New Regulation Adopted on Windshield Installation
Windshields are critical to the safety of vehicles’ occupants because they interact with air bag systems and provide structural support. Effective January 1, 2017, a new regulation (Title 16, California Code of Regulations Section 3365.1) affects the installation of automotive windshields.
The regulation defines “cure time” as the length of time that the adhesive needs to cure until the windshield can properly function as a safety device pursuant to the Federal Motor Vehicle Safety Standards (FMVSS) and vehicle manufacturer specifications. The new regulation also requires that the adhesive itself meet or exceed vehicle manufacturer specifications. Adhesive systems or products shall be used in accordance with adhesive manufacturer specifications and adhesives shall be applied in accordance with vehicle manufacturer specifications.
Under the new regulation, Automotive Repair Dealers (ARDs) are required to notify the customer on the estimate that replacement of the windshield will prevent operation of the vehicle for a period of time and whether the windshield is an Original Equipment Manufacturer (OEM) part or a non-OEM part. Once the windshield installation is complete, the repair facility is required to notify the customer on the invoice of the adhesive cure time, the date and time upon which the windshield installation was completed, and whether the windshield is an OEM or non-OEM part. Renew Your License OnlineAn online license renewal system, which allows payment by credit card, is now available through the Bureau of Automotive Repair (BAR). This system allows Automotive Repair Dealer (ARD) registrants, station licensees, and Smog Check Inspector and/or Repair Technician licensees to renew online and pay their fees via the Official Payments Corporation (OPC) website.
License renewal notices for ARDs and stations are mailed 90 days prior to the expiration date. Notices for Smog Check Inspectors and Repair Technicians and Brake and Lamp Adjusters are mailed 120 days prior to the expiration date. Renewal notices now include information about the availability of online license renewal.
Once an online license renewal payment is made, no further action is necessary. After OPC processes the payment (usually within 2–3 business days), BAR will verify that all renewal requirements have been met. The renewed registration/license will then be sent to the address of record within approximately 7–10 business days.

Upcoming BAR-97 EIS Update
The Bureau of Automotive Repair (BAR) will be updating the BAR-97 Emissions Inspection System (EIS). One of the most important features of the update will require the EIS to connect to the Vehicle Information Database (VID) through Internet connection rather than a dedicated phone line, just like the BAR On-Board Diagnostic Inspection System (BAR-OIS). This change is required because the VID will no longer support outdated dial-up connectivity. BAR-certified software for Internet connectivity may be available in late 2017, giving stations sufficient time to switch before BAR requires Internet communication for all analyzers.
The new specification also includes updates to capture data directly from the Low Pressure Fuel Evaporative Tester (LPFET). Depending on EIS manufacturer preference, this update could be packaged with the Internet connectivity change, or could be a separate update. The exact date for required compliance with the revised 2017 specification will depend on the availability of BAR-certified equipment and software, but will occur no sooner than January 1, 2018. BAR will provide advance notice of the compliance date for the EIS update through ET Blasts and website updates.

Labor Rate Survey RegulationsThe California Department of Insurance (CDI) has developed a new webpage related to recently adopted Labor Rate Survey regulations for collision repairs. The webpage includes a list of registered Automotive Repair Dealers that indicated auto body as their primary or secondary business type on their registration application with the Bureau of Automotive Repair. CDI expects to update the list annually. It is difficult to inform a consumer that a vehicle has failed its Smog Check inspection, but it helps to be able to offer assistance at the same time. The Consumer Assistance Program (CAP) helps thousands of California consumers whose vehicles have failed a biennial Smog Check by offering repair assistance and vehicle retirement options.
Consumers should be referred to CAP’s webpage to review eligibility requirements, fact sheets, and frequently asked questions. A new video highlighting a consumer’s actual experience with repair assistance is available on the webpage. CAP also offers a convenient online application for repair assistance and vehicle retirement in both English and Spanish. Eligibility requirements and the online application are located at www.bar.ca.gov/Consumer/Consumer_Assistance_Program/index.html.
CAP ensures that consumers have access to the repairs they need and also offers many business benefits to STAR Test-and-Repair stations. CAP offers various resources to assist stations with the repair process. Technical support is available by calling the CAP Help Desk at (866) 361-3933.
The CAP Operations Manual includes topics such as what to do when a CAP consumer arrives at the station, how to notify CAP of the repairs you intend to perform, and how to invoice CAP after the repairs have been performed. Stations are reminded that all emissions-related repairs must be entered into the Emissions Inspection System (EIS) or On-Board Diagnostic Inspection System (OIS). Business Information Updates for Automotive Repair Dealers
As a reminder, an Automotive Repair Dealer (ARD) must report any changes to its business name, address, or corporate officers within 14 days to the Bureau of Automotive Repair (BAR) by completing the Change of Name/Address/Corporate Officers form. This form can also be used to report changes to the primary and/or secondary business type, such as auto body, air conditioning, or transmission repair. The form is located at www.bar.ca.gov/pdf/r-8.pdf.
However, any change in business ownership or ownership structure (e.g., changing from a sole proprietorship to a corporation) will require a new ARD application, station application if applicable, and payment of appropriate fees. Any change to the members of a limited liability company (LLC) also requires a new application and fees.

