    The NCAA’s March Madness is just about over, with tattered brackets and crushed dreams of winning the office pool all that remains. The FCBA, as always, has its own lineup of stellar programming to keep you occupied and entertained as the nights get shorter and the days get warmer.

    On April 6, the FCBA’s Congressional reception will take place from 6:00 – 8:00 p.m. at the Hyatt Regency Capitol Hill. We had over 100 Congressional Members and staff at our last reception, we’re hoping for even more this year. Send in your form today.

    Be sure to sign up for the luncheon featuring FTC Chairman Jon Leibowitz and FCC Commissioner Robert McDowell on April 20. This special bipartisan, dual-agency joint appearance will offer some fascinating insights into the roles and responsibilities of the two agencies in the broadband era. We will also be celebrating the FCBA Foundation’s 20th birthday at the luncheon.

    And I know I do not need to remind anyone about the FCBA Annual Seminar on April 29 – May 1. If you have not registered yet, now is the time. Special thanks to the Annual Seminar Committee – Trish Paoletta, Mike Senkowski, Lisa Youngers, and Michele Farquhar – who have been hard at work on the Annual Seminar since last fall. We have a great line up on hand, including the Chief Judge of the D.C. Circuit, David Sentelle, FCC Commissioners Michael Copps and Mignon Clyburn, and NTIA Administrator Larry Strickling. I am excited about the breakfast CLE scheduled for Sunday morning: 40 Years in 60 Minutes, where each panelist will discuss a particular decade’s changes in the communications law field.

    I am pleased to announce that the FCBA’s Spring Reception will take place on May 24 at the Washington Hilton Hotel from 6:00 – 8:00 p.m., and we will announce the winner of the annual Excellence in Government Service award. I look forward to many of you joining us for this worthy tradition.

    Thanks to the diligent work of Bob Pettit and the entire Nominations committee (John Branscome, Matthew Brill, Kyle Dixon, Stacy Robinson Fuller, Angela Giancarlo, Anna Gomez, Christopher Guttman-McCabe, Luisa Lancetti, Melissa Newman, David O’Connor, Gigi Sohn, and Yaron Dori) for their great work in building next year’s team FCBA. Voting will commence in late April for the FCBA’s annual election of officers, executive committee members, nominations committee members, and the board of trustees for the FCBA Foundation. The list of the nominated candidates appears on page 3.

    This month, the Pay It Forward spotlight shines on Grace Koh, who has demonstrated the Pay It Forward ideals of service, dedication, and generosity of spirit. Grace, Policy Counsel at Cox Enterprises, is a tremendous young leader for the FCBA. She serves as one of the Pay It Forward coordinators for the FCBA’s partnership with Byte Back, helping to find “hands-on” ways for FCBA members to participate in closing the digital divide in DC. In addition, Grace serves on the DC Bar Steering Committee for the Computer & Telecommunications Law Section and volunteers at animal shelters in her spare time. For these efforts and her continued commitment to the FCBA, Grace has been selected for this month’s Pay It Forward spotlight.

    Wednesday, May 18, 6:00 – 8:15 p.m.Management of Federal Spectrum – A Guide to NTIA Procedures, Intersecting NTIA/FCC Issues, and Navigating the MazePresented by the Engineering and Technical Practice Committee

    The FCBA Engineering and Technical Practice Committee will hold a CLE on Wednesday, May 18, 2011 from 6:00 – 8:15 p.m. on Federal Government spectrum management practice and procedure. The CLE will focus on the relationship between the FCC and NTIA in managing non-Federal and Federal spectrum resources, and offer guidance on how to identify and navigate the FCC’s and NTIA’s overlapping jurisdictions.

    The first panel will focus on policy: the United States’ bifurcated spectrum management arrangement, underlying legal and administrative concepts, and the mechanisms through which FCC and NTIA interact to share their responsibilities. The second panel will focus on practice: how to recognize when a client’s plans may affect Federal spectrum users, and how to engage with NTIA and the spectrum-using federal agencies to reach a successful outcome.     Robert M. McDowell was first appointed to a seat on the Federal Communications Commission by President George W. Bush and unanimously confirmed by the Senate in 2006. When he was reappointed to the Commission on June 2, 2009, Commissioner McDowell became the first Republican to be appointed to an independent agency by President Barack Obama. He was unanimously confirmed by the Senate on June 25, 2009.

    During his time at the FCC, Commissioner McDowell has worked to help consumers in the communications marketplace enjoy the benefits of more choices, lower prices and useful innovations through increased competition. Creating opportunities for the construction of new delivery platforms that will bring about such competition has been one of his top priorities.

