Section 1 INTRODUCTION

Dear MemberThank you for becoming a GETACTIVE ABCmember of the Leisure Centre facilities withinArmagh City Banbridge & Craigavon BoroughCouncil. The information below is designedto clarify all the guidelines and rules aroundusing and paying for these facilities, withinyour membership.

The GETACTIVE ABC Membership schemeis designed and introduced to provide thesame membership packages (as consistentlyas possible) across all of the main leisurecentres in the Armagh City Banbridge &Craigavon Borough.

The GETACTIVE ABC Membership schemeis designed to give customers as manymemberships benefits as possible, at thebest value possible and of course to providecustomers with maximum opportunity toestablish a healthy and fit lifestyle.A GETACTIVE ABC “member” is defined as acustomer who pays for use of listed facilitiesin advance via a monthly direct debitarrangement or via a one advance singlepayment, after the scheme launch in April2017.

Section 2SCOPE

IMPORTANT NOTE - GOLD MEMBERS ATCASCADES LEISURE COMPLEX (PORTADOWN)- THIS DOCUMENT DOES NOT COVER TERMSAND CONDITIONS FOR GOLD GETACTIVE ABCMEMBERS AT CASCADES LEISURE COMPLEX.DUE TO CONTRACTUAL OBLIGATIONS WITHCOUNCIL’S OPERATING PARTNER TERMSAND CONDITIONS FOR GOLD getactiveabcMEMBERS AT CASCADES LEISURE COMPLEX ARE EXPLAINED IN A SEPARATE DOCUMENT WHICH IS AVAILABLE AT CASCADES LEISURE COMPLEX.

THIS DOCUMENT COVERS - The main payment,access and terms of use for individual andfamily/group members who have purchaseda GETACTIVE ABC membership package via amonthly direct debit or via a single paymentat the centres listed below. The purposeof these terms and conditions is to providemaximum clarity for GETACTIVE ABC membersabout how the membership scheme worksat the commencement of your membershipterm.

The leisure centre facilities which are relevantto this document and applicable under aGETACTIVE ABC membership package arelisted below. These centres are definedas either Tier 1 or Tier 2 centres under adefinition as follows.

TIER 1 CENTRESThere are 6 x Tier 1 Centres;

Banbridge Leisure CentreCraigavon Leisure CentreDromore Community CentreOrchard Leisure CentreWaves Leisure Complex(Cascades Leisure Complex is also a Tier 1Centre but Gold Members at Cascades LeisureComplex should refer to the specific terms and conditions for this membership, available at Cascades Leisure Complex).

TIER 2 CENTRESThere are 4 x Tier 2 Centres;

Section 3 GETACTIVE ABC MEMBERSMAIN TERMS AND CONDITIONS

There are two types of GETACTIVE ABCmembership package proposed (and listedbelow) in order to provide the members withappropriate choice.

TYPE 1 GOLD PACKAGES AND SILVER PACKAGES. The conditions of these packages are thatmembers can use the relevant facilities atONE CHOSEN CENTRE ONLY, probably theirlocal centre - “Gold” refers to Tier 1 centresand “Silver” refers to Tier 2 centres.

TYPE 2PLATINUM PACKAGES.The conditions of these packages are thatmembers can use the relevant facilities at ALLOF THE 10 LISTED COUNCILS INDOOR LEISURECENTRES, INCLUDING CASCADES LEISURECOMPLEX (PORTADOWN) - that is all Tier 1 andTier 2 centres listed in Section 2 above.

Definition of Tier 1 and Tier 2 Centres

Tier 1 Centres are defined as Centres whichhave at least two from the following threecriteria:1. A swimming pool2. A gym3. Deliver more than 16 exercise classes per week

Tier 2 Centres are defined as centres whichhave only one of the above on site.

ExceptionsThere are some exceptions within the GETACTIVE ABC leisure membership scheme across theborough due to centre design and access variations or where other contractual obligationsdictate - these exceptions are as follows;

nominate this centre when they commence membership and can only use this one nominated centre on a Sunday.