LEGISLATION
Assembly Bill (AB) 188 relates to vehicle retirement guidelines within the Enhanced Fleet Modernization Program (EFMP). The bill would require the Air Resources Board (ARB) to amend program guidelines to make the existing miles per gallon standards for minivans applicable to light-duty trucks.
AB 630 relates to the vehicle retire-and-replace option in the EFMP. This bill would require ARB, in consultation with BAR, to update current EFMP guidelines by expanding allocation of funds for the retire-and-replace option and creating a “mobility option” that would offer public transportation vouchers in place of vehicle replacement. The bill would also require ARB to set specific annual goals for EFMP and retire-and-replace participation, and post that information on its public website.
Senate Bill (SB) 638 would require ARB to adopt regulations to require emissions inspections of heavy-duty vehicles used for commercial purposes, and set compliance standards and inspection procedures for these vehicles. Heavy-duty vehicles are currently exempt from the Smog Check Program.
REGULATIONS
Mobile Automotive Repair Advertising
BAR has proposed a new regulation concerning advertising requirements for Automotive Repair Dealers (ARDs) who perform mobile repairs. ARDs whose business model relies primarily on mobile repair typically advertise on the Internet and are more difficult to monitor than other repair dealers since they do not operate out of a registered business address. The proposed regulation was developed in response to and in collaboration with the automotive industry to address this issue. Not only will the regulation assist BAR in combating unlicensed activity, but it will help consumers with verification of a mobile ARD's license status.
The regulation package was filed with the Office of Administrative Law (OAL) and was disapproved. Following a 15-day public comment period, BAR will be resubmitting the package for OAL review.
BAR-97 Emissions Inspection System (EIS) Update
This proposed regulation would remove the requirement for a dedicated phone line to connect an EIS to the Vehicle Information Database (VID). Instead, the EIS would connect to the VID over a secure Internet connection. This regulation change would also require the use of a BAR-97 certified to an updated specification that includes the integration of the Low Pressure Fuel Evaporative Tester (LPFET) into the EIS.
BAR held a regulatory workshop to discuss these changes on October 20, 2016. The regulation package is under review at the Department of Consumer Affairs (DCA) and is expected to be filed with OAL by Fall 2017, which will begin a 45-day public comment period.

used in transactions between ARDs and consumers. The proposed regulations also clarify current language and reorganize estimate, work order, and invoice provisions to more closely align with automotive repair transactions.

Training Provider Requirements
This proposed regulation would update and revise the requirements for certification of training institutions and instructors to align with Smog Check licensing requirements. The regulation also establishes new Bureau Training Programs Standards, which set forth minimum standards necessary to provide training for prospective and current Smog Check licensees. Finally, the proposed regulation will allow vehicle manufacturer training to satisfy the renewal requirements for the Smog Check Repair Technician license.
This regulation also includes updates that conform to recent amendments made to BAR’s Disciplinary Guidelines by allowing BAR to prescribe training for licensees to further understanding and ensure compliance with current laws and regulations. The training may be required under the terms of a probationary status when licensees demonstrate insufficient understanding of BAR’s laws and regulations, or otherwise recommended as voluntary training when found to be beneficial, such as through consumer complaint mediation.

Smog Check OBD Reference The Bureau of Automotive Repair (BAR) created a Smog Check OBD Reference document to assist licensed Smog Check stations and Inspectors when inspecting specific vehicles with known On-Board Diagnostic (OBD) issues. It provides both a summary of pass/fail standards for the OBD test portion of a Smog Check inspection, and instructions for inspecting vehicles with known OBD issues. Issues addressed include incomplete monitor readiness, no communication, no OBDII required, and vehicle software errors. The document also instructs licensed Smog Check Inspectors to send certain vehicles with specific issues to the Referee while BAR investigates the cause and remedy for that issue. The document contains Technical Service Bulletins (TSBs) and warranty information providing licensed Smog Check Repair Technicians diagnostic and repair guidance.