    Jon Leibowitz was sworn in as a Commissioner on September 3, 2004, and designated to serve as Chairman of the Federal Trade Commission on March 2, 2009, by President Barack H. Obama.

    During his tenure as Chairman, Leibowitz has focused on stopping scams that prey upon consumers suffering from the economic downturn; preserving competition in healthcare and blocking anticompetitive “pay-for-delay” patent settlements in the pharmaceutical industry; promoting competition and innovation in the technology sector through law enforcement and policy initiatives; and protecting consumers’ privacy—especially while they are using the Internet.

    In joining the Commission, Leibowitz resumed a long career of public service. He was the Democratic Chief Counsel and Staff Director for the U.S. Senate Antitrust Subcommittee from 1997 to 2000, where

The Wright masterpiece, nestled within the lush, wooded Bear Run Nature Reserve, was designed to rise above a waterfall and is a timeless monument to organic architecture. It is celebrating its 75th

    anniversary this year, with an announced theme of “Celebrating 75 Years of Art in Nature.” Fallingwater is the only major Wright work to come into the public domain with its setting, original furnishings, and artwork intact. So there is much to see.

    After chartered buses deliver our group to the site, we will lunch “on your own” on local sustainably-grown, organic, seasonal, homemade soups, sandwiches, salads, desserts and daily specials. Then, our group will be divided so that one knowledgeable guide can conduct about ten people on a tour of all of the major rooms of the house for about an hour. There is a rhythmic interplay between interior and exterior space due to the numerous terraces, open-air walkways and unexpected views of the trees and water as you move through the house.     FCBA Distinguished Speaker Series Program Featuring Geoffrey Stone on May 11The third in a series of programs featuring distinguished speakers will take place on Wednesday, May 11, 2011 from 6:00-8:00 p.m. at Davis Wright Tremaine LLP, 1919 Pennsylvania Avenue, NW. Geoffrey Stone, Edward H. Levi D i s t i n g u i s h e d Service Professor at the University of Chicago Law School, will be making a presentation on WikiLeaks and the First Amendment, followed by a question and answer session.     Geoffrey Stone has been a member of the law faculty since 1973. From 1987 to 1993, Mr. Stone served as Dean of the Law School, and from 1993 to 2002 he served as Provost of the University of Chicago. Mr. Stone received his undergraduate degree in 1968 from the University of Pennsylvania and his law degree in 1971 from the University of Chicago Law School, where he served as Editor-in-Chief of the Law Review. Mr. Stone served as a law clerk to Judge J. Skelly Wright of the U.S. Court of Appeals for the District of Columbia Circuit and to Justice William J. Brennan Jr. of the Supreme Court of the United States. Mr. Stone was admitted to the New York Bar in 1972.

    Mr. Stone teaches and writes primarily in the area of constitutional law. His most recent books are Top Secret: When Our Government Keeps Us in the Dark (2007) and War and Liberty: An American Dilemma (2007). Mr. Stone’s Perilous Times: Free Speech in Wartime from the Sedition Act of 1798 to the War on Terrorism (2004) received numerous national awards, including the Robert F. Kennedy Book Award for 2005, the Los Angeles Times Book Prize for 2004 as the best book in the field of history, the American Political Science Association’s Kammerer Award for 2005 for the best book in Political Science, the Hefner Award for the best book on the First Amendment, and Harvard University’s 2005 Goldsmith Award for the best book in the field of Public Affairs.

    Mr. Stone is currently chief editor of a fifteen-volume series, Inalienable Rights, which is being published by the Oxford University Press between 2006 and 2012. The authors in the series include, among others, Richard Posner, Richard Epstein, Alan Dershowitz, Larry Lessig, Martha Nussbaum, Jack Rakove, Pamela Karlan, Lee Bollinger, and Larry Tribe.

    Mr. Stone is working on a new book, Sexing the Constitution, which will explore the historical evolution in western culture of the intersection of sex, religion, and law. His past works include Eternally Vigilant: Free Speech in the Modern Era (2001), The Bill of Rights in the Modern State (1992) (with Mr. Epstein and Mr. Sunstein), Constitutional Law (6th ed. 2009) (with Mr. Sunstein), and The First Amendment (3d ed. 2008) (with Mr. Sunstein). Mr. Stone also serves as an editor of the Supreme Court Review (with Mr. Hutchinson and Mr. Strauss), and he writes frequently for huffingtonpost.com and for such publications as the New York Times, the Chicago Tribune, and the Wall Street Journal.