6. Gold Members of Waves LC or Cascades LC or Craigavon LC - Public Holidays - when a public holiday occurs which designates Cascades LC or Waves LC or Craigavon LC as “closed”, then Gold/“One Centre of Choice” members of these centres will be allowed to use, under the terms of their membership, any other indoor centre which is designated as “open” on that public holiday.

7. Gold All Inclusive Members of Dromore Community Centre (Single – Gold 1 and Family – Gold 4) are entitled to use the pool and health suite at Banbridge Leisure Centre (only) within the terms of this membership.”

8. The non-concession Gold 1 Single All Inclusive Membership (paid by monthly Direct Debit at £29.95 per month) is available for a single cash/card payment for one calendar month at £35.00 per month (except in Cascades Leisure Complex). This is the only direct debit monthly membership which is available for a single cash/card payment within the membership scheme.

Important - Local terms and conditions ofuse/access/availability of each centre mayvary and will apply during any members visitto each centre.

1. *Denotes that this package includesuse of the health suites, if available atthe member’s chosen centre - Terms andconditions apply.

2. ** Denotes that this package does not include use of the health suites at the member’s chosen centre. Also denotes that Single Gym or ‘Gym Only’ Memberships are not available at Cascades Leisure Complex.

3. *** Denotes that this package includes use of sauna/stream room at Banbridge LC, if Banbridge LC is the member’s centre of choice, but does not include use of the health suites, at any other centre.

4. *****Important Note: The existing “Family All Inclusive” Direct Debit Package, associated with the Banbridge Legacy Area - Current price of £50 pm and local terms & conditions will be frozen until April 2018, when the price will increase to £60 pm and terms and conditions will convert to the GETACTIVE ABC “Family All Inclusive” Gold Package.

5. Gold Members at Waves LC or Cascades LC - Sundays - Both these centres do not currently open to the public on Sundays. Therefore customers who choose either of these centres as their chosen site for their Gold/“One Centre of Choice” membership will be able to use one other nominated centre ( which is open) on a Sunday. The member must

Section 6Detailed Terms of Use and Benefits of getactiveabc Membership Packages

CONCESSION MEMBERSHIPSIn order to qualify for a Concession Membership a person must demonstrate that they belongto one of the following categories;

to also participate in and enjoy the activitiesthe carer will pay the appropriate concessionrate.

GETACTIVE ABC FAMILY (GROUP) PACKAGESAll ABC ACTIVE “All Inclusive Family” Packageswill allow for a maximum of 2 Adults(persons of 18 years of age and older) and amaximum of 3 children (persons of 17 yearsof age and under) OR a maximum of 1 Adult(persons of 18 years of age and older) and amaximum of 4 children (persons of 17 yearsof age and under). It is not a requirementfor each person listed under a family/groupmembership to reside at the same addressor to be related. It will be a requirement foreach person listed under a family/groupmembership to provide a valid address andphotographic I.D. and proof of age. The priceof the family package remains the samewhere there are less than 2 adults and less

Any requirements to provide repeatedevidence of concessionary status for on-goingdirect debit memberships are displayed onnotice boards in participating centres.For one single payment memberships (12months) documentary proof requested willneed to be valid on the day of purchase,but if this concessionary status lapseswithin the 12 months of the membership,the concessionary purchase price will behonoured by Council for the remaining termof the membership.

CARERS OF PERSONS WITH A DISABILITYWhere an individual with a disability isaccompanied by a carer - free use willbe granted to the carer where the caringresponsibility does not allow the carer toenjoy the activity themselves (e.g. caring foran individual with a severe disability).Where caring responsibilities allow the carer

than 3 children within the membership group.Each Family member, of 8 years and over,will be allocated his/her own membershipidentification - card or fob. Children under8 years of age will not be issued with familymembership identification because they areunable to attend a centre un-accompaniedby a responsible adult. When a child who isincluded in a family/group package reaches18 years of age, their membership under thispackage will cease to be valid from the duedate of the third direct debit collection aftertheir 18th birthday. In the case of a 12 monthsingle payment family/group package, thememberships of all children who reach 18years of age within the 12 month timescale ofthe package will remain valid until the expirydate of the package. Changing people withinthe family or group membership - changingpeople associated with a particular family orgroup membership is permitted except, inorder to control administration, it is a strictcondition of family or group membership thata person or persons within each membershipcan only be changed at least 3 months afterany previous change has been made.

