Rates herein are limited for each carrier for the handling ofhouselrold goods in intrastate commerce as described in earn individual carriers operating authority. The 1111es and regulations as following govern all sections of this tariff unless otherwise provided wit1\in individual sections.

RULE 1

BILL OF LADING AND RATES

A. Unless otherwise provided in this tariff, when property is transported 61' stored subject to the provisions of this tariff, or as amended, the acoeptanoe and USe of the Unifonn Household Goods Bill ofLading as described herein and in Rule 2. is reqllil'ed.

If the bill of lading is issued on the order 6fthe shipper, or,his agent, in exchange, or. . sUbstitution for another, the shipper's signature to the prior bill of lading as to the statement of value or otherwise, or election for cOlllmonlaw liability, in COlllleation'with such prior bill of lading shall be considered a part of the original bill ofiading as fully as If the smne were written or made in connootion with fhe original 'bill ofiading. '

Any alteration, or erasure on a bill of lading which shall be mad(} without the special notation theteon of the agent of the carrier issuing same, will be without effect and the bilI of lading shall be enforceable according to its original tenor.

B. Rates and oharges in this tariff are conditioned upon the use of the Uniform Household Goods Bill of Lading. A shipper may elect not to accept the terms therein, and in lieu thereof, have the carrier transport the properly with carrier's.liability limited only as provided by cOlllmonlaw, aild 'by the laws ofthe United States and the State ofN ew Mexico as they may apply, but subject to the ten:n,g and conditions of the Bill of Ladin'g in 80 far as such tc1'!llS and conditions are not in,consistent with the cOlllll1,on Qa:rrier's liability. Unless the ,shipper expressly releases the shipment to a value not exceeding 60 cents per poun~ per article, me Camel's maxirmunliability for loss and dmnage is provided ill Sectioll Vofthis tariff. (pages 41 & 42).

When the shipper elect8not to aocept any of the telms of such 'bill ofiading, he must give no!-ice to the initial carrier of such election prior to loading, and the can:iel' may refuse transjJ01'lation of said property and shall be held harmlessfro,\\-lany action that may arise,

RULE 3

DECLARATION OF V ALtffi - LIABILlTY LIMIT ATlON

As used in this tariff, the unifolm Household Goods Bill of Lading, the phrases "released value", "declared value", and "value declllXed by .shipper", s4all have the same meaning.

A) A shipper must declare the value of a shipment in tenns of dollars and cents l'er pound per article, in the space provided on the bill of lading, If shipper fails or declines to make such a declaration, or lfthe declaration exceeds $1.50 per pound per article the shipment will only be accepted at option oflhe carrier, '

DEFINITION OF A SHIPMENT

RULE 7

PERISHABLE ARTICLES

Subject to Rule 6, carrier will not aocept perishable articles or those requiring refrigeration, except FROZEN FOODS, and only then und.er tbe follOwing conditions:

1: Carriers disoretion;

2. The food is contained in a regnla:r food freezar and is frozen solid· at time ofloading.

3. Botb points ofpiclrup and delivery are witbin the boundaries of New Mexico, no storage or delay is required in transit, and delivelY may be aocomplishedwithin 24 hom's from time of loacliilg. '

Not withstanding the provisions of this rule, under no condition will carrier assume responsibility or liability for condition or flavor of foods. . .. . '

RULE 8 ,

ARTICLES OF EXTRAORDINARY VALUE··

MARKING AND PACKING

IMPRACTICABLE OPERA TrONS AND SERVICE

A. Nothing in this tariff or e1s~where shall requite a oarrier to perform any smvioe at a plaoe whioh is inaocessible 01' where ille operation of vehicles. 01' presence ofpersomlel would subject either of them to U11l'easonable lisk, or loss or damage to life or property; such as but not limited to conditions of roads, buildings, riots, stlikes, war, civil disturbances, and all oiller canditlons of unreasonable hazard. ..

B, 'When, by reasons named in paragraph "A", above carrier cann~t perfonn pickUp, . delivery, or other service, the vehicle will be made available ~t the nearest accessible point deemed reasonably safe for its operation and personnel thereon.