    Young Lawyers Committee Co-Chair ElectionThe YLC co-chair election will be held on Monday, May 9, 2011 at 12:15 p.m. at Hogan Lovells US LLP, 555 13th Street, NW.     New York ChapterSpring has sprung in New York, along with several timely and exciting programs via the New York Chapter of the FCBA. On Thursday, March 17, the New York Chapter hosted a breakfast program at the Law Offices of Cozen O’Connor, 277 Park Avenue, New York, New York, entitled Content Access and Development Across Advanced Communications Platforms. The program included Susan Crawford, Professor of Law, Benjamin N. Cardozo School of Law and former Special Assistant to President Obama for Science,

    Technology and Innovation Policy, Charles Davidson, Adjunct Professor of Law and Director, Advanced Communications Law and Policy Center, New York Law School, Terry Denson, Vice President of Content Strategy and Acquisition, Verizon Communications Inc., and Howard Homonoff, Esq., Director, Entertainment, Media and Communications, PricewaterhouseCoopers LLP. Attending the program were some thirty people, including area practitioners, various industry, government representatives, a New York City Councilmember and law students. David Bronston, a member in the business law department at Cozen O’Connor, and FCBA co-chair Susanna Zwerling of Verizon, both facilitated discussion among the panelists about the increasing consumer demand for content and programming across advanced communications platforms and how to appropriately protect consumers and ensure non-discriminatory access to the content of their preference.

    The New York Chapter is honored to announce that it will host a breakfast and discussion with FCC Commissioner Robert M. McDowell on Tuesday, April 5 at 8:30 a.m. The event will take place at the Law Office of Mintz Levin Cohn Ferris Glovsky and Popeo, P.C. at the Chrysler Center, 666 Third Avenue, New York, NY 10017. FCBA members and friends are invited to join us in welcoming Commissioner Robert McDowell who will provide brief remarks and respond to questions from attendees.

    The FCBA is also poised to host, in collaboration with the Advanced Communications Law and Policy Institute at the New York Law School, a brown bag lunch program on Tuesday, April 12 beginning at noon. The program will be held at New York Law School located at 185 West Broadway (at Leonard St.), Room W-204, New York, New York; and will feature a roundtable discussion on federal broadband adoption stimulus (BTOP) dollars awarded to the City of New York’s Department of Information Technology and Telecommunications (DoITT) under the American Recovery

    and Reinvestment Act. Confirmed speakers include representatives of the DoITT, as well as DoITT grant partners/collaborators Carol Wacey, Executive Director of Mouse.org; Thomas Kamber, Founder of Older Adults Technology Services (OATS); and Bruce Lai, Chief of Staff to the NYC Department of Education’s Chief Information Officer. The program will provide an update on the status of the projects funded in New York under the stimulus grants.

    The New York Chapter of FCBA will host an Upstate New York program on Thursday, April 28 at 4:00 p.m. The program will feature a panel discussion including Rebekah Goodheart, Associate Bureau Chief, FCC Wireline Competition Bureau (by teleconference), Gregg C. Sayre, Associate General Counsel of Frontier Communications, Michael Shortley, Vice President, General Counsel of Global Crossing North America, Inc., and William A. Haas, Corporate VP Public Policy & Regulatory of PAETEC, titled “Effectively Advocating from “Outside the Beltway” on Intercarrier Compensation Reform and Other Policy Issues,” and moderated by John B. Messenger, Vice President and Associate General Counsel of PAETEC. The substantive discussion will be followed by a networking event co-sponsored by PAETEC, Klein Law Group PLLC, and Syracuse University College of Law.     PAY IT FORWARD News

    On March 5, volunteers from the FCBA met at Byte Back to help Byte Back students sharpen their digital skills. Julie Kearney, Ann Bobeck, Christopher Clark, Kyle Dixon, Jonathan Havens, Jane Havens, Grace Koh, David O’Connor, Mark Walker, and Anita Wallgren worked with students, who were learning how to use email, search for jobs online, create folders, and other fundamentals for digital literacy. Staff at Byte Back remarked that their teachers were hearing enthusiastic reports from students who had come in for the extra help.

    Spring Cleaning Alert!! The FCBA’s Pay It Forward initiative is coordinating donations of used computer equipment to First Time Computers, a DC-based non-profit that trains at-risk youth to refurbish computers and then donates them to eligible families and groups. PIF partner organization Byte Back is able to buy refurbished computers from First Time Computers at a discounted price. The PIF Used Computer Equipment Drive is a great way to find a new lease on life for your old or unused computer equipment, or pass on your existing computer if you plan to upgrade to a new computer soon.     Happy 20th Birthday, FCBA Foundation!This month, the FCBA is proud to wish a very happy 20th birthday to our own FCBA Foundation! In honor of this important milestone, please take a few moments to read about the history of the Foundation, its mission, and how you can participate.