“START TODAY”All New GETACTIVE ABC Members can startto use the centre(s) under the terms of theirmembership from day one.

For those who pay using the 12 month singlepayment method, membership starts on theday on which payment is made.

For those who wish to use the monthly directdebit method, members can pay an initial(pro rata) cash or card payment to cover theperiod from day one until the next directdebit payment from the members bank orbuilding society (direct debits payments are

collected at different dates at each centre –you can discuss details of this with staff atyour chosen centre).

GETACTIVE ABC PLATINUM MEMBERSHIPS Even though this membership will entitlemembers to use of all indoor centres, theadministration and payment arrangementsof the membership will be conducted at ONEcentre only. On the member’s first visit toeach of the other centres, the member willbe required to take a few minutes to registertheir details at reception of each centre. Thisinitial registration will only be required onceat each centre, and you will need to bringphotographic identification with you for yourinitial visit to each centre.

Platinum Members must carry their PlatinumMembership Card when visiting any centre –the Platinum Membership card will displaythe Members photograph on the card foridentification purposes.

NO CONTRACT - CANCEL ANYTIME OR FREEZE For GETACTIVE ABC Members who pay bydirect debit, it is not necessary to committo a contract or a minimum membershipterm. Direct Debit Members can cancel (seebelow) or freeze (see below) at any time after,but only after, the first direct debit paymenthas been automatically collected from themembers bank/building society account. Onesingle payment memberships will run for oneyear and cannot be cancelled/refunded.

RE-JOIN ANY TIMEFor individuals or families who wereGETACTIVE ABC Members at any timepreviously, such individuals may “re-join”i.e. become members again, at any time,providing there is no historical debt owed toCouncil.

NO ADDITIONAL CHARGES New GETACTIVE ABC Members will not becharged any fees which are additional to feeswhich are advertised - e.g. there will be nocharges for Gym inductions, and there will beno administration charges at first registration(Please see below to understand how GymWristbands can be acquired at Banbridge andOrchard Leisure Centres).

ACCESS TO ACTIVITIES All new Platinum GETACTIVE ABC memberswill be given a Platinum GETACTIVE ABCMembership Card on becoming a member.Platinum members will be expected to carrytheir membership card with them at all times,will be expected to show his/her receiptand Membership Card to any member ofany centre staff if requested to do so – thusdemonstrating that payment for the activityis properly covered under the MembershipPackage.

Gold and Silver Members will be issued with aMembership Card or a fob, depending on thechosen centre for membership. Requirementsfor carrying and displaying Membership cardsor fobs will vary from centre to centre andrequirements for carrying/displaying theseare published in each centre Indoor Racket Sports - When GETACTIVE ABC“All Inclusive” Members are playing indoorracket sports ( squash, badminton, tabletennis) with a person or persons who arenot All Inclusive Members, then the non-AllInclusive Member(s) will be expected to paya charge (in advance at reception) which willbe equivalent to approximately 50% of thenormal and relevant charge per court . Thischarge will cover from one to three Non-AllInclusive Members on each occasion. All

Members must report to reception beforecommencing any racket sport activity on eachoccasion.Note: The term “Indoor Racket Sports” doesnot include outdoor tennis courts.

CHANGING YOUR GETACTIVE ABC MEMBERSHIP PACKAGEIt is very straightforward if a member wishesto change their Membership Package i.e.upgrade or downgrade their membershippackage or revert from direct debit to “OneSingle Payment” arrangement - please doso by completing a “GETACTIVE ABC - Changeof Membership ” Form - available fromour website getactiveabc.com, at CentreReception or via email (by request) or post(by request). Members upgrading will need topay the appropriate pro-rata charge by cashor card to activate an upgrade immediately.GETACTIVE ABC Members can only downgradeat the end of a payment month, in the caseof direct debit holders or at the end of the 12month membership in the case of membersusing the 12 month single payment method.