Transportation rates herein do not include disassembl1ng or reassembling of artiol<is embedded in conorete, the earth 01' other substance, nor those affixed to a structure, nor removal of same. Such articles include (but not limited to) swirJg sets, cbl1dt:en's toys, pool tables, shelVing, built-in fU1:ninu.·e, gym eqllipment, and oiller similar items. Providing caJTier has pel'somoj available, shipper may request such labor of carrier, which WOll( abal! be subj ect to the additional charges fur exira labor as pro'vjded. by Section n. RULE 19

PICK-UP AND DELrvERY- LOADING AND UNLOADING

those articles named in Rille 27 when moving by weight thereof; otherwise, rates do not include the handling of single midas weighing in exoess of 1000 pounds, nor those additional men for the handling of such articles, which shall be snbject to additional labor charge from Section II, applicable for each man in excess oftwo, for the period of time required only for the handliug thereof, '

If shipper orders piokup or delivery at a public dock or other point for which a fee is charged, such dock or other fees will be borne entirely by the shipper.

ADVANCED CHARGES: Charges fOl'services of other parties, engaged at the request ofthe shipper, may be advanced on the bill oflacting by the carrier, whioh charges shall be supported with copies of invokes, and shall be in addition to all other charges applicable to the shipment.

RULE 22

DIVERSION OF SHIPMENTS \

"Diversi6n" as used herein shall mean a chl1nge of desti!l1J.t.ion which is beyond 30 rn:iies of odgJna! destination as shown on the bill ofladi-ng, or, a changb in route ordered by shipper. Applicable only to shipments moving on a weight basis, upon written order by a proper party, a shipment may be divelted which shall be subject to the following provisions and additional charges. ..

A. Except as provided in NOTE No.1 balow, transportation ciharges on diverted shipments shall be computed with the through rate from pain,! of origin to a new destination, via the actual point of diversion order, will be aBsessed.. .

, B. When a diVtll'sion order is received under this rule, diligent effort will be ma4e to

locate the shipment and effect the ch8l1ge, however carrier will !lot be responsible for failm:e to make sllch a diversion unless by his oWllllegligence. .

RULE 23

W AITINO TIME

A. Charges accruing hereunder are subject to rates nl1nled in Item 4.0 and 70 or either of them provided for herein., aJ.1d are in addition to all other applicable charges in this tariff. RULE 24

·STORAGE-IN· TRANSIT

When used singularly herein, the word "storage" shall apply to "storage-in.transit",

A. (a). When points of pic Imp or delivery and warehouse are within a 30 mile radius of each other, rates named in Section II shall apply. C. VALUATION: ,

1. Storage-in-transit: When a shipment is placed. into Storage-in-transit upon which a higher value than 60 cents per pound per article has been declared, and as per Rule 3.

2. Change of Value Declaration: Unless portions of storage are added or withdrawn, changes in declaration of value.may only be made as provided herein: . ,

(a) Once a shipment is' placeci into storage-in-transit, the vaiue declm'ed upon the bill of lading shall extend to the lawful storage period of 90 days and no change may be made. If BlICh shipment is subsequently converted to local storage as pr.oviCled in Paragmph A., Depositor may effect such ohange providing he does so within 30 days of the ellpiration o'fthe storage-in-transit period, and 'valllation charges the/'efore shall be adjusted accorclingly. This shall be solely at the carriers dism:etion and only to lesser amount.

D. A])DITXONS TO OR WfrHDRAWALS FROM STORAGE-IN-TRANSIT: Subject to additional oharges provided therefore ill Section II, portions of goods !'nay be added to or withdrawn fronl storage, in which case charges will be adjusted to the new weight and valllation as of the following billing date. HOURLY TRANSPORTATION RATES

APPLICATION . .

A. . Except as provided by paragi:aph "D" below, tr!U1~portation ra:tes.in this section apply to Household·Goods as defined in paragraphs (1) !U1d (2), "Coml110dity Desoription", hge 4 in this tariff; between all points !U1d places within any m~mioipality, and a 30 mile radius thereof, when transportation therein is regulated by the State of New Mexico.

C. RATES IN THIS SECTION APPLY ON SHIPMENTS RELEASED TO A VALUE NOT EXCEEDING 60 CENTS PER POUND PER ARTICLE. WHEN A SHIPMENT IS RELEASED AT A VALUE IN EXCESS OF 60 CENTS PER POUND PER ARTICLE, THESE RATES SHALL BE INCREASED BY THE APPLICABLE AMOUNT IN RULE 3.

These rates do not apply to the piokup 01' delivet·y of Storage-in-Transit shipments regardless of distance mnnicipality involved, nor may they alteruate with other transportation rates in .this tariff 01' elsewhere.
