified, only about 17% obtained Certificate of Practice and the remaining 83% opted for employment. This trend towards more CAs joining industry has adversely affected practising Chartered Accountants and medium-sized firms who are faced with a high staff turnover. This is because these firms cannot match the remuneration levels offered by the industry or even by bigger firms. Since the industry (especially the service sector) is booming, this scenario is not likely to undergo a change in the near foreseeable future. To overcome this difficulty, it is time for the small and medium firms to re-evolve and come together with like-minded firms through ‘networking’ and ‘mergers’. This is also necessitated to keep abreast with new legislations being introduced and numerous amendments being carried out to existing laws. The months of May/June are generally the time when such medium and small firms do not have heavy work pressure. This is, therefore, the most appropriate time to hold discussions with other firms and carry out integration, so that the work pressure from July onwards can be handled better. This will also help these firms to service their clients better, to attract new clients and also other CAs to work with them. ‘E Filing’

Information Technology has managed to pervade almost all aspectsof our professional life. It is no longer just a tool to improve efficiency,but is an integral part of contemporary practice. One major advantageof the technology is that it removes human subjectivity and brings inuniformity and transparency. Thus, taxpayers and practitioners can relyon a system where human intervention is minimised, reducing bias,subjectivity and chances of abuse by vested interests.

In recent times, the Government has invested large sums to createTax Information Network. As professionals, we have become familiarwith ETDS returns and Online PAN & TAN applications. Yet there ismuch more in store, for instance, the recent initiative with MCA-21.

Keeping these developments in mind, the Bombay CharteredAccountants’ Society has designed a full-day seminar which willencompass not only ETDS, but E filing under MCA-21 and servicetax and excise returns. The workshop will be conducted by eminentpersonalities. We also intend to invite the Registrar of Companies andsenior persons with hands-on experience from NSDL, and Service TaxDepartment.

The Right to Information Clinic (RTI Clinic) is headed by Mrs.Hema Sampat, a research scholar on the subject of RTI. TheClinic has two RTI activists, Mr. Kewal Semlani and Mr.Shailesh Gandhi as advisors. Mr. A. K. Asher, Advocate alsoassists in the working of the Clinic.

The Clinic provides help and guidance to BCAS members asalso to non-members, i.e., all citizens, for making applicationsunder the RTI Act and also assists in resolving any relateddifficulties on the subject of RTI.

The Clinic will operate twice a month from BCAS office at7, Jolly Bhavan No. 2, Ground floor, New Marine Lines,Mumbai-400020. (Tel. : 66595601-05).

The Reserve Bank of India has issued the following 3 circulars.

A.P. (DIR Series) Circular No. 31, dated April 21, 2006

Export of goods and services — Extension of period ofrealisation

Presently, authorised dealers are permitted to grant extension of timefor realisation of export proceeds beyond the prescribed period fromthe date of export where the invoice value does not exceed US $100,000.

This circular has increased this limit of US $ 100,000 to US $1,000,000. Thus, authorised dealers can now grant extension of timefor realisation of export proceeds beyond the prescribed period fromthe date of export where the invoice value does not exceed US $1,000,000.

A.P. (DIR Series) Circular No. 32, dated April 21, 2006

Remittance of initial and recurring expenses for branchoffices opened abroad

Presently, an Indian entity is permitted to remit up to 2% of its averageannual sales/income or turnover during the last two accounting yearstowards initial expenses and 1% of its average annual sales/incomeor turnover during the last two accounting years towards recurringexpenses.

This circular has increased the said limits of 2% and 1% to 10% and5%, respectively. Thus, an Indian entity can now remit up to 10% ofits average annual sales/income or turnover during the last twoaccounting years towards initial expenses and 5% of its averageannual sales/income or turnover during the last two accounting yearstowards recurring expenses.

Exim Bank’s Line of Credit of USD 50.40 million to the FijiSugar Corporation Limited, Fiji Islands

The Exim Bank has made available, subject to certain conditions, aLine of Credit (LOC) to the Fiji Sugar Corporation Limited, Fiji Islands,aggregating to US $ 50.40 million for financing exports from India, ofequipment, goods and services which are eligible for export under theForeign Trade Policy of the Government of India, for modernisation,upgradation and capacity expansion of sugar plants of the Fiji SugarCorporation Limited in Fiji Islands.

The terminal utilisation period is 48 months from the scheduled dateof contract in case of project exports and 72 months from the dateof execution of the Credit Agreement in case of other supply contracts.

We, at BCAS, had an encouraging response to the Study Circlestarted for Women CAs at the convenient timing of 11.00 a.m.— 1.00 p.m. The She-CA Study Circle for the year 2006 startedon 21st April 2006, where the topic dealt with was Understandingthe Finance Act, 2006.

After taking consensus of the members present at the meeting,it has been decided to focus on two core areas of practice tohelp sharpen our skills viz. Taxation Aspects for Individuals (withspecial focus on high net worth individuals) and Service Taxrelating to selected industries.

The second meeting of this Study Circle has been fixed onFriday, 9th June 2006 between 11.00 a.m. to 1.00 p.m. asunder :