LOYALTY BENEFIT FOR “DIRECT DEBIT” GETACTIVE ABC MEMBERS For GETACTIVE ABC members, who continuetheir direct debit membership for 12“unbroken” months, a 5% discount will beapplied to the current direct debit chargefor that membership package from the13th month of membership onwards - thisdiscount will remain in place if the directdebit is not cancelled. If the membercontinues their direct debit membership for24 “unbroken” months, then a 10% discountwill be applied to the current direct debitcharge for that membership package fromthe 25th month of membership onwards, andthereafter this discount will remain in placeindefinitely if the direct debit is not cancelled.

LOYALTY BENEFIT FOR “SINGLE PAYMENT” GETACTIVE ABC MEMBERS For GETACTIVE ABC members who continuetheir “One single 12 month payment”membership into a second year without abreak (of more than 7 calendar days betweenvalid memberships) a discount of 5% will beapplied to the current “one single 12 monthpayment” charge for that membershippackage - this will cover the second 12 monthperiod of this membership. For memberswho continue their “One single 12 monthpayment” membership into a third yearwithout a break (of more than 7 days betweenvalid memberships) a discount of 10% willbe applied to the current “one single 12month payment” charge for that membershippackage - this will cover the third 12 month

period of this membership - thereafter this10% discount will remain in place indefinitelyas long as the membership is continuous andpayments are made without a break of morethan 7 days between valid memberships.GETACTIVE ABC Members can change fromdirect debit payments to “One single 12month payment” or vice versa to continuetheir membership and as long as themembership remains unbroken then theappropriate discounts will be applied.

Please note: For both direct debit and onesingle 12 month payment memberships thefollowing conditions should be noted for howloyalty benefits may transfer or not transferwhen membership types are changed;

FREEZE SCHEME FOR GETACTIVE ABC MEMBERSThis scheme applies to GETACTIVE ABC directdebit members. Under this scheme directdebit members are permitted to freeze theirmembership for a period of two months(maximum) in each 12 month period, andthese months do not need to be consecutivemonths - the charge for each month wherethe membership is frozen will be £5.00 -therefore the direct debit payment for eachfrozen month will be £5.00 (or this can bepaid in cash at some centres). Members must“freeze” for a complete month and cannot“freeze” for part of a month. The membercannot use the centres during the monthwhich is frozen, except where they pay theappropriate “pay as you go” charge for eachactivity at reception. The advantage of thescheme is that frozen months, when limitedto a maximum of 2 per 12 month period,will not be deemed to have “cancelled” or“broken” the membership - therefore LoyaltyBenefits will still apply to this membership.

GETACTIVE ABC Members can execute thefreeze procedure by any of the followingoptions;

a. Sending a brief email ( or letter allowing enough notice) to the centre where their membership is administered, which includes the members name and membership numberb. Completing a “Freeze Membership Form” - available at the centre where their membership is administered

BOOKING ACTIVITIESGETACTIVE ABC Members will be able to bookclasses, badminton courts, squash courtsand table tennis before the time of theactivity (where these activities are available) -members booking privileges vary from centreto centre and as such are on display at eachcentre. Members will be able to do this byeither

a. Sending a brief email to the appropriate centre which includes the members name and membership number, orb. Making a phone call to appropriate Centre Reception stating the members name and membership number, orc. Booking in person at the centre reception

GETACTIVE ABC Members are very welcome toarrive at the appropriate centre at any time(“drop in”) with no prior notice to avail of a“bookable” activity such as exercise classes,squash, badminton or table tennis - howevermembers must accept that there is a risk ofdisappointment if their desired activity iseither full or being used by other membersor non-members. Similarly, availability of thepool and/or sauna and/or steam room and/or gym is subject to number of people usingthe facility at that time, albeit that occasionswhen the pool/sauna/steam room/gymhave reached their maximum numbers areinfrequent.

BOOKED ACTIVITY - NON-ATTENDANCEIf a GETACTIVE ABC member is not ableto attend a booked exercise class or abooked badminton/squash/table tennissession, the appropriate centre will expectto be contacted about this with reasonablenotice (in order to allow others to takeup the available place/space) - however

members can be assured that there will beno cancellation charge or “non-attendance”charge applied for non-attendance whetheror not notice is given by members.

However if a particular member repeatedlydoes not attend a booked activity or abusesthe booking privileges in any way e.g. exerciseclasses or badminton/squash/table tennissession without informing the centre ingood time then booking privileges may bewithdrawn from that member. In extremecases, after warnings are given by CentreStaff, the Membership may be cancelled bythe Centre.