    Established in 1991, the Foundation was created to expand the FCBA’s community

    outreach and educational endeavors. The September 1990 edition of the FCBA newsletter ran a column announcing the formation of an ad hoc Foundation Committee for the 1990-91 FCBA year and seeking volunteers for its activities.

    Today, the Foundation’s mission is to: (1) Support worthwhile communications-related and educational projects, as well as other community service projects, particularly those directed towards children and students, through financial contributions and through volunteer services provided by Foundation members and others; and (2) Foster greater public awareness and understanding of the development of communications technology, resources and law. It is a non-

    profit tax-exempt organization qualified under Section 501(c)(3) of the Internal Revenue Code.

    Over the past 20 years, thanks to the generosity of companies, organizations, and individuals in the Bar, the Foundation has raised more than $2 million in pursuit of its mission. These funds have been directed primarily toward three areas of core activities:

    ■■ Awarding more than 130 college scholarships to high school seniors in the Washington, D.C. public schools. Applicants are evaluated on the basis of financial need, academic achievements, and a demonstrated interest in the area

    of communications. The scholarships range in value from $4,000 to $25,000, allocated over four years. For the last five years, each scholarship recipient was also given a laptop computer.

    ■■ Providing stipends to more than 150 law students working in government or entities with a relation to the communications field. Applicants are evaluated on the basis of financial need, academic achievements, community service, and the relationship of their proposed internship to communications law. The base amount of each stipend is $5,000, which is intended to assist in covering the student’s expenses over the course of the internship. In addition, one student is selected to receive an additional $600 Max Paglin Award.

    ■■ Contributing volunteers and funds to community organizations in the Washington, D.C. area. These efforts include longstanding volunteer relationships with Martha’s Table and McKenna’s Wagon, as well as a holiday gift drive. In 2010-2011, the Foundation has played an active role in the FCBA’s new “Pay It Forward” initiative.

    The Foundation is led by a Board of Trustees, 12 of whom are nominated by the FCBA Nominations Committee and elected by the FCBA membership; the Board may also include trustees appointed in accordance with the Foundation’s bylaws. Trustees serve staggered three-year terms, with four trustees rotating off (and four new trustees rotating on) each year. One trustee serves as Foundation Chair.

    The Foundation Board works closely with the FCBA Executive Committee, the Young Lawyers Committee, the Charity Auction Committee, the FCBA staff, and numerous volunteers within the Bar. These volunteers participate in various Foundation activities and assist in furthering the Foundation’s mission in numerous ways, including

    the process of identifying recipients for college scholarships. Each year, the Foundation awards a Volunteer of the Year Award to the FCBA member who best serves the goals of the Foundation and the greater community through their volunteer efforts.

    Many FCBA members who have served on the Foundation Board, as well as others who have volunteered in Foundation activities, describe this experience as one of the most rewarding of their FCBA careers.

    The Foundation raises funds in a variety of ways to support its scholarship and internship programs. Some money is raised through the sponsorship of tables at the Annual Chairman’s Dinner and registration for the Annual Golf Tournament. The Foundation also has been fortunate for the past several years to be a partial beneficiary of the highly successful FCBA Annual Charity Auction. The support of FCBA members for these FCBA and Foundation fundraising activities is essential and tremendously appreciated. But the bulk of the funds that enable the Foundation to provide more than $180,000 in scholarships and internship stipends on an annual basis come from direct contributions to the Foundation’s programs by communications companies, organizations, and individuals within the Bar.

    The Foundation seeks to provide meaningful philanthropic and community service opportunities for FCBA members and always is open to your suggestions in this regard. It is YOUR Foundation.     FCBA Foundation 15th Annual Golf Tourney to be Held Monday, June 20This June, the U.S. Open returns to the D.C. area—and the day after that premier event, the FCBA Foundation Charity Golf Tournament will return to the Country Club at Woodmore. Look for the registration form on page 31 of the newsletter.

    Last year’s event at Woodmore was a tremendous success and the feedback from the players on the quality of the course and the hospitality of the club staff were extremely positive. So we are very pleased to be able to return to CC Woodmore in Mitchellville, MD for our 15th Annual Tournament on Monday, June 20. The Arnold Palmer designed course is consistently ranked as one of the best in the Mid-Atlantic region and has received the Golf Digest Architecture Award in recognition of outstanding design. Better yet, CC Woodmore is conveniently located just minutes outside the Beltway for those feeling the need to head to work afterwards (though we promise not to tell anyone if you don’t).
