AG OPINION & CRIMINAL IMMUNITY CLAUSE MISSING INACTON

Los Angeles , CA The Full Disclosure Network has been investigatingCalifornia Senate Bill SBX2 11 that was enacted into law on February 20, 2009and became part of Government Code Sections 68220 on May 21, 2009. Thiscontroversial bill, signed into law by Governor Arnold Schwarzenegger, wasintended to legalize "Double Benefits" for Judges and was inserted into part ofthe budget package this February and was intended to legalize the "doublepayments" being made to California Judges by the county governments.

NO DEBATE BU T LOTS OF SECRECYThere was no debate or public scrutiny of the bill prior to the vote. Thesecounty payments to Judges were ruled illegal in an appellate court decision ina case brought by the Judicial Watch organization in Sturgeon v. County of LosAngeles that held the Judges are State employees who were not entitled to"double benefits" from the county due to a Constitutional Provision that Judgessalaries and benefits are to be set by the legislature and cannot be delegated.

WHY MISSING PARAGRAPHS ON CRIMINAL IMMUNITY?

Most notably three important paragraphs in SBX2 11 were missingfrom Government Code Sections 68220, 68221,68222. These paragraphsincluded the most critical and controversial part of the bill, that being thatCalifornia Judges and county government officials were given retroactiveimmunity from criminal prosecution and civil liability for crimes committedprior to May 21, 2009. What the bill doesn't say is what happens to the crimescommitted after May 21st 2009? Is cr iminal behavior for governmentoff icials now legal?

CHALLENGING JUDI CAL PAYMENTSRichard I. Fine was sentenced indefinitely forCivil Contempt of Court by Judge David Yaffe,whom he alleges testified in court on December22, 2008 that he had received the illegal"benefits" payments from the County and hadfailed to disclose this fact to interested partiesin Court, as well as omitting it from hisEconomic Disclosure Form 700. Mr. Fine hadattempted to disqualify Judge Yaffe from thecase before him, M a r i n a St r a n d Co l o n y I I Ho m e o w n e r s A s s o ci a t i o n v . Co u n t y o f L o s A n g e l e s . After seven months in jail Fine hasappealling for his release all the way up to theU S Ninth Circuit Court, acting as his ownattorney.