PRECOR GYM WRISTBAND (BANBRIDGE ANDORCHARD LEISURE CENTRE GYMS ONLY) To achieve maximum benefit from thegym equipment in these centres, use ofa “performance monitoring interactive”wristband is recommended. Such wristbandswill be included as a free of charge benefit forGETACTIVE ABC “All Inclusive” Members. OtherGETACTIVE ABC members whose packageincludes use of the gym will be charged£5.00 for a wristband. The wristband in allcases becomes the property of the member,and even after the membership has expiredcan still be used on Precor equipment. Allreplacement wristbands (if lost or mislaid)will be charged at £5.00 per replacement,including for “All Inclusive” members..

CAFÉ DISCOUNT All GETACTIVE ABC Members, Silver, Gold orPlatinum, on production of a valid GETACTIVEABC Membership Card/fob, will receive a 10%discount at the Café at Banbridge LeisureCentre and a 5% discount at the Café atOrchard Leisure Centre on the purchase of allprepared hot and cold foods. This discount

does not extend to confectionary or packagedsoft drinks or tea/coffee - this benefit issubject to continual agreement from therespective Café Franchise Holders and maybewithdrawn by the respective Café FranchiseHolders with reasonable notice.

PHOTOGRAPHS AND NON-TRANSFERABILITYOF MEMBERSHIP CARDS/FOBS It is a condition of GETACTIVE ABCmemberships that the Centre staff, wherethe membership is administered will take aphotograph of the member for use within thecentre’s computer system and for display onthe GETACTIVE ABC Membership Card whereappropriate. For platinum members, a photoof the member will need to be registeredonto all centres computer systems. It is acondition of membership that the GETACTIVEABC membership card/fob is strictly non-transferable.It must only be used by the member his/herself and by no other person.Where non-transferability has been abusedby the member, then membership may becancelled by Council staff.

CONTACT DETAILSIt is a condition of GETACTIVE ABCmemberships that each member provides thecentre the complete, accurate and updatedcontact details and bank account detailswhere appropriate - the centre will treat allsuch information correctly in accordance withData Protection Regulations. It is a conditionof membership approval that validity of bankaccounts will be checked in confidence at theapplication stage.

CLOSURES OF CENTRE(S) Centres may be closed or may operate ona reduced hour’s basis on certain days

e.g. public holidays such as Christmas Day, Boxing Day etc. and government events suchas elections. Such closures and reducedhours operations will always be planned andpublished well in advance. It is deemed thatall Members agree and accept, in advance,that such closures and reduced hoursoperations are an integral part of the packagepurchased.

NON AVAILABILITY OF FACILITIES/ACTIVITIESIn exceptional circumstances some facilitiesor activities may not be available from timeto time e.g. major equipment failure. We willendeavour to have the problem rectified assoon as possible to ensure normal serviceis resumed. It is deemed that all Membersagree and accept, in advance, that suchcircumstances can occur and are an integralpart of the package purchased.

GENERAL TERMS OF USE OF CENTRESAll activities for GETACTIVE ABC Membersare subject to availability but also, becausethe age, design and layout of each centre isdifferent, it is a condition of GETACTIVE ABCMemberships that all local terms of use applyat each centre e.g. supervision of children inpools, changing room protocols, lockers andcar parking, in addition to your terms andconditions of membership outlined in thisdocument. PAYING FOR MEMBERSHIP BY DIRECT DEBIT All new monthly direct debit arrangementswill be set up on a “payment in advance”basis. Dates when direct debit payments are

taken from accounts will vary from centreto centre, depending from which centre themembership is administered. Dates whenpayments are taken from bank accountscan also vary slightly from month to monthat an individual centre. Staff will assist inadvising you how to set up the direct debitand also how to avail of the benefits of thismembership from “day one”. Each centre willinform you of the approx. dates on whichpayments will be taken from your accounteach month.

USE OF THE CLIMBING WALL AT GILFORDCOMMUNITY CENTRE

This is available to GETACTIVE ABC Platinum“All Inclusive” Members or Gilford CommunityCentre GETACTIVE ABC Silver “All Inclusive”(Site Only) Members and YOU DO NOTNEED CLIMBING EXPERIENCE TO ENJOY THISFACILITY.

These members are entitled to free of chargeuse of the climbing wall at Gilford CC underthe terms of their membership, and subjectto the following local conditions; For Non-Experienced Climbers • Individual and Family All Inclusive Members will be able to use the Gilford Community Centre Climbing Wall during specific Climbing Sessions where safe instruction and supervision is provided by qualified Council staff members. Booking is essential to confirm your place.• A maximum of 20 places are available in any one Climbing Session.• All equipment and Instructors will be provided by the Council. • All participants must be a minimum of 4 years of age. Failure to provide proof of

age will result in the child not being able to participate on the Climbing Wall.• All children aged from 4 to 7 years of age (inclusive) must be accompanied by a responsible adult, aged 18 years or over.• Children of 8 years of age and over do not need to be accompanied by a responsible adult. (Note: All Council staff are vetted for and trained in the area of Child Protection).• The length of each session is 1.0 hours. This includes a Safety Briefing and fitting of harnesses.• All participants must complete the Climbing Wall Booking Agreement Form prior to commencing activity.• All participants must abide by the Terms and Conditions as set out in the Booking Form Agreement Competent Climbers• If an All Inclusive Member becomes a regular climber or is a regular climber, then the qualified Council Staff may decide (based on a test of competency) that the member is a “Registered Competent Climber”.• Registered Competent Climbers will be able to book and use the Climbing Wall without Council Staff Supervision

Instruction - such sessions must be bookedin advance by contacting Gilford CommunityCentre and are subject to the same safetystandards as supervised sessions.

The All Inclusive Membership entitlementto use the climbing wall does not cover allof the climbing activities on offer at GilfordCommunity Centre - for example, climbingcourses, wall party packages and holidayschemes etc. These activities are available toAll Inclusive Members, but must be booked

and paid for separately - please contactGilford Community Centre for guidance.

CANCELLING MEMBERSHIP IIf an GETACTIVE ABC Member wishes to cancel a direct debit Membership, they can do so by using any of the following options tocontact the centre where they registered theirmembership application;a. Send a brief email (or letter via post) to the centre where their membership is administered and the cancelling member should include their name, address and date of birth (and membership identification number if known) within this email.b. Complete a Direct Debit Cancellation Form and hand this to a receptionist - forms are available at the Centre Receptionsc. ALL EMAIL ADDRESSES ARE LISTED IN THIS DOCUMENT, ON CENTRE NOTICE BOARDS AND ON OUR WEBSITE GETACTIVEABC.COM

In all cases the direct debit membershipswill be cancelled on the day when thenext monthly direct debit payment is dueand the member(s) will be entitled to usethe centre(s) under the condition of theirmembership until the day of cancellation -thereafter the ex-member(s) must either

a. refrain from using any centre orb. pay for use using the “pay as you go” prices from the following day to continue to use the centrec. pay for use via a single 12 month payment membership to continue to use the centre Unfortunately, centres cannot accept a membership cancellation made via a phone call.

Family Memberships paid by direct debit canonly be cancelled by the direct debit holder.

TERMINATION OF MEMBERSHIP BY COUNCILThe centre reserves the right to terminate anGETACTIVE ABC membership with immediateeffect where rules have been broken bythe member or where conduct of themember is unreasonable, or where there isa repeated failure of completing payments.In particular, memberships will be declaredinvalid with immediate effect when it isdiscovered that any person included in amembership has declared false informationby that person or another person (e.g. dateor birth, address, bank account details).When a centre terminates a membershipbecause of a breach of rules, then personsinvolved in this membership may not bepermitted to purchase another membershipproduct in future. When a centre terminatesa membership because of a breach of rules,then persons involved in this membershipmay not be permitted to use any of CouncilsLeisure Centres in future.

Section 7 EXISTING CENTRE MEMBERSHIPS Existing members of Council’s leisureCentres, i.e. those who have purchased amembership on or before 2nd April 2017 havebeen contacted via separate correspondenceand have been made aware of how the newgetactiveabc memberships impacts on theircurrent memberships and their existing termsand conditions.
